      Abstract: Lembaga Amil Zakat Yatim Mandiri merupakan salah satu lembaga yang bertujuan mengumpulkan dan pendistribusian zakat, infak dan sedekah bagi kaum dhuafa dan anak-anak yatim yang berada di Provinsi Lampung khususnya Kota Bandar Lampung, dalam berbagai program salah satunya program beasiswa. Adapun permasalahan dalam artikel ini adalah bagaimana pengelolaan dan pendistribusian zakat, infak dan sedekah di Lembaga amil zakat nasional Yatim Mandiri Lampung serta relevansinya dalam meningkatkan kesejahteraan anak yatim dan kaum dhuafa kota Bandar Lampung' Tujuan penelitian ini adalah menganalisis pengelolaan dan pendistribusian zakat, infak dan sedekah di Lembaga amil zakat nasional Yatim Mandiri Lampung serta relevansinya dalam meningkatkan kesejahteraan anak yatim dan kaum dhuafa kota Bandar Lampung. Metode penelitian dalam artikel ini dilihat dari jenisnya penelitian lapangan yang dilakukan pada Lembaga Amil Zakat Nasional Yatim Mandiri Lampung. Data primer dikumpulkan melalui observasi, wawancara dan dokumentasi. Populasi dari seluruh karyawan Lembaga Amil Zakat Yatim Mandiri Lampung dan penerima dana ZIS. Analisis data menggunakan analisis kualitatif dengan pendekatan berfikir menggunakan metode deduktif.Hasil penelitian ini, Pengelolaan dana ZIS di Lembaga Amil Zakat Nasional (LAZNAS) Yatim Mandiri Lampung yaitu belum maksimalnya penghimpunan dana zakat infaq dan sedekah dari calon muzakki. Data total penghimpunan dan pendistribusian dana ZIS di 3 tahun terakhir mulai tahun 2018 sampai dengan 2020 tidak menentu (fluktuatif) disetiap bulannya, ini dipengaruhi oleh rendahnya tingkat kepercayaan calon muzakki kepada lembaga amil zakat dan kurangnya sosialisi dan edukasi tentang zakat, infaq, sedekah kepada masyarakat khususnya di kota Bandar Lampung. Hal tersebut berpengaruh pada program-program dan operasional lembaga, dan kuota penerimaan manfaat untuk yatim dan dhuafa. Semakin banyak muzakki yang berzakat melalui Yatim Mandiri Lampung semakin banyak pula kuota calon penerima manfaat (yatim dan dhuafa), yang bertujuan untuk meningkatkan kejahteraan masyarakat khususnya anak-anak Yatim Mandiri dan dhuafa Bandar Lampung. Kata Kunci : Penditribusian Pengelolaan zakat, Infak dan sedekah, Yatim Madiri

           ULAMA TAHUN 2019 TENTANG HUKUM BISNIS MULTI LEVEL MARKETING

      Abstract: Kegiatan ekonomi dalam pandangan Islam merupakan tuntutan kehidupan. Untuk memenuhi kebutuhan hidup yang beragam, manusia tidak mungkin sendirian, ia harus bekerjasama dengan orang lain, antara individu dengan individu lain atau antara produsen dengan konsumen. Salah satu bentuk kerjasama yang dikembangkan dewasa ini adalah sistem penjualan langsung berjenjang atau sering disebut Multi Level Marketing (MLM). Meskipun bisnis MLM berkembang cukup baik di Indonesia, namun tidak sedikit juga kejadian yang menunjukkan bahwa masyarakat dirugikan bahkan ditipu dengan bisnis MLM ini. Berbagai penafsiran hukum pun muncul dari beberapa ulama, ada yang menyatakan halal, ada juga yang menyatakan haram. Pada tahun 2019 organisasi masyarakat Nahdlatul Ulama (NU) dalam Musyawarah Nasional Lembaga Bahtsul Masail NU membahas juga mengenai hukum bisnis MLM. Penelitian ini adalah penelitian kualitatif dan termasuk jenis penelitian pustaka (library research). Metode pendekatan penelitian yang digunakan yaitu metode pendekatan yuridis, historis, dan uṣūl fiqh. Sifat dari penelitian ini adalah deskriptif-analisis, yang menggambarkan suatu keadaan atau suatu subjek, dan kemudian menganalisisnya. Hasil yang diperoleh dari penelitian ini adalah: (1) Hukum bisnis MLM dalam tinjauan Islam berdasarkan Musyawarah Nasional Lembaga Bahtsul Masail NU tahun 2019 adalah haram. Keharaman tersebut dimaksudkan untuk jenis MLM dengan skema matahari, piramida atau ponzi yang mengandung praktik money game (permainan uang) atau penipuan. (2) Hukum bisnis MLM dianalisis menggunakan teori sadd aż-żarīʻah jika dilihat dari tingkat kerusakan (kemafsadatan) yang ditimbulkan, MLM adalah bisnis yang pada dasarnya boleh dilakukan karena mengandung kemaslahatan, tetapi memungkinkan terjadinya kemafsadatan. Ada 3 (tiga) poin yang memenuhi dilarangnya bisnis Multi Level Marketing (MLM). Poin-poin tersebut, yaitu: (a) Rentan terjadi penipuan. (b) Memperdaya ummat agar tergoda dengan iming-iming, (c) Dampak-dampak lain yang ditimbulkan akibat bisnis MLM.Kata kunci: Multi Level Marketing, Sadd aż-Żarīʻah, Munas Bahtsul Masail NU.

