      Abstract: Abstract Purpose of this study to find out how the criminal law is responsible for the corruption of grant funds in Indonesia. Accountability is absolute to legal subjects. It sticks when doing everything. It's the same with a grant. The laws and regulations in Indonesia divide grants into 2 concepts, namely grants in private and public law. A grant in private law means a free gift  both mean living giver and receiver. If a grant in public law means, the transfer of rights to something comes from a gift from another party or the government to a local government or vice versa which is specifically and through an agreement on the grant process. The purpose of the grant itself is for welfare. However, the reality that occurs in the context of grants is actually seen as an opportunity by individuals to commit criminal acts of corruption. In fact, corruption in grant funds has had an impact on various sides, one of which is the potential to harm regional finances. The method used in this study is the statue approach and conceptual approach. In this study, it will be known how when using grant funds for corruption will be asked for an accountability as regulated in the Corruption Crime Act. Keywords: accountability; corruption; grants Abstrak Tujuan penelitian ini adalah untuk menemukan bagaimana pertanggungjawaban dari sisi hukum pidana terhadap korupsi dana hibah yang ada di Indonesia. Pertanggungjawaban sangat mutlak terhadap subjek hukum. Hal tersebut melekat ketika melakuan segala sesuatunya. Sama halnya dengan suatu dana hibah. Peraturan perundang-undang di Indonesia membagi hibah dalam 2 konsep, yakni hibah dalam hukum privat dan publik. Hibah pada hukum privat berarti di berikannya secara cuma-cuma dari seseorang (pemberi hibah) kepada seseorang (penerima hibah), dan keduanya sama-sama masih hidup. Apabila hibah didalam hukum publik maka, beralihnya hak atas sesuatu berasal dari suatu pemberian dari pihak lain atau pemerintah kepada pemerintah, atau sebaliknya yang secara spesifik dan melalui suatu perjanjian terhadap proses hibah tersebut. Adapun suatu tujuan dari hibah sendiri, yakni demi kesejahteraan. Namun, realita yang terjadi konteks hibah justru dianggap sebagai suatu kesempatan oleh para oknum untuk melakukan tindak pidana korupsi. Bahkan, korupsi terhadap dana hibah ini sangat memberikan suatu dampak di berbagai sisi, salah satunya yakni adanya potensi merugikan keuangan daerah. Metode yang dilakukan pada penelitian kali ini yakni menggunakan metode pendekatan undang-undang dan konseptual. Dalam penelitian ini nantinya akan diketahui bagaimana ketika menggunakan dana hibah untuk korupsi akan diminta suatu pertanggungjawaban yang di atur di dalam Undang-Undang Tindak Pidana Korupsi.       Abstract: Abstract The existence of the return of the TAP MPR in the hierarchy of laws and regulations in Indonesia has sparked a polemic, where the Constitutional Court itself stated that it was not authorized to test the products of the TAP MPR so that this raises a norm vacuum, which means that the norm vacuum is in the absence of arrangements for testing the MPR TAP and the absence of an institution authorized to conduct testing when later an MPR TAP is contrary to the legal norms above it or to a higher degree, namely the NRI Constitution 1945. This study aims to provide an understanding by reconstructing the law regarding the review of the MPR TAP, which the Constitutional Court should have declared itself authorized to conduct a judicial review of the MPR TAP on the Constitution as the Constitutional Court's function is to guard and enforce the supremacy of the constitution. The method in this research is a normative juridical research method with a statutory approach, and a conceptual approach. From the results of the legal reconstruction regarding the review of the TAP MPR, it can be said that the TAP MPR can actually be tested for constitutionality through a judicial review by the Constitutional Court. Keywords: constitutional court; judicial review; legal reconstruction; TAP MPR Abstrak Keberadaan kembalinya TAP MPR dalam hierarki peraturan perundang-undangan di Indonesia menuai polemik, di mana Mahkamah Konstitusi sendiri menyatakan dirinya tidak berwenang untuk menguji produk TAP MPR sehingga hal ini memunculkan sebuah kekosongan norma, yang artinya kekosongan norma itu dalam hal tidak adanya pengaturan pengujian TAP MPR serta tidak terdapatnya suatu lembaga yang berwenang