  • New lost decade in Latin America. Reductions of national power in the
           Southern Cone, the Andes and Mexico

    • Abstract: Resumen. Esta investigación busca mostrar que, desde la década de los 70, los países latinoamericanos han experimentado tres grandes periodos de reducción de poder nacional, el último de los cuales constituye una nueva década perdida, desde 2012 hasta nuestros días. Para ello, se revisan los estudios sobre el posicionamiento de los países de la región desde los 60 hasta el siglo XXI; luego, con apoyo del World Power Index, se identifican las crisis vividas en la región. Finalmente, se analiza los estancamientos y retrocesos en el Cono Sur, los Andes y México durante la última década. Se concluye que la pandemia, pese a su gran impacto negativo, solo ha profundizado una tendencia ya existente de mediano plazo y ha prolongado el posicionamiento periférico y semiperiférico de la región de largo plazo.Abstract. This research seeks to show that, since the 1970s, Latin American countries have experienced three major periods of reduced national power, the last of which constitutes a new lost decade, from 2012 to the present. To this end, studies on the positioning of the countries of the region from the 1960s to the 21st century are reviewed; then, with the support of the World Power Index, the crises experienced in the region are identified. Finally, the stagnation and setbacks in the Southern Cone, the Andes and Mexico during the last decade are analyzed. It is concluded that the pandemic, despite its major negative impact, has only deepened an already existing medium-term trend and has prolonged the peripheral and semi-peripheral positioning of the region in the long term.
       
  • Measurement and evaluation of criminal governance and its relation to drug
           trafficking in Colombia

    • Abstract: RESUMEN. Las gobernanzas criminales son un fenómeno difícil de medir por su naturaleza clandestina, por lo cual resulta igualmente difícil estudiar su relación con otras problemáticas que, como el tráfico de drogas, impactan severamente a poblaciones particularmente vulnerables. Este artículo se propone investigar la compleja relación entre gobernanzas criminales y el narcotráfico en Colombia, mediante la creación de un Índice Departamental de Gobernanzas Criminales (IDGC) y un indicador de delitos por narcotráfico. Esta investigación es novedosa, ya que se basa en técnicas de minería de datos para procesar grandes volúmenes de información. Desde la definición de constructos, la selección de variables y la definición de indicadores hasta su medición, ponderación y visualización, este trabajo ofrece insumos para la política criminal y la política antidrogas, incluyendo análisis diferenciados para cada departamento de Colombia.ABSTRACT. Criminal governance is a phenomenon that is difficult to measure due to its clandestine nature, making it equally difficult to study its relationship with other problems that, like drug trafficking, severely impact particularly vulnerable populations. This article aims to investigate the complex relationship between criminal governance and drug trafficking in Colombia, through the creation of a Departmental Criminal Governance Index (IDGC) and an indicator of drug trafficking crimes. This research is novel, as it is based on data mining techniques to process large volumes of information. From the definition of constructs, the selection of variables and the definition of indicators to their measurement, weighting and visualization, this work provides inputs for criminal policy and anti-drug policy, including differentiated analyzes for each department of Colombia.
       
  • Territorially Focused Development Programs, violence rates and criminal
           governance in Colombia

    • Abstract: Resumen. Los Programas de Desarrollo con Enfoque Territorial (PDET), surgidos del acuerdo de paz de 2016, buscan fortalecer las instituciones estatales y disminuir la incidencia de organizaciones criminales en zonas afectadas por el conflicto armado. Este artículo analiza la correlación entre recursos destinados al fortalecimiento estatal en municipios priorizados por el PDET y los índices de violencia criminal, mediante un análisis estadístico, segmentado en cuatro corredores, durante el periodo 2017- 2019 y 2020. Los resultados evidencian que solo el corredor Amazonía-Guaviare redujo índices de violencia como efecto de gastos de inversión, particularmente las desapariciones forzadas. Se plantea que la inversión en los PDET no necesariamente repercute en índices de violencia, pues se dan prácticas de gobernanza criminal en las cuales actores ilegales reacomodan sus intereses en el territorio y se adaptan a las transformaciones institucionales del posacuerdo.Abstract. The Territorially Focused Development Programs (PDET), derived from the 2016 peace agreement, seek to strengthen state institutions, and reduce the incidence of criminal organizations in areas affected by armed conflict. This article analyzes the correlation between resources allocated to state strengthening in municipalities prioritized by the PDET and criminal violence rates, through a statistical analysis, segmented into four corridors, during the period 2017-2019 and 2020. The results show that only the Amazon-Guaviare corridor reduced violence rates as an effect of investment expenditures, particularly enforced disappearances. It is considered that investment in the PDETs does not necessarily have an impact on violence rates, as there are criminal governance practices in which illegal actors rearrange their interests in the territory and adapt to the institutional transformations of the post-agreement.
       
