  • Legal Aid Post Services at the Indonesian Religious Courts during the
           COVID-19 Pandemic

      Abstract: The spread of the Corona Virus Disease 2019 (COVID-19) has been declared as a health and economic emergency that has an impact on social life, including Legal Aid Post services at the Indonesian Religious Courts. This study aims to analyze the types, forms, and methods of Legal Aid Post services at the Religious Courts and the level of public access to the Religious Courts during the COVID-19 pandemic. This research uses an empirical juridical method with a qualitative approach. Descriptive and exploratory analysis are carried out to identify Legal Aid Post services at the Religious Courts in providing judicial access to the public. This study also uses purposive sampling before conducting in-depth interviews with several informants. These include Religious Court employees, advocates, and Legal Aid Post officers. The results show that the case registration services at the Legal Aid Post for the Religious Courts have been carried out in various forms, namely online through the E-Court application and manually by visiting the Religious Court. Thus, this study shows that Legal Aid Post services at the Indonesian Religious Courts during the COVID-19 pandemic have been carried out differently in various Religious Courts.   AbstrakPenyebaran COVID-19 telah ditetapkan sebagai darurat kesehatan dan ekonomi yang berdampak pada kehidupan sosial, termasuk pelayanan posko bantuan hukum di Pengadilan Agama. Penelitian ini bertujuan untuk menganalisis jenis, bentuk, dan metode pelayanan Pos Bantuan Hukum di Peradilan Agama serta tingkat akses masyarakat terhadap Peradilan Agama selama periode COVID-19. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif. Analisis deskriptif dan eksploratif dilakukan untuk mengidentifikasi layanan Pos Bantuan Hukum di Pengadilan Agama dalam memberikan akses peradilan kepada publik. Penelitian ini juga menggunakan purposive sampling sebelum melakukan wawancara mendalam dengan beberapa informan, termasuk pegawai pengadilan agama, advokat, dan petugas Pos Bantuan Hukum. Hasil penelitian menunjukkan bahwa pelayanan pencatatan perkara di Pos Bantuan Hukum Pengadilan Agama telah dilakukan dalam berbagai bentuk yaitu secara online melalui aplikasi E-Court dan secara manual dengan mengunjungi Pengadilan Agama. Terkait tingkat akses, masyarakat yang mengakses Pengadilan Agama saat pandemi COVID-19 mengalami penurunan. Dengan demikian, penelitian ini menunjukkan bahwa pelayanan Pos Bantuan Hukum di Pengadilan Agama selama periode COVID-19 telah dilakukan secara berbeda di berbagai Pengadilan Agama.

  • The Level of People's Obedience to MUI Fatwas (COVID-19, Bank
           Interest, and Interfaith Marriage)

      Abstract: Indonesian Ulama Council (MUI) is an organization for Muslim scholars who provide guidance for the Muslim community in the form of fatwās on a particular situation on which the community can rely. In the ongoing situation relating to the COVID-19 pandemic since March 2020, MUI released a fatwā as to how to face the pandemic. This research is aimed to measure the level of people’s obedience to the fatwā. To obtain an accurate measurement, this research involves two others MUI's fatwās - a fatwā related to bank interest and a fatwā related to interfaith marriage – by way of making a comparison. This research uses mixed methods which combined the quantitative method using SPSS and the qualitative method. This research finds that the young unmarried Muslim, mostly under-25- year-old university students, have the highest level of obedience to the fatwā related to COVID-19. The fatwā related to interfaith marriage is the most obeyed fatwās, and fatwā related to COVID-19 is the least one among three fatwās in this research.    AbstrakMajelis Ulama Indonesia (MUI) merupakan wadah bagi para ‘ulamā’ yang memberikan pembinaan bagi umat Islam dalam bentuk fatwā tentang situasi tertentu yang dapat diandalkan oleh masyarakat. Terkait pandemi COVID-19 sejak Maret 2020, MUI mengeluarkan fatwā tentang cara menghadapi pandemi tersebut. Penelitian ini bertujuan untuk mengukur tingkat kepatuhan masyarakat terhadap fatwā. Untuk mendapatkan pengukuran yang akurat, penelitian ini juga melibatkan dua fatwā MUI lainnya - fatwā terkait bunga bank dan fatwā terkait perkawinan beda agama - dengan cara membuat perbandingan. Penelitian ini menggunakan metode campuran yang memadukan metode kuantitatif dengan SPSS dan metode kualitatif. Penelitian tersebut menemukan bahwa pemuda Muslim yang belum menikah, kebanyakan berusia di bawah 25 tahun, memiliki tingkat kepatuhan tertinggi terhadap fatwā terkait COVID-19. Fatwā terkait perkawinan beda agama merupakan fatwā yang paling banyak ditaati, dan fatwā terkait COVID-19 merupakan yang paling sedikit di antara tiga fatwā dalam penelitian ini.