untuk melakukan pengujian ketika nantinya sebuah TAP MPR bertentangan dengan norma hukum yang berada diatasnya atau derajatnya lebih tinggi yaitu UUD NRI 1945. Penelitian ini bertujuan untuk memberikan pemahaman dengan melakukan rekonstruksi hukum mengenai pengujian TAP MPR yang seharusnya Mahkamah Konstitusi menyatakan diri berwenang melakukan judicial review atas TAP MPR terhadap Undang-Undang Dasar sebagaimana fungsinya Mahkamah Konstitusi sebagai pengawal dan penegak supremasi konstitusi. Metode dalam penelitian ini adalah metode penelitian yuridis normatif dengan pendekatan perundang-undangan, dan pendekatan konseptual. Dari hasil rekonstruksi hukum mengenai pengujian TAP MPR, dapat dikatakan bahwa TAP MPR sebenarnya dapat di uji konstitusionalitasnya melalui judicial review oleh Mahkamah Konstitusi.       Abstract: Abstract One of the functions of the House of Representatives is to form laws and regulations, which is called the legislative function. Regarding the legislative function of the House of Representatives, it is important to see how the performance of the legislation carried out by the House of Representatives during the Covid-19 Pandemic, where there are several problems which include the legislative function of the House of Representatives during a pandemic, namely related to the quantity of legislative products produced, the process the formation of legislation products, up to and also related to the compliance of the House of Representatives in following the procedures for the formation of laws and regulations. In writing this research article, the form of research used is normative juridical, namely by analyzing secondary legal sources such as legislation or books through literature study to see the function of legislation by the House of Representatives during a pandemic. namely by using a descriptive approach to explain the quantity of legislative products made by the House of Representatives and also related to the procedural manufacture of statutory products that have been regulated in Law Number 15 of 2019 concerning Legislation. Keywords: house of representative; legislation; pandemic Abstrak Salah satu fungsi Dewan Perwakilan Rakyat adalah membentuk peraturan perundang-undangan yang disebut dengan fungsi legislasi. Terkait fungsi legislasi Dewan Perwakilan Rakyat, penting untuk melihat bagaimana kinerja legislasi yang dilakukan oleh Dewan Perwakilan Rakyat di kala Pandemi Covid-19, dimana terdapat beberapa permasalahan yang meliputi fungsi legislasi Dewan Perwakilan Rakyat di kala pandemi, yaitu terkait kuantitas produk legislasi yang dihasilkan, proses pembentukan produk legislasi, hingga dan juga terkait kepatuhan Dewan Perwakilan Rakyat dalam mengikuti prosedur pembentukan peraturan perundang-undangan. Dalam penulisan artikel penelitian ini ini, bentuk penelitian yang digunakan adalah yuridis normatif yaitu dengan menganalisis sumber hukum sekunder seperti peraturan perundang-undangan atau buku melalui studi kepustakaan untuk melihat fungsi legislasi oleh Dewan Perwakilan Rakyat di masa pandemi.Selain itu dilihat dari sifat penelitian ini, yaitu dengan menggunakan pendekatan deskriptif untuk menjelaskan tentang kuantitas produk legislasi yang dibuat oleh Dewan Perwakilan Rakyat dan juga terkait prosedural pembuatan produk perundang-undangan yang telah diatur dalam Undang-Undang Nomor 15 Tahun 2019 tentang Peraturan Perundang-Undangan Kata kunci: dewan perwakilan rakyat; legislasi; pandemi

      Abstract: Abstrak Pengadilan agama adalah lingkup pengadilan yang ada di Indonesia yang khusus dalam menangani kasus, perkara dan hal-hal yang bersifat perdata agama. Pengadilan agama secara khusus merupakan layanan peradilan untuk warga negara Indonesia yang memiliki agama Islam seperti dalam kasus perceraian, perkawinan dini, waris, waqaf dan lain-lainnya yang diatur dalam Undang-undang Kompilasi Hukum Islam. Pada nomor perkara 609/Pdt.G/2019/PA.Kbm yang mana dalam duduk perkara yang diajukan oleh istri dalam hal 'cerai gugat' adalah seorang penggugat yang melakukan tindakan gugatan kepada seorang suami yang dalam konteks ini adalah seorang terlawsuit. Dalam gugatan pada perkara tersebut, penggugat secara gamblang memberikan hal-hal yang sekiranya kuat untuk dapat diputus oleh hakim agar terlaksananya suatu perceraian dengan pembobotan syarat yang dijatuhkan kepada pihakt tergugat. Pada perkara tersebut juga diberikan kesempatan untuk pihak tergugat dalam menyampaikan