  • The Chinese Approach to Extraterritoriality

    • Free pre-print version: Loading...

Abstract: Extraterritorial jurisdiction, or extraterritoriality, refers to a state's prescriptive power to enact domestic law to regulate individuals and activities outside its territory. Extraterritoriality is an exemption to the traditional territorial principle of jurisdiction.1 States take advantage of extraterritoriality because they lack confidence and trust in other states to act promptly and to effectively or diligently protect their interests. As extraterritorial jurisdiction attempts to regulate matters within other countries' territory, its enforcement affects other states' sovereignty. However, extraterritorial prescriptive jurisdiction is absolutely legal in international law. The Permanent Court of ... Read More

  • Expressions of Interest in Politics in Authoritarian China

    • Free pre-print version: Loading...

Abstract: Interest in politics is an important element of civic culture. As early as in ancient Greece, Aristotle recognised that "man is a political animal". As ordinary people play a key role in democracy, it is unimaginable for a democracy to be sustained and work effectively in the absence of citizens' interest in political affairs. Such an interest in politics motivates people to pay attention to it, voice their policy preferences and influence the political decision-making process. Citizens with political culture orientations conducive to democracy are pivotal to the successful democratisation of a country.1 Based on civic culture theory, interest in politics is a democratic political orientation.2 It is associated ... • Personal Backgrounds, Constituency Demands and Policy Issues Raised by
Deputies of China's National People's Congress

    • Free pre-print version: Loading...

Abstract: Do legislators base their actions more on constituency factors or on their own personal attributes' In Western democracies, the electoral connection is regarded as the most important basis for legislators' behaviour;1 thus, such behaviour is strongly influenced by constituents' preferences and interests,2 although legislators' personal identities and experiences also have an influence.3 However, since deputies of China's people's congresses are elected in basically noncompetitive elections, the electoral connection is considered very weak;4 thus deputies' activism, roles and articulation of interests have been claimed to be affected mainly by their personal attributes instead of by constituency factors.5Based on ... • Political Education and Children's Political Cognition in China

    • Free pre-print version: Loading...

Abstract: Political cognition refers to individuals' knowledge and understanding of political symbols or information; it is closely related to the level of individual cognitive development and also affected by environmental factors. How children get to know a political system and the process by which children acquire knowledge and perceptions of political life are major topics of political socialisation. Applications of Piaget's theory of cognitive development to the study of political science and research on children's political cognition dominated the direction of political socialisation1 and political psychology in the 1950s and produced a voluminous body of literature.2 However, the study of the effects of early ... • Political Attitudes and National Identity of Mainland Chinese Migrants in
           Hong Kong

    • Free pre-print version: Loading...

Abstract: In recent years, against a background of conflicts between regimes with different political ideologies, migration has been at the centre of increasing debates. Political attitudes and national identity are key aspects of acculturation and political integration among immigrants.1 Therefore, studies of this issue have important implications for domestic politics in both the origin and host societies.2 The effects of migration channels and premigration socialisation on political attitudes and national identity have received greater attention in the migration literature, especially in relation to transnational immigration involving drastically different political systems in the origin and host societies.3While previous ... • Legal Judgements on the Employee Status of Platform Workers in China—A
Combination of Legal Formalism and Pragmatism

    • Free pre-print version: Loading...

Abstract: In China, where workers are classified as employees or independent contractors,1 the emergence of platform employment2 raises awkward questions and compounds the issues related to the existing dichotomy. Although platform companies impose certain controls over the labour process and determine the remuneration standard for each order filled, the platform worker also enjoys increased job flexibility, such as the choice of when and where to work. Due to such flexibility, platform companies tend to treat workers as independent contractors. Consequently, platform workers cannot obtain the rights generally accorded to regular employees, such as a minimum wage and workers' compensation benefits. Platform workers may ... Read More

  • Blind Shaft Crimes: A Transient Phenomenon in Contemporary China

    • Free pre-print version: Loading...

Abstract: The heinous crime of deliberately killing a workmate, making the scene look like a fatal accident and pretending to be a relative of the victim in order to request compensation from the employer used to be a frequent occurrence in China. Crimes of such a nature were called "blind shaft crimes" because most of them took place in underground coal mines. Blind shaft crimes peaked at the beginning of the 21st century and then rapidly mysteriously vanished. An investigation adopting both criminological and sociological perspectives unveils the causes of the quick rise and fall of blind shaft crimes.Blind shaft crimes, even if they have received occasional mention by news media and in films, have received scant attention ... • "Afterlives" of the Danwei in 21st-century China: The Case of the
           University Sector

    • Free pre-print version: Loading...

Abstract: As an integral component of Chinese socialism, "the danwei system came into being as a concomitant of central planning and 'totalitarian' political control".1 The term danwei refers both to a generic socialist workplace configuration in urban areas of the People's Republic of China (PRC) and also to a macro sociopolitical system undertaking both the political function of a tool for controlling urban society and the social function of providing comprehensive welfare to the urban populace.2 Since the introduction of reform and opening up, the danwei has become an important area of study. Contributors to the research are primarily sociologists3 and scholars of Chinese politics.4How have post-Mao reforms impacted the ... Read More

  • Court–Government Interaction in the Context of Administrative Litigation
           and Competition Enforcement in China

    • Free pre-print version: Loading...

Abstract: The courts' role in reviewing administration actions has been a controversial issue since the enactment of the Administrative Litigation Law in 1989. Scholars and academia are concerned about the courts' institutional competence in confronting the administrative branch, especially when the judgement may invalidate the administrative actions in dispute. In particular, interactions between courts and governments may provide the latter with unique opportunities to lobby, threaten and manipulate the former. It follows naturally that such interactions should be banned in the context of administrative litigation.1This article, however, challenges the conventional view and shows that court–government interaction has ...
