REFLECTIONS ON THE FRAMEWORK CONTRACTS
- Abstract: Resumen Los contratos marco son una herramienta de uso frecuente en el tráfico jurídico, pero la doctrina colombiana los ha estudiado de forma muy limitada a pesar de las dificultades que presenta tanto en la teoría como en la práctica. El presente artículo busca analizar la noción de contrato marco para diferenciarlo de otras figuras afines; estudiar su naturaleza jurídica y determinar cuáles son sus efectos jurídicos.Abstract Framework contracts are a frequently used tool in the legal dealings. However, they have been studied scantily in the Colombian legal doctrine despite the difficulties they posit in both the theory and the practice. This paper aims to examine the notion of framework contract in order to differentiate it from other related legal concepts, study its legal nature, and ascertain its legal effects.
RESETTLEMENT PROCESSES IN COLOMBIA: IS THIS A MEASURE OF BOTH ADAPTATION
AND THE PROTECTION OF THE HUMAN RIGHTS OF COMMUNITIES AFFECTED BY CLIMATE
CHANGE'
- Abstract: Resumen Este artículo presenta las deficiencias del ordenamiento jurídico en la configuración del reasentamiento como una medida excepcional de adaptación al cambio climático y de protección de los derechos humanos de las comunidades afectadas. Entre las deficiencias objeto de análisis resaltan: la falta de un encuadre conceptual adecuado del reasentamiento; la ausencia de una política pública sobre el tema y su relación con la adaptación al cambio climático y el otorgamiento de una amplia discrecionalidad a los municipios para llevar a cabo procesos de reasentamiento que, en la práctica, se manifiestan a través de actuaciones informales –sin regulación especial o protocolos que guíen su ejecución– y que han generado la violación de los derechos humanos. Este trabajo es el resultado de la investigación que soportó el respectivo informe a la Comisión Interamericana de Derechos Humanos, construido mediante una investigación documental exploratoria y analítica, estudio e intervención en casos reales.Abstract This article presents the deficiencies of the legal system in relation to resettlement of communities as an exceptional measure of climate change adaptation and protection of human rights. Among the deficiencies under analysis: the lack of an adequate conceptualization of resettlement, lack of public policy regarding resettlement and its relation to climate change adaptation, and the granting of broad discretional powers to municipal governments to undertake resettlement process that, in practice, are implemented through informal actions –without specific regulation and protocols that guide its implementation– that have caused violations of human rights. This document is the result of an investigation that supported the construction of a report to the Inter-American Commission of Human Rights, through both exploratory and analytical documentary research and the study of and intervention in real cases.
THE HUMAN RIGHT TO DRINKING WATER IN COLOMBIA: DECISIONS BY THE STATE AND
PRIVATE ACTORS
- Abstract: Resumen Este artículo presenta reflexiones alrededor de las discusiones que se suscitan desde el pronunciamiento de la ONU A/64/L.63/Rev.1, resolución del 26 de julio de 2010, que declara el agua potable y el saneamiento como un derecho humano esencial, lo cual genera para los Estados obligaciones exigibles por parte de los particulares. A partir de lo anterior, surge para los Estados miembro de las Naciones Unidas, entre ellos Colombia, la tarea de garantizar el servicio de acueducto con calidad y cobertura al 100 % a todos sus habitantes pero, a la vez, el Gobierno enfrenta el reto de conservar las fuentes de agua, que son el insumo para garantizar los derechos que la ONU ha considerado exigibles para todo ser humano. Es por ello que se plantean en este artículo los interrogantes e inquietudes en torno a las tareas que deben emprender el Estado colombiano y los particulares para el cumplimiento de las directivas de la ONU, sin detrimento de las fuentes de agua y la sostenibilidad del medio ambiente.Abstract This paper provides some reflections on the discussions resulting from the UN declaration, A/64/L.63/Rev.1. It is a resolution dated July 26, 2010 whereby the UN enacts the drinking water and sanitation as an essential human right, which creates some obligations the private actors will demand the Member States to comply with. Based on the foregoing, the UN Member States, including Colombia, are now required to ensure a water supply with quality and 100% coverage to their inhabitants via an aqueduct. However, governments face, in turn, the challenge to preserve the water sources constituting the raw material for ensuring those rights the UN has enacted as claimable by all human beings. This way, this paper poses some questions and queries regarding the tasks to be undertaken by both the Colombian State and the private actors to comply with the UN directives, without detriment to the water sources and the environmental sustainability.