jawaban-jawaban atas lawsuitan yang diberikan oleh penggugat. Atas jawaban yang diberikan oleh pihak tergugat menjadi penentu bagaimana hasil dari pertimbangan dalam memutuskan perkara yang diajukan yang mana akan ditentukan oleh Majelis Hakim. Kata kunci: cerai gugat; penolakan; pengadilan agama; perceraian Abstract Religious courts are the scope of courts in Indonesia that specialize in handling cases, cases and matters of a religious civil nature. Religious courts are specifically a judicial service for Indonesian citizens who have a Muslim religion such as in cases of divorce, early marriage, inheritance, waqf and others which are regulated in the Compilation of Islamic Law.. In case number 609/Pdt.G/2019/PA.Kbm which in the case filed by the wife in the case of 'divorce lawsuit' is a plaintiff who takes action against a husband who in this context is a defendant. In the lawsuit in this case, the plaintiff clearly gave things that if strong enough to be decided by the judge in order to carry out a divorce with the weighting of the conditions imposed on the defendant. And in this case, the defendant is also given the opportunity to submit answers to the claim given by the plaintiff. The answer given by the defendant is what determines how the results of the considerations in deciding the proposed case will be determined by the Panel of Judges.       Abstract: Abstract The focus of this study is to analyze the services of medical personnel for Covid-19 patients in the framework of Emmanuel Levinas' responsibility ethics. The total service they have been providing is an ethical consequence of their encounter with the faces of Covid-19 patients as the Others. This could happen because the faces of Covid-19 patients show their nakedness as weak human beings. Moreover, this responsibility is also the impact of the awareness that the Others’ faces bear the imprint of the Infinite One. Here, Covid-19 patients have become means of the Infinite One giving commands to serve to medical personnel. This encounter in turn has succeeded in transcending medical personnel in their responsibility for Covid-19 patients. The methodology used in this study is a critical reading of news items in Kompas daily of April 26, 2020, and in Tempo magazine, edition of January 3, 2021, regarding the total service of medical personnel. These news items were then elaborated according to Emmanuel Levinas' philosophy of responsibility ethics. The findings of this study are that the responsibility of medical personnel for Covid-19 patients is an ethical consequence of their encounter with the patients’ faces. Hal ini terjadi karena pasien Covid-19 menampakan wajah ketelanjangan sebagai manusia yang lemah yang membutuhkan pelayanan. Oleh karena itu, perjumpaan ini melahirkan tanggung jawab pelayanan tenaga medis bahwa pasien Covid-19 sebagai Yang-Lain yang memuat jejak Tak-Terbatas. Dengan kata lain, kehadiran pasien Covid-19 memberi perintah kepada tenaga medis untuk memberi pelayanan. Perjumpaan ini pada gilirannya mentransendensikan tenaga medis untuk bertanggung jawab secara penuh dengan pasien Covid-19. Metode yang digunakan dalam penelitian ini berupa pembacaan kritis atas fenomena pelayanan tenaga medis yang dimuat dalam pemberitaan surat kabar harian Kompas edisi 26 April 2020 dan majalah Tempo edisi 3 Januari 2021. Penelitian ini dielaborasi dalam filsafat etika tanggung jawab Emmanuel Levinas.       Abstract: Abstract This writing is intended to convey basic understanding of the application of the prudential principle in credit agreement that applied negative ledge of assets clause by commercial banks. The method is normative legal research with comparative legal system as the approach between Indonesia, Singapore and the Netherlands. The problem arises when the credit provided is in the form of large provision of funds which can be deemed as the form of syndicated loan. The collateral is set only for one holder and when set for more than one holder, it changes the creditors structure. Meanwhile, the distribution of assets for each creditors is not efficient. Therefore, to overcome this matter, a possible way of conducting credit agreement by the commercial banks is to apply the negative pledge of assets clause, which is, a clause which states that the debtor will waive his/her rights to pledge the assets to any other party. The result of the comparison is that there is a legal vacuum in Indonesia, while in Singapore and