  • Challenges and realities of peace in Colombia: an analysis of the
           discourse of the voices of retired military personnel

    • Abstract: Resumen Este artículo se propone analizar la perspectiva de algunos oficiales en retiro de las Fuerzas Militares colombianas en relación con la violencia producida tras el Acuerdo de Paz con las FARC- EP, suscrito en 2016. Para ello, se analizan los puntos del acuerdo más relevantes sobre esta cuestión, y se abordan aspeaos como la proliferación de las disidencias, el narcotráfico o las dificultades para cooptar el territorio inscrito en la geografía de la violencia. Como resultado, se encuentra un relativo sentimiento de recelo y escepticismo que, en todo caso, incluye elementos de autocrítica y de necesidad de transformación. Con esto se busca aportar a la comprensión de la perspectiva de los militares, quienes ofrecen un valioso aporte para fortalecer la respuesta del Estado en la gestión del conflicto armado interno.Abstract. This article aims to analyze the perspective of some retired officers of the Colombian Armed Forces in relation to the violence produced after the Peace Agreement with the FARC-EP, signed in 2016. For this purpose, the most relevant points of the agreement on this issue are analyzed, and aspects such as the proliferation of dissidence, drug trafficking or the difficulties to co-opt the territory inscribed in the geography of violence are addressed. As a result, there is a relative feeling of suspicion and skepticism that, in any case, includes elements of self-criticism and the need for transformation. The purpose of this article is to contribute to the understanding of the perspective of the military, who offer a valuable contribution to strengthen the States response in the management of the internal armed conflict.
       
  • Shared sovereignty, criminal governance and challenges to the State model
           in Colombia

    • Abstract: Resumen. La persistencia y actividad de grupos ilegales en Colombia se puede explicar a través de la inviabilidad del concepto tradicional del Estado moderno. El objetivo de este artículo es analizar cómo los principios fundamentales de la soberanía y la gobernanza que implica la idea del Estado moderno son menoscabados por la presencia endémica de estructuras ilegales en Colombia. Mediante una aproximación metodológica ecléctica e híbrida, se muestra cómo se han configurado en el país algunas soberanías compartidas y gobernanzas criminales, en especial tras la desmovilización de las FARC-EP y la disipación de la agenda de seguridad nacional respecto a sus objetivos. Se concluye que Colombia debe continuar en la senda de la cohesión, para consolidar sus intereses nacionales y proteger la ciudadanía.Abstract. The persistence and activity of illegal groups in Colombia can be explained through the unfeasibility of the traditional concept of the modern State. The objective of this article is to analyze how the fundamental principles of sovereignty and governance implied by the idea of the modern State are undermined by the endemic presence of illegal structures in Colombia. Through an eclectic and hybrid methodological approach, it is shown how shared sovereignty and criminal governance have been configured in the country, especially after the demobilization of the FARC-EP and the distraction of the national security agenda regarding its objectives. It is concluded that Colombia must continue on the path of cohesion, to consolidate its national interests and protect citizens.
       
  • Migration dynamics on the Colombian-Venezuelan border and its relationship
           with transnational crime

    • Abstract: RESUMEN. Durante los últimos años, los flujos migratorios en la frontera colombo-venezolana han experimentado un cambio notable en sus dinámicas y perfiles. La expansión y consolidación de economías irregulares con cierto arraigo en el área fronteriza, así como la crisis económica y social en Venezuela y el conflicto en Colombia, han conducido a problemas de gobernabilidad y conflictos en las relaciones bilaterales entre ambos países. Este artículo estudia la transformación del fenómeno migratorio colombo-venezolano, sus implicaciones y riesgos para ambos países, con énfasis en el aprovechamiento de esta situación por parte de estructuras criminales. Se concluye que las acciones institucionales diseñadas para abordar dicha problemática requieren de gran colaboración a nivel regional, e incluso de la participación de actores extrarregionales.ABSTRACT. In recent years, migratory flows along the Colombia-Venezuela border have experienced a notable change in their dynamics and profiles. The expansion and consolidation of irregular economies with certain roots in the border area, as well as the economic and social crisis in Venezuela and the conflict in Colombia, have led to governance problems and conflicts in bilateral relations between the two countries. This article studies the transformation of the Colombia -Venezuela migration phenomenon, its implications, and risks for both countries, with emphasis on the use of this situation by criminal structures. It is concluded that the institutional actions designed to address this problem require great collaboration at the regional level, and even the participation of extra-regional actors.
       