      Abstract: Zakat Perusahaan, Hak Kepemilikan, Badan Usaha Milik Negara (BUMN)Abstract: In the zakah regulations in Indonesia, it is explained that zakah is an asset that must be issued by a Muslim or a business entity to be given to those who have the right to receive it in accordance with Islamic law. And the generality of the word “business entity” includes State-Owned Enterprises (BUMN), Regional-Owned Enterprises (BUMD), and Swata-Owned Enterprises (BUMS). In accordance with Islamic law, zakah assets is required for assets with the status of milk al-tâm (perfect ownership), which are owned by muzakkî in the form of individuals or business entities. The problem in this study is the ownership rights of State-Owned Enterprises (BUMN) and its relation to the obligation of zakah, which is known that the assets/shares owned by BUMN are assets owned by the state. This research is library research, using primary, secondary and tertiary legal data. In addition, this research is descriptive qualitative by using a juridical, philosophical, historical approach. After the data has been collected, the next step is to analyze the existing data using data reduction techniques, data presentation and drawing conclusions. Based on the available data, it is concluded that the right of ownership of State Owned Enterprises (BUMN) is perfect ownership (milk al-tâm) which is one of the obligatory objects of zakah.Keywords: Company Zakah, Ownership Rights, State Owned Enterprises (BUMN)

  • ANALISIS PENCABUTAN IZIN USAHA DAN LIKUIDASI BANK DI INDONESIA

      Abstract: Indonesia's economy in the banking sector is experiencing ups and downs. There are times when it grows rapidly, and under certain conditions there are a number of banks experiencing problems and eventually being revoked their licenses. Revocation of business license is done as a last step in the efforts to heal the bank if the bank's difficulties interfere with its business continuity or endanger the banking system. It is a mandate from Law No. 7 of 1992 on Banking as amended by Law No. 10 of 1998. This paper wants to reveal the understanding, legal basis, liquidation factors to analasis revocation of business license and liquidation of banks in Indonesia. The method used in this study is the normative juridical approach method, in which the research conducted is by examining library research materials, which relate to the title being studied. This study concluded, first, OJK can revoke bpr business license because the condition of a bank endangers the banking system. Like the level of difficulty experienced in conducting business activities, the bank is unable to fulfill its obligations to other banks. Second, the bank has difficulties that jeopardize the continuity of its business and actions to overcome them are not enough to overcome the difficulties faced by the bank.

      Abstract: The Covid-19 pandemic has made funding and lending problems even bigger. There is no lending, the withdrawal is also bigger. Thus, BMT's need for funding will be greater, because the need for funds to be withdrawn is also greater. Of course, the liquidity problem of financial institutions including BMT becomes a more serious challenge in the case of Covid-19. In fact, there are several BMTs that can provide financing. Hopefully, this will come. The revolving fund management agency in collaboration with small, medium and micro-medium enterprises (LPDB-KUMKM) has a financing role and comes from banks. The government's role is needed to provide BMT funds, so this BMT will not stop lending. As the growth of Islamic cooperative countries slows down, the global Islamic finance industry is under threat. According to data from SEISRIC, the total number of cases in the Organization of Islamic Cooperation (OIC) countries has reached 180,000.This study used qualitative research methods. This is due to the flexibility in getting information from the latest news stories from trusted sources, regarding how the impact/impact caused by Covid-19 (corona virus), the author also took several news samples from the internet and then combined them into a result. The results are sourced from several news and sources obtained by the author. The author uses an observation technique in the form of observing data related to this Covid-19 (Corona) virus. The results obtained indicate that with the Covid-19 virus pandemic, BMT Amanah Indonesia's financial statements have had an impact on financing achievement, revenue achievement, and operating profit achievement.Keywords: Islamic Financial Institutions