the Netherlands has been regulated the application of such clause as a means in conducting the 5 C’S principle. In the event of bankruptcy, the structure of the bank as one of the creditors will become concurrent and the collateral is debtor’s assets. Keywords:, comparative law; credit agreement; negative pledge of assets Abstrak Tulisan ini bertujuan untuk mengetahui penerapan prinsip kehati-hatian terhadap perjanjian kredit oleh bank umum yang menggunakan klausul negative pledge of assets. Metode yang digunakan ialah yuridis normatif dengan pendekatan perbandingan hukum antara Indonesia, Singapura, dan Belanda. Permasalahan muncul ketika kredit yang diberikan berupa penyediaan dana besar sehingga berbentuk kredit sindikasi. Jaminan kebendaan hanya diberikan untuk satu orang pemegang jaminan dan ketika diberikan untuk lebih dari satu orang akan menimbulkan peringkat. Sementara pembagian aset untuk masing-masing piutang kreditur tidaklah efisien. Oleh karenanya, untuk mengatasi hal ini, terdapat opsi untuk menggunakan klausul Negative Pledge of Assets, yakni klausul yang menyatakan bahwa debitor tidak akan menjaminkan satu atau sebagian dari aset-asetnya kepada pihak lain. Hasil perbandingan ialah terdapat kekosongan hukum di Indonesia, sementara di Singapura dan Belanda telah diatur dan menjadi bagian dari prinsip 5C. Dalam hal terjadi kepailitan, kedudukan kreditor akan menjadi kreditor konkuren dan jaminan yang digunakan ialah jaminan meliputi aset-aset debitor.       Abstract: Abstract The Covid-19 pandemic has had a huge impact, one of which is on the national economy. Indonesian migrant workers are ready to help revitalize the national economy during the Covid-19 pandemic, moreover, there has been a gradual opening for the placement of Indonesian migrant workers. To place Indonesian migrant workers abroad, there is a placement fee charged to the government and employers. This study intends to describe the government's policy in financing the placement of Indonesian migrant workers and their consequences. The type of research used is normative legal research based on primary and secondary legal materials, solved by statutory approaches and conceptual approaches, then analyzed descriptively qualitatively. The results of this study indicate that there is a rechts vacuum in determining the financing of the placement of Indonesian migrant workers due to technical, substance and external factors which results in the practice of overcharging, fraud that leads to criminal acts of trafficking in persons, delays in placement services and delays in PMI departure. Pekerja migran Indonesia siap membantu membangkitkan perekonomian nasional di masa pandemi Covid-19, terlebih lagi telah dilakukan pembukaan secara bertahap untuk penempatan pekerja migran Indonesia. Untuk menempatkan pekerja migran Indonesia ke luar negeri, terdapat biaya penempatan yang dibebankan kepada pemerintah dan pemberi kerja. Penelitian ini bermaksud untuk mendeskrisipkan mengenai kebijakan pemerintah dalam pembiayaan penempatan pekerja migran Indonesia dan akibatnya. Jenis penelitian yang digunakan yaitu penelitian hukum normatif berdasar pada bahan hukum primer dan sekunder, dipecahkan dengan pendekatan perundang-undangan dan pendekatan konseptual, kemudian dianalisis secara deskriptif kualitatif. Hasil dari penelitian ini menunjukkan bahwa terdapat kekosongan hukum dalam penentuan pembiayaan penempatan pekerja migran Indonesia dikarenakan faktor teknis, substansi dan eksternal yang mengakibatkan praktek overcharging, adanya penipuan yang mengarah ke tindak pidana perdagangan orang, terhambatnya pelayanan penempatan dan tertundanya keberangkatan PMI.       Abstract: Abstract Take it or leave it, that is what happens in the development of contract law, especially for contracts where there is almost no bargaining position, especially for a debtor in a credit and guarantee contract or agreement in the banking world. The increasing rate of growth in consumption of goods and/or services is one indicator that shows the development of national and international trade activities. This condition is also supported by advances in science, telecommunications and information technology (internet) as well as modern modes of transportation that provide freedom of movement for transactions of goods and/or services to cross the boundaries of a country. The rapid exchange of data in the world of information and technology has had a significant