      Abstract: AbstractCorruption is a criminal act that causes state financial losses, hampers national development, loses of social and economics community rights. But, the perpetrators of corruption cannot be sentenced to death, except in certain circumstances as regulated in the elucidation of Article 2 paragraph (2) of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption. That vacum of norm of the death penalty against the perpetrators of corruption causes for the inequality between the impact of corruption with that punishment. Different way to punish in the application of nisab restrictions for theft in islamic law, namely theft with a minimum loss of 1/4 dinar victims can be sentenced to cut off hands. The purpose of this study is to reformulate the regulation of the death penalty in the Eradication of Corruption act based on the application of nisab restrictions for theft in islamic law. This study is a normative legal research with the legislation and comparative approach. Legal material collection techniques by the literature study, and legal material analysis techniques by descriptive method of analysis with deductive reasoning. Based on this study revealed that the need for changes in the Eradication of Corruption act by expanding the meaning of certain circumstances in the explanation of Article 2 Paragraph (2), namely determining the minimum limit for state financial losses that can be sentenced to death. AbstrakTindak pidana korupsi merupakan tindak pidana yang merugikan keuangan negara, menghambat pembangunan nasional, merugikan hak-hak sosial dan hak-hak ekonomi masyarakat. Namun terhadap pelaku tindak pidana korupsi tidak dapat dijatuhi hukuman mati kecuali dalam keadaan tertentu sebagaimana diatur dalam penjelasan Pasal 2 ayat (2) Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Tidak diaturnya hukuman mati terhadap pelaku tindak pidana korupsi berimplikasi terhadap ketimpangan antara dampak yang ditimbulkan dari tindak pidana korupsi dengan ancaman hukuman yang dianggap terlalu ringan. Cara berhukum tersebut berbeda dengan penerapan batasan nisab dalam jarimah pencurian yaitu pencurian dengan minimal kerugian korban 1/4 dinar dapat dijatuhi hukuman potong tangan. Tujuandari penelitian ini adalah untuk melakukan reformulasi pengaturan hukumam mati dalam undang-undang pemberantasan tindak pidana korupsi berdasarkan batasan nisab dalam jarimah pencurian. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan perbandingan. Teknik pengumpulan bahan hukum melalui studi kepustakaan, sedangkan teknik analisis bahan hukum menggunakan metode deskriptif analisis dengan penalaran deduktif. Adapun temuan dalam penelitian ini adalah perlunya dilakukan perubahan terhadap undang-undang pemberantasan tindak pidana korupsi dengan memperluas makna keadaan tertentu dalam penjelasan Pasal 2 ayat (2) Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi yaitu kerugiaan keuangan negara dalam batas minimal tertentu dapat dijatuhi hukuman mati.

      Abstract: AbstractThe demonopolization policy towards PT.Pelindo (Persero) through Law No.17 Year 2008 concerning Shipping, is carried out by the government based on the demands of globalization in order to create perfect competitive market conditions, efficiency and effectiveness in corporate management. Demonopolization has an impact on the change in the status of PT. Pelindo (Persero), which was previously a regulator and operator by monopolizing port business activities, and become a port operator in the format of a Port Business Enterprise (PBE). As PBE PT.Pelindo (Persero) has the same status as a Private PBE, where the exploitation of ports is done through concession rights granted by the Port Authority (PA). The fundamental issue is to examine whether the concession rights which are the impact of demonopolization are in line with the concept of economic democracy based on the Indonesian constitution. The study was conducted using a normative juridical research method and a legislative approach. The results of the study are anticipatory strategies that can be considered by the government in determining policies that prioritize the principles of democracy economy in accordance with the Constitution of the Republic of Indonesia. Determination of the choice to determine the granting of the port concession rights to the private sector must be able to be decided on carefully consideration. The most important thing is to ensure that the economic democratic system must be able to be implemented in the performance of ports even though managed by the