  • THE INTERNATIONAL PROTECTION OF INTERNALLYDISPLACED PERSONS

    • Abstract: Résumé Le présent article a comme but de donner une analyse du régime de protection internationale des personnes déplacées à l’intérieur de leur propre pays. Si bien ces personnes ne relèvent que du pays duquel elles sont nationales, des instruments internationaux ont été élaborés pour traiter leur situation. Cette étude analytique se subdivise en deux grandes parties. Dans une première partie, on trouve des instruments internationaux qui malgré leur force non-contraignant ont acquis un statut spécial, comme c’est le cas des Principes directeurs relatifs aux personnes déplacées à l’intérieur de leur propre pays. D’autre part, au niveau tant régional comme national des instruments contraignants ont été créés pour traiter ladite question, en ce regard une analyse des apports donnés par le continent africain, au niveau régional, et par la Colombie au niveau national est fournie.Resumen El presente artículo tiene como objetivo proponer un análisis del régimen de protección internacional de las personas desplazadas internamente. Aunque estas personas son, en principio, únicamente responsabilidad del país del cual son nacionales, algunos instrumentos internacionales han sido creados para tratar su situación. El presente estudio analítico se divide en dos grandes partes. En un primer momento, encontramos instrumentos internacionales que, a pesar de no ser vinculantes para los Estados, han adquirido una importancia especial; tal es el caso de los Principios rectores del derecho internacional sobre el desplazamiento forzado. De otra parte, tanto en el ámbito regional como en el nacional se han desarrollado instrumentos vinculantes sobre el desplazamiento. Aquí, se presenta un análisis de los aportes en la materia hechos por el continente africano, en el plano regional y por Colombia en el nacional. The objective of this article is to provide an analysis of the international norms applicable to internally displaced persons. Even though, internally displaced persons are responsibility of the country ofwhich they are nationals, international instruments have been created to address their situation. This analytic study is divided into two parts. The first part addresses the international instruments of soft law for the protection of these persons, it focus particularly in Guiding Principles on Internal Displacement. The secondpart concentrates in the hard law that has been adopted by the African continent in a regional level, and by domestic legislation in the Colombian case.
       
  • CRITICAL TO THE THOUGHT OF KAREL VASAK AND NORBERTO BOBBIO ON THE
           DEVELOPMENT OF HUMAN RIGHTS IN CONNECTION WITH INTERNATIONAL TREATIES AND
           CONVENTIONS

    • Abstract: Resumo O trabalho intitulado A era dos direitos, de autoria de Norberto Bobbio, consiste em uma das principais fontes que afirmam um primeiro momento de proteção no histórico do constitucionalismo que, na linha do pensamento de Karel Vasak, determinou o surgimento dos denominados direitos civis e políticos como prerrogativas de primeira geração ou dimensão. Porém, do ponto de vista de Tratados e Convenções Internacionais, as primeiras proteções não ocorreram com direitos civis e políticos como propôs o pensamento de Vasak e Bobbio, mas sim com os direitos sociais protegidos com a Convenção da OIT (Organização Internacional do Trabalho) de 1919. Assim, os desvios do pensamento das gerações e dimensões de direitos em detrimento as primeiras formalizações em Tratados e Convenções Internacionais acabam pontuando problemas que afirmam que o surgimento de direitos humanos não depende do momento em que foram juridicamente protegidos. O trabalho conclui que o surgimento de direitos consiste em processo multifatorial, reduzindo o critério positivista que atenta ao momento histórico de proteção jurídica de direitos como tão somente um dentre os vários fatores que devem influenciar o surgimento desses direitos. Em resumo, direitos surgem de inúmeros fatores, dentre os quais, de natureza antropológica, histórica, sociológicas, tecnológicas e outras; colocando o momento de proteção e formalização jurídicas de direitos, não como fator determinante, mas sim como uma das várias influências a serem consideradas no processo de surgimento e determinação de prerrogativas fundamentais.Resumen El trabajo titulado La era de los derechos, escrito por Norberto Bobbio, es una de las principales fuentes que afirman uno primero tiempo de la protección en la historia del constitucionalismo que, en la línea del pensamiento de Karel Vasak, determina la aparición de los llamados derechos civiles y políticos como de primera generación o dimensión derechos. Sin embargo, desde el punto de vista de los tratados y convenciones internacionales, las primeras protecciones no se produjo con los derechos civiles y políticos como propuso la idea de Vasak y Bobbio, pero con los derechos sociales protegidos por la Convención de la OIT (Organización Internacional del Trabajo) 1919. Por lo tanto, las desviaciones de la idea de "generaciones” y "dimensiones” de los derechos sobre la primera formalización de los tratados y convenciones internacionales problemas de puntuaciónfinal que afirman que la aparición de los derechos humanos no depende de la época estaban protegidos legalmente. El documento concluye que la aparición de los derechos es un proceso multifactorial, reduciendo el criterio positivista que se parece al momento histórico de la protección legal de los derechos, como sólo uno de varios factores que deben influir en la aparición de estos derechos. En resumen, surgen los derechos de muchos factores, entre los cuales, antropológicos, históricos, sociológicos, tecnológicos y otros; comprendiendo el tiempo para la protección y la formalización de los derechos legales, no como un factor determinante, sino más bien una de las muchas influencias a considerar en el proceso de surgimiento y la determinación de las prerrogativas fundamentales. The work entitled The Age of Rights, by Norberto Bobbio, is one of the main sources that affirm a first moment of protection in the historical of the constitutionalism that, in the line ofthe thought of Karel Vasak, determined the emergence of denominated civil and political rights as prerogatives of first generation or size. However, from the point of view of International Treaties and Conventions, the first protections did not occur with civil and political rights as proposed by Vasak and Bobbio, but rather by the social rights protected by the ILO (International Labor Organization) Convention 1919. Thus, deviations from the thinking of generations and dimensions of rights to the detriment of the first formalizations in International Treaties and Conventions end up punctuating problems that affirm that the emergence of human rights does not depend on the momen t in which they were legally protected. The work concludes that the emergence of rights consists of a multifactorial process, reducing the positivist criterion that attentive to the historical moment of legal protection of rights as only one of several factors that must influence the emergence of these rights. In short, rights arise from innumerable factors, including anthropological, historical, sociological, technological, and other factors; Placing the moment of legal protection and formalization of rights, not as a determining factor, but as one of the several influences to be considered in the process of emergence and determination off undamental prerogatives.
       