impact on business behavior and contractors, such as fast food (fast food) existing business contracts have also been "standardized" or prepared in a "ripe" state and “directly served” to its consumers. Such circumstances provide very little room for bargaining over the benefits contained in the contract. This certainly affects their freedom in contracting, especially in the current state of the Covid-19 pandemic through research methods with the statue approach and conceptual approach, the author explores and analyzes problems in the community, especially in banking contracts to determine the principle of freedom of contract in standard agreements, especially in credit and guarantee agreements in the banking world. Keywords: freedom of contract; standard contract; debt and mortgage agreement Abstrak Take it or leave it, itulah yang terjadi dalam perkembangan hukum kontrak khususnya terhadap kontrak-kontrak yang hampir tidak ada posisi tawar-menawar khususnya bagi seorang debitor dalam kontrak atau perjanjian kredit dan jaminan di dunia perbankan. Laju pertumbuhan konsumsi barang dan/atau jasa yang semakin meningkat merupakan salah satu indikator yang menunjukkan adanya perkembangan aktifitas perdagangan nasional maupun internasional. Kondisi tersebut juga didukung dengan kemajuan di bidang ilmu pengetahuan, teknologi telekomunikasi dan informatika (internet) serta moda transportasi modern yang memberikan keleluasaan gerak transaksi barang dan/atau jasa hingga melintasi batas-batas wilayah suatu negara. Begitu cepatnya pertukaran data dalam dunia informasi dan teknologi tersebut memberikan dampak perubahan yang signifikan terhadap perilaku bisnis dan para kontraktan, ibarat fast food (makanan cepat saji) kontrak-kontrak bisnis yang ada juga telah “dibakukan” atau disiapkan dalam keadaan yang “sudah matang” dan “langsung disajikan” kepada para konsumennya. Keadaan yang demikian memberikan ruang yang sangat kecil untuk melakukan tawar menawar atas manfaat yang ada dalam kontrak. Hal ini tentu mempengaruhi kebebasan mereka dalam berkontrak apalagi dalam kondisi pandemi Covid-19 yang terjadi saat ini. Melalui metode penelitian dengan pendekatan perundang-undangan dan pendekatan konseptual, penulis menggali dan menganalisa masalah di masyarakat khususnya pada kontrak-kontrak perbankan untuk mengetahui asas kebebasan dalam berkontrak (freedom of contract) dalam perjanjian baku khususnya pada perjanjian kredit dan jaminan dalam dunia perbankan.       Abstract: Abstract The environment is a meeting place between every living thing, both humans and humans, humans and plants, humans and animals, humans and nature, and humans with inanimate objects though. Environmental health is the right of every human being and one of the elements of welfare that must be realized in accordance with the ideals of the Indonesian nation as referred to in Pancasila and in the 1945 Constitution of the Republic of Indonesia, meaning that there are principles that are non-discriminatory, participatory and sustainable. Environmental health management, in fact, cannot be separated from the government's very complex role, one of which is the role of the health government or the so-called Health Service. Hospitals in general are one of the supporters of development in the health sector, meaning that this hospital is a public facility, a gathering place for sick people and healthy people which does not rule out the possibility of causing environmental pollution, health problems and can be a place for disease transmission. This is because the hospital is a public administration organization that has a great responsibility for public services in the health sector which is organized and accounted for by the government. This research uses a normative juridical method. This legal research approach is through a statutory approach and a conceptual approach. Kesehatan lingkungan merupakan hak setiap manusia dan salah satu unsurkesejahteraan yang harus diwujudkan sesuai dengan cita-cita bangsa Indonesia sebagaimana dimaksud dalam Pancasila dan Undang-Undang DasarNegara Republik Indonesia Tahun 1945, artinya terdapat asas yang non-diskriminatif, partisipatif dan berkelanjutan. Pengelolaan kesehatan lingkungan sebenarnya tidak lepas dari peran pemerintah yang sangat kompleks, salah satunya adalah peran dari kesehatan pemerintah atau yang disebut dengan Dinas Kesehatam. Rumah sakit pada umumnya merupakan salah satu penunjang pembangunan di bidang kesehatan, artinya rumah sakit merupakan fasilitas umum, tenpat berkumpulnya orang sakit dan orang sehat yang tidak menutup kemungkinan dapat menimbulkan pencemaran lingkungan, gangguan kesehatan dan sebagai tempat penularan penyakit. Hal ini dikarenakan rumah sakit merupakan organisasi administrasi publik yang memiliki tanggung jawab besar terhadap pelayanan publik di bidang kesehatan yang diselenggarakan dan dipertanggungjawabkan oleh pemerintah.       