  • Legal Policy Dynamics of the Foreign Workers in Indonesia: Should it be
           justified'

      Abstract: The enactment of Presidential Regulation Number 20 of 2018 concerning the Use of Foreign Workers and Job Creation Law has triggered pros and cons. On the one hand, these arrangements define as advanced approach to increase investment in Indonesia and assist transfer knowledge that can be obtained from equipped foreign workers with their skills and technologies. There are substantial arrangements to ease foreign workers access under growth investment idea, facilitating business licensing through deregulation, and scrutinize legal provisions for foreign workers to be able to work in Indonesia. This article was aimed to analyze, and finding analysis of policy dynamics regulating the use of Foreign Workers in Indonesia, as well as the gaps of the use of Foreign Workers arrangement in the Job Creation Law. This article was normative legal research using statutory approach, and conceptual approach. The study indicated that the dynamics of regulation in various legal policies on the use of Foreign Workers especially between Law on Employment and Law on Job Creation, even though there are fields and types of work that are also required to prioritize Indonesian Workers, along with the use of Foreign Workers to a certain time limit to adopt Foreign Workers skills. The prospective policy direction through this article is expected to be more selective policy in the context of utilization of foreign workers, state protection, and adequate improvement quality/standard of competence for Indonesian workers.

  • Law Enforcement of Pirated Film User Sites Due to the Implementation of
           Physical Distancing in Denpasar

      Abstract: The purpose of this study was to determine the effectiveness of the application of the Copyright Act to the number of pirated movie sites viewers as the impact of physical distancing in Denpasar City. This research was empirical legal research that examines the expectations and using a descriptive qualitative manner. This research population was Denpasar City residents, with a random sample of 172 respondents filled in an online questionnaire. The results indicated that decreased the percentage of pirated film provider sites before and during COVID-19 by 21,7%. That was influenced by the proportion of the time and costs spent watching movies on legal sites and also the blocking of pirated film sites by the government. After looking at the data and reviewing it with the theory of legal effectiveness and legal protection, it concludes that as long as physical distancing implemented, the Copyright Law enforcement has not been going well and must be corrected in one way. It was namely replacing the complaint offence contained in it with an ordinary offence.

  • The The Legality of Russia’s Special Military Operation Against Ukraine
           from International Law Perspective

      Abstract: Russia has launched a Special Military Operation against Ukraine, which resulted in a crisis therein. According to Vladimir Putin, current Russia’s President, the action aimed to exercise the state’s inherent right of individual and collective self-defense for the Donetsk People’s Republic (‘DPR’) and Luhansk People's Republic (‘LPR’). This article was aimed to analyze the legality of Russia’s use of force. This article applied normative legal research and using statutory, case, conceptual, and fact approaches in analyzing the case. The study indicated that Russia’s Special Military Operation constitutes illegal use of force. Based on the criteria set in international law, Russia’s justification for individual self-defense is invalid since no armed attack exists, unnecessary and unproportionate. As well as its collective selfdefense plea, which does not apply in these circumstances as DPR and LPR statehood is not clear, let alone its United Nations membership status. Suppose that it does apply, the use of force is still unlawful since other non-forcible means are available to achieve the end sought.

      Abstract: Penelitian ini bertujuan untuk menganalisis keberadaan UndangUndang Nomor 11 Tahun 2020 tentang Cipta Kerja dan peraturan pelaksanaannya dalam menumbuhsuburkan pasar buruh fleksibel di Indonesia serta menganalisis makna dibalik pengaturan perjanjian kerja waktu tertentu dan outsourcing di dalamnya. Penelitian normatif yang bersifat deskriptif analitis ini mengandalkan data sekunder berupa bahan hukum sebagai sumber data. Penelitian dilakukan dengan cara studi dokumen, didukung wawancara dengan narasumber, dan hasilnya dianalisis secara kualitatif. Hasil penelitian menunjukkan Undang-Undang Cipta Kerja dan peraturan pelaksanaannya berdampak pada tumbuhsuburnya pasar buruh fleksibel di Indonesia melalui pengaturan perjanjian kerja waktu tertentu dan outsourcing yang semakin fleksibel, karena bergerak dari model hubungan industrial yang bersifat korporatis menjadi lebih berbasis pada pasar. Pengaturan perjanjian kerja waktu tertentu dan outsourcing tersebut dimaknai sebagai gambaran lemahnya posisi buruh di hadapan pemodal dan kuatnya pemodal dihadapan negara. Ada pertimbangan ekonomis dibalik pengaturannya, yaitu untuk menciptakan iklim permisif bagi ekosistem investasi sebagai bagian dari kerangka besar liberalisasi ekonomi.

