  • Ten years on the Chilean unification of labor jurisprudence legal remedy.
           Empirical research of the Chilean Supreme Court jurisprudence

    • Abstract: Resumen: El recurso de unificación de jurisprudencia laboral inició su vigencia en Chile en el año 2008. Su finalidad fue generar una jurisprudencia uniforme. El presente trabajo analiza si aquello se cumplió en el nivel interno. Es decir, si la Corte Suprema de Chile siguió de manera consistente sus propias interpretaciones. Con dicho objetivo, el presente estudio analiza los recursos de unificación de jurisprudencia deducidos entre marzo de 2008 y marzo de 2018. Esto significó revisar cerca de 5000 sentencias pronunciadas entre octubre de 2008 y enero de 2020.Abstract: The unification of labor jurisprudence remedy entered into force in Chile in the year 2008. Its aim was to generate a uniform jurisprudence (judicial precedent). This article analyzes whether this purpose was accomplished from an internal point of view. This is to say, if the Supreme Court of Chile consistently followed its own interpretation of law. Whit that goal, this study analyzes all the unification of labor jurisprudence remedies lodged between March of 2008 and March of 2018. This implied to review nearly about 5000 judgments pronounced between October 2008 and January 2020.
       
  • From the Spanish Constitution to the Civil Registry Law, an experience for
           Cuba in restricted publicity

    • Abstract: Resumen: La publicidad del Registro Civil no es absoluta. En sentido general, el respeto al honor y a la intimidad de las personas representan su principal límite a partir del reconocimiento que de estos derechos hacen tanto la Constitución española como la cubana. En este contexto es, por tanto, notorio que la Ley N° 51 (1985) del Registro del Estado Civil en Cuba, no disponga de un sistema de datos protegidos que ordenadamente sirvan como límite de su publicidad. Por lo que, valorar dicha situación constituye el objetivo del estudio, que toma como referente la organización del contenido de publicidad restringida que presenta el sistema registral español, a partir de las semejanzas que se observan entre las instituciones registrales de ambos países y, en especial, por la organización que alcanza esta materia en la Ley 20/2011, de 21 de julio, del Registro Civil de España.Abstract: Publicity of the Civil Registry is not absolute. In a general sense, respect for the honor and privacy of people represents its main limit based on the recognition that both the Spanish and Cuban Constitution make of these rights. In this context, it is, therefore, notorious that Law No.51 (1985), of July 15th, on the Civil Status Registry in Cuba, does not have a protected data system that orderly serves as a limit to its publicity. Therefore, assessing this situation is the objective of the study, the one that takes as a reference the organization of the restricted publicity content presented by the Spanish registry system, based on the similarities observed between the registry institutions of both countries and, especially, by the organization that reaches this matter in Law 20/2011, of July 21st of the Civil Registry of Spain.
       
  • Early determination of the useful life of mining projects as essential for
           the setting of the temporary limits of mining legal easements and the
           quantifying of the indemnifications to which the owner of the servant
           property will be entitled

    • Abstract: Resumen: La servidumbre minera es esencialmente transitoria. Ella está delimitada en virtud del aprovechamiento que se efectúe del predio dominante, por lo que resulta necesario que al momento de su constitución se determine anticipadamente la vida útil de la operación minera proyectada por el concesionario minero, lo cual permitirá identificar la extensión temporal del gravamen que se busca imponer al predio sirviente, como también, cuantificar adecuadamente los perjuicios que el titular de éste último tendrá derecho a percibir a título de indemnización. En la actualidad, se generan graves efectos jurídicos adversos a los intereses del propietario del predio sirviente, toda vez que al no existir normas legales que permitan establecer el límite temporal al momento de constituirse este tipo de servidumbres, se desnaturaliza la transitoriedad que les es característica, mutando a una inefable prolongación indeterminada de las mismas, lo que redunda, además, en la inespecificidad de los perjuicios que se deban resarcir al dueño del predio.Abstract: The mining easement is essentially temporary. It is delimited by virtue of the use made of the dominant property, so it is necessary that at the time of its constitution the useful life of the mining operation projected by the mining concessionary be determined in advance, thus allowing the identification of the temporary extension of the lien that is sought to be imposed on the servant property, as well as adequately quantify the damages that the owner of the latter will have the right to receive by way of compensation. At present, serious adverse legal effects are generated to the interests of the owner of the servant property, since there are no legal norms that allow establishing the time limit at the time of constituting this type of easement, the transitory nature that is characteristic of them is distorted, mutating to an ineffable indeterminate extension of them, which also results in the non-specificity of the damages that must be compensated to the owner of the property.
       
