The margin of appreciation in international human right to life:
Restriction of personal rights and response of the Strasbourg Court
- Abstract: Resumen: El derecho humano a la vida plantea serias dificultades. El conflicto entre el derecho a la vida, el derecho a la vida privada y la protección de la propia vida, no obtiene una clara respuesta de los tribunales de derechos. Resulta imprescindible un ejercicio de ponderación que justifique la proporcionalidad de la restricción de derechos del individuo, por parte de algunos Estados. El Tribunal de Estrasburgo, garante de los derechos en Europa, ante la complejidad de dar una respuesta unánime en un marco de diversidad y de falta de consenso, recurre al libre margen de apreciación nacional. Esta doctrina permite al Tribunal Europeo ofrecer una respuesta abierta que se acomode a las distintas realidades jurídicas en Europa, aunque marca ciertos límites infranqueables que salvaguardan el contenido esencial de los derechos humanos, frenando una restricción jurídica ´pro-vida´ desproporcionada. Sin embargo, juega con la ambigüedad compaginando la priorización de los ´valores morales profundos´ por encima del consenso europeo, con una reciente priorización del derecho de la mujer a interrumpir su embarazo conforme a la ley nacional sobre la objeción de conciencia de los sanitarios, lo que podría aventurar una tendencia pro-libertad (pro-aborto y, por extensión, pro-eutanasia) en su jurisprudencia.Abstract: The human right to life poses serious difficulties. The conflict between the right to life, the right to privacy and the protection of life itself, does not obtain a clear answer from the courts of rights. A balancing exercise that justifies the proportionality of the restriction of the individual's rights by some States is essential. The Strasbourg Court, guarantor of rights in Europe, faced with the complexity of giving a unanimous answer in a framework of diversity and lack of consensus, resorts to the free margin of national appreciation. This doctrine allows the European Court to offer an open response that accommodates the different legal realities in Europe, although it marks certain insurmountable limits that safeguard the essential content of human rights, restraining a disproportionate ´pro-life´ legal restriction. However, it plays on ambiguity by combining the prioritization of ´deep moral values´ over the European consensus, with a recent prioritization of the right of women to terminate their pregnancy in accordance with national law on conscientious objection by health workers, which could risk a pro-freedom tendency (pro-abortion and, by extension, pro-euthanasia) in its jurisprudence.

as a consequence of covi-19: A reflection on its opportunity
- Abstract: Resumen: En el presente trabajo se analiza las medidas adoptadas en España a raíz del estado de alarma por la COVID-19 y el derecho a la vida y la protección de la salud con una reflexión sobre la oportunidad de las mismas. Se parte de la regulación establecida en el cuerpo normativo, así como la postura de la doctrina más reciente para analizar las restricciones que se han establecido a determinados derechos y las medidas que se han adoptado para limitar las actividades de la vida habitual, con la finalidad de proteger la salud de las personas en la situación de crisis sanitaria. Se atenderá en el estudio, especialmente, a diversas situaciones como es el caso de los colectivos vulnerables, y los ciudadanos, con la finalidad de determinar la relación entre la protección de la salud y el derecho a la vida, así como si ello ha constituido o no una suspensión de sus derechos constitucionales.Abstract: This paper analyzes the measures adopted in Spain as a result of the state of alarm by COVID-19 and the right to life and health protection with a reflection on their timeliness. It starts from the regulation established in the regulatory body, as well as the most recent doctrine position to analyze the restrictions that have been established to certain rights and the measures that have been adopted to limit the activities of normal life, in order to protect the health of people in the situation of health crisis. The study will attend, especially, to various situations such as the case of vulnerable groups, and citizens, in order to determine the relationship between health protection and the right to life, as well as whether this has constituted or not a suspension of your constitutional rights.
