  • Copyright and Preservation of Born-digital Materials: Persistent
           Challenges and Selected Strategies

      Abstract: ABSTRACTThis article surveys and analyzes archival literature and legal resources (primarily United States–focused) related to copyright considerations that archivists and other content managers must be aware of to effectively and legally maintain a collection of born-digital materials. These considerations include the centrality of copying to preservation actions, shifting definitions of ownership, unclear distinctions between published and unpublished content, digital rights management laws and technologies, and the layered copyrights that can exist in complex digital objects and their dependencies. Strategies for dealing with these challenges include securing rights ahead of time, adopting legal rationales related to orphan works and fair use, adapting practices from specialized digital preservation subfields, ensuring routine procedures adequately address copyright-related recordkeeping and risk management, and advocating for preservation-enabling copyright reforms. An examination of these issues and strategies in the context of current thinking about copyright suggests that while certain legal exceptions and existing rights frameworks can help to facilitate digital preservation activities, copyright will continue to be a barrier until significant reforms are enacted.

  • Becoming an Imagined Record: Archival Intervention in Autofiction

      Abstract: ABSTRACTHuman rights are intricately tied to the practice of archivists, and the imperative to address the silence of the archive has been discussed in archival scholarship. After examining the evolution of archival intervention in arts (films, novels, plays, etc.), this article analyses the narrative components of two novels—W. G. Sebald's Austerlitz (2001) and Valeria Luiselli's Lost Children Archive (2019)—and demonstrates that certain works of autofiction are uniquely fit to become “imagined records.” Through the lens of “archival reading,” the article reveals these novels' narrative traits, such as their tendency to rely heavily on photographs, maps, and other iconography; their use of a specific type of narrator; and their intention to supplement the silence of the archive, the characteristics that facilitate the construction of imagined records. By delineating the ways in which these traits were implemented in the creation of an imagined record, the article paves a way for more imagined records to come in the future. Rooted in real sociohistorical traumas, these two novels expand the notions of evidence and the forces that shape archival theory and practice.

  • Reimagining Instruction in Special Collections: The Special Case of Haiti

      Abstract: ABSTRACTA growing body of literature has developed around critical archival instruction and archivists as educators. This development demonstrates the pedagogical evolution beyond show-and-tell sessions to critical approaches in archival instruction and specific standards in archival literacy. This article provides a cross-disciplinary discussion of an approach to archival instruction. Also included is a reimagined instruction session using a fragmentary collection from the Saint-Domingue/Haiti colonial administration. Stories of the enslaved are usually marked by death and brutality. But Haiti's is a story of triumph; though fleeting, a victory nonetheless. When instructors decolonize archival instruction, they bring the past into the present and the future. The Haitian Revolution was a large-scale revolt by enslaved Africans, and it was also directly connected to the expansion of the United States. Archival instructors should encourage students to reimagine the stories told from the Saint-Domingue colonial administration collection and from any colonial collections that may be under their care.

  • Maintaining Records in Context' Disrupting the Theory and Practice of
           Archival Classification and Arrangement

      Abstract: ABSTRACTThe role and the associated practices of the archivist are attuned to notions of facilitation. Archivists facilitate people's engagement with the historical record by providing access to records in context: a context instantiated through archival classification, arrangement, and description. In the second of a two-part article, the author draws from the archival literature to present a historical overview of the factors that contributed to evolving notions of archival classification and arrangement from the 1960s to today. A review of the literature of this time frame provides its own context for understanding how, why, and through whose influence competing understandings and implementations of core classification ideas persist. In the process, the author highlights classification as a historically situated interpretive act, drawing attention to the implications of various disciplinary influences and analytical perspectives on the present status and future conception of, and possibilities for, the American archival profession.