  • The writ of inapplicability due to unconstitutionality as an apt and
           effective mechanism in the context of the constitutionality problems of
           Article 2331 of the Civil Code

    • Abstract: Resumen: Se postula que la acción de inaplicabilidad por inconstitucionalidad, es un medio idóneo y efectivo para habilitar la legitimación activa a fin de demandar la indemnización por un daño extrapatrimonial ocasionado por imputaciones injuriosas en contra del crédito o el honor de una persona. La discusión cobra relevancia debido a las distintas interpretaciones que ha recibido el artículo 2331 del Código Civil, y que han afectado el reconocimiento de la titularidad de la acción de reparación integral del daño en la materia específica que trata dicho artículo. Esta investigación demuestra que se está ante una antinomia cuya resolución corresponde al Tribunal Constitucional en el ejercicio de su atribución de inaplicación de la ley. Y que, de un análisis de la jurisprudencia ordinaria y la jurisprudencia de inaplicabilidad, es posible concluir que la acción de inaplicabilidad es el mecanismo más efectivo para el reconocimiento del acceso a la justicia y la obtención de una reparación integral ante un daño en contra de un derecho personalísimo.Abstract: It is argued that the writ of inapplicability due to unconstitutionality is an apt and effective means to enable the legal standing, in order to sue compensation for non-pecuniary damages caused by slanderous allegations against a person’s credit or honor. This is a relevant debate in view of the different interpretations that have been given to Article 2331 of the Civil Code, as these have had an impact on whether or not there is a chance to claim full compensation in this context. The present research shows that we are faced with an antinomy whose solution is up to the Constitutional Court by means of its power to inapply the laws. It also shows that, based on an analysis of both ordinary case-law and inapplicability case-law, one can conclude that the writ of inapplicability is the most effective mechanism for granting access to justice and for providing full compensation of damages caused against this highly personal right.
       
  • Legal framework for combination and alternative sentencing within Chilean
           criminal law. Some applications and uses of legislative and judicial
           nature

    • Abstract: Resumen: Se realiza una revisión del estatuto normativo del tipo de penas que el derecho penal chileno y el derecho penal español denominan penas conjuntas y penas alternativas, y se exponen las críticas de la doctrina penal a ellas. A partir de su estudio dogmático y del análisis lógico-jurídico de su configuración, se intenta explicar la ratio de su uso dentro de las referidas legislaciones. Y, así, proponer modos de uso y aplicación de estas penas, tanto para el legislador como para el sentenciador penal.Abstract: The criminal penalties that Chilean and Spanish criminal legislation refer to as combined sentences and alternative sentences are addressed. First, in order to describe their legal framework and, then, to present the criticisms raised against them by the criminal law literature. On the basis of a dogmatic study of them and a legal-logical analysis of their configuration, the purpose is also to explain the rationale behind the use of these sentences within the aforementioned legislations. And, thus, to propose ways of use and application of these penalties, both for the legislator and for the criminal adjudicator.
       
  • Guidelines for the application of the legal regime of
           entrepreneur-consumer in Chile

    • Abstract: Resumen: Se busca elaborar algunas directrices necesarias para la correcta aplicación de la Ley Nº 19.496 a pequeñas y medianas empresas; asimismo, se analizan críticamente ciertas disposiciones de este estatuto y su aplicación judicial. Se concluye proponiendo, de lege lata, orientaciones que sirvan a los operadores jurídicos al momento de aplicar esta normativa.Abstract: Some necessary guidelines are outlined concerning the proper application of Law No. 19.496 to small and medium-sized companies, while at the same time, certain provisions of this regime and its judicial application are critically assessed. To conclude, some (de lege lata) guidance is offered which may be useful to legal practitioners at the time of applying these rules.
       