- Abstract: Resumen Este artículo de investigación busca profundizar en los antecedentes que dieron origen a la protección de las obras cinematográficas en Colombia. Igualmente, el artículo reflexiona sobre cómo la evolución legislativa en materia de cine, fue de la mano del crecimiento de la industria en el país. También se explora cuál es el alcance de los derechos que tiene cada uno de los autores e intérpretes de las obras cinematográficas en el país. Igualmente se estudia la evolución de sus derechos y su relación con el cine en Colombia.Abstract This research work aims to delve into the background issues that led to the protection acts of the film productions in Colombia. In addition, this paper reflects on how the legislative evolution concerning film issues occurred hand in hand with the industry growth in our country. The scope of the copyrights for every film author and interpreter in our country is also explored herein. Finally, this work studies the evolution of their copyrights and how it relates to the film industry in Colombia.
THE HERMETIC QUALITY OF THE CHILEAN CONSTITUTIONAL JURISDICTION REGARDING
THE CONVENTIONALITY CONTROL
- Abstract: Resumen El presente trabajo de investigación analiza cómo el diseño constitucional chileno incide tanto en el ejercicio del control de convencionalidad por el órgano de justicia constitucional, como en el diálogo entre el Tribunal Constitucional chileno y la Corte Interamericana de Derechos Humanos; y en la consiguiente contribución a la conformación del Ius Constitutionale Commune latinoamericano. La insularidad de la Constitución Política de la República de Chile en relación con el Derecho Internacional de los Derechos Humanos ha determinado una posición hermética de la jurisdicción constitucional respecto al ejercicio del control de convencionalidad. Lo anterior se constata mediante un análisis del articulado constitucional, mediante un estudio de la doctrina y de la jurisprudencia sobre la recepción del bloque constitucional de los derechos como parámetro del control de constitucionalidad y por medio de un examen de la jurisprudencia del Tribunal Constitucional chileno sobre sus competencias para ejercer el control de convencionalidad.Abstract This research work examines how the Chilean constitutional design affects, on one hand, the exercise of the conventionality control by the constitutional justice body, like in the dialog between the Chilean Constitutional Court and the Inter-American Court for Human Rights; and on other hand, the consequent contribution to the building of the Latin American Ius Constitutionale Commune. The isolated condition of the Constitution of the Republic of Chile regarding the International Human Rights Law has brought the constitutional jurisdiction to a hermetic position regarding the conventionality control exercise. All the foregoing is verified with an analysis of the constitutional articles; the study of the doctrine and jurisprudence concerning how the constitutional legislators received the human rights as a benchmark for the constitutional control; and the examination of the jurisprudence by the Chilean Constitutional Court regarding the competences to exercise the conventionality control.

