  • Corporate Governance: The long term impact of the Sarbanes-Oxley Act on
Capital structure and Investment of firms

    • Authors: Khanh Linh Nguyen, Duyen Dai Chu
Abstract: Corporate governance can have influence on the overall performance of a firm. That influence can be positive or negative, dependent on the effectiveness of corporate governance. The existence of agency issues can make corporate governance even more complicated. In the wake of numerous infamous corporate scandals, the Sarbanes-Oxley Act was set out in the US in 2002 in order to improve corporate governance and auditing practice of publicly listed companies. Although there have been studies on the impact of the adoption of the Act on corporate governance, findings are still controversial. Employing a deductive approach and drawing on a sample dataset of 12,822 firms during a period of 31 years, this paper helps to shed more light on the long term impact of the Sarbanes-Oxley Act on corporate governance. We take capital structure and investment as the two measures of corporate governance. Our findings show that the adoption of the Act helps to reduce over-leverage and over-investment in the financing and investment decision making of firms. Our findings also reveal that firms tend to follow a target leverage level, which is consistent with the trade-off theory. We also examine the possibility of under-leverage and under-investment of firms.

  • Reconciliation Between Economic Development and Sustainability: A Case
           Study in Vietnam

    • Authors: Van Thi Ai Tran, Ian Barnes, Duyen Dai Chu
Abstract: Sustainability has increasingly become an essential factor in economic development. Environmental pollution, climate change and natural resource exhaustion are currently serous challenges to sustainability development as well as human life. However, the reluctance of firms to respond to these issues is not uncommon. Reconciliation between economic development and sustainability is still a challenge for not only firms but also most countries worldwide, particularly developing countries. In this research, we employ a qualitative approach, using single case study method to examine the issue in the context of a developing country, Vietnam. Our findings show that the environmental disaster by the Formosa Ha Tinh Steel Corporation causes severely negative effects on the environment, economics and social life of local communities. The research also finds that corruptions and corporate unethical behaviours are among key hurdles to sustainability development in Vietnam. This study contributes to the existing literature on sustainability development by providing qualitative empirical evidence on the issue of reconciliation between economic development and sustainability in the context of a developing country. The study also identifies key hurdles to maintain a balance between economic development and environmental sustainability in a developing economy and recommends some possible solutions.

  • Equity crowdfunding: Success factors in the German context

    • Authors: Cem Kose, Hao Manh Quach, Duyen Dai Chu
Abstract: The emergence of equity crowdfunding has provided ventures at early stages of development with an important alternative source of finance over the past decade. However, it is still relatively understudied and many equity crowdfunding campaigns are still unsuccessful. This paper make contributions into research on success factors in equity crowdfunding. Drawing on a sample dataset of 93 campaigns collected from the two biggest equity platforms in Germany, our findings provide evidence that success factors from traditional entrepreneurial finance can be relevant in predicting success in equity crowdfunding context. Our findings also show that numerous campaign characteristics and the use of social media networks can be success drivers in equity crowdfunding. Our findings are supported by rigorous diagnostic tests.

  • Book Review: Mark S. Reed, The Productive Researcher (Huntly: Fast Track
           Impact 2017) RRP £17.99

    • Authors: Holly Rebecca Parker
Abstract: This article is a book review of Mark S. Reed’s 2017 publication, The Productive Researcher. The text helps current PhD students and early years researchers understand their priorities in order to gain a better work-life balance. The most important message of this book lies in Reed’s assertion that being more productive does not necessarily mean producing more work, but rather ‘opens up the choice to produce more; or to produce no more’ (The Productive Researcher, p45). Reed’s support of a better work-life balance in academia is refreshing, and suggests that the power to be successful does not necessarily lie in burning oneself out, but by reminding one to set clear goals and boundaries. Overall, this book is an insightful read that I would recommend to academics at all stages of their career.

  • Understanding Chinese Philosophy from Three Simple Words

    • Authors: Rujia (Annie) Xu
Abstract: As one of the leading research objects in my PhD research Art and Text Collisions in Contemporary Chinese Art, the term Contemporary Chinese Text Art combines Western Contemporary Text Art and Chinese written language. This research covers a wide range of academic fields in both China and the West, such as philosophy, philology, art, linguistics, calligraphy and literature. It also relates China’s historical and political context. With the purpose of introducing a new understanding of the term, several research methodologies and strategies are employed, such as curating, philosophical reflection, comparative analysis, translation and interview. Through my research, I realised that the key to understanding Chinese Text Art is Fu Xi Ba Gua, which is believed as the origin of the Chinese characters and the Chinese civilization. From this perspective, my research analyses the philosophical basis of Chinese characters and clarifies some confusion in Chinese art and philosophy. Furthermore, through a series of art practices, my research explores unique phenomena and textuality of contemporary Chinese text art, as well as innovative art practices including VR text art. This paper is an extended version of my same titled presentation of my 2018 Postgraduate Research Showcase Conference. By introducing the implications of three simple Chinese words, the paper introduces essential traditional Chinese philosophical concepts, such as Tai Ji, Yin Yang and Ba Gua, which are the foundation of the whole Chinese civilisation. Through further comparison with Contemporary art philosophy, the paper suggests a new interpretation which sees the temporal-spatial nature of Contemporary as a historical-universal unity which has infinite dynamic-static changes in one spacetime.

