  • El problema de las Indias en la corona de Castilla Una exégesis de la
           Política Indiana, de Juan de Solórzano Pereira

    • Abstract: Resumen: El presente artículo enfoca el estudio exhaustivo de la obra más significativa del más relevante jurista de Indias, Juan de Solórzano Pereira, con el objeto de establecer cuál habría sido la posición del autor respecto de “el problema más importante del derecho indiano” (Zorraquín Becú): el status jurídico-político de las Indias dentro de la monarquía hispánica, concretamente si las Indias pertenecían al reino de Castilla o si, como lo proclamaron los movimientos de 1808-1810 en América, la vinculación de las Indias se daba sólo con la persona del monarca castellano. La obra de Solórzano se estudia en el contexto de sus fuentes doctrinales contemporáneas, y se arriba a la conclusión de que Solórzano sostenía la primera de las mencionadas posiciones. Sin embargo, el estudio concluye analizando una institución jurídica que podría haber dado pábulo a la tesis de una vinculación directa y personal de las Indias con el monarca castellano.Abstract: This article focuses on the study of the most significant work of the most relevant jurist of the Indias, Juan de Solórzano Pereira, in order to establish which would have been the position of the author concerning "the most important problem of the Indian Law" (Zorraquín Becú): i.e., the legal-political status of the Indies as a part of the Spanish monarchy. Namely, whether the Indies belonged to the kingdom of Castile itself or, as the movements of 1808-1810 proclaimed it in America, the Indies were only subject to the person of the Castilian monarch. The issue is addressed in the context of Solórzano's doctrinal contemporary sources. The main conclusion is that Solórzano supported the former view. Nevertheless, this study ends up by analyzing a juridical institution that could have fuelled the thesis of a direct and personnel link between the Indies and the Castilian monarch.
       
  • La responsabilidad patrimonial de los socios en la compañía sevillana
           (siglos XVIII y XIX) *

    • Abstract: Resumen: La responsabilidad de la compañía es un elemento esencial del contrato de sociedad. El presente artículo analiza mediante las cláusulas de las escrituras sociales, la legislación y la doctrina, la forma en la que se desarrolla durante un período histórico de especial importancia, la evolución desde la cultura jurídica del ius mercatorum hacia el régimen liberal y codificador del derecho mercantil. El trabajo demuestra la existencia de acuerdos que limitan la responsabilidad de los socios en las sociedades colectivas en base a la libertad de pactos con carácter previo al primer Código de Comercio. La llegada de la sociedad anónima no supone una profunda transformación en el contrato de sociedad en Sevilla, y tiene una importancia limitada.Abstract: The company's responsibility is an essential element of the partnership contract. Supported by contractual terms, laws, and doctrine, this paper analyzes the way responsibility develops in a historical period, which has a special significance: the evolution from the legal culture of the so called ius mercatorum towards the codifying, liberal regime of Commercial Law. This study demonstrates the existence of agreements limiting the responsibility of the members in general partnerships according to contract freedom before the first Commercial Code. The arrival of the Public Limited Company does not imply a significant transformation in the partnership contract in Seville, but it is of limited importance.
       
  • Juan José O’Connor: alma, mente y nervio del sistema
           penitenciario argentino *

    • Abstract: Resumen: Este trabajo indaga en la figura de Juan José O’Connor, promotor de la sanción de la ley 11.833 de Organización Carcelaria y Régimen de la Pena (que creó el actual sistema penitenciario argentino), primer Director General de Institutos Penales y Juez de Menores, entre otros cargos desempeñados. No obstante la importancia que tiene para el ordenamiento penitenciario argentino, O’Connor no ha sido objeto de atención de la historiografía social y jurídica que estudia la administración del castigo estatal. Así, no contamos con ningún trabajo académico que analice en profundidad la labor de O’Connor en el ramo de prisiones. Por ello, en esta ocasión, indagaremos sobre la reivindicación de O’Connor que realiza la corporación penitenciaria desde su muerte hasta la actualidad; presentaremos un breve esbozo biográfico de aquél y los pormenores de la sanción de la ley 11.833.Abstract: This paper examines the figure of Juan José O'Connor, promoter of the sanction of Law 11.833 of Prison Organization and Penalty Regime (which created the current Argentine penitentiary system), first General Director of Penitentiary Institutes and Juvenile Judge, among other positions held. Despite his importance for the Argentinean prison system, O'Connor has not been the object of attention in the social and legal historiography that studies the administration of state punishment. We do not have any academic work that analyzes in depth O'Connor's work in the field of prisons. Therefore, on this occasion, we will investigate the vindication of O'Connor made by the prison corporation from his death to the present day; we will present also a brief biographical sketch on O'Connor and the details of the sanction of Law 11.833.
       
  • Entre Weimar y Buenos Aires: Ernesto Katz y la recepción de Hugo
           Sinzheimer en el derecho laboral argentino *

    • Abstract: Resumen: La obra de Hugo Sinzheimer, una de las figuras más importantes del derecho laboral alemán y figura clave en la Asamblea que diera origen a la célebre Constitución de Weimar, ha trascendido fuera de Alemania de la mano de sus discípulos, en su mayoría exiliados. Este artículo revisa la biografía y obra de Ernesto Katz, quien estudió y ejerció el derecho durante la República de Weimar y emigró a Argentina a fines del treinta, insertándose rápidamente en la vida profesional y académica laboralista de los años cincuenta y sesenta. La hipótesis de esta investigación sostiene que Katz actuó como traductor de las ideas de Sinzheimer en Argentina, no en el sentido literal, sino a partir de introducir sus ideas y erigirse como un referente del derecho alemán del trabajo en Argentina.Abstract: The work of Hugo Sinzheimer, one of the most important figures of German labor law and key figure in the Assembly that gave rise to the famous Weimar Constitution, has transcended outside Germany thanks to his disciples, most of them exiles. This article reviews the biography and work of Ernesto Katz, who studied law in Frankfurt am Main and worked as a lawyer and judge in Berlin in times of Weimar Republic. Katz arrived in Argentina at the end of the 1930s, and adapted quickly to Argentina. The hypothesis of this research argues that Katz acted as a translator of the ideas of Sinzheimer in Argentina, not through a translation of his work in the literal sense, but from introducing Sinzheimer´s ideas in his own work and establish himself as a reference of German labor law in Argentina.