PANELS. AN ANALYSIS OF SOME OF ITS PROCEDURAL DEFICIENCIES BASED ON THE
REQUIREMENT OF “CONTRIBUTION TO THE DEVELOPMENT OF THE RECEIVING
STATE” AS A REQUIREMENT FOR ACCESS TO ITS JURISDICTION
- Abstract: Resumen En las últimas décadas hemos observado un creciente protagonismo de los actores judiciales en materia interpretativa, especialmente en aquellas vinculadas a conceptos indeterminados propios del derecho internacional, y más particularmente, de los derechos fundamentales. El trabajo postula que este mayor activismo judicial no puede ser apreciado ni justificado con iguales criterios en asuntos tan distintos como los conflictos entre derechos constitucionales (que admiten una mayor construcción judicial) o los temas comerciales y penales (en los que el apego a la norma y a la seguridad jurídica ofrecida debe ser mayor). Para justificar lo anterior, analiza los oscilantes criterios que han tenido los paneles arbitrales del Centro Internacional de Arreglo de Diferencias relativas a Inversiones (Ciadi) en la evaluación del criterio central del sistema y que da el acceso a su jurisdicción: la inversión extranjera. A partir de ello, señala una serie de cuidados y precauciones que el sistema podría adoptar para mejorar sus estándares y prácticas jurídicas y hace un análisis basado en el rol y los criterios exigibles a los distintos tribunales en un sistema de justicia global.Abstract During the last decades we have seen a growing prominence by the judicial actors in interpretative issues, particularly in those related to indeterminate concepts proper to the international law and, even more particularly, to the fundamental rights. This work proposes that such growing judicial activism cannot be appreciated or justified with the same criteria as other issues so dissimilar like the conflicts between constitutional rights (which allow for a greater judicial construct) or the business and criminal cases (when the adherence to the rules and the legal security is expected to be higher). To justify the foregoing, this work examines the fluctuating criteria drawn upon by the arbitration panels in the International Centre for Settlement of Investment Disputes (ICSID) when assessing the system core criterion providing the access to its jurisdiction: the foreign investments. Based on the foregoing, a series of measures and precautions are indicated, which could be adopted to enhance the legal practices and standards. Finally, this work includes an analysis of the role and the criteria that are to be required to the different courts in a global justice system.
FREEDOM AND PRIVATE WEALTH: A LEGAL STRATEGY AGAINST SLAVERY IN THE
COLOMBIAN INSTITUTIONAL HISTORY (1780-1851)
- Abstract: Resumen La presente propuesta de investigación ha sido motivo de interés durante los últimos dos años de labor investigativa doctoral, cuyo propósito pretende inicialmente abordar la problemática de la historia de los derechos y especialmente de aquellos relacionados con el reconocimiento de la libertad y del acceso a la propiedad en favor de la comunidad de esclavos negros durante un periodo concreto. Dicho interés respecto a la historia se concentra en la importancia que tuvo durante muchos años de la vida institucional de Colombia, tanto antes como después de la Independencia, la institución de la esclavitud y todo lo que se entiende en contexto respecto a la actividad no solo jurídica sino económica y política alrededor de tal institución. En cuanto al método, se realizará un análisis documental, de referencias primarias ubicadas especialmente en dos archivos: La Biblioteca del Colegio de Misiones de Popayán y sus fondos del siglo XVIII y el Catálogo de negros y esclavos del Archivo General de la Nación y la revisión de las fuentes secundarias que han trabajado estas referencias, tanto en Colombia como en otras latitudes. Finalmente se pretende mostrar como principal conclusión la existencia de contradicciones presentes para la institución de la esclavitud en el tiempo propuesto, lo que permitirá continuar en nuevos caminos hacia la identificación de denominadores comunes que adviertan nuevas lecturas desde las tensiones propuestas en el presente documento.Abstract This research proposal encapsulates the interest from the last two years of a doctorate research project. To begin, it aims to deal with the problems in studying the history of the rights and particularly those related to the recognition of freedom and the access to ownership for the enslaved black community during a specific period. Such interest in history focuses on the significance of the slavery as an institution in the Colombian institutional life for many years –before and after the Independence– with all the aspects implied in the context of such an activity, not only legally but also economically and politically. Regarding the research method, this work is firstly intended as a documentary analysis of primary source references located mostly in two archives. First the Library of the ‘Colegio de Misiones de Popayán’ with its records from 18th century and second, the ‘Blacks and Slaves Catalogue’ of the General Archive of the Nation; and secondly, a review of the secondary sources who developed their work based on the primary sources, both in Colombia and abroad. Finally, a major conclusion is drawn that there were some contradictions in the instituting of the slavery during the period stated above. This will enable to break new grounds towards the identification of common threads appearing in the new readings derived from the tensions suggested by this document.