  • In search of the best officer training: Spain’s military academy vs.
           West Point

    • Abstract: RESUMEN. Este artículo presenta dos estudios de caso sobre el modelo de formación de oficiales de la Academia General Militar de España y de la Academia Militar de West Point de Estados Unidos. Luego se hace un estudio comparado para dilucidar si proporcionan competencias similares a los cadetes de cada ejército. Para ello se revisan los respectivos currículos que definen las competencias que debe tener un oficial, según las necesidades y circunstancias de cada ejército. Luego se añade la observación participante en ambos casos. Esta investigación concluye que ambos sistemas proporcionan competencias similares, si bien varían en su adaptación a las necesidades de cada ejército. También se identifican ciertas áreas de mejora en articulación y formación en habilidades para toda la carrera profesional en el caso español, que pueden motivar reformas y nuevas investigaciones.ABSTRACT. This article presents two case studies on the officer training model of the General Military Academy in Spain and the West Point Military Academy in the United States. A comparative study is then carried out to elucidate whether they provide similar competencies to the cadets of each army. For this purpose, the respective curricula that define the competencies an officer must have, according to the needs and circumstances of each army, are reviewed. Participant observation is then added in both cases. This research concludes that both systems provide similar competencies, although they vary in their adaptation to the needs of each army. Certain areas for improvement in articulation and training in skills for the entire professional career are also identified in the Spanish case, which may motivate reforms and new research.
       
  • Evolution of civil-military relations in Latin America: a comparative
           study between Peru and Colombia

    • Abstract: RESUMEN. En toda democracia liberal, hay una tensión entre el ejercicio del poder militar para sostener la institucionalidad y el control civil de dicho poder para mantener la democracia. En América Latina, dicha tensión pesa sobre las relaciones civiles-militares, en el marco de dictaduras militares, transiciones democráticas y amenazas subversivas. Este artículo estudia los casos de Colombia y Perú, países con una historia de conflicto que ha puesto en riesgo su democracia, y que ha requerido unas Fuerzas Militares suficientemente fuertes para enfrentar amenazas cambiantes. A la vez, ambos países han requerido buscar el control civil para garantizar la gobernabilidad y legitimidad democrática. Se encuentra que en ambos países ha habido esfuerzos por el control civil de las Fuerzas Armadas, sin prescindir completamente de la participación militar mediante la Acción Integral en busca de la paz.ABSTRACT. In every liberal democracy, there is tension between the exercise of military power to sustain institutionality and civilian control of said power to maintain democracy. In Latin America, this tension weighs on civil-military relations, within the framework of military dictatorships, democratic transitions, and subversive threats. This article studies the cases of Colombia and Peru, countries with a history of conflict that has put their democracy at risk, and that has required Military Forces strong enough to face changing threats. At the same time, both countries have sought civilian control to guarantee governability and democratic legitimacy. It is found that in both countries there have been efforts for civilian control of the Armed Forces, without completely setting aside military participation through Integral Action in the search for peace.
       
  • Sovereign immunity and the case of the United States v. Noriega

    • Abstract: Resumen. La inmunidad soberana es una doctrina internacional según la cual ni un soberano ni un Estado pueden ser demandados por tribunales judiciales extranjeros. Los Estados Unidos regulan esta figura jurídica a través de la Ley de Inmunidades Soberanas Extranjeras de 1976. Dicha regulación, sin embargo, no define la inmunidad soberana de jefes de Estado. Por eso, el caso de los Estados Unidos contra Noriega resulta de gran interés, pues fue la primera vez que los tribunales judiciales de un país juzgaron a un jefe de Estado de otro país. En este caso, los tribunales cometieron un error al no solicitarle al órgano ejecutivo una aclaración oficial para definir el estatus de jefe de Estado del General Noriega. En ese sentido, la decisión no se apegó al estricto derecho y se basó en motivaciones políticas.Abstract. Sovereign immunity is an international doctrine according to which neither a sovereign nor a state can be sued by foreign courts. The United States regulates this legal figure through the Foreign Sovereign Immunities Act of 1976. Said regulation, however, does not define the sovereign immunity of heads of state. For this reason, the case of the United States v. Noriega is of great interest, since it was the first time that the courts of one country tried a head of state of another country. In this case, the courts made a mistake by not asking the executive branch for official clarification to define General Noriegas status as head of state. In that sense, the decision did not adhere to strict law and was based on political motivations.
       