  • CASES AT ICSID AND THE HUMAN RIGHT TO WATER: INVESTMENT TREATIES VS. HUMAN
           RIGHTS'

    • Abstract: Resumen Argentina es el país más demandado ante el Centro Internacional de Arreglo de Diferencias sobre Inversiones (CIADI) y uno de los que más Tratados Bilaterales de Inversión (TBI) ha firmado (58 en total, 55 vigentes). La mayoría de esas demandas fueron presentadas por empresas transnacionales (ETN) por la crisis de 2001-2002 y se refirieron a sectores económicos relacionados con recursos naturales. El 20% de esas demandas se vincula con el sector de agua potable y saneamiento1, lo que también convierte a Argentina en el país más demandado en el CIADI por este sector. Son casos de alta conflictividad social y en los que se evidencia el rol del Estado como regulador frente al reclamo por parte de las ETN de protección de la propiedad privada, en los que resalta una asimetría jurídica que favorece la protección de las inversiones sobre el resguardo de los derechos humanos, en particular del derecho humano al agua reconocido por la Organización de Naciones Unidas, ONU, en 2010. Tomando el caso argentino como testigo, esta ponencia expondrá esa asimetría que contraviene las bases más elementales del derecho internacional, para evidenciar la necesidad de revisar el régimen internacional de protección de inversiones y su adecuación a los derechos humanos como obligaciones erga omnes. Argentina is the most sued country in the International Centre for Settlement of Investment Disputes (ICSID) and one of the most Bilateral Investment Treaties (BITs) signed (58 in total, 55 into force). Most of these lawsuits were filed by transnational corporations (TNCs) by the 2001-2002 crisis and linked to economic sectors related to natural resources. 20% of these claims are related to the drinking water and sanitation, which also makes Argentina in the country that has received claims in ICSID this sector. These are cases of social conflict and where the role of the state is evident as a regulator against the claim of protection of private property by TNCs, which highlights a legal asymmetry that favors the protection of investments on the protection of rights humans, particularly the human right to water recognized by the UN in 2010. Taking the Argentine case as a witness, this paper will present an asymmetry that violates the most basic foundations of international law, highlighting the need to revise the international investment protection regime and its relevance to the human rights obligations erga omnes.
       
  • ENVIRONMENTAL PROTECTION FROM FINANCIAL SUPPORTMECHANISMS FOR THE
           GENERATION OF GREEN ENERGY, AND EUROPEAN UNIONLAW, THE ÁLANDS VINDKRAFT
           CASE