CAPITAL AND TERRITORIAL DEVELOPMENT. INSTITUTIONAL DESIGNS AND
GENTRIFICATION IN THE CASE OF MEDELLÍN, COLOMBIA
- Abstract: Resumen El proceso de globalización ha fracturado los límites impuestos a la circulación de capitales. La planeación y gestión del suelo han sido impactados por este proceso y grandes ciudades han venido adoptando estrategias para capturar capital privado en procesos de desarrollo urbano y prevenir o mitigar los impactos gentrificadores que ello supone. A pesar de la importancia del tema, en Colombia no hay producción académica que permita definir elementos y criterios de atención del fenómeno, ya que esta es una necesidad sentida en la que el derecho juega un papel fundamental. A partir de un rastreo documental se reconstruye un marco teórico sobre la gentrificación, se describen los diseños institucionales para motivar la inversión de capital privado en la gestión del suelo y se analiza la política de protección a moradores en Medellín, Colombia. Finalmente, se identifican los retos que debe asumir el derecho con respecto a la relación entre estos tres aspectos. Se concluye que es necesario desarrollar procesos de investigación interdisciplinaria para identificar la tensión entre el proceso de intervención territorial urbana, la inversión de capitales y el régimen de derechos constitucionales.Abstract The globalization process has fractured the limits imposed to the circulation of capitals. The soil planning and management have been impacted by this process and some big cities have increasingly adopted strategies intended to catch private capitals in the form of urban development processes, thus preventing or mitigating the implied gentrification impacts. Despite the importance of this issue, there is not any scholarly production in Colombia enabling to define the elements and criteria to focus the phenomenon. This is a strong need where the law has a crucial role to play. Starting from a documentary tracking, a theoretical framework is reconstructed for the gentrification, institutional designs are outlined to encourage the private capital investment in the soil management, and the policy of protection to dwellers is studied for the case of Medellín (Colombia). Finally, this work identifies the challenges to be coped with by the law regarding the relationship between these three aspects. A conclusion is drawn on the need to develop interdisciplinary research processes in order to identify the tension between the urban territorial intervention process, the capital investment and the regime of constitutional rights.
MITIGATION OF DAMAGES IN CONTRACTUAL ISSUES
- Abstract: Resumen La reparación integral es un principio consagrado en la legislación colombiana. Existen algunas instituciones jurídicas como el daño directo y la culpa de la víctima, que limitan la aplicación de este principio. Si bien la mitigación de daños está claramente relacionada con dichas instituciones, no es menos cierto que existen razones desde el punto de vista ético, social, jurídico y económico que justifican su existencia como un principio independiente. Esta regla, que en Colombia obedece a un deber secundario de conducta emanado de la buena fe objetiva, implica que el acreedor afectado debe realizar esfuerzos razonables para mitigar la pérdida causada por el incumplimiento. Cuando el acreedor no realiza tales esfuerzos, el deudor puede pedir que se le reduzca el monto de la indemnización. La lógica que subyace a dicha regla es que por medio de ella se intenta disuadir al acreedor a que asuma una actitud pasiva que le permita ver aumentar las pérdidas, sin que se afecte el monto de la indemnización a la que tiene derecho. Para lograr tal propósito, por una parte, la mitigación no le permite al acreedor afectado recuperar los daños que pudo haber evitado, y, por otra, le otorga la posibilidad de recuperar cualquier gasto en que haya incurrido en aras de reducir la pérdida que sufrió.Abstract Comprehensive reparation is a principle established in the Colombian legislation. There are some legal concepts such as direct damages and victim blaming that restricts the application of the said principle. Although the mitigation of damages is clearly related to those concepts, it is no less true that there are reasons –under an ethical, social, legal, and economic viewpoint– justifying its existence as an independent principle. This norm, which stems from a behavioral secondary duty subject to the objective goof faith in Colombia, implies that an affected creditor must make the reasonable efforts to mitigate the loss caused by any non-compliance. If a creditor does not make such efforts, the debtor can request a reduction in the indemnity amount. The logic underlying this norm is to try to dissuade the creditor from taking a passive attitude leading to an increase in the loss, without seeing affected the receivable indemnity. To that end, on one hand, the mitigation does not allow the affected creditor to be paid for damages he/she could have prevented. On the other hand, it provides to opportunity to recover any expenses he/she might incur when trying to reduce the loss.