  • The leniency system in the securities market three years after its
           incorporation into Chilean law

    • Abstract: Resumen: Con la entrada en vigencia de la Ley N° 21.000, que creó la Comisión para el Mercado Financiero, se incorporó la llamada “colaboración compensada” como mecanismo de detección y persecución de ilícitos en el mercado de valores. Se trata de una herramienta que permite mejorar la detección y sanción de ilícitos, al mismo tiempo que promueve la implementación de mecanismos de autodisciplina que previenen la comisión de infracciones. Pese a que la colaboración compensada se encuentra incorporada en nuestra legislación desde comienzos de 2018, a tres años de su implementación, son pocos los casos en los que ha recibido aplicación por parte de la Comisión para el Mercado Financiero. Por lo anterior, en el presente trabajo se realizará un análisis general de la colaboración del presunto infractor y de su consagración normativa, para luego entrar de lleno en el estudio de algunos de los primeros casos en que ha sido aplicada, los que resultan relevantes a efectos de constatar el escenario actual de dicha institución y, específicamente, de analizar si la técnica legislativa implementada ha sido la adecuada.Abstract: With the entry into force of Law N° 21.000, which created the Financial Market Commission, the called "leniency system" was incorporated as a mechanism for detecting and prosecuting illicit activities in the securities market. This is a tool that allows for improved detection and punishment of illicit activities, while promoting the implementation of self-disciplinary mechanisms that prevent the commission of infringements. Although it has been incorporated in our legislation since the beginning of 2018, three years after its implementation, there are few cases in which it has been applied by the Financial Market Commission. Therefore, in this paper we will conduct a general analysis of the “leniency system” and its normative consecration, to then fully enter into the study of some of the first cases in which it has been applied, which are relevant in order to verify the current scenario of this institution and, specifically, to analyze whether the legislative technique implemented has been the correct one.
       
  • The link between the concept of and the evidence on moral damages. A case
           law analysis

    • Abstract: Resumen: El análisis del daño moral permite reflexionar en torno a lo que debemos entender conceptualmente por él sea desde una perspectiva subjetiva como objetiva. En el primero de los ámbitos la doctrina en general ha tratado el daño moral bajo la perspectiva de perturbaciones extrapatrimoniales de bienes, cosas o derechos; en circunstancias que, desde el segundo, se refleja un esfuerzo por analizarlo desde el prisma de la afectación a intereses, postura que defendemos. A su turno, la aproximación conceptual repercute en estándar probatorio de los presupuestos que lo configuran, aspecto que debiera incidir en la cuantificación del agravio. Así, el daño moral subjetivo supone mayor relajo en el estándar, mientras que el daño moral objetivo o anclado en el interés, exige un reforzamiento en el mismo. Ambos aspectos si bien son susceptibles de distinguirse tanto en el plano contractual como en el extracontractual, se constriñen en el primero básicamente por razones de régimen, el cual exige la identificación de interés protegido dentro del ámbito del contrato.Abstract: The analysis of moral damages must lead us to reflect upon the boundaries of such a concept, either from a subjective or an objective standpoint. In the case of the first approach, the specialized literature has understood moral damages, in general, under the idea of non-pecuniary disturbances on goods, things or rights. While, in the case of the second, efforts have been focused on analyzing the infringement of certain interests, which is actually the standpoint we defend here. Additionally, it should be noted that the respective conceptual approach has major implications on the evidentiary standard when it comes to proving moral damages, as well as it also impacts on the quantification of torts. Accordingly, subjective moral damages imply a more relaxed standard, while objective moral damages (or those anchored to interests) call for a stricter one. Although these two aspects can be distinguished according to the corresponding sphere, whether it be contractual or non-contractual, they remain limited in the former mainly because of its own legal regime, which requires identifying a protected interest within the scope of a contract.
       
