  • Online Solicitation Of Children For Sexual Purposes (Cyber Grooming)

      Abstract: As the age of using technological devices and internet decreases, children become easy targets for cybercrimes. Their vulnerability and innocence on the one hand and the accessibility and anonymity of the internet on the other creates opportunities for the commitment of sexual offences against children in cyber space. One such offence is cyber grooming, which is very dangerous because of the gravity of its possible consequences on a child’s life, but also because of the significantly vague scope of application arising from the difficulties to detect the real intent of the groomer. Although international legislation has influenced some national legal systems to criminalize child grooming as a separate offence, Turkish law has not initiated such a reaction yet. However, there exists other courses of action to criminalize cyber grooming in order to prevent such threats to a child’s physical and moral well-being. This study aims to examine the offence of cyber grooming of children for sexual purposes in comparative law and its reflection in Turkish law.

  • Administrative Dependence of Environmental Criminal Law

      Abstract: The aim of this paper is to examine administrative dependence, which is one of the important issues of environmental criminal law. Although there are extensive studies on the subject in German Environmental Criminal Law, there are few studies examining the subject in Turkish law. In this paper, first of all, the necessity of criminal law intervention in the protection of the environment will be discussed. This point is important because it is necessary to establish that the tendency toward the protection of the environment only within the scope of administrative law is not appropriate. The paper comprises the examination of administrative dependence within the framework of the general principles of criminal law; thus, administrative environmental law will not be assessed. The effect of administrative dependence, which comes to the fore because environmental criminal law is related to both administrative law and criminal law, constitutes the main framework of the paper. In this context, the gradation of administrative dependence in terms of the regulation of environmental offenses will be included. To provide the integrity of the subject, the forms of administrative dependence will be examined and the problems arising within the scope therein will be discussed.

  • Indecent Acts (TPC Art. No. 225)

      Abstract: The crime of indecent acts is regulated in Article 225 of the Turkish Penal Code (TCPC) No. 5237, with acts involving intentionally engaging in sexual intercourse and exhibitionism being covered by criminal sanctions in this same article. Besides having a wide application area, this type of crime also involves many discussions in terms of crime theory, such as the legal value protected by this type of crime, how to make sense of the concepts of sexual intercourse and exhibitionism in the legal text, whether the purpose or motive of the perpetrator has an effect on the formation of the crime in terms of its moral element, and what the characteristics this type of crime has in terms of the application of the provisions of participation. Many issues require a holistic analysis within the framework of crime theory. In this context, examine the types of crime is thought to be useful within the framework of both German and Turkish teachings and current judicial decisions. Within the scope of the study, the crime of indecent acts is the subject of analytical examination within the framework of the examination method of the crime theory adopted by the new TPC.

  • The Decision on Obviating Investigations (CPC Art. 158/6)

      Abstract: Through the provision in paragraph 6 of Article 158 of the Turkish Criminal Procedure Code (CPC), public prosecutors have the authority to issue the decision on obviating an investigation (DOOI), as clearly regulated in the Turkish legislation. This decision accepts that no investigation shall be conducted regarding abstract, general, or non-criminal denunciations and complaints, thus preventing a person from being named a suspect and having protective measures applied against them. Article 158/6 of the CPC attempts to protect individuals’ right to a good reputation and seeks to ensure their legal security. The opportunity to object to a DOOI was additionally introduced to the denouncer and complainant in accordance with Article 173 of the CPC in order to prevent arbitrary behaviors from public prosecutors. The practice of recording all transactions and decisions made in the private system has been adopted, and these records can only be seen by a court, judge, and/or public prosecutor. This study will reveal the positive aspects and deficiencies of the introduced provisions and explain the criticisms regarding the doctrine and the approach of the practice to the case.

  • Committing the Offense of Intentional Injury with “Any Instrument, Not
           Having Been Specifically Manufactured for the Purpose of Attack or
           Defense, Which May Be Used for Such Purpose” and is Accepted as a Weapon

      Abstract: The commission of the offense of intentional injury with a weapon is included as a secondary element requiring the aggravation of the penalty in subparagraph (e) of paragraph 3 of Article 86 of the Turkish Penal Code numbered 5237 (TCK). According to the 4th subparagraph of paragraph (f ) of Article 6 of the TCK, “in the implementation of the criminal law,” it is stated that “[a]ny instrument, not having been specifically manufactured for the purpose of attack or [defense], which may be used for such purpose” will be understood as a weapon. However, it is not clear what should be understood from the aforementioned expression in subparagraph 4. In this study, the problems caused by the phrase “[a]ny instrument, not having been specifically manufactured for the purpose of attack or defense, which may be used for such purpose” will be examined in practice. Subsequently, the necessity of abolishing the 4th subparagraph and using another expression with an amendment to be made in article 6 or the subparagraph (e) of the 3rd paragraph of article 86 of the TCK will be emphasized.

  • International Court of Justice Judgments on the Protection of Individual
           Rights in the Context of Diplomatic and Consular Rights

      Abstract: The International Court of Justice (ICJ), the main judicial body of the United Nations, has contributed significantly to the protection of human rights in its efforts to build up the rule of law on a global scale. The ICJ has dealt with issues directly related to the rights and interests of individuals in cases brought before it, and in the 21st century, began to endorse a more active approach in the protection of individual rights. This is apparent in several judgments since the early 2000s on the protection of certain consular rights. The relevant cases are LaGrand, Avena and Others, and Jadhav, the latter being one of the most recent judgments of the ICJ. In this article, these cases are examined in detail, to illustrate the abovementioned tendency of the ICJ. In particular, the different and more progressive aspects of the Jadhav Judgment compared to the LaGrand and Avena Judgments are highlighted. The main aim of this article is to prove the evolving approach of the ICJ in terms of actively protecting individual rights, through a comparison of three similar cases where it dealt with the violation of the same individual rights.