  • The Autologic Archive: Appraisal, Institutional Motives, and
           Essentializing Identity in Refugee and Asylum Application Narratives, In
           and Out of Fiction

      Abstract: ABSTRACTThis article merges the postmodern critical thinking that scrutinizes bias and power in the formation of archival collections with the refugee and asylee resettlement process in the United States. It proposes that the theoretical accumulation of narratives recorded on applications for refugee and asylum status can be conceived of as a theoretical archive, physically boundless and spread across countries of origin, temporary host countries, and countries of resettlement. A postmodern-archivist lens helps to interrogate the implications of what Mireille Rosello calls the “problematic gap” separating what happened to a person and the narrative that is bureaucratically established during the application process; this article explores this “gap” by engaging fieldwork and scholarship from lawyers, field researchers, and humanitarians who critique how application narratives are recorded, processed, and preserved. It then turns to fiction from Chimamanda Ngozi Adichie, Dinaw Mengestu, and Imbolo Mbue that inhabits this “problematic gap,” reading a character in each text as personification of the processes of appraisal, institutional motives, and essentialization of identity. These texts make visible ways in which the application narrative archive operates through what the author calls an “autologic function” that prioritizes familiar forms of narratives while determining who is eligible for refugee status. In turn, the article proposes that these fictional illustrations of autologic processes might inform archival projects focused on inclusion of marginalized communities.

  • Preservation and Access for Born-digital Electronic Records: The Case for
           an Institutional Digital Content Format Registry

      Abstract: ABSTRACTSince 2014, the University of Illinois at Urbana-Champaign Library has taken custody of a growing number of collections of “born-digital” records, largely through the University Archives. These collections comprise a panoply of digital content formats, ranging from those in common use to obscure varieties from the early days of personal computing. As such, they pose a challenge to digital preservation and access. Knowing what software to use to open files in formats that have fallen out of use is often difficult, let alone installing obsolete software on contemporary operating systems. At the same time, the sheer bulk of collections, as well as an accelerating rate of born-digital accessions from faculty and campus offices, makes it difficult to assess these files at the time of acquisition. These challenges suggest the need for preservation policies on digital formats in collections of electronic records, as well as for firsthand knowledge of the software required to facilitate curator control over and patron access to these collections. This article presents an overview of an evolving approach taken by archivists and librarians at the University of Illinois at Urbana-Champaign to build the policies, technical knowledge, and systems for an effective preservation and access program for electronic records. Their implementation of a local digital content format registry, while young, suggests that archivists and digital preservationists would benefit from further development of tools and practices focused on born-digital formats, and the thoughtful integration of institutional knowledge with international format registries.

  • From Datum to Databases: Digital Humanities, Slavery, and Archival
           Reparations

      Abstract: ABSTRACTThis article examines several projects that apply digital technologies to the study of transatlantic slavery and assesses the potential benefits of these projects while also noting their limitations. It argues that despite the absence of race, and specifically African American history and culture, in much digital humanities scholarship, the study of slavery has been considerably enhanced and transformed by the work of archivists and digital humanities scholars who apply digital technologies to the study and representation of slavery and enslaved people. This subject must continue to be studied so that we understand not only the past but also slavery's impact on the present. Digital technologies such as databases and geographic information system mapping have been useful in helping us understand this chapter of human history more fully and in new ways. Digital applications to archival materials relating to transatlantic slavery not only increase access to these materials for students and researchers, but also offer ways of obtaining new insights into this topic. However, to enhance our understanding of the history of slavery and to be effective agents of progressive social change, such initiatives should be cognizant of how data analysis can be driven by false assumptions of neutrality and can unwittingly contribute to the reification and dehumanization of people of African descent that was characteristic of transatlantic slavery. Digital humanities as a field should both continue such digitizing initiatives and also use digital tools to create critical analyses of oppressive hierarchies to weaken or destroy them.

      Abstract: The archival profession recently lost a brilliant archival scholar, educator, and advocate, Dr. David B. Gracy II. I was fortunate to know Dr. Gracy when I was a graduate student at the University of Texas at Austin. While I never had him as an instructor, the few opportunities I had to talk to him made a great impact on me. He was always generous with his time, knowledge, and encouragement. I will never forget a time at one of the UT Austin alumni reception “Roundups” when Dr. Gracy put a chair in the middle of the room and made everyone take turns standing on it and telling their fellow Longhorns what they had recently accomplished. We all had something to be proud of, and he made sure we knew the importance of advocating for ourselves as well. No accomplishment should go unnoticed.
