  • Addressing Jurisdictional Challenges in Prosecuting ISIL Fighters

      Abstract: This paper addresses some of the jurisdictional challenges in prosecuting fighters who joined the ranks of the Islamic State of Iraq and the Levant. It argues primarily in favor of prosecution by the states of which the fighters are nationals. International avenues for prosecution should be examined, as a subsidiary, in case states are reluctant to investigate crimes committed by their nationals. The paper argues in favor of prosecuting suspected ISIL fighters, by a court that respects due process of law with the aim of promoting accountability in a region constantly plagued by conflict.

  • Prioritizing Fair Information Practice Principles Based on Islamic Privacy
           Law

      Abstract: All global privacy law is, to varying degrees, based upon the Organization for Economic Cooperation and Development’s Fair Information Practice Principles (FIPPs). Though first developed in 1973, few have questioned the extent to which the FIPPs and subsequent regulations operationalizing them account for non-Western (i.e. nonneoliberal) legal and cultural systems. But given the increasingly international character of data flows and the number of non-European countries now enacting national data privacy laws for the first time, that oversight should be remedied. In particular, nations that observe some form of Islamic law or culture have rich histories of discourse that speak directly to definitions of privacy interests and methods of privacy protections. Those studying data privacy in these nations or looking to move information to and from them should be mindful of Islamic perspectives on privacy and encourage greater examination of such perspectives’ intersection with extant data privacy regimes.

  • The Corporate Waqf in Law and Practice

      Abstract: Over the past fifty years, the corporate waqf has emerged in Turkey, Pakistan, India, Bangladesh, and Malaysia. Corporate waqf hybridizes the Islamic trust (the waqf) and the modern Western corporation to create a charitable endowment whose asset base consists of shares in a company. The corporate waqf has gone virtually unnoticed in Western scholarship, and, until now, comprehensive theorization and mainstreamed models of the corporate waqf have not been developed. Such an effort would benefit from comparative reference to the foundation-owned firms of Northern Europe, which have attracted scholarly attention in the past decade due to their favorable economic performance and apparent contravention of mainstream agency theory. An account of the structure and features of the corporate waqf can contribute to this growing literature and offer the beginnings of institutional knowledge transfer between regions with differing cultural, legal, political, and economic contexts. This article offers the beginnings of such a venture, by introducing the corporate waqf to Western legal academia and outlining its main features.

  • The Legacy of the 1951 Refugee Convention and Palestinian Refugees:
           Multiple Displacements, Multiple Exclusions

      Abstract: Article 1D of the 1951 Refugee Convention singles out individuals who receive aid from UN agencies, and specifically applies to Palestinian refugees receiving aid from the UN Refugee and Works Agency (UNRWA). While Article 1D was first introduced to afford Palestinian refugees heightened protection, national courts have often interpreted this clause to leave Palestinian refugees without protection. More than 60 years after the initial refugee crisis, how does this provision affect displaced Palestinians today' This paper shows that the haphazard interpretation of Article 1D has often left Palestinian refugees without protection and that this lack of protection has been exacerbated for Palestinians fleeing the crisis in Syria. One solution would be to enable the UNHCR to take on some of the protective functions that used to be provided by the now-defunct UN Conciliation Commission for Palestine.
