Abstract: The evolving landscapeof aerospace technologies, including suborbital flights, reusable rockets, andsatellite constellations, blurs the traditional distinction between airspaceand outer space. This article examines the legal implications of thisconvergence, highlighting the need for a clear and internationally recognizedspatial delimitation. Abstract: This article examinesthe prospects and challenges of competition regimes in the Single African AirTransport Market (SAATM), an initiative of the African Union’s Agenda 2063 fora liberal intra-continental aviation industry. It theorizes the major economicand regulatory concerns related to competition and contextualizes them withinintra-African air transport competition. A principal focus is placed on Annex 5to the Yamoussoukro Decision (YD) relating to Regulations on competition in airtransport services on the continent. The YD is a foundational legal instrumentfor liberalizing intra-African aviation and the primary regulatory instrumentfor SAATM. The article examines the effectiveness of competition regulationunder Annex 5, the role of the Executing Agency (EA) established under it, andthe functions and limitations of sub-regional and national competitionframeworks. The findings show that the continent has made substantial progressin advancing legal and institutional frameworks for competition management butsuffers several challenges, including the implementation and enforcementcapacities of African Civil Aviation Commission (AFCAC) as the EA, the dualrole of Regional Economic Communities’ (REC’s) competition regimes, and thefragmentation and varying level of maturity of national competitionregulations. An urgent need to foster implementation capacity of AFCAC, inaddition to aligning regional and national policy frameworks with Annex 5 isindicated. Abstract: On 18–20 February 2025, the International Air Transport Association (IATA), representing some 340 airlines over 80% of global air traffic, hosted its annual World Legal Symposium (WLS) in Shanghai, China. After a confidential briefing session to its member airlines on 18 February 2025, the WLS convened discussions on the topic of ‘Beyond the Chicago Convention: The New and the Unresolved’ on 19–20 February 2025. The WLS attracted about 330 aviation legal professionals and fifty-two speakers in twelve sessions.
