  • Analisis Status Anak Luar Kawin Terhadap Orang Tuanya: Studi Komparatif
           antara Hukum Positif dan Hukum Islam

      Abstract: Anak (keturunan) dalam sebuah perkawinan merupakan salah satu tujuan yang diingikan semua keluarga. Namun, akan menjadi problem besar manakala seorang perempuan melahirkan anak tanpa melalui proses perkawinan yang sah atau yang populer disebut anak luar kawin. Disebut problem karena status anak tersebut dengan kedua orang tuanya menjadi absurd, terutama yang berkaitan dengan hak waris, hak perwalian, maupun hak nafaqah. Di sinilah pentingnya penelitian ini dilakukan. Penelitian ini merupakan penelitian pustaka (library research) dengan mengkaji bahan hukum primer maupun bahan hukum sekunder, kemudian menganalisanya dengan berbagai teori, doktrin, maupun asas hukum. Hasil dari penelitian ini menunjukkan bahwa dalam hukum positif, status anak luar kawin tidak hanya memiliki hubungan nasab dengan ibu dan keluarga ibunya, melainkan juga dengan laki-laki yang mengakibatkan kelahirannya, sepanjang dapat dibuktikan dengan ilmu pengetahuan dan teknologi atau alat bukti lainnya yang sah menurut hukum. Sementara dalam hukum Islam, status anak luar kawin hanya memiliki hubungan nasab, waris, dan nafaqah dengan ibu dan keluarga ibunya, hanya saja hakim selaku penegak hukum dapat menjatuhkan hukuman ta’zir kepada laki-laki yang mengakibatkan kelahiran.Keyword: Anak Luar Kawin, Hukum Positif, Hukum Islam

  • WAWASAN PEMBERANTASAN KORUPSI DALAM PERSPEKTIF HUKUM POSITIF DAN HUKUM
           ISLAM

      Abstract: Almost every day, issues and news about corruption become part of several headlines in newspapers, or become a theme raised in television media in this country. This fact indicates that, today Indonesia is still unable to escape from a culture of corruption that is getting stronger and running systemically. Although it is not proclaimed as an Islamic state, Indonesia is listed as a country with a Muslim majority. Even so, the quantity of diversity is not directly proportional to the moral quality and practice of religion which explicitly states, both in the Koran and al-Sunnah, that it prohibits actions that harm others, let alone the State. Because Indonesia is dominated by a Muslim majority, whether it is recognized or not, the perpetrators of corruption in this country are mostly Muslims. This article will discuss the discourse on the eradication of corruption as stipulated in Law Number 20 of 2001 and in Islamic law. By using literature research methods and descriptive analysis of the sources of positive law and Islamic law, this article produces several findings, namely; 1) efforts to eradicate corruption as regulated in Law Number 20 of 2001 are carried out with physical punishments such as fines and a maximum sentence of life which does not provide a deterrent effect to the perpetrators; 2) Islam emphasizes that the eradication of corruption is carried out by means of theological-morality, namely awareness of corruptors and the provision of moral sanctions, such as being displayed to the public so as to provide an educational effect for others. From these findings, this article agrees with Mahfud MD's idea that punishment for corruptors should be carried out in the aspects of physical and moral punishment.

  • KEDUDUKAN ANAK ZINA DITINJAU DARI YURIDIS NORMATIF

      Abstract: Problems related to children resulting from adultery are still interesting to discuss, namely in terms of how the position of adultery children in the Compilation of Islamic Law in Article 43 paragraph (1) and Article 272 of the Criminal Code. This research is in the form of normative legal research, namely legal research conducted by researching library materials and using an approach. The type of research used is Libray Research. that the adulterous child in Compilation of Islamic Law or Civil Code both cannot be recognized by his genetic father, while in Compilation of Islamic Law he has more empathy so that the child has a kinship relationship with his mother and mother's family, while in the realm of the Civil Code an adulterous child will not have a juridical relationship with his parents , either to the father or to the mother. However, the child can only obtain rights from his mother and his mother's family. Whereas in the realm of the Criminal Code, adulterous children can only earn what they need according to the ability of their biological parents. But besides that, the adulteress child cannot ask and demand more for what he has given.

  • PENENTUAN HARI PERNIKAHAN MENGGUNAKAN PRIMBON DARI SISI ISTIHSAN

      Abstract: The determination of the wedding day by using primbon happened  in Karanggeger’s society is a Tradition that has been inherited by the ancestors, as in Islam this tradition certainly contradicts with Islamic Shari'a, where as the majority of the Karanggeger people are Muslim, but the tradition is still carried out as a habit that has been handed down for generations by the society, to determine the law from that tradition by using Istihsan, where Istihsan assesses an event based on whether or not there are benefits in it.How to find out the process of determining the marriage contract day in Karanggeger village by using Primbon and how the Istihsan study of the determination of marriage contract by using the primbon. This research used some methods those are Phenomenology, Observation, Interview, and Documentation. The data obtained is then processed with a qualitative approach.The results of the study were that Karanggeger people came to the local religious figures who understood the Primbon problem then determine a good wedding day, every thing that was done and considered something good was worthy of being called Istihsan, as well as legal exclusion from general shari'ah principles, based on habits applicable.

  • PEMBATALAN HIBAH OLEH PENGADILAN AGAMA

      Abstract: A grant is a gift made by someone to another party that is carried out while still alive and its implementation is carried out while the grantor is still alive. Grants in any law are basically irrevocable, but if certain conditions are met the grant can be cancelled. This study aims to determine that the decision to cancel the grant made by the Situbondo Religious Court in case number 0374/Pdt.G/2017/PA.Sit was in accordance with applicable legal provisions or not, to determine whether the cancellation of the grant made by the Religious Court was allowed or not. not in fiqh. Based on this research, the results obtained: first, the cancellation of the grant made at the Situbondo religious court in accordance with the applicable legislation, the legal basis for the judge's assembly to decide the case was because the grant did not meet the requirements of the grant. Second, the cancellation of grants made by religious courts is allowed in fiqh.