private sector, not to override the protection function of the lives of many people in order to achieve the demands of the maximum profit of the company.AbstrakKebijakan demonopolisasi terhadap PT.Pelindo (Persero) melalui Undang-undang No.17 Tahun 2008 tentang Pelayaran, dilakukan oleh pemerintah atas dasar tuntutan globalisasi demi menciptakan kondisi pasar persaingan sempurna, efisiensi serta efektifitas dalam pengelolaan korporasi. Demonopolisasi berdampak pada perubahan status PT.Pelindo (Persero) yang semula berkedudukan sebagai regolator dan operator dengan memonopoli kegiatan usaha kepelabuhanan, berubah hanya menjadi operator pelabuhan dalam format Badan Usaha Pelabuhan (BUP). Sebagai BUP PT.Pelindo (Persero) memiliki status yang sama dengan BUP Swasta, dimana pengusahaan atas pelabuhan dilakukan melalui hak konsesi yang diberikan oleh Otoritas Pelabuhan. Persoalan mendasar yang menjadi bahasan dalam artikel ini adalah untuk menguji apakah hak konsesi yang merupakan dampak dari demonopolisasi sejalan dengan konsep demokrasi ekonomi berdasarkan konstitusi Indonesia. Kajian dilakukanlah dengan menggunakan metode penelitian yuridis normatif dan pendekatan perundang-undangan. Hasil penelitian berupa strategi antisipasi yang dapat dipertimbangkan oleh pemerintah dalam menentukan kebijakan yang mengutamakaprinsip-prinsip perekonomian kerakyatan sesuai dengan Konstitusi Republik Indonesia. Penentuan pilihan untuk menetapkan pemberian hak konsesi pelabuhan kepada swasta harus mampu diputuskan dengan dasar pertimbangan yang kuat. Hal terpenting adalah memastikan bahwa sistem demokrasi ekonomi harus mampu diterapkan dalam pelaksanaan kinerja pelabuhan meskipun dikelola oleh swasta, jangan sampai mengenyampingkan fungsi perlindungan akan hajat hidup orang banyak demi mencapai tuntutan keuntungan maksimal perusahaan.

      Abstract: AbstractOne of the characteristics of a rule of law state is the existence of a State Administrative Court (PTUN) which guarantees that the government does not act arbitrarily against their people. The decision-making organs of the state sometimes do not pay much attention to the general principles of good governance and the applicable laws which result in losses for the community. To guarantee the rights of citizens, there is an extension of PTUN's authority. The type of research used is normative juridical research. The formulation of the problem in this paper is the extension of the authority of the Administrative Court and its implication to the community rights. It also creates obstacles to get justice because there is no clear mechanism in implementing the demands compensation for tort (PMH) by Government. Therefore, people can only sue but do not get actual compensation. The findings in this study regarding the decisions of flood cases in Jakarta and Banjarmasin are that there are injustice in demanding compensation. To ensure legal certainty and protection of the community, the extension of PTUN's authority must stipulate complete provision regarding the tort compensation mechanism, compensating for factual losses experienced by the community by the House of Representative in the amendment to Law Number 5 of 1986 concerning PTUN.AbstrakSalah satu ciri dari negara hukum adalah adanya Peradilan Tata Usaha Negara (PTUN) yang menjamin agar pemerintah tidak bertindak sewenang-wenang terhadap rakyatnya. Sering kali pengambilan keputusan organ negara tidak memperhatikan asas-asas umum pemerintahan yang baik dan peraturan perundang-undangan yang berlaku yang mengakibatkan kerugian bagi masyarakat. Untuk menjamin hak-hak warga negara maka terdapat perluasan kewenangan PTUN. Jenis penelitian yang digunakan adalah penelitian hukum yuridis normatif. Rumusan masalah dalam makalah ini adalah perluasan kewenangan PTUN dan implikasinya terhadap hak-hak warga negara. Perubahan ini berdampak pada adanya hambatan dalam mendapatkan keadilan karena belum adanya mekanisme yang jelas dalam pelaksanaan atas tuntutan ganti kerugian. Sehingga masyarakat hanya dapat menuntut namun tidak mendapatkan ganti kerugian aktual yang dideritanya. Adapun temuan dalam penelitian ini terhadap putusan kasus banjir di Jakarta dan Banjarmasin adalah adanya ketidakadilan dalam menuntut ganti kerugian pada perluasan kewenangan PTUN. Untuk menjamin kepastian hukum dan perlindungan masyarakat maka perluasan kewenangan PTUN harus mengatur ketentuan lengkap tentang mekanisme ganti kerugian PMH, mengganti kerugian faktual yang dialami oleh masyarakat oleh Pemerintah dalam perubahan UU Nomor 5 Tahun 1986 tentang PTUN.