The right to the protection of personal data and the recognition of
informational self-determination in the Chilean Constitution
- Abstract: Resumen: El texto examina el reconocimiento del derecho a la protección de datos personales como un derecho fundamental en la Constitución chilena. Para ello revisa la historia legislativa de la reforma constitucional y los principales debates que se produjeron. En particular, se revisan tres dilemas: primero, la necesidad de constitucionalizar o no la autodeterminación informativa como derecho fundamental; segundo, la densidad normativa requerida para constitucionalizar el derecho; y la relación de titularidad o propiedad sobre los datos personales. El texto concluye anticipando dos desafíos para la regulación del derecho: primero, relativo al tipo de remisión o reserva al legislador del mandato de protección de datos personales y, segundo, a la garantía de la autodeterminación informativa y, en particular, a la protección del derecho a través del recurso de protección, a través del habeas data y a través de una agencia especializada como autoridad de control.Abstract: The paper examines the recognition of the right to the protection of personal data as a fundamental right in the Chilean Constitution. To this end, it reviews the legislative history of the constitutional amendment and the main debates that took place. In particular, three dilemmas are reviewed: first, the need to constitutionalize or not informational self-determination as a fundamental right; second, the normative density required to constitutionalize the right; and, third, the legal relationship of entitlement or ownership over personal data. The text concludes by anticipating two challenges for the legal regulation of the right: first, regarding the type of constitutional referral to the legislator to protect personal data and, second, the jurisdictional protection of informational self-determination and, in particular, the protection of the right through the recurso de protección, through habeas data and through a specialized agency as control authority.
Digital rights in Europe after the Personal Data Protection Regulation: A
before and after for the right to be forgotten
- Abstract: Resumen: Europa se ha convertido en el continente que ha desarrollado de forma más prolija el derecho al olvido digital, no solamente dentro de la Unión Europea, sino también en el ámbito de los ordenamientos jurídicos nacionales de sus Estados miembro. El presente artículo comienza haciendo un repaso de las primeras sentencias que se dictaron en la materia, y que son previas a la creación de internet, para posteriormente analizar el punto de inflexión que se produjo en el año 2014 con el Caso Costeja, y que influyó directamente en la nueva legislación que se ha dictado en la materia tanto en el Parlamento de Bruselas, como en los diferentes parlamentos nacionales europeos. Todo ello con el objetivo de poder demostrar la complejidad de este derecho poliédrico tan importante para los ciudadanos en la actual sociedad digital.Abstract: Europe has become the continent that has developed the right to digital oblivion more neatly, not only within the European Union, but also within the scope of the national legal systems of its member state. This article begins by reviewing the first sentences that were issued on the subject, and that are prior to the creation of the internet, to later analyze the turning point that occurred in 2014 with the Costeja Case, and which directly influenced the new legislation that has been issued on the subject both in the Brussels Parliament, and in the different European national parliaments. All this with the aim of being able to demonstrate the complexity of this polyhedral right so important for citizens in today's digital society.
Right to Protection of Persons Displaced by Environmental Factors in light
of the Jurisprudence of the Inter-american Human Rights System
- Abstract: Resumen: Este trabajo tiene por objeto demostrar la existencia de la obligación y del derecho a la protección contra el desplazamiento forzado por factores medioambientales, a partir del derecho al medio ambiente sano, en el marco del Sistema Interamericano de Derechos Humanos. Para tal fin, la hermenéutica jurídica contribuye, en primer lugar, a definir el concepto de desplazamiento por factores medioambientales y sus categorías. En segundo lugar, desde la caracterización del derecho al medio ambiente sano como un Derecho Económico, Social, Cultural y Ambiental se relata el debate jurisprudencial y doctrinal de la exigibilidad de esta última categoría, haciendo énfasis en el método de derivación de derechos del artículo 26 de la Convención Americana sobre Derechos Humanos. Luego, se sugiere recurrir al artículo 25.1 de la Convención a fin de complementar el método de derivación de derechos del artículo 26 convencional con base en la derivación de derechos a partir del marco legal de los Estados parte. Finalmente, se analizan las obligaciones internacionales, para verificar la viabilidad de la exigencia de protección contra el desplazamiento por factores medioambientales.Abstract: This text seeks to demonstrate the existence of the obligation and the right to protection against forced displacement due to environmental factors, based on the right to a healthy environment within the framework of the Inter-American Human Rights System. To comply with this obligation, resort to legal hermeneutics to, firstly, define the concept of displacement due to environmental factors and its categories. Secondly, we start from the characterization of the right to a healthy environment as an Economic, Social, Cultural and Environmental Law and we relate the jurisprudential and doctrinal debate regarding the enforceability of this last category, emphasizing the method of derivation of rights of Article 26 of the American Convention on Human Rights. Subsequently, it is recommended to resort to article 25.1 of the Convention in order to complement the method of derivation of rights of the conventional article 26 based on the derivation of rights from the legal framework of the States party. Finally, analyze the international obligations derived from the right to a healthy environment, to verify the enforceability of protection against displacement due to environmental factors.