      Abstract: Eksploitasi seksual anak merupakan masalah yang sangat serius dan bukan masalah yang baru muncul akhir-akhir ini. Pemerintah Indonesia telah lama berupaya untuk meminimalisir peningkatan jenis kejahatan yang menyerang masa depan anak seperti dengan mengeluarkan beberapa kebijakan. Akan tetapi, semakin hari kejahatan ini memakan korban semakin banyak. Hal ini dikarenakan pelaku kejahatan melakukan aksinya dengan sebuah perencanaan dan berdasarkan pilihan rasional mereka. Sehingga penelitian ini hendak mengkaji secara serius bagaimana kondisi obyektif eksploitasi seksual anak era digital serta kelemahan pencegahannya dari perspektif rational choice theory. Dengan tujuan untuk mencari cara dalam pencegahan eksploitasi seksual anak lebih baik lagi. Penelitian ini merupakan penelitian hukum normatif yang melibatkan juga penelitian socio-legal yakni selain mengkaji norma-norma yang berada di dalam perundang-undangan, juga mengkaji ilmu sosial lainnya yang dalam hal ini ilmu kriminologi yang diperoleh dari buku, wawancara, dan karya ilmiah lainnya. Sehingga penelitian ini menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier serta dianalisis secara kualitatif dan disajikan secara deskriptif analitis. Hasil dari penelitian ini diperoleh gambaran secara rinci dan sistematis mengenai kondisi eksploitasi seksual anak dan kelemahan pencegahannya dilihat dari perspektif rational choice theory pada era digital di Indonesia.

  • Kebijakan Formulasi Pemidanaan Terhadap Penyebar Selebaran Mengandung
           Unsur Provokatif Dalam RKUHP

      Abstract: Penelitian ini bertujuan untuk mengkaji pemidanaan terhadap perbuatan penyebar selebaran yang mengandung unsur provokatif dalam Hukum Positif dan sanksi terhadap perbuatan penyebar selebaran yang mengandung unsur provokatif dalam perspektif ius constituendum agar memiliki kepastian hukum. Metode yang digunakan dalam penelitian ini mempergunakan jenis penelitian hukum yuridis normatif, karena adanya kekaburan norma. Analisis isu hukum dalam penelitian ini, menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Memprovokasi adalah perbuatan berupa pernyatakan perasaan permusuhan, kebencian atau penghinaan di depan umum terhadap suatu atau beberapa golongan, dapat dikatakan sebagai ujaran kebencian jika perasaan permusuhan, kebencian atau penghinaan tersebut dilakukan dalam bentuk tindakan dan usaha baik secara langsung maupun tidak langsung. Pengaturan hukum terhadap perbuatan menyebar selebaran yang mengandung unsur provokatif yang paling mendekati terdapat dalam RKUHP tahun 2019, Pasal 241, 243 ayat (1), Pasal 246 dan Pasal 247. Apabila dalam unsur provokatif tersebut mengandung makna menghasut untuk melakukan tindak pidana, maka diatur dalam Pasal 246 dan 247. Terdapat perbedaan sanksi pidana yang diatur dalam KUHP dan RKUHP 2019. Sanksi pidana mengenai unsur yang mengandung provokatif untuk melakukan perbuatan pidana diatur dalam Pasal 161 KUHP diancam dengan pidana penjara paling lama empat tahun atau pidana denda paling banyak empat ribu lima ratus rupiah. Sedangkan dalam RKUHP 2019 Pasal 247, sanksi pidana terhadap setiap orang yang melakukan perbuatan menyebar selebaran yang mengandung unsur provokatif untuk melakukan tindak pidana diancam dengan pidana penjara paling lama 4 (empat) tahun 6 (enam) bulan atau pidana denda paling banyak kategori V

      Abstract: Maraknya perilaku konsumsi masyarakat Indonesia dalam mengkonsumsi jamu tradisional belum sepenuhnya dilindungi dengan aspek perlindungan hukum konsumen yang kuat. Pasal 4 Undang-Undang Perlindungan Konsumen (UUPK) menentukan konsumen memiliki hak atas kenyamanan, keamanan, dan keselamatan dalam mengkonsumsi barang dan/atau jasa. Salah satu kasus yang merugikan konsumen, yaitu kasus konsumsi jamu kuat “Gali-Gali” yang mengandung Bahan Kimia Obat (BKO) jenis Sildenafil Sitrat. Padahal, Pasal 35 huruf b Peraturan Menteri Kesehatan Republik Indonesia Nomor 61 Tahun 2016 tentang Pelayanan Kesehatan Tradisional Empiris menentukan bahwa obat tradisional dilarang mengandung BKO. Sildenafil Sitrat juga memerlukan resep dokter karena jenis obat keras yang berbahaya jika dikonsumsi oleh penderita gangguan jantung, stroke, dan penderita tekanan darah dibawah 90/50 mmHg. Adapun tujuan dari penulisan ini adalah untuk mengetahui implementasi prinsip kehati-hatian dalam hukum perlindungan konsumen yang disebut caveat emptor dan caveat venditor dalam praktik peredaran jamu tradisonal (Jamu “Gali-Gali”). Dalam menjawab problematika ini, dilakukan penelitian hukum normatifempiris (terapan) yang menggabungkan antara pendekatan empiris dan normatif. Pada akhirnya, diketahui bahwa kedua prinsip ini harus berjalan seimbang dalam rangka mewujudkan asas keseimbangan dalam hukum perlindungan konsumen dan dalam rangka meningkatkan kesadaran, kemampuan, serta kemandirian konsumen untuk melindungi diri dari ekses negatif pemakaian produk jamu mengandung BKO.
