  • THE CASE OF THE TRANSPOSITION OF EU DIRECTIVES

    • Abstract: Resumo: Na transposição de directivas europeias, os Estados-Membros dispõem de liberdade quanto à escolha do instrumento que melhor se ajusta à prossecução dos objectivos traçados. Não obstante a transposição ter que ocorrer através de um acto legislativo, a forma como a política pública em questão é realizada internamente pode beneficiar do recurso a “nudges”, a par de outros instrumentos mais tradicionais. A eficácia revelada pelos “nudges” tem, contudo, como contraponto, algumas questões éticas e políticas que suscitam, nomeadamente acerca da transparência na relação entre cidadãos e representantes. Além disso, pode questionar-se a sua conformidade com o princípio da proporcionalidade, especialmente quando os “nudges” implicam comportamentos contrários ao livre exercício de liberdades e direitos fundamentais. Os “nudges” podem ser prima facie menos restritivos, na comparação com estratégias normativas mais tradicionais, mas também podem implicar uma forma de instrumentalização que instancie a aplicação do princípio da dignidade humana.Abstract: Member States transposing Directives can choose the methods for such transposition but should elect such practices which are best suited to ensure the attainment of the Directive’s goals. Notwithstanding the fact that a legislative act is needed in order to transpose EU law into national law, the goals addressed by the directive can often be attained through the use of “nudges”. The efficacy they reveal comes, some will argue, with the downside of some ethical and political concerns, namely concerning transparency in the relationship between citizens and representatives. Also, nudges can be seen as contrary to the principle of proportionality, especially if they induce individuals to act in a way that is contrary to fundamental rights and freedoms. Nudges can be prima facie less restrictive comparing to more traditional strategies, but they can also implicate a form of instrumentalization, which may trigger the application of the principle of human dignity.
       
  • The Problem With Nudges: Paternalism, Autonomy, and Transparency

    • Abstract: Resumo: O nudging como um instrumento de políticas públicas tem sido frequentemente criticado com base em dois pressupostos: 1) é mais perigoso para a dignidade humana e autonomia do que a tradicional regulação de “comando e controlo”; 2) é ainda mais problemático quando assenta em razões paternalistas, quando comparado com as suas aplicações não paternalistas. Este artigo procura desafiar ambos os pressupostos, mostrando que o principal problema do nudging é o da transparência, sendo que a mesma pode ser garantida sem prejudicar eficácia do nudging; além disso, o nudging paternalista corresponde a um paternalismo de meios e não a um paternalismo de fins, o que significa que não é uma forma de perfeccionismo que se sobrepõe aos fins individuais de cada pessoa.Abstract: Nudging as a tool of public policies has often been criticized on account of two assumptions: 1) it is more dangerous than traditional command & control regulation for human dignity and autonomy; 2) when it is justified on paternalistic grounds, it is even more problematic than in its non-paternalistic applications. This paper seeks to challenge both assumptions, by showing that the main problem with nudging is one of transparency, but this can be obtained without impairing its effectiveness; moreover, paternalistic nudging is means paternalism, not ends paternalism, which means that it is not a form of perfectionism superimposed on the people’s individual ends.
       
  • How to identify “gold-plating”: challenges and solutions

    • Abstract: Resumo: A intervenção pública tem de encontrar um equilíbrio entre os objetivos inerentes à política pública e os impactos secundários que exerce sobre cidadãos e empresas ao condicionar a sua atividade e capacidade de decisão, bem como quando gera encargos. No quadro do processo legislativo europeu, esta dicotomia é ainda reforçada pela complexidade da cadeia regulatória, que inclui as instituições europeias e os Estados-Membros, pela aplicação do princípio da subsidiariedade e pelos objetivos de promoção da competitividade da economia europeia e de sustentação do mercado único. É neste quadro que nos propomos discutir o tema do gold-plating, as razões da sua existência e as dificuldades práticas de identificação. Propomos, ainda, que se atribua particular atenção à possibilidade de olhar para este tipo de dinâmica na perspetiva da promoção da transparência do processo legislativo europeu.Abstract: Public intervention must find the balance between public policy objectives and the secondary impacts on citizens and businesses by conditioning their activity and decision-making capacity, as well as by creating burdens. Within the European legislative process, this dichotomy is further reinforced by the complexity of the regulatory chain, which includes the European Institutions and the Member States, by the application of the subsidiarity principle and by promotion the European economy competitiveness and the sustainability the Single Market. It is in this framework that we propose to discuss the topic of gold-plating, the reasons for its existence and the practical difficulties of its identification. We also look at this type of dynamic from the perspective of promoting transparency in the European legislative process.
       
  • 'Gold-Plating' in the transposition of EU Law

    • Abstract: Resumo: Este artigo tem o propósito de discutir alguns dos principais aspectos relativos ao ‘gold-plating’, focando em conceitos, casos e possíveis soluções. O objetivo da investigação é analisar alguns elementos teóricos a respeito do conceito principal de ‘gold-plating’, incluindo a visão histórica e estudos de casos, e também discutir medidas adotadas pelos Estados-membros para lidar com o assunto, ou seja, procedimento de transparência e revogação de transposição excessiva, bem como melhores práticas para ajudar a minimizar os aspectos negativos das práticas de ‘gold-plating’.Abstrac: This paper has the purpose of discussing some of the main aspects concerning gold-plating, focusing on concepts, cases and possible solutions. The investigation aims to analyse some theoretical elements regarding the main concept of gold-plating, including the historical view and case studies, and also discussing measures adopted by Member-States to deal with the matter, namely transparency procedure and repeal of over transposition, as well as best practices to help minimizing the negative aspects of gold plating’s practices.
       
  • Collisions of social rights: the role of proportionality & other
           standards

    • Abstract: Resumo: A doutrina e parte da jurisprudência universais têm assumido paulatinamente que a estrutura dos direitos sociais não difere significativamente da estrutura dos direitos de defesa. Isto leva a inferir que os direitos sociais - ou, mais propriamente, as diferentes situações jurídicas subjetivas em que se desdobram - entrem em vários tipos de colisão com outros bens, interesses ou valores. Identificados esses tipos de colisão, pode então definir-se quais os instrumentos adequados para cumprir as exigências de um processo substantivo devido na composição de cada um deles. Sustenta-se que os instrumentos mais adequados são, variando em função de cada colisão, a proibição do excesso, a proibição do defeito e a garantia do conteúdo mínimo do direito. As jurisdições constitucionais mostram considerável uniformidade na reação às interferências em dimensões negativas, ou ao retrocesso na efetivação, de direitos sociais, bem como na situação de eventual incumprimento da dimensão positiva desses direitos.Abstract: Global scholarship and court decisions have been gradually assuming that social rights structure does not differ radically from political and civil rights structure. This assumption leads us into the conclusion that social rights - meaning all different claims in which they unfold - might enter in several kinds of collision with other principles, rights, interests or values. After identifying all those possible kinds of collisions one can define what are the tools or standards suitable for the due substantive process to be performed for overcoming each of them. We argue that the most suitable tools are classical proportionality (“proibição do excesso”), prohibition of the insufficient promotion of the social right (“proibição do defeito”) and the guarantee of the minimum core of the social right. Constitutional courts show considerable uniformity as far as the reactions against limitations to the negative dimensions of the social rights are concerned and also when it comes to the review of any eventual breach of the duties of promotion of the positive dimensions of the social rights.