  • The implicit sociology within the pure theory of law

    • Abstract: Resumen: Se pretende dar cuenta del lugar que ocupa el análisis sociológico en el esquema de la teoría pura de Kelsen, argumentando que la propuesta de un estudio exclusivamente normativo del derecho descansa sobre un conjunto de condiciones empíricas, de cuya constatación depende la posibilidad de presuponer la Grundnorm de un sistema. En este orden de ideas, para reconocer que algo cuenta como derecho, se hace necesario evaluar la relación global entre validez y eficacia, incorporando conocimientos externos a la ciencia jurídica, de orden político y sociológico. Para estos efectos, se comenzará por presentar la escisión ontológica entre Sein y Sollen asumida por Kelsen para fundamentar su distinción metodológica entre ciencias empíricas y normativas, problematizada a continuación, a partir de la condición de eficacia que se impone a la validez del derecho, con la finalidad de concluir la tesis del trabajo. Ella consiste en que la teoría pura supone una sociología para determinar su objeto de estudio.Abstract: An attempt is made to establish the place of sociological analysis within the scheme of Kelsen’s pure theory. In this respect, it is argued that the proposal of an exclusively normative approach to law rests on a set of empirical conditions, on the verification of which the very possibility of assuming the Grundnorm of a system depends. Thus, when it comes to identifying something as law, it becomes necessary to examine the overarching relationship between validity and efficacy. But this can only be done by including knowledge beyond the legal science, that is, of a political and sociological nature. Correspondingly, this paper begins by presenting the ontological split between Sein and Sollen adopted by Kelsen as the basis for his methodological distinction between empirical and normative sciences. Then, this distinction is questioned from the perspective of the requirement of efficacy imposed on the validity of law, so as to finally arrive to the work’s conclusion. That is, that the pure theory presupposes a certain sociology in order to determine its own subject of study.
       
  • Plurality of legal sources concerning the matrimonial regime. A necessary
           review for its incorporation within Cuban law

    • Abstract: Resumen: Se analiza la pluralidad de fuentes del régimen económico del matrimonio, ante la ausencia de regulación del régimen de tipo convencional en el ordenamiento jurídico familiar cubano. Lo anterior, en virtud de que nuestra legislación sólo asume el régimen económico de tipo legal e imperativo, sin margen a la actuación de la autonomía de la voluntad de los cónyuges en lo que a la determinación del régimen rector de sus relaciones patrimoniales se refiere. De ahí que, se realice una fundamentación teórica en cuanto a la necesidad de implementación en Cuba de la pluralidad de fuentes del régimen económico del matrimonio en la ley familiar ante el nuevo contexto social.Abstract: An analysis is conducted on the plurality of legal sources regarding the matrimonial regime, especially considering the lack of regulation for an agreed-upon regime within Cuban family law. This is due to the fact that Cuban legislation only provides for a mandatory matrimonial regime, leaving no room for the spouses’ freedom of choice with regards to the legal framework of their economic relations. Accordingly, a theoretical basis is provided for the necessary implementation of plurality among the legal sources of matrimonial regime within Cuban family law, in view of the new social context.
       
  • Directors' liability within preventive insolvency procedures under
           Argentinian law