Abstract: Abstract Article 26 paragraph (1) of the Law of the Republic of Indonesia Number 19 of 2016 on Amendments to Law Number 11 of 2008 on Information and Electronic Transactions (Law No.19/2016) has mentioned that any use of a person's personal data, must be done on the basis of the consent of the owner of personal data. In Financial Technology with paylater payment scheme that conducts borrowing activities by utilizing consumer personal data to transact in the form of Population Master Number as the main condition. The formulation of the issues studied is an aspect of the position of electronic system organizers as paylater providers in the protection of consumer personal data as well as arrangements on the guarantee of personal data protection according to the Law No.19/2016 and The Minister of Communication and Information Regulation No. 20 of 2016 on The Protection of Personal Data in Electronic Systems (Permenkominfo No.20/2016). Research methods use normative juridical through literature studies by studying and reviewing other legal materials sourced from primary and secondary legal materials. The results showed that there is no legal certainty regarding the position of Paylater providers in order to protect consumers' personal data, Article 19 paragraph (4) of Financial Services Authority Regulation No. 77/ POJK.01/2016 on Information Technology-Based Lending Services (POJK No. 77/POJK.01/2016) mentioned that consumer personal data is not included as access to information provided to lenders. In addition, the regulations governing personal data only contain the general understanding of personal data and have not accommodated concrete forms of protected personal data objects so that the Population Master Number and Sensitive Data have no legal basis as objects of consumer personal data. Therefore, more comprehensive legislation is needed that can regulate the position of paylater providers in protecting consumer personal data and concretely regulating the forms of consumer personal data objects as a form of legal certainty over privacy rights. Keywords: consumer protection; data privacy; paylater Abstrak Pasal 26 ayat (1) Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU No. 19/2016) telah disebutkan bahwa setiap penggunaan data pribadi seseorang, harus dilakukan atas dasar persetujuan dari pemilik data pribadi. Pada Financial Technology dengan skema pembayaran paylater yang melakukan kegiatan pinjam-meminjam dengan memanfaatkan data pribadi konsumen untuk bertransaksi dalam bentuk Nomor Induk Kependudukan sebagai syarat utama. Rumusan masalah yang dikaji adalah aspek kedudukan penyelenggara sistem elektronik sebagai penyedia paylater dalam perlindungan data pribadi konsumen serta pengaturan tentang jaminan perlindungan data pribadi menurut UU No. 19/2016 dan Peraturan Menteri Kominfo Nomor 20 Tahun 2016 tentang Perlindungan Data Pribadi Dalam Sistem Elektronik (Permenkominfo No. 20/2016). Metode penelitian menggunakan yuridis normatif melalui studi kepustakaan dengan menelaah dan mengkaji materi bahan hukum lainnya yang bersumber dari bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa belum adanya kepastian hukum terkait kedudukan penyedia paylater dalam rangka melindungi data pribadi konsumen, Pasal 19 ayat (4) Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi (POJK No. 77/POJK.01/2016) disebutkan bahwa data pribadi konsumen tidak termasuk sebagai akses informasi yang diberikan kepada pemberi pinjaman. Selain itu, peraturan yang mengatur tentang data pribadi hanya memuat pengertian data pribadi secara umum dan belum mengakomodasikan bentuk-bentuk konkrit dari objek data pribadi yang dilindungi sehingga Nomor Induk Kependudukan serta Data Sensitif tidak memiliki dasar hukum sebagai objek data pribadi konsumen. Oleh karena itu, diperlukan Undang-undang yang lebih komprehensif yang dapat mengatur kedudukan pihak penyediapaylater dalam melindungi data pribadi konsumen serta mengatur dengan konkrit bentuk-bentuk dari objek data pribadi konsumen sebagai wujud dari kepastian hukum atas hak privasi.       