    • Abstract: Resumen La protección del medio ambiente y la consolidación del desarrollo sostenible en el mercado son simultáneamente realizables y constituyen parte de la cimentación del derecho europeo. Este derecho resalta su viabilidad, en el ámbito de los mecanismos financieros de apoyo a la producción de energía renovable como acciones frente al cambio climático. La armonía de estos mecanismos, previstos, por ejemplo, en la Directiva 2009/28/CE y su adopción por los Estados miembro de la Unión Europea con la libre circulación de mercancías, es analizada por el Tribunal de Justicia en el asunto Álands Vindkraft AB contra Energimyndigheten (C-573/12). El Tribunal resalta en este caso, el cómo la compatibilidad del clima, la producción de energía verde y el desarrollo del mercado son una necesidad. En este ámbito, la Comisión Europea plantea al Parlamento y al Consejo, un marco de trabajo y un paquete de medidas, que conjuntamente desde sus funciones, concretarán en concordancia con los postulados del derecho europeo. The protection ofthe environment and the consolidation of sustainable development in the market are simultaneously achievable, and constitute part of the foundation of European law. This law highlights their viability, in the area of financial mechanisms that support the production of renewable energy in an effort to address climate change. The harmony of these mechanisms, provided, for example, in Directive2009I28IEC and its adoption by the Member States of the European Union with the free movement of goods, is analyzed by the Court of Justice in the case of Alands Vindkraft AB v. Energimyndigheten (C-573I12). In this case, the Court highlighted how compatibility among the climate, green energy production and the development of the market is a necessity. In this area, the European Commission has proposed to the Parliament and the Council a framework and package of measures, which they will implement together, based on their functions, in accordance with the provisions of European law.
       
  • THE NEED FOR COOPERATION IN THE PROTECTION OF INTERNALLY DISPLACED PEOPLE
           PERSECUTED BY THE ISLAMIC STATE IN IRAQ 2014-2016

    • Abstract: Resumo Este artigo aborda o aumento dos deslocados internos no Iraque após o surgimento do grupo terrorista Estado Islâmico e a necessidade de cooperação regional e internacional na proteção desses indivíduos. É discutido o conceito de deslocado interno segundo as convenções internacionais e exposta a relação entre o aumento do número de indivíduos nessa situação no Iraque e o surgimento do grupo, em 2014. Além disso, são sugeridas algumas medidas de solução para a problemática. Como referencial teórico, faz-se uso da teoria da cooperação por interesse, proposta por Robert Axelrod e Robert O. Keohane e do conceito de cross-issue-persuasion, formulado por Alexander Betts. Por fim, é sugerida a criação de uma zona de safe haven no Norte do Iraque, a fim de proteger as minorias religiosas forçadas a se deslocarem em virtude das ações do Estado Islâmico. This article addresses the increase in internally displaced persons in Iraq after the emergence of the Islamic State and the need for regional and international cooperation in the protection of these individuals. The article discusses the concept of internal displacement as the international conventions and examines the relationship between the increase of the number of individuals in this situation in Iraq and the emergence of the group in 2014. Besides this, it also recommends some resolutions to the problematic. Regarding International Relations to analyze the problematic in question, the cooperation by interest theory, proposed by Robert Axelrod and Robert O. Keohane is used, as well the concept of cross-issue-persuasion, formulated by Alexander Betts. Finally, the article recommends the creation of a safe haven zone in northern Iraq to protect religious minorities forced to move because of the actions of the Islamic State.Resumen Este artículo aborda el aumento de los desplazados internos en Irak tras el surgimiento del grupo terrorista Estado Islámico y la necesidad de cooperación regional e internacional en la protección de esos individuos. Se discute el concepto de desplazamiento interno según las convenciones internacionales y expone la relación entre el aumento del número de individuos en esa situación en Irak y el surgimiento del grupo en 2014. Además, se sugieren algunas medidas de solución a la problemática. Como referencial teórico, se hace uso de la teoría de la cooperación por interés, propuesta por Robert Axelrod y Robert O. Keohane y del concepto de cross-issue-persuasion, formulado por Alexander Betts. Por último, se sugiere la creación de una zona de safe haven en el norte de Iraq, con el fin de proteger a las minorías religiosas forzadas a desplazarse en virtud de las acciones del Estado Islámico.
       
  • THE POSITIVISM OF KELSEN AND HART IN CONTEMPORARY INTERNATIONAL LAW: A
           CRITICAL PERSPECTIVE

    • Abstract: Resumen El presente artículo de investigación busca analizar los principales aspectos de las teorías del derecho internacional de Hans Kelsen y Herbert Hart desde una perspectiva crítica. Para lograr este objetivo, se realiza una investigación documental basada en un análisis de contenido de la obra directa de los autores, de otros autores que revalúan esta obra y de exponentes de la teoría crítica del derecho internacional y de las relaciones internacionales. Para el análisis propuesto, se escinden los planos epistemológico y normativo de las teorías citadas, lo que arroja como conclusión que hay una mayor sintonía entre las teorías positivistas y las críticas en lo que respecta al plano normativo mientras que en el epistemológico hay una fuerte discrepancia, en particular con el positivismo metodológico de Kelsen. The present research article seeks to analyze the main aspects of Hans Kelsen and Herbert Hart’s theories of international law from a critical perspective. To achieve this objective, a con ten t analysis is carried out based on the documental research of the direct work of the authors, other authors who revalue this work and exponents of the critical theory of international law and international relations. For the proposed analysis, the epistemological and normative planes of the aforementioned theories are separated, which concludes that there is a greater harmony between the positivist and critical theories as far as the normative plane is concerned, while in the epistemological there is a strong discrepancy, particularly with Kelsen’s methodological positivism.
