  • The different legislative policy adopted by the autonomous regions with
           civil law in accordance with article 149.1.8th CE

    • Abstract: Una de las singularidades del Derecho civil español radica en la existencia de una pluralidad de Ordenamientos civiles, pudiendo distinguirse entre el Derecho civil estatal y los Derechos civiles territoriales o especiales. Esta realidad viene avalada no sólo por la historia, sino por la Constitución de 1978, cuyo art. 149.1.8ª atribuye a aquellas Comunidades Autónomas en las que a la entrada en vigor de la Norma Fundamental existiera Derecho civil foral o especial la competencia exclusiva no sólo para conservarlo y modificarlo, sino también para desarrollarlo. Al amparo de esta competencia las Comunidades Autónomas con Derecho civil propio han seguido su propia política legislativa sobre el particular, siendo posible identificar tres grandes modelos de ejercicio competencial: el de mantenimiento de la Compilación (Baleares y Navarra), el de Leyes de Derecho civil propio que sustituyen a la Compilación (País Vasco y Galicia) y el codificador (Aragón y Cataluña). Mención aparte merece la singular y, de momento, fallida política legislativa desarrollada por la Comunidad Autónoma de Valencia, y me permito tacharla de "singular", dado que en el momento en que fue promulgada la Constitución de 1978 y se dotó de competencia para conservar, modificar y desarrollar su Derecho civil propio a aquellas Comunidades autónomas "allí donde exista", no parece que estuviese en mente del legislador constituyente la Comunidad valenciana, lo que no ha impedido la aprobación por sus Cortes de una nutrida legislación en materia civil que ha venido seguida de su declaración de inconstitucionalidad por parte del Tribunal Constitucional.One of the peculiarities of Spanish civil law lies in the existence of a plurality of jurisdictions civilians, and can distinguish between civil law State and territorial or special civil rights. This reality is backed not only by history but by the 1978 Constitution, whose article 149.1. 8th attributed to those autonomous communities in which the entry into force of the Fundamental norm existed foral or special civil law exclusive jurisdiction not only to preserve it and to modify it, but also to develop it. Under cover of this competition the autonomous communities with their own civil right have followed their own legislative policy on the matter, being possible to identify three major models of competence exercise: that of maintenance of compilation (Balearic Islands and Navarra), on own civil law to replace the compilation (Basque country and Galicia) and the encoder (Aragón and Catatonia). The singular deserves special mention and, for the moment, failed legislative policy developed by the autonomous community of Valencia, and allow me to delete it "unique", because at the moment which was promulgated the Constitution of 1978 and acquired competence to retain, modify and develop its own autonomous communities to civil law "where exists", does not seem that it was in the mind of the legislator constituent Valencia that has not prevented the approval by its courts of large civil legislation which has been followed by the Declaration of unconstitutionality by the Constitutional Court.
  • Does the cuban legal system have sufficient tools to protect the right of
           disposal of the corpse'.

    • Abstract: Con las presentes líneas se busca reflexionar sobre la deficiente protección del derecho de disposición sobre el cadáver en el ámbito sustantivo y procesal civil en Cuba. Se parte de analizar los aciertos y desaciertos de la regulación de este derecho en los espacios mencionados, y la necesidad de atemperar nuestras normas a la naturaleza jurídica del mismo en aras de prevenir litigios y que el derecho objeto de estudio se pueda realizar de forma más completa, en tanto y en cuanto se modifique la legislación vigente. Además se analiza críticamente la última sentencia dictada por el Tribunal Supremo de Cuba sobre la materia, y se trata de ilustrar como se manifesta esa insuficiente tutela ante una faceta concreta de este derecho.With these lines we seek to reflect about the poor protection of the right to dispose of the corpse in the substantive and procedural civil law in Cuba. It starts analyzing the successes and failures of regulation of this right in the mentioned areas, and the need of our law to understand it essence, in order to avoid future litigation and that the right under study can be performed in a more fully way, as long as the legislation is modified. In addition, the last sentence issued by the Supreme Court of Cuba on the subject is critically analyzed, and it is a question of illustrating how this insufficient protection is manifested before a specific facet of this right.
  • Fair comment and less protection to the right to one's own image of a
           politician in Chile