    • Abstract: Resumen: Se efectúa un doble estudio, por un lado se contempla la responsabilidad falencial de los administradores en las quiebras, analizando para ello el daño que debe producirse y la presencia necesaria del dolo -y las críticas referenciadas por la doctrina sobre el particular-; ambas como características de este instituto. Asimismo, se estudian las particularidades que presenta, los requisitos de su procedencia y su alcance. En una segunda parte se analiza la responsabilidad de estos sujetos en los concursos preventivos por los daños que le podrían haber ocasionado a los acreedores la sociedad concursada. Mediante la aplicación sistémica del Código Civil y Comercial y en un diálogo de fuentes con la Ley General de Sociedades (Ley N° 19.550, 1972) se logra llenar el vacío legal presente en la Ley de Concursos y Quiebras (Ley N° 24.522, 1995) sobre este particular. También se contempla la Responsabilidad Social Corporativa como generadora de responsabilidad, para evaluar también desde este ámbito la posibilidad de atribución de la misma, en caso de ser posible. En la última parte se realiza un repaso sobre la cuestión procesal de las acciones de responsabilidad en los concursos preventivos que, ante la falta de normativa específica sobre la materia, en una interpretación armónica se ha arribado a una posible solución.Abstract: A twofold analysis is carried out as, on the one hand, the directors' liability arising from bankruptcy is addressed. For this purpose, both damage and intention are examined (including the criticisms about the latter by the specialized literature) as typical features of this regime, whose peculiarities and conditions are described. On the other hand, the directors' liability is analyzed in the specific context of a preventive insolvency procedure, within which the respective company could actually cause damages to the creditors. Since the Statute on Insolvency Procedures and Bankruptcy (Nr. 24.522 of 1995) presents a legal gap on this point, it is necessary to fill it by means of a systematic interpretation of the Civil and Commercial Code, following a dialogue of legal sources that leads to the General Statute on Corporations (Nr. 19.550 of 1972). Additionally, Corporate Social Responsibility is also discussed as a potential generator of liability. And in the last part, the question arises as to the judicial procedures according to which the aforementioned liability could be declared, since in the absence of a specific rule on the matter, a harmonizing interpretation is required to reach a solution.
       
  • The ratification of the CEDAW Optional Protocol: implications and
           challenges of the individual communications procedure for the Chilean
           State

    • Abstract: Resumen: La reciente ratificación del Estado de Chile al Protocolo Facultativo de la Convención sobre la eliminación de todas las formas de discriminación contra la mujer (PFCEDAW) invita a reflexionar sobre el modo en que Chile se ha relacionado con procedimientos de comunicaciones individuales del Sistema Universal de Derechos Humanos. El presente artículo describe y analiza estos procedimientos, enfocándose especialmente en el rol del Comité para la eliminación de la discriminación contra la mujer. Además, analiza críticamente las razones que dilataron la ratificación del PFCEDAW, y articula los desafíos principales que supone este tratado internacional para la institucionalidad chilena de derechos humanos.Abstract: The recent ratification of the State of Chile to the Optional Protocol to the Convention on the Elimination of All Forms of Discrimination against Women (OP-CEDAW) invites us to reflect on how Chile has related to individual communications procedures of the Universal Human Rights System. This article describes and analyzes individual communications of the Universal Human Rights System, with a special focus on the role of the Committee on the Elimination of Discrimination against Women. Moreover, it critically addresses the reasons that delayed the ratification of OP-CEDAW and the challenges it entails for Chilean Human Rights Institutions.
       
  • Public service contracts concluded as adhesion contracts, in the face of
           abusive or economic hardship clauses. Perspectives from Cuban law

    • Abstract: Resumen: El Estado como ente de poder público ejerce funciones administrativas encaminadas a suplir las crecientes necesidades sociales. Para ello encarga dichas funciones a la Administración Pública, la que entonces debe poner a disposición de la población los servicios públicos. Los destinatarios de estos se convierten en consumidores activos a través de relaciones contractuales y, por ende, se generan contratos de servicios públicos entre ambos sujetos de derecho. Al ser la Administración la parte privilegiada, por sus amplias prerrogativas, establece cláusulas predispuestas que podrían ser abusivas o generar una excesiva onerosidad. Por lo tanto, se requiere el establecimiento de sistemas de control: legal, administrativo y judicial, que actúen en conjunto y den seguridad jurídica al consumidor al requerir el servicio público.Abstract: The State as an entity of public power exercises administrative functions aimed at providing the growing social needs. To do so, these functions are performed by the Public Administration, which is then in charge of offering the corresponding public services to the public. The recipients of these become active consumers through contractual relationships and, thus, public service contracts are estipulate between these two parties. Due to its broad prerogatives in this context, the Administration appears as the privileged party and determines contractual clauses unilaterally, which might be potentially abusive or generate economic hardship. Therefore, it is necessary to establish control systems: legal, administrative, and judicial; all of them must act together and are set in place in order to provide legal certainty to consumers.
       