      Abstract: Wanprestasi umumnya sering terjadi karena salah satu pihak yang terikat dalam kontrak/perjanjian tidak melakukan kewajibannya dengan tidak membayar hutangnya tepat waktu, atau membayar tetapi tidak selayaknya. Terhadap peristiwa wanprestasi tersebut, pihak yang dirugikan dapat mengajukan gugatan ke Pengadilan Agama. Dalam penelusuran peneliti, ditemukan dua Putusan yang berkaitan dengan kasus wanprestasi akad murabahah pada Bank Syari’ah, yakni Putusan Pengadilan Agama Muara Enim Nomor 0945/Pdt.G/2014/PA.ME dan Putusan Pengadilan Agama Purwokerto Nomor 2370/Pdt.G/2016/PA.Pwt, keduanya sama-sama mengadili sengketa wanprestasi akad murabahah.Penelitian ini merupakan penelitian pustaka (library research) dengan sifat penelitian deskriptif-analitik komparatif. Penelitian ini dilakukan dengan membandingkan dua putusan, kemudian dideskripsikan dan dianalisis secara mendalam menggunakan teori kepastian hukum dan teori maslahah mursalah.Hasil penelitian ini adalah, baik Putusan Pengadilan Agama Muara Enim maupun Pengadilan Purwokerto, masing-masing menggunakan dasar hukum yang relatif sama dalam mememutus perkara gugatan wanprestasi akad murabahah, yakni berdasarkan atas akad yang telah dibuat dan ditandatangani oleh pihak-pihak yang berakad, kemudian diperkuat dengan ayat-ayat al-Qur’an, KUHPerdata, KHES dan Undang-undang, serta peraturan-peraturan lain yang terkait. Sedangkan perhitungan sisa hutang dan sisa margin keuntungan juga sama-sama menggunakan perhitungan keuntungan tetap (flat) sebagai salah-satu wujud penerapan prinsip-prinsik syari’ah, yakni demi menjamin adanya kepastian hukum dan kemaslahatan yang lebih luas.Kata Kunci: murabahah, wanprestasi, kepastian hukum, maslahah mursalah.

  • PELUANG DAN TANTANGAN PERBANKAN SYARIAH DI INDONESIA PASCA MERGER

      Abstract: The development of sharia banks in Indonesia is very rapid, the latest three sharia banks owned by the Association of State-Owned Banks (Himbara) namely PT Bank BRISyariah Tbk (BRIS), PT Bank Syariah Mandiri (BSM), and PT Bank BNI Syariah (BNIS) merged into Bank Syariah Indonesia (BSI). However, the existence of sharia banks and the merger of three banks into BSI have not been fully responded positively by the market. Some Indonesians, especially Muslims have not made sharia banks a reference, not even infrequently they prefer to use conventional banks. In fact, in its system, BSI refers to sharia principles that guarantee its halalness and away from ribawi systems and practices. This study uses the library study method. This study concluded that BSI has a great opportunity in improving the economy of Indonesian people. BSI can improve the competitiveness of Sharia finance in the digital age. BSI has many opportunities to progress because many components support the creation of superior and reliable Sharia banking. BSI has enough power to advance to become a leading bank that plays an important role in economic growth in the country. On the other hand, BSI also faces challenges, namely the lack of institutional development, socialization and promotion, the quality of human resources and the utilization of technology.Keywords : Islamic Bank, Economic Growth, Indonesia

      Abstract: : Syariah Card (syaria card) adalah salah satu produk baru dari perbankan syariah, sehingga dalam penerapannya dalam transaksi keuangan perlu mendapatkan perhatian khusus sehingga pelaksanaannya tetap sesuai dengan konsep syariah. Penerbitan Syariah Card sangat bermanfaat bagi manusia, yaitu mempermudah manusia untuk melakukan pembayaran, dan memberikan rasa aman kepada manusia. Namun daripada itu, Indonesia sebagai negara yang berlandaskan hukum perlu menyiapkan landasan hukum positif yang jelas dan terperinci terkait dengan kemunculan dan tren penggunaan Syariah Card di Indonesia yang semakin meningkat. Diperlukan adanya pengaturan hukum yang tidak cenderung rigid dan tertinggal dengan adanya harmonisasi antara Kompilasi Hukum Ekonomi Syariah, Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia dan Peraturan Otoritas Jasa Keuangan yang mengatur tentang implementasi Syariah Card di lembaga-lembaga keuangan Syariah di Indonesia. Penelitian ini merupakan upaya untuk memaparkan sejauh mana pengaturan hukum di Indonesia mengatur Syariah Card di dalam Kompilasi Hukum Ekonomi Syariah, Fatwa Dewan Syariah Majelis Ulama Indonesia, dan Peraturan Otoritas Jasa keuangan. Diharapkan dari penelitian ini dapat berguna sebagai informasi bagi lembaga-lembaga keuangan syariah dan masyarakat khususnya praktisi hukum di Indonesia dalam menangani perkara hukum yang terjadi seputar implementasi Syariah Card di Indonesia. Penelitian ini termasuk penelitian kepustakaan (Library Research) yaitu suatu penelitian yang dilakukan dengan mengumpulkan bahan-bahan kepustakaan, membaca buku-buku, literatur dan menelaah dari berbagai macam teori yang mempunyai hubungan dengan permasalahan yang diteliti.Kata Kunci: Syariah Card, Syariah Card, Hukum Ekonomi Syariah

Penelitian ini adalah termasuk kajian pustaka yang akan mengkaji tentang pengertian dan beberapa hal penting lainnya tentang tiga lembaga kontemporer tersebut, dengan bersumberkan kepada sumber data primer berupa undang undang serta sumber data sekunder yang berasal dari beragam literatur tentang lembaga keuangan.