Equality and non-discrimination assessment of indigenous peoples in
Peruvian Constitutional Court decisions
- Abstract: Resumen: El presente artículo pasa revista al estado del arte del desarrollo contemporáneo, tanto doctrinal como jurisprudencial, del derecho fundamental a la igualdad y no discriminación de las personas y pueblos indígenas, con el propósito de identificar el contenido constitucional e interamericano de este derecho que el Tribunal Constitucional (TC) peruano podría tomar en cuenta. Luego, analiza la escasa jurisprudencia desarrollada por el TC en esta materia hasta el momento de escribir el presente documento para, finalmente, formular algunas recomendaciones al máximo intérprete de la Constitución en torno a cómo podría desarrollar a futuro el derecho fundamental a la igualdad y no discriminación de las personas y pueblos indígenas, a partir de las nociones de discriminación estructural, indirecta e interseccional.Abstract: This article reviews the state of the art of contemporary development, both doctrinal and jurisprudential, of the fundamental right to equality and non-discrimination of indigenous people, with the purpose of identifying the constitutional and inter-American content of this right that the Peruvian Constitutional Court (TC) could take into account. Then, it analyzes the limited jurisprudence developed by the TC in this matter until the moment of writing this document. Finally, the article makes some recommendations to the high constitutional court of regarding how the fundamental right to equality of indigenous people could develop in the future, based on the notions of structural, indirect and intersectional discrimination.
Protection of sentient beings and legal personalization of nature

- Abstract: Resumen: En los últimos años, distintas experiencias jurídicas han identificado y enriquecido la protección de los animales al reconocerlos como seres sintientes, y de la naturaleza, dándole a ella, personalidad jurídica. No obstante, en este artículo se argumenta que, a pesar de la relevancia de la protección jurídica de la naturaleza, la biodiversidad y los seres sintentes, en realidad no se trata de una ampliación dela carta de derechos constitucionales a quienes no tienen voz; se trata de una reiterada posición jurídica en torno a la protección ecocentrista, que parecería haber surgido en distintos países, con categorías jurídicas disímiles, pero idénticas funciones, y que en realidad, encarnan sentencias estructurales con órdenes complejas de protección. Igualmente, se argumenta que la protección de los seres sintientes y los ecosistemas es aún un problema jurídico sin solución autónoma, dependiendo en todos los casos, del vínculo de los derechos fundamentales de seres humanos.Abstract: In recent years, various legal experiences have identified and enriched the protection of animals by recognizing them as sentient beings, and of nature, subjecting fundamental rights in it. However, in this article it is argued that, despite the relevance of the legal protection of nature, biodiversity and living beings, it is not really an extension of the charter of constitutional rights to those who have no voice; It is a repeated legal position around ecological protection, which seems to have been operated in different countries, with dissimilar legal categories, but identical functions, and in fact, embody structural sentences with complex orders of protection. Likewise, it is argued that the protection of sentient beings and ecosystems is still a legal problem without an autonomous solution, control in all cases, of the bond of the fundamental rights of human beings.

- Abstract: Resumen: El objeto del presente trabajo es averiguar qué efectos produce la declaración de inconvencionalidad realizada por la Corte Interamericana de Derechos Humanos al interior de un ordenamiento jurídico, en aquellos casos en que la norma impugnada resulta absolutamente incompatible con sus criterios, no siendo posible una armonización entre ambas mediante la llamada “interpretación conforme”. Para ello se analiza la doctrina que ha tratado esta cuestión, así como la jurisprudencia atingente emanada de este tribunal internacional.Abstract: The purpose of this paper is to find out what effects the declaration of unconventionality made by the Inter-American Court of Human Rights within a legal system produces, in those cases in which the contested norm is absolutely incompatible with its criteria, not being possible harmonization between them through the so-called “according interpretation”. For it, the doctrine that has dealt with this issue is analyzed, as well as the relevant jurisprudence emanating from this international tribunal.