Abstract: Abstract Mediation is a method of resolving disputes through a negotiation process to obtain an agreement between the Parties with the assistance of a Mediator. Normally the mediation process is carried out directly face to face. Still, the COVID-19 pandemic that has spread in Indonesia since March 2020 has significantly impacted the order of people's lives, including the justice sector. One of the keys to minimizing the spread of COVID-19 is to reduce the intensity of face-to-face meetings, including implementing the mediation process, which has begun to be directed to be carried out remotely or electronically. This study seeks to provide answers related to the extent of the role of electronic mediation as an alternative to civil dispute resolution in the District Court (PN). In addition, this study also discusses the factors that hinder the implementation of electronic mediation. The research that uses the PN Padang and PN Marabahan as the object of this research is qualitative research with empirical juridical nature. It analyzes the collected data using a qualitative descriptive method. The study results show that in both the PN Padang and PN Marabahan, the application of electronic mediation has not been appropriately implemented and standardized. This can be seen in the non-uniform application of electronic mediation among the district courts that are the research object. At the PN Marabahan, the application of electronic mediation was only carried out several times, but this was not done because it prevented the spread of COVID-19 but had to be done when the province of South Kalimantan experienced a flood. Hence, the parties couldn't attend court. In the PN Padang, electronic mediation has been carried out by one of the judges several times. However, the implementation is still sporadic, where other judges have not utilized the electronic mediation. The factor that hinders the implementation of electronic mediation is that there is no technical rule from the Supreme Court that regulates the implementation of electronic mediation. Keywords: alternative civil dispute resolution; electronic mediation; COVID-19 pandemic  Abstrak Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan Para Pihak dengan dibantu oleh Mediator. Normalnya proses Mediasi dilaksanakan secara langsung dengan bertatap muka, akan tetapi Pandemi COVID – 19 yang merebak di Indonesia sejak bulan Maret 2020 berdampak besar pada tatanan kehidupan masyarakat tidak terkecuali pada sektor peradilan. Salah satu kunci untuk meminimalisasi penyebaran COVID – 19 adalah dengan mengurangi intensitas pertemuan tatap muka secara langsung, termasuk pada pelaksanaan proses Mediasi yang mulai diarahkan untuk dilaksanakan secara jarak jauh atau elektronik. Penelitian ini berupaya memberikan jawaban terkait sejauh mana peranan Mediasi elektronik sebagai alternatif penyelesaian sengketa perdata di Pengadilan Negeri (PN). Selain itu, penelitian ini juga membahas mengenai faktor yang menghambat terimplementasinya Mediasi elektronik. Penelitian yang menjadikan PN Padang dan PN Marabahan sebagai objek penelitian ini merupakan penelitian kualitatif yang bersifat yuridis empiris dan menganalisa data yang terkumpul dengan metode deskriptif kualitatif. Hasil penelitian menunjukan bahwasanya baik di PN Padang maupun PN Marabahan penerapan Mediasi elektronik belum terlaksana dengan baik dan terstandar. Hal ini terlihat pada masih belum seragamnya penerapan Mediasi secara elektronik di antara pengadilan negeri yang menjadi objek penelitian. Pada PN Marabahan penerapan Mediasi elektronik baru dilaksanakan beberapa kali namun hal tersebut dilakukan bukan karena mencegah penyebaran COVID – 19 tetapi terpaksa dilakukan saat provinsi Kalimantan Selatan mengalami musibah banjir sehingga para pihak tidak mungkin hadir ke pengadilan. Pada PN Padang Mediasi elektronik sudah beberapa kali dilaksanakan oleh salah seorang Hakim, namun pelaksanaannya masih bersifat sporadis dimana Hakim – Hakim lain belum memanfaatkan Mediasi elektronik tersebut. Faktor yang menghambat terlaksananya Mediasi secara elektronik adalah dikarenakan belum adanya aturan teknis dari Mahkamah Agung yang mengatur pelaksanaan Mediasi secara elektronik Kondisi ini ditambah juga dengan adanya ketidakpahaman dari masyarakat pengguna peradilan terkait dimungkinkannya pelaksaanaan Mediasi secara elektronik.