  • Third World Approaches to International Law: The Responsibility to Protect
           and Regional Organisations

    • Authors: Amber Amelia Smith
Abstract: The Responsibility to Protect is administered through the United Nations Security Council, which is often criticised for being ineffective, too selective and for using its power to veto to the detriment of States in mass atrocity. Third World States within the international arena are often at the mercy of the Security Council and are excluded from decision making processes which may impact them. This research proposes that the Responsibility to Protect should be administered by regional organisations rather than the Security Council, owing to the comparative advantages regional organisations have to offer. For example, regional organisations who have proximity to conflict are likely to understand the culture and history of States and possess in-depth local knowledge. Neighbouring States within the region also have more at risk, such as bearing the burden of unwanted armed groups in their territory, disproportionate numbers of refugees and the impact conflict can have on the economy. Regional organisations are also best suited for addressing the structural and root causes of conflict. It will be argued that regional organisations could legally intervene within the parameters of their own region through ex post facto application of Article 53 of the Charter of the United Nations.A Third World Approach to International Law (TWAIL) will be applied throughout this research. TWAIL operates on a philosophy of suspicion which enables it to adopt a critical stance on International Law by pushing boundaries to expose injustice. TWAIL will be particularly useful in considering the Responsibility to Protect as it will assist in identifying any colonial origins, rhetoric and imperialism that is in both policy and law in this area. Doctrinal legal analysis is the method which will be applied as it will centre its focus on a comprehensive overview of the key literature in this area. A qualitative method is also used as the research involves analytical interpretation and analysis and uses TWAIL’s theoretical framework to provide legal reasoning.

It is likely that this research shall conclude that if we do not fix a system that is broken, then the international community is failing and will continue to fail in its responsibility to protect. The way to fix this is through restricting the Security Council’s ability to exercise imperialism and to identify the colonialist structures surrounding the Responsibility to Protect. Therefore, regional organisations may offer a solution with their comparative advantages, lack of veto power and through including the voices of less developed States in the decision-making processes surrounding intervention.

  • Improving flood risk assessment in the Trent, Witham and Yorkshire Ouse
rivers using documentary and floodplain sedimentary archives

    • Authors: Josephine A Westlake
Abstract: Interest in predicting UK flood events continues to grow following an increase in both the frequency and magnitude of recorded floods over the last 20 years.  (Foulds and Macklin, ). However current methods for analysing flood risk are based on statistical extrapolation of gauged flow records that are rarely longer than 50 years on average (Jones et al., 2010). It is also well known from historical sources (McEwen, 1987; Longfield and Macklin, 1999; Macdonald and Black, 2010; Macdonald and Sangster, 2017) and floodplain sedimentary records (Macklin et al., 1992; Macklin and Rumsby, 2007; Jones et al., 2012) that much larger floods have occurred before modern flow records began in the 20th century. This study aims to address these problems by reconstructing multi-centennial length flood histories and undertaking long term flood frequency analysis (FFA) on three UK river systems: the Witham, Trent and Yorkshire Ouse. It will extend the flood series record by incorporating historical and palaeoflood (floodplain sedimentary archives) data into a single flood series and assess non-stationarity arising from climate and land-use change (Naylor et al., 2017) and modification of channel capacity (Slater, 2016).

  • Meteotsunami: The AD 1607 Bristol Channel Flood

    • Authors: Josephine A Westlake
Abstract: The cause of the 1607 Bristol Channel coastal flooding, despite it resulting in over 2,000 fatalities, remains controversial, with both storm surge and tsunami (wave) mechanisms proposed. Contemporary written accounts were examined critically in the context of a possible meteorological (weather) rather than geological (submarine landslide or earthquake) tsunami trigger. Evidence supporting both theories; storm surge and tsunami, is based primarily on historical accounts, however strong limitations have been found in the sourcing and interpretation of these documents. A geological tsunami is considered unlikely due to the lack of a realistic trigger mechanism while coastal topography (landscape) and climatology were found to be supportive of a meteotsunami (atmospheric pressure) source. Flooding from this mechanism is therefore proposed as a possible alternative to the surge and, if correct, demonstrates the potential for a similar mechanism to cause future dangerous flood events, both in the South West and around the British Isles.
