Authors:Ștefănuț Radu Abstract: The object of this scientific study is represented by the comparative analysis between the critical-legal perspective of the element of differentiation between the two incriminations, respectively of the crime of capital market manipulation and of the crime of deception. The result of this approach consists in obtaining a better delimitation of the object of incrimination of the crime of capital market manipulation and of the crime of deception, aspects that practitioners can discover when drafting a better legal implementation of a concrete offense. The conclusion is that the crime of capital market manipulation, due to particular elements, although apparently a form of deception, is an independent crime against the business environment, being a practical application of the principle of law specialia generalibus derogant. Authors:Newman - Wadesango, D Denford, O Wadesango Abstract: This desk top research evaluated the effectiveness of Presumptive tax administration on revenue collection. The method of assessment and collection of presumptive tax were discussed as well as the challenges that are encountered by Zimbabwe Revenue Authority (ZIMRA) on presumptive tax administration on revenue collection. The challenges have negatively affected the collection of presumptive tax. The research findings revealed that the effectiveness of presumptive tax administration is affected by the high tax rates that were imposed by the ministry of finance relative to the income levels that the cottage industry earn on a monthly basis, high levels of corruption and the political interference that occur. The study recommends that authorities should implement a tax system that will provide mechanisms for the informal sector operators to graduate into the normal tax system as well as intensifying education and awareness campaigns to the informal sector operators. Major factors contributing to this are a number of major corporate fraud cases and the introduction of new regulations, such as the Sarbanes-Oxley Act in 2002 for American companies and the King II report for South Africa. The attention to corporate governance also leads to attention to information technology (IT) governance because IT plays a vital role in supporting business processes. Information technology governance is a subset discipline of corporate governance, focusing on information and technology and its performance and risk management. Information technology governance is essential to ensure that the National Regulator for Compulsory Specifications (NRCS) gets expected return on investment. Information technology (IT) governance is all about the implementation of processes, structures and mechanisms that enable business to realise value from IT investment. The main objective of this study was to evaluate the impact and effectiveness of IT governance in NRCS. The researcher’s aim was: to examine the effectiveness of IT controls implemented on the NRCS IT systems; the enforcement of IT policies; the alignment of the IT department with business; and accountability of IT management. This study was conducted using a qualitative research design – specifically case study as a research method. A case study allowed the researcher to gather information through interview questions and observation of the target population, which comprises NRCS management, IT personnel and systems. To conclude the study, the researcher has identified factors prohibiting the NRCS IT department to enforce and implement IT governance for NRCS to realise return on investment they made on IT infrastructure. The inferences may be drawn that effectiveness of IT governance can be achieved by training management and IT personnel in IT governance, using approved IT policies and aligning IT strategy with a business strategy. The paper notes that Nigeria has a substantial amount of human and material resources while the way and manner the resources are managed influences environmental sustainability within the nation and at the world at large. It is observed that despite numerous policy measures human and material resources are continuously wasted in Nigeria even as the nation continues on a downward trend of poverty. Authors:Tănase Tasente Abstract: Social Media (Facebook, Instagram, Twitter, etc.) have revolutionized the communication strategies of public institutions in recent years, and communication strategies have understood the different principles on which these new media have been built, compared to traditional means of communication. The decisive role of Social Media on citizens proved especially by increasing the proximity and accessibility of online public and political life not only contributed to the extension of political information, especially on the participation and engagement of citizens in political life. Beyond the huge openness of these social environments, encouraging users to participate in content generation and public reactions, Social Media generates new social structures and, most importantly, empowers the "people" to manifest themselves and to imposes a public agenda, to the detriment of the agendas imposed by the institutional, political and media spectrum. Thus, Social Media has opened a new innovative mechanism through which institution becomes a person, and institutional communication becomes interpersonal communication. This important aspect has forced both advertisers, large corporations, and even public institutions and political parties to reconfigure social media communication strategies and to place great emphasis on personal relationships with the public and less, or not at all, on communicating under institutionalized form. This study focused on analyzing the Social Media communication strategy of the European Commission, from 1 January 2019 to 1 July 2019. Thus, we have analyzed the Key Performance Indicators (KPIs) that facilitate Social Media communication, we have identified and analyzed the messages that generate high engagement from users as well as the dominant reactions generated by the online audience. Authors:Olise Charles Nnamdi, Emeh Ikechukwu Eke Abstract: The Nigerian state has been having insecurity challenges at different times since independence but the recent wave of insecurity has taken different and outrageous dimension. Today, loss of lives and properties in the hands of insurgents are no longer news because we have lost count with the numbers of deaths. With the combined efforts of agitation for regional secession, religion extremism cum insurgency, and herder/farmers clashes, the Nigeria society has been soaked with blood of defenseless civilians massacred in their homes. Unfortunately, despite huge national budget committed to this menace in response to recommendations of many studies towards tackling state insecurity in Nigeria that include increment of defense allocation and regional and international assistance, the result has been disappointing. But anchored on the social contract theory, this study posits that with effective social security administration, state insecurity will be drastically reduced in Nigeria because state insecurity is driven by local grievances of poor governance and lack of economic opportunities, among others. This position was derived from data generated from secondary sources and analyzed with the content analysis approach. Authors:Olalekan Eyitayo Ajibade, Ismail Alani Busari Abstract: The study focuses on the link between local government fiscal autonomy and rural development, the effect of local government fiscal autonomy on rural development and to investigate the extent at which poor capital funding has affected the rate of rural development; empirical evidences from Yewa South and Ifo local government areas of Ogun State. The research utilized both primary and secondary data. The primary data were collected through questionnaire from a sample of 130 staff out of the total population of the staff of the 2 local governments. The respondents were selected using stratified random sampling technique in which the total number of staff in each local government was put into consideration before final selection using simple random sampling. The paper employed descriptive statistics using ordinary least square in SPSS to analyze the hypotheses in order to achieve the objectives of the study. The study finds out that there is a negative effect of poor capital funding on the lives of the local people with the P-values <5% significant level. Hence, the study concludes that local governments need financial autonomy to perform their civic responsibilities of improving the standard of living and rural development of the people at the grassroots. Therefore, the study recommended that federal and state government should stop undue interference in the finances of local government councils so that yearly statutory allocations to them can be used for developmental projects.
