  • The Dutch Supreme Court’s Climate Judgment: Its Consequences and
           Implications for Business – Revolution Through Litigation
    • Abstract: The Supreme Court’s ruling in the Urgenda climate case requires that the Netherlands government step up the fight against climate change to reduce CO2 emissions by the end of 2020 by 25% (relative to 1990). Urgent action against ‘dangerous climate change’ was deemed scientifically necessary to safeguard the right to life of Netherlands residents. Upon close analysis, however, this revolutionary judgment appears to be based on uncritical examination of the factual evidence presented by Urgenda, judicial misappropriation of legislative power, expansive interpretations of the applicable law, careless or incomplete reasoning, and intentional omissions. Due to these deficiencies, the court’s ruling will have serious consequences for future policy-making in The Netherlands and the liability exposure of companies in relation to climate change. This article analyses the judgment and discusses its implications.

  • On Modern Threats to Environmental Sustainability in the Arctic: The
           Climate Change Factor
    • Abstract: Given the high pace of acceleration with which climate change is occurring, the unprecedented amount of floods and fires and the extremely high temperatures of the last years, new habitable and exploitable areas are bound to increase as a result of the extremely rapid ice melting in the Arctic. These areas will allow the exploration of natural resources and the use of new navigation routes in shipping. The Arctic region is rich in natural resources, but, at the same time, faces challenges due to its sparse population, limited logistical networks, and fragile environmental conditions; hence, any future sustainable growth and development in it should address the need to build sustainable infrastructure and explore and expropriate the natural resources sustainably, in an effort to achieve transformation towards an inclusive green economy that respects the indigenous peoples and their communities and lifestyle. This article not only synthesizes the existing literature on the topic of the impact of climate change on the Arctic, but also discusses and analyses the ways in which any exploration and exploitation of natural resources and any increased shipping activity in the Arctic should take place, in the light of the impact of climate change. By bringing together different literatures – on the Arctic exploration, legal regulation and Arctic shipping – not usually considered together, it analyses and discusses the multiple social and environmental effects of climate change in the region and its indigenous populations, and, finally, proposes policy options and legislative and other measures so as to best meet the various challenges imposed.

  • Climate Clubs and International Trade Across the European and
           International Landscape
    • Abstract: This article provides a comprehensive examination of the greatest threat humanity faces today: climate change. It does so by looking at the legal, political, institutional, regulatory, and economic angles of climate change from the perspective of major emitters and the most relevant actors in the mitigation of climate change. The article offers a fresh understanding of the international trading system as a way to reach a prosperous, modern, and sustainable society that will help decarbonize the economy effectively. The article offers new ideas on the creation of a climate club linked to the international trade regime as an effective way to mitigate climate change. How should policies, regulations, laws, and agreements change to get us there' What incentives will be necessary to get there effectively' What has failed and why' We conclude that innovation and technology will be among the key elements of this equation, without which we will miss the goal.Volume 29 Online ISSN 0966-1646

  • Climate Change Litigation: Civil Liability for Greenhouse Gas Emissions
    • Abstract: Climate change is a phenomenon whereby the influences of many actors, both natural and anthropomorphic, are producing damage to our environment. This article explores issues of causation that arise when considering claims against polluters, which may in theory result in the payment of damages that could mitigate environmental degradation. The authors examine the legal frameworks for causation in both German and US law, and identify various difficulties in the application of traditional notions of causation to climate damage scenarios. The authors also explore several alternative theories and the role they might play in determining causation vis-a-vis polluters, before concluding that in fact, the only way forward must lie with international/multilateral efforts towards solutions.

  • Climate Change and Decentralized Renewable Energy: The Role of Smart
           Cities
    • Abstract: This article, first and foremost, aims to frame the climate change phenomenon in the international context in order to highlight the impact of public energy policies on global warming. Than the article focuses on analysing the provisions of the Directive 2018/844/ EU and the centrality foreseen in it, of energy efficiency and therefore on capturing the role of local governments in designing cities. The smart cities model, combined with the transition of electricity generation from a centralized model to a distributed one, promotes various virtuous scenarios in terms of pollution’s containment. Therefore, it would be appropriate to provide political support in terms of economic incentives, aimed to encourage the bottom-up thrust, promoting investments aimed to develop smart cities and to create new small energy producers, which represent the natural and physiological framework of the new distributed and decentralized energy model.

  • The Ukrainian Public Administration of Territorial Seas: A European
           Example
    • Abstract: The article evaluates the modern doctrine of territorial sea administration. The article views the administration of coastal state as an application and enforcement of UNCLOS based regimes of maritime zones. The article examines the legal regulation of the territorial sea. It also studies the process of overlapping and interaction between different administrative and legal regulations applicable to a given maritime zone. The features of such regulation are pointed out based upon the combination and mutual influence of international, EU and national law. Ukraine’s experience in administering the territorial sea after the illegal annexation of Crimea is studied. The pros and cons of EU concept of Maritime spatial planning with respect to the demands of protection and security are revealed in the context of hybrid conflicts.

  • Improving Environmental Legislation in Central Asia: Current Trends and
           Features of Cooperation with the European Union
    • Abstract: The article describes the results of a study of environmental problems that intensely limit socioeconomic development in Central Asia. The authors analyse the current environmental problems as follows. The loss of biodiversity and the complexity of the network of protected natural areas. Insufficient level of municipal solid waste processing, energy efficiency problems, in particular, the deterioration of the energy system. There are as well the imbalance between hydropower, irrigated agriculture and the environment, problems of the Aral Sea. The article proposes solution methods, including amendments to the legislation, i.e. the adoption of managerial decisions, as well as strengthening judicial control over compliance with the law. Gaps in the legislative regulation of environmental safety are examined. Along with policies at the national, regional and international levels. As well as future trends in the distribution of global resources that will be effective in protecting the environment, including the activities of The Regional Environmental Centre for Central Asia (hereinafter – CAREC). The article analyses the basic environmental rights of citizens as well as cases and consequences of violation of such rights.

  • Towards Low-Emission Transport: Biofuels’ Tax Incentives and State Aid
           for Climate Change Mitigation
    • Abstract: This article analyses the regulation of biofuels’ tax incentives under three European Union (EU) legal frameworks; the 2003 energy taxation directive (ETD), the renewable energy directives (RED), and State aid law. These frameworks lack a common understanding of biofuels’ sustainability and climate performance. The ETD’s minimum tax rates do not differentiate fuels according to their climate performance and has no relevance for greenhouse gas emission reduction in the transport sector. At the same time, the RED instruct EU Member States to promote biofuels that meet its sustainability criteria. As shown by the case studies in this article, this comes with challenges for Member States’ tax incentives to biofuels in relation to State aid law. In principle, governments may freely structure incentives according to national (climate) policy objectives. Yet, that freedom is restricted by State aid law, and national objectives are typically overlooked when incentives are assessed in State aid procedures.
