  • Examining the legality of abuse by failure to manufacture patents locally
           as a substantive condition for granting compulsory licences pursuant to
           the TRIPS Agreement

      Abstract: This article assesses whether abuse by failure to manufacture patents locally remains a valid condition for granting compulsory licences under TRIPS. The author examines Article 27(1) of TRIPS, which stipulates that patent rights shall be enjoyable without discrimination as to the place of invention, the field of technology and whether products are imported or locally produced, and Article 5(A)(2) of the Paris Convention, which recognises failure to manufacture locally as an example of the abuse of patent rights, and argues that the former is incorporated into Article 2 of TRIPS, thus validating the same as a condition for granting compulsory licences under TRIPS. This argument rests on the notion that India has used Section 84(1) of its TRIPS-compliant Patent Act, related to a requirement that patented inventions be manufactured locally, as a condition for granting a compulsory licence to Natco, and this decision remains unchallenged within the WTO DSU system.

  • Exploring the suitability of Chesbrough's open innovation concept for
           the exploitation and management of orphan works under copyright law

      Abstract: Orphan works are copyright-protected works whose holders cannot be located. The solutions to enable access to these works include the use of fair defence, the extended collective licensing regime, the scheme for reappearing copyright holders, and the blockchain-based system. None of these options, however, have included an open innovation framework as part of the solutions. Therefore, this paper aspires to explore the suitability of Chesbrough's open innovation concept. This paper discusses two underlying theories for the exploitation of the orphan works and further highlights the suitability of the open innovation concept based on the said theories. This paper further argues that the open-innovation based model is suitable for the exploitation of the orphan works because it may encourage grassroots innovations and promote sustainable economic growth through one of open innovation's mechanisms, IP licensing.

  • Structural condition of combinatorial innovation through patent ability AI

      Abstract: The innovation achieved by reconfiguring an invention to obtain a new combination of existing technology elements is referred to as combinatorial innovation. The combinatorial invention processes involved in combinatorial innovation are essential, but as yet there are no quantitative evaluation methods for determining whether the invention should be open or closed. In this study, we demonstrate that utilising the existence rate of similar prior patents can be used as a quantitative evaluation method using artificial intelligence technology.

  • Efficient retrieval of trademark images from large databases

      Abstract: Trademarks law is considered as the most pervasive amongst all the intellectual property laws because all the judgments require contemplating the imaginations of the consumers. Once the trademark has been submitted for registration, the examiners at the trademark office make sure that it is not similar to any of the previous registered trademarks. This motivated the need of an automated trademark retrieval system. This paper makes a contribution in the field of trademark image retrieval by proposing a retrieval technique that allows a flexible combination of colour, texture and shape features. Moreover the proposed technique utilises HSV colour histogram, for colour, multi resolution Gabor wavelet for texture and an integration of Zernike moments for global shape and scale invariant feature transform (SIFT) for local shape feature extraction. The results have been tested on MPEG7, MPEG trademark, WANG and self-compiled datasets. The improvement achieved in precision is 14% on MPEG7, 30% on the WANG and 38% on self-compiled dataset. Similarly, 26% improvement in average recall is achieved and around 16% when our proposed shape feature is compared with other state of the art techniques like Fourier descriptors, Hu moments, wavelet descriptors, Zernike moments and edge gradient co-occurrence matrix.

  • Patent ranking indicators: a framework for the evaluation of a patent

      Abstract: The purpose of this study was to define a managerial solution to patent evaluation. The problem of patent evaluation is widely analysed in the body of literature, but there has not been a study considering the patent value through an aggregate perspective. Over the past decade, numerous quantitative approaches to patent evaluation have been developed. However, the indicators adopted in the evaluation process are considered separately. In this study, we fill this gap by designing a new methodology that provides a ranking of patents by reducing the qualitative evaluation components and in addition an evaluation based on certain key performance indicators (KPIs). After a brief illustration of the different steps of the methodology, we validate the framework drawing upon a case study undertaken in an Italian company leader in the satellite solution and services field.