      Abstract: AbstractIn making a notary deed, the reading and signing of the deed is carried out in the physical presence of the appearers before the notary. Such provisions do not accommodate the demands of an all-digital era, while the authentic nature of the deed still needs to be maintained because it contains the hopes of the appearers for guaranteed certainty and legal protection of the rights of the appearers. This study aims to examine the relevance of applying the provisions of the physical presence of appearances before a Notary in reading and signing of deeds in making Notary deeds in the digital era and to examine the weaknesses of applying the reading and signing of deeds in making digital-based Notary deeds. The author uses normative legal research methods. The results show that the physical presence of appearers before a Notary at reading the deed in making a Notary deed is not fully relevant to be applied in the digital era because it does not accommodate the demands of the times that require practicality, but on the other hand the conventional way of signing the deed remains relevant to be implemented because it protects the authentic values of
      the Notary's deed. The weakness of digitizing the reading of the deed is that it allows a lack of correct understanding by the appearers of the contents of the deed so that it has the potential for conflict.       mengkaji kelemahan penerapan pembacaan dan penandatanganan akta pada pembuatan akta Notaris berbasis digital. Penulis menggunakan metode penelitian hukum normatif, Hasil penelitian menunjukkan bahwa kehadiran fisik para penghadap di hadapan Notaris pada pembacaan akta dalam pembuatan akta Notariil tidak sepenuhnya relevan untuk diterapkan di era digital karena tidak mengakomodir tuntutan zaman yang menghendaki kepraktisan, namun di sisi lain cara konvensional penandatanganan akta tetap relevan untuk diterapkan karena melindungi nilai-nilai otentik akta Notaris. Kelemahan digitalisasi pembacaan akta yaitu memungkinkan minimnya pemahaman yang benar oleh para penghadap terhadap isi akta sehingga berpotensi konflik. Sedangkan digitalisasi penandatangan akta menyebabkan hilangnya yurisdiksi kewenangan, persaingan tidak sehat diantara Notaris, tidak terjaminnya kepastian tanggal
      pembuatan akta serta berpotensi terjadi kejahatan siber.

      Abstract: AbstractLiterally, Restorative Justice is the restoration of justice, but more clearly Restorative Justice is an approach that focuses on conditions for the creation of justice and balance for the perpetrators and the victims themselves. Meanwhile, defamation is an act of attacking someone's honor or good name by accusing
      something that is clearly meant so that it is publicly known. This study aims to find out what Restorative Justice is, how cases of defamation are resolved with this approach, and what are the factors the perpetrators commit criminal acts of defamation in the study of decisions examined. The factors causing the occurrence of defamation crimes through social media in the city of Bandar Lampung are heartache factors due to events experienced by perpetrators of defamation through social media, there are also political factors, as well as factors of lack of legal awareness by perpetrators of defamation crimes through social media. AbstrakSecara harfiah Keadilan Restoraif adalah pemulihan keadilan, tetapi secara lebih jelas Keadilan Restoratif adalah suatu pendekatan yang menitik beratkan pada kondisi terciptanya keadilan dan keseimbangan bagi pelaku serta korbannya sendiri. Sedangkan pencemaran nama baik adalah perbuatan menyerang kehormatan atau nama baik seseorang dengan menuduhkan sesuatu hal yang maksudnya terang supaya hal itu diketahui umum. Penelitian ini bertujuan untuk mengetahui apa itu Keadilan Restoratif atau Restorative Justice, bagaimana penyelesian perkara pencemaran nama baik dengan pendekatan tersebut, dan apa faktor-faktor pelaku melakukan tindak pidana pencemaran nama baik dalam studi putusan yang di teliti. Adapun faktor penyebab terjadinya kejahatan pencemaran nama baik melalui media sosial di kota Bandar Lampung adalah faktor sakit hati akibat adanya peristiwa yang dialami pelaku kejatahan pencemaran nama baik melalui media sosial, juga ada pula faktor politik, serta faktor kurangnya kesadaran hukum oleh pelaku kejahatan pencemaran nama baik melalui media sosial.