  • The decisive character of the legal precept within inapplicability
           procedures and the temporal effects of the ruling: regulatory gaps and
           practical problems

    • Abstract: Resumen: La inaplicabilidad posee severas deficiencias en su configuración. La regulación deficitaria de algunos de sus aspectos esenciales, tales como sus requisitos, la oportunidad para promoverla y los efectos de sus sentencias, ha permitido que, en muchas ocasiones, se frustren los objetivos perseguidos con su interposición. Así, es posible que, incluso logrando la declaración de inconstitucionalidad de un precepto legal para su caso concreto, la situación del requirente ganancioso acabe siendo la misma que si no hubiese recurrido al Tribunal Constitucional. Lo anterior, puede deberse a que el examen sobre los preceptos que podrían resultar decisivos en la gestión pendiente, por parte de un tribunal que no es experto en la materia debatida, resulta inherentemente complejo. Desde una perspectiva práctica, además, se evidencia cierta reticencia de la justicia ordinaria a considerar que, tras la sentencia de inaplicabilidad, pueda producirse una hipótesis de ilegalidad sobreviniente. Algunas sentencias que ejemplifican casos como los descritos, enseñan que el instrumento vigente se encuentra en crisis. Ello reafirma la urgente necesidad de una revisión del sistema de control de constitucionalidad represivo de la ley en Chile.Abstract: Inapplicability has several configurational shortcomings. The deficient regulation of some of its essential aspects, such as its requirements, the opportunity to file it and the effects of its judgments, has frustrated the goals pursued with its filing on many occasions. Thus, it is possible, even achieving the declaration of unconstitutionality of a legal precept for the specific case, that the winning plaintiff's situation ends up being the same as if he had not resorted to the Constitutional Court. This may be due to the fact that examining the precepts that could be decisive in the pending case, by a court that is not an expert in the matter under discussion, is inherently complex. From a practical perspective, there is also evidence of some reluctance of the ordinary courts to consider that, after the ruling of inapplicability, a hypothesis of supervening illegality may arise. Some judgments that exemplify cases such as those described, show that the current instrument is in crisis. This reaffirms the urgent need to revise the system under which legislation is made subject to repressive judicial review in Chile.
       
  • Jurisdiction and judicial misconduct for misapplication of the law: a
           proposal for the controversy on the criminal perpetrator

    • Abstract: Resumen: El delito de prevaricación judicial puede ser entendido como un mecanismo idóneo para garantizar la legalidad de la actuación de los jueces y de quienes realicen “funciones análogas”. Sin embargo, este delito tiene un escaso desarrollo por parte de los tribunales y de la doctrina nacional. Por ese motivo, deseamos contribuir a la discusión del sujeto activo del delito a través del concepto de jurisdicción delineado por el Tribunal Constitucional chileno. La idea que subyace es que el ejercicio de la función jurisdiccional constituye un criterio suficiente para identificar al sujeto activo del delito de prevaricación judicial.Abstract: The crime of judicial misconduct for misapplication of the law can be considered as a proper mechanism to ensure the legal behavior of judges and of those who perform “analog functions”. However, the specific legal features of this crime have been scarcely developed in both national courts and doctrine. Therefore, we seek to contribute to the specific discussion on the perpetrator by examining the concept of jurisdiction given by the Chilean Constitutional Court. The idea underlying our reasoning is that the exercise of the jurisdictional function is a sufficient criterion when identifying the potential perpetrator of this crime.
       
  • Double registration, overlapping lands and Decree Law 2695. Extraordinary
           acquisitive prescription against a registered title: comments on the
           

