  • Tracing the “Infectious Criminal”: A Genealogy of HIV Criminalization
           and Infectious Injustice in Finland

      Abstract: This article examines the junction of state healthcare and punishment through HIV criminalization. By problematizing the application of criminal law to HIV in Finland, the study locates a genealogy of the “infectious criminal” – a figure at the cusp of these two forms of state power. The article traces how this figure, evoked in official debates from the early 20th century onwards, justified punitive measures to control marginalized people, from poor merchants to prisoners-of-war, sex workers, vagrants, and later, migrants. Drawing on parliamentary archives, the article asks how punishment and existing social injustices are narrated, maintained, and connected. Revealing a continuum of punishment and healthcare, HIV criminalization – especially within a nation deemed exceptionally non-punitive and welfare-oriented – is a crucial point from which to examine the connections of social injustice and criminal justice.

  • Trafficking on Trial: The Judge, the Pimp and the Victim

      Abstract: Based on an ethnography of French trials for trafficking in human beings and aggravated procuring, this article seeks to contribute to the analysis of the reframing, in penal terms, of the struggles engaged in the name of social justice and women’s rights, of which anti-trafficking policies are particularly emblematic. Studying the judging practices and logics at stake during trials reveals how fantasized representations of the pimp and the victim take on substance. In particular, I argue that judges invoke a set of gendered, sexualized and racialized extra-legal norms, which, along with their legal foundations, constitute their knowledge base and impose a moral and penal hierarchy among litigants. Therefore, not only does this analysis contribute to defining the contours of the elusive figures of the pimp and the victim in the penal arena, it also exposes how maintaining public order is based on the perpetuation of a gendered and sexual national order in the name of gender justice.

  • Threats, Victims and Unimaginable Subjects of Rights: A Genealogy of Sex
           Worker Governance in Poland

      Abstract: This paper sketches the emergence of, and shifts within, the social, legal, and political figurations of sex workers in Poland. By adopting a genealogical perspective, I investigate how sex workers have been (re)constituted as subjects of governance and unimaginable social justice claimants in legislation, political debates, and law enforcement strategies. With a broad temporal scope, this article traces continuities, transformations, and disruptions within modes of sex work governance in Poland from the adoption of the first laws relating to sex work enacted during the early 19th century to the present day. Through analysis of policy documents, scholarly work on the history of sex work policies in Poland, and personal accounts by sex workers, I identify and examine two dominant discursive and legal figurations of a sex worker: as a threat, and as a victim in need of rescue and protection. While analysing the emergence of and interplay between these two figurations, this article demonstrates how these seemingly contradictory frames of recognition gradually conjoined within 20th-century Polish sex work governance strategies, rendering sex workers unimaginable subjects of rights and social justice claimants.

  • The Just Prison' Women’s Prison Reform and the Figure of the
           “Offender-as-Victim” in Germany

      Abstract: During the 1990s, the Berlin women’s prison was reformed to do justice to female inmates. This redesigning of space and programs was intended to meet women-specific conditions and needs. The present paper engages with this prison reform as transformation in the name of gender justice. Based on interviews with prison reformers, criminologists, and policymakers, as well as on the analysis of historical documents, we illuminate how a specific figure of the “criminalized woman” helps to translate the abstract notion of social justice into situated practice. From the 1970s onward, a new knowledge of women’s crime would emerge: it constituted female offenders as victims of patriarchal oppression and victimization, allowing the prison system to be criticized as androcentric and discriminatory against women. We argue that subsequent reform pursued gender justice in the form of difference-based, gender-responsive programs and spaces targeting individual inmates’ character and mindset. Thereby, the reformers’ initial critique of social justice would be unintentionally depoliticized and so gender, economic, and political inequalities remained unaddressed. Our purpose is hence twofold: first, to review the recent history of women’s incarceration in Germany, and second, to add a social justice focus to the international criminological debate on gender, prison, and reform.

  • Against Care: Abolition and the Progressive Jail Assemblage

      Abstract: This article uses the concept of a progressive jail assemblage to think about the focus on jails as both a target of social justice organizing and a tool for advancing social justice goals. Drawing on ethnographic research conducted among formerly incarcerated organizers and their allies in Western Massachusetts (New England), I explore how the sheriffs who operate jails in this region, along with their collaborators, have increasingly sought to redefine the figure of the criminal as not just a danger to others but also a danger to themselves, someone in need of rehabilitative treatment and even care. In doing so, these sheriffs have attempted to reinvent their role, from the quintessentially American crime fighting figure, to one who is also a provider of care. Social justice activism has helped to expand the “caring” role of the jail, through increased addiction treatment, re-entry support, and community outreach – even to the extent of incarcerating individuals dealing with addiction who have not been charged with a crime. As progressive jails have been reconfigured as providers of care, abolitionists are confronted with the ongoing dilemma of how to remain a figure opposed to the use of prisons and jails without being seen as against care.