    • Abstract: En Chile, prevalece la tesis que dice que el derecho a la imagen de los "personajes públicos" merece menor protección que la dispensada a las personas comunes, máxime si en la difusión de informaciones y retratos, que los involucren, concurre un "interés público". A partir de la implicancias de un caso que afectó a un candidato a la presidencia de la República, nuestra conclusión es que la atávica comprensión del retrato de personas impide dar debida solución a fenómenos propios de la era digital ya que todas las cuestiones jurídicas involucradas terminan reducidas solamente a una ponderación entre el derecho fundamental a la vida privada del efigiado y el "interés público" que llevaría implícito la libertad de expresión.In the Chilean law, the thesis prevails that the "public figures" have a significantly diminished right to one's own image than others, more so if a "public interest" is involved in the dissemination of news, information or portraits. Based on the case that affected a candidate for the presidency of the Republic of Chile, our conclusion is that the outdated understanding of creating portraits prevents a proper solution to typical phenomena of the digital and information age, since all the legal issues involved end up reduced only to balancing test between the fundamental right to privacy versus the contribution to a debate of "general interest".
  • Human dignity and the free development of personality in family law in
           Mexico: main jurisprudential criteria

    • Abstract: La protección de la persona a través de los distintos sujetos que la integran en la familia, adquiere connotaciones diferentes según las características socio-políticas y económicas del país. Lo anterior permite presentar una realidad sobre el Derecho de Familia alejada del derecho romano en algunas instituciones fundamentales y con la perspectiva de la protección de los derechos humanos y su constitucionalización en el sistema jurídico mexicano. Se ha realizado este trabajo para destacar el cambio paradigmático de ciertas instituciones familiares, algunas que han variado en el contexto del derecho internacional privado, otras que son propias de las características históricas y culturales mexicanas y del desarrollo del Derecho familiar como disciplina autónoma del Derecho Civil por la presencia del orden público en el desarrollo de la familia, donde prima el interés superior del menor y la protección del sujeto más débil, por eso se destacan en este artículo varias figuras que han jugado un papel fundamental en la nueva concepción del derecho de familia como el concubinato y el patrimonio de familia.The protection of the person through the different subjects that integrate ¡t into the family, acquires different connotations according to the socio-political and economic characteristics of the country. This allows us to present a reality about Family Law that is removed from Roman law in some fundamental institutions and with the perspective of the protection of human rights and its constitutionalisation in the Mexican legal system. This work has been carried out to highlight the paradigmatic change of certain family institutions, some of which have changed in the context of prívate international law, others that are characteristic of Mexican historical and cultural characteristics and the development of family law as an autonomous discipline of Civil Law by the presence of public order in the development of the family, where the best interests of the child and the protection of the weakest subject matter, this article highlights several figures who have played a fundamental role in the new conception of the right of family as the concubinage and the family patrimony.
  • Some considerations on the nullity of the clause of expenses in the

    • Abstract: Cuando las reclamaciones judiciales por abusividad, sustanciadas de manera habitual en el incidente de oposición a la ejecución hipotecaria, parecían agotarse en los motivos relativos a la nulidad por abusivas de las cláusulas de intereses moratorios y vencimiento anticipado, asumida la estimación retroactiva de las demandas, tramitadas a través del procedimiento declarativo correspondiente, por las que se interesa la restitución de las cantidades indebidamente cobradas por las entidades financieras por aplicación de las estipulaciones que limitan la subida de interés en los préstamos pactados con interés variable, se abre una nueva brecha reivindicatoría de los derechos de los consumidores que ahora reclaman a los bancos la devolución de los gastos generados por la constitución del préstamo hipotecario.When legal for abusiveness claims, substantiated on a regular basis in the incident of opposition to foreclosure, seemed exhausted on the grounds relating to the annulment by abusive clauses of moratorium interest and early maturity, assumed the estímate retroactive claims, processed through the corresponding declarative procedure, which is interested in the restitution of the sums unduly charged by financial institutions by application of the provisions that limit the rise of interest in loans agreed with variable interest, opens a new gap reinvidicatoria of the rights of consumers who now claim the banks refund of costs generated by the establishment of the mortgage loan.
  • The transparency control in floor clauses