    • Abstract: Resumen: La sentencia que se comenta se sitúa en la problemática del valor de la inscripción y su relación con la posesión y, de hecho, en la discordancia entre el Registro inmobiliario y la realidad extrarregistral. La inexactitud del Registro en este caso alude al desacuerdo que, en cuanto a los derechos aparentemente inscritos del demandante y demandado, existe entre el Registro inmobiliario y la realidad jurídica que afecta la situación real del Lote en cuestión. La controversia no ha sido fácil de resolver, pues la Corte Suprema revoca lo resuelto en la instancia anterior. Sin embargo, el análisis y la ponderación de las pruebas del tribunal de primera y segunda instancia, permiten plantear que las decisiones que favorecen la inscripción no pueden amparar situaciones en las que existen señas de tenencia material por largo tiempo. No admitirlo, implica equiparar las instituciones de la posesión con la inscripción conservatoria de un bien raíz.Abstract: The judgment under discussion deals with the problem of the legal value of a registration and its relationship with the possession and, in fact, with the discordance between the Real Estate Registry and the extra-registral reality. The inaccuracy of the registration in this case refers to the disagreement that, with regards to the apparently registered rights of the plaintiff and the defendant, exists between the Real Estate Registry and the legal reality concerning the situation of the disputed land. The controversy has not been easy to settle, since the Supreme Court reversed the previous decisions. However, the analysis and the weighing of the evidence displayed by the judges of first and second instance, allow us to state that the decisions in favor of registration cannot cover situations in which there are signs of material tenure for a long time. Not to admit this, implies equating the institutions of possession with the official registration of a land.
       
  • Ultra-activity in the application of article 127 of the 1932 Mining Code
           regarding the expiration of a mining concession: Commentary on the
           decision issued by the Court of Appeals of Santiago on January 23, 2019
           (Case N° 8.845-2017), confirmed by the Supreme Court (Case N°
           12.482-2019)

    • Abstract: Resumen: Se comenta una sentencia de la Corte de Apelaciones de Santiago de fecha 23 de enero de 2019, confirmada por la Corte Suprema en noviembre de 2020, que se pronuncia sobre la caducidad de una pertenencia minera en virtud de la figura de la caducidad automática o ipso iure del artículo 127 del Código de Minería de 1932. En la conclusión se estima que el tribunal efectúa un errado análisis causal al declarar la caducidad de las pertenencias mineras, toda vez que aplica ultractivamente una norma derogada sin sentencia declaratoria de caducidad, invierte la carga de la prueba y desconoce el valor probatorio de los actos de autoridad.Abstract: This commentary deals with a judgment issued by the Court of Appeals of Santiago on January 23, 2019, and confirmed by the Supreme Court in November 2020. In it, the expiration of a mining concession was declared on the grounds of article 127 of the Mining Code of 1932, which used to establish a rule of automatic or ipso iure expiration. It is concluded that the Court fails its analysis when declaring the expiration of the concession, as it opts for ultra-activity in the application of a derogated rule in the absence of a judgment formally declaring the expiration, reverses the burden of proof and disregards the probative value of acts of authority.

En el comentario se puntualizan los argumentos esgrimidos para la declaración de inconstitucionalidad, se determina qué tipo de argumentación presenta el tribunal, se reconstruye la teoría constitucional que subyace a la sentencia y se evalúa el posible impacto que esta decisión podría tener en la determinación de los límites de la potestad de reforma constitucional.Abstract: The Chilean Constitutional Court declared unconstitutional a constitutional amendment bill that allowed, by means of a transitory constitutional provision, the withdrawal of 10% of individual pension funds. The commentary points out the grounds on which this declaration was based, determines the type of argumentation presented by the Court, reconstructs the constitutional theory underlying the Court’s ruling and assesses the potential impact of this decision on the determination of the constraints placed upon the power of constitutional amendment.

    • Abstract: Resumen: Se presenta el origen, definición, elementos diferenciadores y naturaleza jurídica del derecho real de conservación, a la luz del contraste de dos visiones que se enfrentaron en el proceso legislativo, explicando las razones por las que la ley finalmente adoptó la visión ´post-moderna´ dando así origen a un nuevo derecho real afirmativo distinto de las servidumbres de conservación o ´real covenants´ que existen en el derecho comparado.Abstract: The origin, definition, differentiating elements and legal nature of the conservation right are presented here, in light of the contrast between two visions that faced each other in the legislative process; explaining the reasons why the law finally adopted the 'post-modern' vision, thus giving rise to a new affirmative real right different from the conservation easements or real covenants that are found in comparative law.
