  • Identifying the Stateless in Statelessness Determination Procedures and
           Immigration Detention in the United Kingdom

      Abstract: Stateless persons, not recognized as citizens of any State, have restricted access to identification and travel documents. As they often also do not enjoy the right to enter, leave, or remain in any country, stateless persons can be at great risk of prolonged and arbitrary immigration detention. It is therefore crucial to identify stateless persons in or facing detention. Adopting an access to justice lens, this article explores aspects and legal challenges of the statelessness determination–immigration detention nexus in the United Kingdom. Despite the adoption of a national statelessness determination procedure, stateless persons still experience a plethora of problems. This is especially so for applicants who are in immigration detention. Statelessness is generally not acknowledged due to gaps in the legal framework and a number of interrelated objective, subjective, and physical barriers that prevent tackling the problem of statelessness and concomitant restriction-of-liberty problems. This situation sits uneasily with access to justice principles, which require the guarantee of an effective remedy and a fair solution to the legal problems of every individual. As such, the article ultimately shows that lack of access requires a holistic approach, whereby the special problems and needs of the users must always be taken into consideration.

  • The Life-or-Death Cost of Being Stateless in a Global Pandemic

      Abstract: For the approximately 15 million stateless people worldwide – who already endure discrimination and denial of basic rights and services – the harm caused by statelessness during the pandemic has risen to an unprecedented level.11 Being stateless is akin to having a pre-existing medical condition, in the sense that stateless people already face many challenges that are now compounded by the pandemic. The stateless are used to being invisible, excluded, and marginalized, and this invisibility both catalyses and reinforces structural discrimination and unequal treatment.22 As the United Nations High Commissioner for Refugees, Filippo Grandi, has observed, ‘the right to a nationality is a fundamental human right, and in this time of crisis it can mean the difference between life or death’.33

      Abstract: As Paul White has written,11 success in our COVID-19 response in humanitarian settings should not be measured in the ‘number of webinars, seminars, guidance and strategies’. Part of achieving success, though, is ensuring that humanitarian actors in the field are aware of key laws, so as to ensure that governments fulfil their obligations and displaced persons do not fail to obtain their rights. While this pandemic raises new challenges, there are well-established bodies of law to keep at the front and centre of responses, including international human rights law, international refugee law, and international humanitarian law.

  • The Right to Leave Any Country and the Interplay between Jurisdiction and
           Proportionality in Human Rights Law

      Abstract: This article shows the importance in human rights law of the right to leave any country, in light of increasing efforts by European countries of destination to prevent departures and to contain movement by enlisting countries of origin and transit to act as gatekeepers. The article highlights the autonomous nature of the right and challenges in triggering its application. It assesses whether this right is opposable to destination countries, and finds two key challenges – first, meeting the requisite jurisdictional threshold, and secondly, as this is a qualified right, applying the proportionality test. The article examines the interplay between these difficulties. It argues that the jurisdictional threshold expresses a political and legal relationship between the duty bearer (the State) and the right holders (the individuals). This relationship enables us to operationalize the proportionality test – namely whether measures limiting rights are in accordance with the law and are proportionate.

  • South America’s Response to the Venezuelan Exodus: A Spirit of
           Regional Cooperation'

      Abstract: Based on the premise that massive influxes of Venezuelans might overwhelm their asylum systems, South American host States have resorted to ‘Temporary Protection or Stay Arrangements’ (TPSAs) as an uncoordinated but pragmatic response in times of regional hardship. As the Venezuelan situation deteriorated, however, a May 2019 United Nations High Commissioner for Refugees (UNHCR) Guidance Note encouraged host States to apply their extended refugee definitions in tandem with prima facie refugee status determination (PFRSD), an expedited procedure that can prevent the overburdening of asylum capacities. Despite the availability of a more favourable approach, host States have continued to rely on TPSAs, raising questions about whether they truly intend to adopt a regionally coordinated plan, as agreed in the Quito Process. Drawing primarily on domestic refugee legislation and UNHCR’s ‘Guidelines on International Protection No 11’, the article argues that host States’ motivation to provide temporary protection is not so much related to the potential overburdening of their asylum systems but rather to the long-term commitments that would come with the granting of refugee status. It is shown that PFRSD is already regulated in the national laws of four South American States, with the potential of turning into a regional centralized response, but its application remains largely ignored. The article ultimately serves as a reminder for South American governments that displaced Venezuelans do not need temporary humanitarian visas as they are, first and foremost, entitled to legal protection under domestic refugee law.
