  • Il certificato COVID digitale nel contesto del federalismo europeo, tra
tutela della privacy e libertà di circolazione, e il suo impiego
           nell’ordinamento italiano

      Abstract: Arianna Carminati, Matteo Frau
The article describes the decision-making process that led to the introduction of a uniform, European-wide framework for digital COVID certificates. It proposes a comparison with the different situation in the US federal system and addresses some of the constitutional issues related to the use of the so-called green pass, both with regard to the protection of privacy and with regard to the use of this instrument by Member States.

  • Cambiamenti climatici e diritto dell’Unione europea

    • Free pre-print version: Loading...

      Abstract: Mariaida Cristarella Oristano
This contribution aims to examine EU policies and law on climate change, in order to understand the role the Union plays in the fight against this phenomenon and the relationship between the actions to combat it, the provisions set to protect fundamental rights and the achievement of the sustainable development goals set out in the 2030 Agenda. To this end, the analysis addresses the issue of the existence of an internal and external EU competence in this area, and it focuses on the role of the European institutions in defining climate policy and relevant legislation, in particular with regard to the European Green Deal, as well as with regard to international negotiations in which the EU participated, most recently Cop-26. Finally, in the light of recent ECJ case law, particular attention is paid to the problematic aspects inherent to access to climate justice in the EU.

  • Parabole evolutive e problematiche attuali del regionalismo, fra riforme
attuate, inattuate (federalismo fiscale, Carta delle autonomie)
           e aleggiate (regionalismo differenziato) .. a vent’anni dalla riforma
           del Titolo V della Costituzione

      Abstract: Silvio Gambino
After some hints, also of a methodological nature, on the evolutionary problems of regionalism in the first post-war republican period, the article analyzes some of the problems of the distribution of powers in the light of the twenty years following the constitutional reforms of Title V. This analysis will also be made in a comparative perspective with the homologous forms of territorial decentralization of the powers that can be observed in the European states with a regional and federal form. In conclusion, the paper will question the new relationships created between regional political autonomy, the impact of the economic crisis, European integration, and issues of the effectiveness of rights, above all (social but not only).

  • Información, desinformación y pandemia. Un análisis contextual de la
Orden de 30 de Octubre de 2020 por la que publica el procedimiento de
actuación contra la desinformación aprobado por el Consejo de Seguridad
           Nacional de España

      Abstract: Enrique Guillén López
This article tries to analyze the Order of October 30, 2020 approved by the National Security Council of Spain in order to establish a procedure to fight against disinformation. In this sense, a constitutional methodology is used to consider the changes that the internet and, especially, social networks, have caused in the communication paradigm, taking the infodemic caused by COVID-19 as the closest reference. This is the context that explains the October Order, which can be understood as an affirmative answer to the question of constitutional roots about whether the public powers have to react in matters of disinformation. However, many doubts remain about the concret measures of the intervention.

  • El Estado de Derecho y el mercado de la verdad

    • Free pre-print version: Loading...

      Abstract: Ricardo Martín Morales
Deliberative democratic processes are threatened by the intentional large-scale misinformation that is spread through the internet and the social networks, which have significantly increased the risk of the electoral manipulation of public opinion. Any good specialist can manage at present the emotions of millions of people to place them at the service of their own interests. Member states of the European Union are organised and collaborate in order to fight against this type of misinformation. This paper analyses how far law can and must react to fake news, evaluating the scope, the nature, the content and protected legal asset of "the right not to be deceived".