Además, se analizan los efectos de las decisiones del Tribunal Constitucional y la posibilidad de su control por vía del mencionado recurso de protección.Abstract: This article aims to analyze the procedural consequences that the recent jurisprudence of the Supreme Court may have on the structure of the protection remedy, as it is understood as an extraordinary remedy. In addition, the effects of the decisions of the Constitutional Court and the possibility of their control through the aforementioned protection remedy are analyzed.
The parlamentarization of presidential systems and the political rights of
presidents democratically elected: One vision from the human rights
- Abstract: Resumen: Uno de los temas que se encuentran en la actual agenda latinoamericana es referente a los juicios políticos involucrando presidentes democráticamente elegidos. Los casos de Honduras, Paraguay y Brasil ilustran un desafío contemporáneo de cómo interpretar los derechos políticos dentro de un marco constitucional que equilibre el control de poder del mandatario y la soberanía popular. La principal cuestión es si un juicio con perfil político, aunque realizado dentro de las formalidades legales, no podría violar los derechos políticos que se encuentran en los tratados internacionales de derechos humanos, en un continente todavía carente de consolidación democrática. En este sentido, por medio de una revisión bibliográfica crítica deductiva, se formula una respuesta a esta cuestión a partir de lo que se conoce por proceso de parlamentarización de los sistemas presidencialistas en América Latina, avanzando para una interpretación de los derechos políticos tanto en la Declaración Americana como en la Convención, para luego hablar sobre la eventual necesidad de coaliciones para el ejercicio del mandato de presidente y la relación de esto con la soberanía popular.Abstract: One of the most polemic issues involving presidential systems in the Latin-American political landscape is the possibility of impeachment of presidents democratically elected. Cases happened in Honduras, Paraguay and Brazil illustrate the challenge of how to understand the political rights in a constitutional framework which can balance the necessary control of power of presidents and popular sovereignty. The main question is if an impeachment, being a political procedure, even if celebrated according to the legal rules, would not violate presidents’ political rights stated by international treaties of human rights in a continent that still suffers with lack of democracy consolidation. In this sense, through a bibliographic critical deductive review, it is tried to answer this question, having as a starting point the parlamentarization processes of presidential systems in Latin America, following by the interpreting of political rights concerning the American Declaration and Convention of Human Rights. Then, it will argue about the eventual need of coalitions to the exercise of the mandate and its relation with popular sovereignty.

- Abstract: Resumen: El presente comentario de jurisprudencia estudia la Sentencia STC-1976 de 2019 de la Corte Suprema de Justicia colombiana, la cual evidencia, como a través de la aplicación axiológica de postulados superiores, la filiación de crianza o social, es congruente con la prevalencia del interés superior de los niños, niñas y adolescentes; en contraste a la lógica conservadora de las reglas ordinarias sobre filiación. Esto es, frente a un mismo problema sobre relaciones filiales donde intervienen menores de edad criados por padres con quienes no comparten vínculo biológico, existen dos soluciones jurídicas antagónicas; donde la respuesta legalista que expone la inflexibilidad del derecho positivo clásico, antagoniza con el principio pro infants, en desarrollo del Bloque de constitucionalidad.Abstract: The present jurisprudence commentary studies the STC-1976 Judgment of 2019 of the Colombian Supreme Court of Justice, which evidences how through the axiological application of superior postulates, the parentage of upbringing or social, is consistent with the prevalence of the best interest of children and adolescents; in contrast to the conservative logic of ordinary filiation rules. That is, when faced with the same problem regarding filial relationships involving minors raised by parents with whom they do not share a biological bond, there are two antagonistic legal solutions. On the one hand, the legalistic response that exposes the inflexibility of classical positive law. And on the other, the family constitutional correction where the specific cases are harmonized with the pro infants principle, in development of the Constitutionality Block.