NULLITY AND EXECUTION OF A DECISION UNDER THE INTERNATIONAL COMMERCIAL
ARBITRATION. DISQUISITIONS ON THE DOUBLE CONTROL, CAUSES OF NULLITY AND
REVISION OF THE CHILEAN JURISPRUDENCE
- Abstract: Resumen En el presente texto abordaremos la eficacia del arbitraje internacional por medio del control de nulidad y ejecución del laudo. Analizaremos las distintas discusiones que se han propiciado en la materia y nos centraremos en la pertinencia del doble control ejercido por tribunales diferentes; el contenido de las causales de nulidad; para finalizar con la revisión de la jurisprudencia que ha dictado los tribunales estatales chilenos sobre el recurso de nulidad y las solicitudes de exequatur, como una forma de contextualizar la discusión en una realidad concreta.Abstract In this text we will address the effectiveness of the international arbitration based on the control of nullity and execution of a decision. We will analyze the different discussions that aroused on this subject-matter; we will focused on how pertinent is the double control by different courts and on the content of the causes of nullity. To conclude, we will conduct a revision of the sentences passed by the Chilean national courts regarding the nullity appeals and the exequatur applications, as a way of contextualize the discussions in the concrete reality.
PROTECTION FOR BUYERS AGAINST MATERIAL DEFECTS OF THE SOLD GOODS. FROM THE
FRAGMENTATION TO A UNIFIED REGIME
- Abstract: Resumen El presente trabajo tiene por objeto presentar el régimen de protección del comprador y evidenciar su fraccionamiento y distintos niveles de protección frente a un conjunto de circunstancias susceptibles de calificarse jurídicamente de incumplimiento de la obligación de entrega. Cualquiera sea la hipótesis, de defecto en la entrega, el vendedor no hizo lo que se había establecido en el contrato, empero la respuesta del legislador decimonónico difiere causando no solo un trato desigual sino también incertidumbre para el comprador. La pregunta que se plantea es: ¿Existe algún modelo que supere tal fraccionamiento y diferente protección del comprador' Y la respuesta es que sí, la Convención de Viena sobre compraventa internacional de mercaderías (CISG), que es el modelo para lo construcción del nuevo derecho de contratos, prevé un sistema unitario de remedios a partir de un concepto amplio y omnicomprensivo de incumplimiento. En la CISG el modelo de vinculación contractual es el de garantía de realización del contrato y el vendedor no incumple obligaciones particulares sino el contrato todo. A partir de este modelo se ofrece una relectura de las normas de los códigos civiles chileno y colombiano, relectura que ha tenido acogida, al menos con cierta intensidad, por los Tribunales de Justicia de Chile y Colombia.Abstract This work aims to introduce the buyer protection regime and make evident the fragmentation and different protection levels in connection with a range of circumstances liable to be legally deemed as a failure of the delivery obligation. Whatever the hypothesis may be for a delivery failure, the seller is not complying with the provisions in the contract. Nevertheless, the 19th-century lawmakers’ answers differ, which not only result in an unequal treatment but also in uncertainty for the buyer. Thus, the question is: Is there any model to overcome such fragmentation and the different protections for buyers' And the answer is ‘Yes’. The Vienna Convention or CISG [the UN Convention on Contracts for the International Sale of Goods], which is the model to build the new contract law, provides a unified system of remedies from a broad and all-encompassing concept of the contract non-compliance. Under the CISG model, the contractual relation is a warranty to execute the contract and so the seller will not breach any particular obligations but the whole contract. Based on this model a re-reading of the regulations in both the Chilean and Colombian civil codes is proposed. This re-reading has been welcomed, to some extent, in the Justice Court both in Chile and Colombia.