  • Strategies for Combating Sexual Harassment in Islamic Higher Education

      Abstract: Recent series of widely-published sexual harassment at Maulana Malik Ibrahim State Islamic University (UIN) Malang arise a question on how this Islamic campus handles the situation and promotes institutional change. This research examines sexual harassment and the way the UIN deals with it. It employs participatory action research to make it possible for researchers and stakeholders to work together to find out the strategies to prevent sexual harassment. This research obtains three strategies to prevent and combat sexual harassment including comprehensive planning strategies, infrastructure development, and building key partnerships. These partnerships include revitalizing the functions of the academic counselor, conducting campaigns against sexual harassment, building a positive-content website, integrating sexual education with the learning curriculum, and keeping relationships with the surrounding sub-district heads for the students’ control. Further research is supposed to examine and reflect on the result of the respected actions to find out the most suitable prevention, intervention, and policy protocols for Islamic higher education.     AbstrakSerangkaian pelecehan seksual yang dipublikasikan secara luas di Universitas Islam Negeri (UIN) Maulana Malik Ibrahim Malang baru-baru ini menimbulkan pertanyaan tentang bagaimana kampus Islam ini menangani situasi dan mendorong perubahan kelembagaan. Penelitian ini mengkaji pelecehan seksual dan cara UIN menanganinya. Penelitian ini menggunakan penelitian aksi partisipatif agar peneliti dan pemangku kepentingan dapat bekerja sama untuk mengetahui strategi pencegahan pelecehan seksual. Penelitian ini memperoleh tiga strategi untuk mencegah dan memberantas pelecehan seksual antara lain strategi perencanaan yang komprehensif, pembangunan infrastruktur, dan membangun kemitraan kunci. Kemitraan tersebut mencakup revitalisasi fungsi konselor akademik, kampanye anti pelecehan seksual, pembuatan situs web yang berisi konten positif, pemaduan pendidikan seksual dengan kurikulum pembelajaran, dan menjaga hubungan dengan camat di sekitarnya untuk dikontrol siswa. Penelitian lebih lanjut diharapkan untuk memeriksa dan merefleksikan hasil dari tindakan yang dihormati untuk menemukan protokol pencegahan, intervensi, dan kebijakan yang paling sesuai untuk perguruan tinggi Islam.

  • Towards a Progressive Fatwa: MUI's Response to the COVID-19 Pandemic

      Abstract: This study examines the Fatwās issued by the Indonesian Ulama Council (Majelis Ulama Indonesia/MUI) on Indonesian Muslim attitudes and practical procedures towards their religious behaviors and public demands on the government appreciation and recognition. The fatwās present logical reasoning which has attracted the government’s attention to adopting them and issue legal products based on them. With a normative legal research approach, this study is considered as qualitative research which using critical legal theory to analyze the important points in the Fatwās. As a result, this study finds four important cases in the fatwā on religious attitudes and behaviors during the COVID-19 pandemic: first, the fatwa on COVID-19 has logical reasoning which is in line with paramedical advice; second, the fatwa on COVID-19 is consistent with the government political interests concerning physical and social restrictions; third, the fatwa on COVID-19 ends the negative stigma on the political role of religious actors; and fourth, the fatwa shows the increasing role of Kiai (religious figures) from cultural brokers to actors of Islamic legal scientism.     AbstrakPenelitian ini menguji fatwā hukum yang dikeluarkan oleh Majelis Ulama Indonesia (MUI) tentang sikap dan prosedur praktis umat Islam Indonesia dalam beragama serta tuntutan publik atas penghargaan dan pengakuan pemerintah. Fatwā tersebut menghadirkan nalar logis sehingga menarik perhatian pemerintah untuk mengadopsi dan mengeluarkan produk hukum yang didasarkan pada fatwā tersebut. Dengan pendekatan penelitian hukum normatif, penelitian kualitatif ini menggunakan teori hukum kritis untuk menganalisis poin-poin penting dalam fatwā. Hasilnya, studi ini menemukan empat kasus penting dalam fatwā tentang sikap dan perilaku beragama selama pandemi COVID-19. Pertama, fatwā hukum tentang COVID-19 memiliki penalaran logis yang sejalan dengan nasihat paramedis; kedua, fatwā hukum tentang COVID-19 sejalan dengan kepentingan politik pemerintah mengenai pembatasan fisik dan sosial; ketiga, fatwā hukum tentang COVID-19 mengakhiri stigma negatif terhadap peran politik aktor agama; dan keempat, fatwā hukum menunjukkan semakin meningkatnya peran kiai dari calo budaya menjadi pelaku ilmu hukum Islam.