    • Abstract: El presente artículo analiza la trayectoria de las cláusulas suelo en los últimos años. Para ello, realiza una revisión doctrinal y jurisprudencial que pretende clarificar los límites del control de transparencia, su configuración jurídica y las consecuencias de su incumplimiento. Asimismo, pone de relieve las diferentes controversias que ha suscitado su puesta en práctica.This paper analyses the development of floor clauses in the last years. Thereby, it makes a doctrine and jurisprudence rewiew in order to clarify the limits of the transparency control, its legal configuration and the consequences of its non-fulfillment. Moreover, it sets out the different problems which have appeared from its use.
  • Notes of the patrimony in Venezuelan law

    • Abstract: El artículo sistematiza analíticamente los aspectos fundamentales de la institución del “patrimonio” en el Derecho Civil Venezolano, a la vez que considera referencias doctrinales foráneas, pues se trata de una figura de interés universal. Se ofrece así un breve panorama del tema en sus aspectos fundamentales, tales como: noción, naturaleza jurídica, características, elementos y teorías. Finalmente se cierra con referencias a los supuestos particulares que configuran los patrimonios separados, así como los patrimonios autónomos, para culminar con una breve reseña de la responsabilidad patrimonial, garantía básica del Derecho Civil.The article systematizes the fundamental aspects of the institution of patrimony in Venezuelan Civil Law, while considering foreign doctrinal references, since it is a figure of universal interest. It offers a brief overview of the theme in its fundamental aspects: notion, legal nature, characteristics, elements and theories. Finally, it closes with references to the separate patrimony, as well as the autonomous patrimony, to culminate with a brief account of the patrimonial responsibility, basic guarantee of Civil Law.
  • Principle of proportionality and the mortgage guarantee

    • Abstract: El presente estudio analiza el papel del principio de proporcionalidad en el marco de la garantía hipotecaria, sugiriendo ideas útiles para aclarar el problema general de la relación entre la deuda y las garantías. El A. Arroja luz sobre el sustrato axiológico del principio que se manifiesta en el necesario equilibrio del interés del deudor a no sufrir un sacrificio “mayor de lo necesario” y aquél, opuesto, del acreedor a estar adecuadamente garantizado. El principio, antes de ser elevado a rango constitucional, orientó al legislador de 1942 en la definición de las reglas del C.C. sobre inscripción y sobre reducción de la hipoteca, donde se contempla un equilibrio tanto en la fase de constitución de la garantía, con los requisitos relativos a la reducción, como en la fase ejecutiva, con las disposiciones relativas a la “reducción impropia”. Su valor como principio general lo hace aplicable no sólo como un instrumento hermenéutico, sino también en su capacidad prescriptiva, como maximización de los valores subyacentes, lo que permite reducir los remedios de equidad en los casos de otorgamiento voluntario de la garantía.The research analyses the role of the principle of proportionality in the regulation of mortgage security, in addition also suggesting practical solutions for the clarification of the more general problem of the relationship between debt and securities. The Author explains the axiological basis of the principle that manifest in the necessity of balancing the interest of the debtor to not incur a sacrifice “beyond that which is strictly necessary” and, on the other hand, that of the creditor to possess adequate guarantees. The principle, before assuming a constitutional status, orientated legislators in 1942 to define the civil code rules as regards the registration and reduction of mortgages wherever a balance is contemplated both in the phase of the setting up of securities, with limitations regarding their reduction, as well as in the executive phase with arrangements relative to «improper reductions». Its value as a general principle makes it applicable not only as a hermeneutical instrument but also as regards its perceptive capacity, such as the maximization of its underlying values, making possible remedies for the reduction of equity in cases of the voluntary concession of securities.

This way, heirs are prevented from possible acts directed towards the avoidance of the legacy. This regulation was novel to the civil code and has lasted to present. Therefore, it is necessary to rethink its purpose and to review specific issues that arise from the updating changes of the registry system.