  • The Hero, the White Savior, and the Smuggler: Criminalized Figures in the
           Landscape of Solidarity Toward Migrants

      Abstract: One recent shift in the ever-expanding crackdown on migration and implementation of a hostile environment for migrants in the EU has been the criminalization of migrant solidarity. Using various legal tools, EU governments have been trying to hinder solidarity actions from civil society. In particular, a narrative depicting civilians helping migrants as criminals has been elaborated by European organizations and strengthened by far-right groups and dominant press outlets. In reaction, a counter-narrative has been constructed and spread by pro-migrant groups and liberal media, which presents criminalized activists as criminalized heroes and their actions as humanitarian. Based on a critical discourse analysis of academic texts, press articles, and empirical research with pro-migrant activists, this article examines two criminal figures from the civilian search and rescue field: the “activist associated with smugglers” and its counterpart, the “criminalized hero.” Through the lens of figuration of crime and social justice, the article brings a new understanding of the de- and repoliticization processes that occur in the field of humanitarian help and migration. By analyzing these two figures, the paper also contributes to a better understanding of the competing moral orders underpinning criminal and social justice claims in the field of solidarity toward migrants. On the one hand, the figure of the activist associated with smuggler is part of a criminal justice narrative depicting migration as a threat to political, social, and economic stability. On the other hand, the criminalized hero figure includes a counter-narrative to this moral order based on the defense of a social justice frame of solidarity and the protection of human rights. Within the pro-migrant activist’s scene, the criminalized hero and its social justice frame are criticized for reproducing racist and post-colonial practices of humanitarianism.

  • Temporalization and the Digital Vigilante: Past Presencing, Un/Doing
           Futures and “Jewish Revenge” as Affective Justice in Talia Lavin’s
           Culture Warlords

      Abstract: This paper examines the figure of the hate-fighting digital vigilante as embodied through Aryan Queen, an online persona developed and depicted by self-proclaimed antifa member Talia Lavin in her book Culture Warlords. One chapter in the 2020 memoir relays Lavin’s pursuits to elicit and make known identifying information of Der Stürmer, an anonymous white supremacist online hater. I first locate Lavin’s undertaking in the porous policy landscape regulating online hate transnationally to make a case for its value as an entry into the navigation of hate on Telegram, a platform that has become a popular enclave for hate, and one that remains otherwise impenetrable to state efforts at formal governance. I then introduce the digital vigilante as a cultural figure that has become increasingly distinguished from, but developed in relation to, the classical or analogue vigilante in academic literature, albeit with only limited attention paid to the seemingly boundless temporality that constitutes the virtual sphere. Attending to processes of temporalization, I argue, can well serve an analysis of the moral universe within which the digital vigilante operates, thereby enabling a critical engagement with the motivations, methods, and intentions of her justice pursuits online. With the support of anthropological theories of temporalization – namely, past presencing, un/doing futures, and affective justice – I show that justice pursuits by way of digital vigilantism for Lavin are entangled with an affective longing for revenge, and manifest a complex intermingling of open wounds from injustices that emerge from and produce entanglements of the past, present, and future.

  • Beti’s Perspective: Using Critical Race Theory’s Composite
           Counterstory to Interrupt Antiracism Projects in Vancouver, BC

      Abstract: Building on research conducted in feminist organizations in Vancouver, British Columbia, on the unceded territories of the xʷməθkʷəy̓əm (Musqueam), Sḵwx̱wú7mesh (Squamish), and səlilwətaɬ (Tsleil-Waututh) Nations, this paper explores the role, relationship, and responsibility of advocating for antiracism and social justice in the context of antiracism projects in feminist nonprofit organizations. In doing so this paper asks: What do antiracism projects look like in feminist organizations' And how are these projects informed or interrupted by racialized and Indigenous activists within these spaces' Using critical race theory’s composite counterstory, this paper uses storytelling methodologies to understand how racialized settlers and Indigenous folks can collaborate and thrive – as they have been doing – on occupied unceded territories in Canada. Based on a series of interviews with racialized and Indigenous activists engaging in feminist nonprofit organizations, these stories shed light on contemporary realities of colonization, including collaboration within white settler systems.