      Abstract: This study reviews the dichotomous concept of secular and shari’a laws. Such concept has led to new discourses: first, shari’a can influence national (modern) law without mentioning the Islamic framework in the formulation process. Second, the shari’a can stand on its own for particular religious groups who believe in its truth and place it in a higher position than the secular law. Third, the substance of shari’a and modern laws is integrable. This study uses an anthropological-sociological approach with Maqāṣid al-Sharī‘at framework. As a result, the study shows both national and regional legal products, on the one hand, are considered as the shari’a law as long as they are beneficial to and protect all people. On the other hand, the shari’a, which substantially reflects equality and fairness, can be claimed as modern law.     AbstrakStudi ini mengkaji konsep dikotomis hukum sekuler dan shari’a. Konsep tersebut melahirkan wacana-wacana baru: pertama, shari’a dapat mempengaruhi hukum nasional (modern) tanpa menyebutkan kerangka Islam dalam proses perumusannya. Kedua, shari’a dapat berdiri sendiri bagi kelompok agama tertentu yang meyakini kebenarannya dan menempatkannya pada posisi yang lebih tinggi dari hukum sekuler. Ketiga, substansi shari’a dan hukum modern terintegrasi. Penelitian ini menggunakan pendekatan antropologis-sosiologis dengan kerangka Maqāṣid al-Sharī‘at. Studi ini menyimpulkan bahwa produk hukum nasional dan daerah di satu sisi dianggap sebagai hukum shari’a selama bermanfaat dan melindungi semua orang. Di sisi lain, shari’a yang secara substansial mencerminkan kesetaraan dan keadilan dapat diklaim sebagai hukum modern.

  • Maqāṣid Al-Sharī‘at: The Main Reference and Ethical-Spiritual
           Foundation for the Dynamization Process of Islamic Law

      Abstract: The two primary and significant roles of maqāṣid al-sharī‘at worth studying are directive and defensive systems. The directive system, for instance, puts the maqāṣid al-sharī‘at as the main reference for any reformation or changing processes and dynamization of the Islamic law, whereas the latter places it as the supreme principle of morality that provides the foundation and ethical-spiritual power for Muslim Societies when they interact with the law. With these two roles, the maqāṣid al-sharī‘at can serve as a driving force to create future changes towards a more constructive and humanistic society. This study is library research which examines the maqāṣid al-sharī‘at from the time of Prophet Muhammad (Peace be Upon Him) to this very day. It aims at elaborating the position of maqāṣid al-sharī‘at as the primary reference and ethical-spiritual foundation for the dynamization process of Islamic law in dealing with contemporary issues. It also examines the concept of maqāṣid al-sharī‘at and analyzes the flexibility, adaptability, and dynamic of Islamic law. In addition, it is intended to open the mind of those who claim that Islamic law is so immutable, doctrinal, eternal, and final. This means that Islamic law is assumed to be inadaptable to various forms of social changes and modernization.     AbstrakPeran paling utama dan penting maqāṣid al-sharī‘at yang patut dipelajari adalah sistem direktif dan pertahanan. Sistem direktif, misalnya, menempatkan maqāṣid al-sharī‘at sebagai rujukan utama untuk setiap reformasi atau proses perubahan dan dinamisasi hukum Islam, sedangkan yang terakhir menempatkannya sebagai prinsip moralitas tertinggi yang memberikan landasan dan kekuatan etis-spiritual untuk masyarakat Muslim ketika mereka berinteraksi dengan hukum. Dengan dua peran tersebut, maqāṣid al-sharī‘at dapat menjadi pendorong perubahan masa depan menuju masyarakat yang lebih konstruktif dan humanistik. Penelitian pustaka ini meneliti maqāṣid al-sharī‘at dari masa Nabi Muhammad Saw. hingga hari ini. Hal ini bertujuan untuk menguraikan posisi maqāṣid al-sharī‘at sebagai acuan utama dan landasan etis-spiritual bagi dinamisasi proses hukum Islam dalam menghadapi persoalan kontemporer. Ini juga mengkaji konsep maqāṣid al-sharī‘at dan menganalisis fleksibilitas, kemampuan beradaptasi, dan dinamika hukum Islam. Selain itu, dimaksudkan untuk membuka pikiran mereka yang menyatakan bahwa hukum Islam begitu lestari, doktrinal, abadi, dan final sehingga dianggap tidak dapat beradaptasi dengan berbagai bentuk perubahan sosial dan modernisasi yang membawa banyak isu kekinian.