    • Abstract: RESUMEN: El trabajo analiza las diversas implicaciones del fenómeno del abaratamiento y la facilitación de los despidos en la legislación española y sus consecuencias tras las últimas reformas laborales operadas a raíz de la reciente crisis financiera. Al respecto se exponen, en primer lugar, diversas cuestiones que afectan a los despidos colectivos tales como las relativas al control judicial sobre la decisión extintiva empresarial, los conflictos generados por las obligaciones formales dimanantes de la Directiva 98/59 y la necesaria reordenación de este tipo de despidos para su adaptación a las decisiones del TJUE en relación con el cálculo de dichas extinciones. En segundo lugar, se referencian cuestiones atinentes al despido disciplinario tales como el uso inadecuado del despido disciplinario en España para encubrir despidos económicos o la limitación de los salarios de tramitación. Por último se analiza la posible conveniencia de una propuesta legislativa basada en la posible constitución de un fondo de capitalización para los trabajadores como alternativa al actual sistema de indemnizaciones por despido.ABSTRACT: The paper analyses firstly the various implications of the underselling and facilitation of dismissals in the Spanish Law and its consequences due to labor reforms and financial crisis. In this regard, there follows, firstly, various matters affecting collective redundancies such as the judicial review on the employer dismissal decision, the labor conflicts due to formal obligations from the Council Directive 98/59/EC and the necessary reorganization of this kind of dismissals for their adjustment to the Court of Justice of the European Union rulings related with the calculation of these dismissals. Secondly, the paper analyses issues regarding disciplinary dismissals such as the improper use of this type of dismissals to conceal redundancy for economic reasons or others as limitation of the procedural salaries. Finally, the potential suitability of legislative proposal based on a labor capitalization fund as alternative to current severance pay system is analyzed.

    • Abstract: RESUMEN: El "phishing" se revela como una modalidad de estafa informática cuyo objeto principal es obtener del usuario, entre otros, datos, claves o números de cuentas bancarias con la finalidad de obtener un beneficio económico ilícito utilizando para ello de forma fraudulenta y mediando engaño datos personales del usuario. Dicha modalidad delictiva ha ido evolucionando con el paso del tiempo adoptando diferentes perfiles, proliferando actualmente el denominado phishing bancario, el cual tiene como objetivo los clientes de Banco y servicios de pago en línea. La SAP de Valencia se hace eco de los últimos pronunciamientos jurisprudenciales para profundizar en los conceptos de "phishing", "mulero" y posible responsabilidad del mismo en la comisión del citado delito informático.ABSTRACT: "Phishing" is a modality of computer scam whose main purpose is to obtain from the user, among others, data, passwords or bank account numbers in order to obtain an illicit financial benefit by using it fraudulently and mediating scam user's personal data. This criminal modality has evolved over time adopting different profiles, currently enabling the so-called banking phishing, which aims to bank customers and online payment services online. The sentence of AP reflected the last judgmental decisions to deepen in the concepts of "phishing", "mulero" and possible responsibility of the same in the commission of the mentioned computer crime.

El estado-nación español moderno, nacido con las revoluciones burguesas del siglo XIX, negó oficialmente dicha diversidad e impuso el castellano como única lengua oficial de todo el país. La actual Constitución española es un intento de reconocer la diversidad lingüística española y establecer un sistema de derechos lingüísticos para los hablantes de las lenguas españolas distintas del castellano. Con todo, el sistema es jerárquico, desigual y complejo, y está sometido a críticas y cuestionamientos políticos desde diferentes posiciones.ABSTRACT: Spain is a country with twelve autochthonous languages. The modern Spanish nation-state, born with the bourgeois revolutions of the nineteenth century, officially denied this diversity and imposed Castilian as the only official language of the whole country. The current Spanish Constitution is an attempt to recognize Spanish linguistic diversity and establish a system of linguistic rights for speakers of Spanish languages other than Castilian. However, the system is hierarchical, unequal and complex, and is subject to criticism and political questioning from different positions.