  • A devaluation of the Eurocentric myth about the universality of human
           rights: The Latin American suspicion

    • Abstract: Resumen. Desde la hermenéutica de la sospecha, este artículo explora cómo la teoría crítica de los derechos humanos inspiró la perspectiva latinoamericana de emancipación, que cuestiona el universalismo convencional, eurocéntrico, de los derechos humanos. Se desarrolla una investigación causal y filosófico-jurídica, basada en la metodología de análisis documental de fuentes bibliográficas. La investigación identifica tres herramientas claves en el pensamiento latinoamericano que han influenciado la devaluación de la visión impuesta de los derechos humanos: las ideologías de emancipación, la cultura y la literatura. Se muestra cómo ha habido diversos movimientos sociales y culturales que promueven dicha emancipación. Finalmente, la investigación abre nuevas líneas de estudio sobre la viabilidad de establecer una cultura propia latinoamericana de los derechos humanos, desafiando el conocimiento occidental impuesto en este contexto pluricultural.Abstract. From the hermeneutics of suspicion, this article explores how the critical theory of human rights inspired the Latin American perspective of emancipation, which questions the conventional, Eurocentric universalism of human rights. A causal and philosophical-legal investigation is developed, based on the methodology of documentary analysis of bibliographic sources. The research identifies three key tools in Latin American thought that have influenced the devaluation of the imposed vision of human rights: emancipation ideologies, culture and literature. It shows how there have been various social and cultural movements that promote said emancipation. Finally, the research opens new lines of study on the viability of establishing a Latin American culture of human rights, challenging the Western knowledge imposed in this multicultural context.
       
  • Protecting collective rights in Colombia: group actions implementation,
           and an approximation to U.S. class actions concept

    • Abstract: Abstract. The defense of collective rights, and the appropriate reparation of damages to victims is a recent development issue in the Colombian legal system. Although some legal provisions mentioned damages to an indeterminate group of people in cases of negligence, it was not until the 1991 Constitution that Colombia established the types of actions all individuals or groups can initiate to advocate for the integrity of their rights in the lace of illegal actions or omissions by the State. There is currently no mechanism for groups to sue private entities efficiently that guarantees all individual and collective rights, akin to class actions. This scientific article delves into the multifaceted landscape of collective rights protection in Colombia, focusing specifically on the mechanisms and implications surrounding the deployment of group actions.Resumen. La defensa de los derechos colectivos y la adecuada reparación de los daños a las víctimas es un tema de reciente desarrollo en el ordenamiento jurídico colombiano. Aunque algunas disposiciones legales mencionaban perjuicios a un grupo indeterminado de personas en casos de negligencia, no fue sino hasta la Constitución de 1991 que Colombia estableció los tipos de acciones que todo individuo o grupo puede iniciar para defender la integridad de sus derechos frente a acciones u omisiones ilegales por parte del Estado. En la actualidad no existe un mecanismo para que los grupos demanden a entidades privadas de manera eficiente que garantice todos los derechos individuales y colectivos, similar a las acciones de clase. Este artículo científico se adentra en el multifacético panorama de la protección de los derechos colectivos en Colombia, centrándose específicamente en los mecanismos e implicaciones que rodean el despliegue de las acciones de grupo.
       
  • The performance of intelligence in Spain in the public, business and
           academic spheres

    • Abstract: Resumen. Este artículo analiza dos cuestiones clave en los servicios de inteligencia en España: su desempeño profesional y el avance teórico de carácter académico que impulsa el uso de la inteligencia en distintos espacios públicos y privados, en búsqueda de dar prestigio a la inteligencia en la academia. Analizando especialmente la obra del investigador español Díaz-Matey, se evidencia que la valoración de la inteligencia tanto en el sector público como en el empresarial impacta la funcionalidad y legitimidad de los organismos de inteligencia. Se concluye que debe avanzarse en los procesos de democratización y desclasificación, rompiendo el secretismo, para que la inteligencia permee la cultura general, se consolide como disciplina académica y ayude a tomar mejores decisiones en todos los ámbitos.Abstract. This article analyzes two key issues in the intelligence services in Spain: their professional performance and the theoretical advance of academic character that drives the use of intelligence in different public and private spaces, in search of giving prestige to intelligence in the academy. Analyzing especially the work of the Spanish researcher Diaz-Matey, it is evidenced that the valuation of intelligence both in the public and business sectors impacts the functionality and legitimacy of intelligence agencies. It is concluded that progress must be made in the processes of democratization and declassification, breaking secrecy, so that intelligence permeates the general culture, consolidates as an academic discipline and helps to make better decisions in all fields.