  • Access to Justice for Women and Children in Divorce Cases in the
           Indonesian Religious Courts

      Abstract: This research aims to investigate access to justice for children and women in the Religious Court Decisions after the issuance of Circular Letter of Supreme Court No. 4 of 2016, Point 5 on Religious Chamber. This particular point states that the Religious Court can require a father to provide child maintenance if the child is under the custody of the mother. This is a normative study, with the data obtained from interviews and 150 Religious court decisions. These decisions are issued by the Religious Courts of East Jakarta and Central Jakarta from 2015-2017. The examination of those Decisions reveals that most of the decisions on divorce do not mention any stipulation about child maintenance. This means that the Supreme Court Circular No. 4 of 2016 has not been able to protect children rights in the case of divorce, as well as women’s rights. From the court used in this study, only 14% that require the fathers to provide child maintenance after divorce. This percentage is almost similar to the decisions issued before the issuance of the Circular, which only 12% in 2016, and 14% in 2017.     AbstrakPenelitian ini bertujuan untuk mengetahui akses keadilan bagi anak dan perempuan dalam Putusan Pengadilan Agama pasca terbitnya Keputusan Mahkamah Agung Nomor 4 Tahun 2016 Poin 5 tentang Kamar Beragama. Dalam poin khusus ini disebutkan bahwa Pengadilan Agama dapat meminta seorang ayah untuk mengasuh anak jika anak tersebut berada di bawah asuhan ibunya. Penelitian ini bersifat normatif, dengan data diperoleh dari wawancara dan 150 putusan Pengadilan Agama. Putusan-putusan tersebut dikeluarkan oleh Pengadilan Agama Jakarta Timur dan Jakarta Pusat dari tahun 2015- 2017. Berdasarkan pemeriksaan terhadap Putusan tersebut, sebagian besar Putusan perceraian tidak menyebutkan ketentuan tentang pengasuhan anak. Artinya, Surat Edaran Mahkamah Agung Nomor 4 Tahun 2016 belum mampu melindungi hak anak dan hal perempuan dalam kasus perceraian. Data pengadilan yang digunakan dalam penelitian ini, menyebutkan hanya 14% yang mewajibkan ayah untuk mengasuh anak setelah perceraian. Persentase ini hampir sama dengan keputusan yang dikeluarkan sebelum keluarnya keputusan tersebut, yaitu hanya 12% pada 2016, dan 14% pada 2017.

  • أحكام موانع النفقة الزوجية في أقوال
           المذاهب الفقهية مقارَنة بِقانون الأحوال
           الشخصية الليبي

      Abstract: تهدف هذه الدراسة إلى توضيح أحكام موانع النفقة الزوجية في أقوال المذاهب الفقهية الأربعة المعتمدة عند أهل السنة ومذهب الجعفرية ومذهب الإباضية ومقارنتها بقانون الأحوال الشخصية الليبي رقم 10 لسنة 1984 ميلادي وتعديلاته، تحث اسم الأحكام الخاصة بالزواج والطلاق وأثارهما، وقد خصص اختيار هذا القانون لذهابِهِ في تعديله الأول إلى عدم الحديث عن أحكام موانع النفقة الزوجية واكتفي بالحكم في مسألة واحدة منها وهي حق النفقة للمطلقة البائن، بشرط أن لا تختل عقلياً، بل ذهب إلى أبعد من ذلك بإلغائه أحكام النشوز واعتبارها كأن لم تكن، وهي من موانع النفقة، وبقي هذا القانون على حالهِ إلى أن جاء في تعديلهِ الأخير رقم 14 أكتوبر 2015 ميلادي، بحذف مادة أحكام النشوز من الأساس واكتفى بالذكر أنه إذا لم يوجد نص تشريعي يمكن تطبيقه فيها فيحكم بمقتضى المذاهب الفقهية المعتبرة الأكثر ملاءمة لنصوص هذا القانون.    Abstrak: Studi ini bertujuan untuk menjelaskan hukum yang menghalangi hak istri atas nafkah dari suami berdasarkan empat mazhab fikih Ahlussunnah wal jama’ah, Ja'fari, dan Ibadhi, yang dibandingkan dengan Hukum Keluarga Islam Libya No. 10 tahun 1984 dan perubahannya, yaitu Peraturan Khusus tentang Perkawinan, Perceraian, dan Dampaknya. Peraturan ini dipilih karena amandemen pertama tidak menyebutkan ketentuan yang menghalangi hak istri untuk mendapatkan nafkah dari suami. Ketentuan yang disebutkan hanya tentang hak pasca cerai dalam hal perceraian ba'in dengan syarat istri memiliki kondisi mental yang sehat. Ketentuan mengenai nushuz dihilangkan meski konsekuensinya menghalangi hak atas nafkah. Dengan demikian, undang-undang tersebut tetap sama hingga amandemen terakhir diberlakukan pada 14 Oktober 2015. Dengan dicabutnya ketentuan nushuz, maka undang-undang tersebut mengikuti ketentuan empat mazhab fikih.
