  • The Implementation Of The 'Urf And Its Implications On The Determination
           Of Contemporary Sharia Economic Law

      Abstract: Business activities in the free market in the globalization era present a unique challenge for legal practitioners who actively carry out ijtihad to generate thoughts on shari'ah economic law. These efforts seek to reconstruct economic law principles, actualize, and contextualize various contemporary shari'ah economic law cases, such as online sale and purchase contracts ('aqd bai' al-salm), online transactions of sale and purchase contracts without pronouncing sigat al-'aqd, and others. Contract transactions like this have become a tradition and a necessity for the corporate sector in the modern day. From here, an academic challenge develops, namely, how to explain various legal problems that continue to occur regarding Shari'ah economic law and the legal istinbat process. Using 'urf as an ijtihad method in extracting law to establish law in contemporary shari'ah economic law cases is one of the various solutions.Keywords: 'urf application, implications, and shari'ah economic case.

  • Perspektif Maslahah Terhadap Pembagian Keuntungan Pada Unit Usaha Kelompok
           Usaha Tani Desa Wates Timur Pringsewu

      Abstract: The purpose of this study is to find out the profit sharing from the collaboration between farmer groups and their administrators where the initial agreement at the East Wates Village Farmers Group business unit stated that all members would receive the same profit sharing every year. However, as time goes by, the distribution of profits is no longer the same as the original contract agreement. In practice, the management of the Farmer Group gets a higher profit share than ordinary members. The focus of the research is: how is Maslahah's review towards the profit sharing of farming business sales in the Farmer Groups of Wates Timur Pringsewu Village' The type of study is field research with descriptive-analytic. The primary data derives from the interviews and observations with administrators as well as the members of the East Wates Village Farming Group. Then the data was supplemented with secondary materials from library documents.  The conclusion of this study is that the review of the Maslahah in terms of profit-sharing practices in Farmer Groups in East Wates Village does not bring benefits because there is an element of injustice. It violates the pillars of syirkah where the profits distributed to members are not in accordance with the agreement at the beginning. While the agreement is not immediately damaged or canceled because one of the pillars in the agreement is not implemented. It happens in accordance with a sense of justice due to administrators getting higher profits to match their responsibilities.Keywords: Profit Sharing, Maslahah, Farming Group

      Abstract: The Covid-19 pandemic emerges new challenges for Islamic banking, namely how the bank can maintain people's welfare. The birth of Indonesian Sharia Banks is expected to be able to improve the people's economy during this pandemic. The purpose of this study is to examine the role of Indonesian Islamic Banks after the merger of Islamic Banks of state-owned enterprises. The study uses a qualitative method to understand social phenomena which focus on the analysis of written material based on the context. Data sources are obtained from published documents, textbooks, journals, manuscripts, articles, and trusted websites. It is hoped that the initiation will impact to increase in capital support for various financial sectors and the halal industry in the country.       Abstract: Tujuan penelitian dalam artikel ini menganalisis sistem investasi dengan skema ponzi serta pandangan hukum Islam terhadap praktek tersebut, sehingga fokus masalah dalam penelitian ini adalah bagaimana sistem dan pandangan hukum Islam terhadap investasi dengan skema ponzi' Jenis penelitian ini adalah penelitian kepustakaan (library research) yaitu penelitian yang sumber data-datanya berasal dari buku, jurnal, dokumen, dan penelitian/ karya tulis ilmiah. Prosedur pengumpulan data penelitian kepustakaan ini adalah Fatwa Dewan Syariah No. 20/DSN-MUI/IV/2001 dan UU No. 7 Tahun 2014 Penelitian ini bersifat deskripsi analitik kemudian menggunakan teknik analisis data kualitatif dengan pendekatan deduktif. Berdasarkan hasil penelitian dapat di simpulkan bahwa investasi dengan skema ponzi adalah skema memberikan penawaran keuntungan yang tinggi sehingga masyarakat tertarik untuk melakukan investasi, dengan cara meminta pembayaran diawal sebagai bentuk biaya administrasi, dan uang ini akan diputarkan untuk membayar anggota lain sehingga anggota baru tidak mendapatkan keuntungan. Sistem ini akan terus berputar sampai tidak ada lagi anggota yang bergabung. Dalam hukum Islam investasi ini dilarang serta hukumnya haram karena mengandung unsur gharar serta investasi yang didalamnya terdapat najsy (penawaran palsu), bai al-ma’dum (melakukan penjualan atas barang yang belum ada wujudnya), insider trading (menyebarluaskan informasi yang menyesatkan). Sedangkan dalam hukum positif investasi ini dinyatakan ilegal karena terdapat unsur penipuan dan memakai konsep piramida seperti yang terdapat dalam UU No. 7 Tahun 2014 tentang perdagangan.Kata Kunci: Investasi, Skema Ponzi, Hukum Islam dan Hukum Positif

      Abstract: The study is about the settlement of disputes over land grants to adopted children in the village of Gedung, Palas District, South Lampung Regency from the perspective of Islamic law and positive law in Indonesia. The focus of the research is how Islamic and Indonesian Positive Law view the settlement of land grant disputes adopted children. The purpose of this study is to find out how to resolve disputes in cases of grants to adopted children. In the research, the data collection method used by the author is field research by interview methods with parties related. After the data is collected, then it is analyzed using qualitative methods with an inductive thinking approach. The results of the study can be concluded that the resolution of land grant disputes to adopted children in Islamic law is by means of mediation. Mediation involves internal families and religious leaders as well as community leaders. In Islam, this means known as deliberation. Meanwhile, the settlement is carried out by way of dispute resolution outside the court known as Alternatif Penyelesaian Sengketa (APS)  or known as non-litigation.Keywords: Land Grant Dispute Resolution, Adopted Children, The mediation, Alternatif Penyelesaian Sengketa (APS) /non litigation.

      Abstract: The development of the bank accompanied by an increasingly advanced model of channeling funds, one of which is carried out by Islamic banks, is one of the solutions to help the community's economy, especially in Sukamulya Lempasing Village. The study focuses on the system and perspective of sharia economic law in the distribution of Islamic bank funds to the community in Suka Mulya Lempasing Village.  The purpose of this study is to find out the system and perspective of Islamic economic law are adopted there.  The study is conducted by field research with data collection, one of which is an interview. Then it is analyzed using descriptive analysis with an inductive thinking approach.  The results of the research can be concluded that the system of channeling funds or Islamic bank financing in Suka Mulya Lempasing Village, Teluk Pandan District, Pesawaran Regency uses financing with a joint liability system (Tanggung Renteng).  From the perspective of sharia economic law, the fund distribution system implemented in Sukamulya Lempasing Village, the system of shared obligations (Tanggung Renteng), is in accordance with the principle of Muamalah, namely Kafalah.  In which a commitment is formed to work together and be responsible between one member to another in the event of arrears of installments by one of the members.Keywords: Sharia Economic Law, Bank Fund Distribution System, Community.

      Abstract: Growth and economic development are very closely related. Economic growth is an important indicator in carrying out economic development in a country. Some economists pay special attention to capital as one of the factors that influence economic growth. One of the efforts that can be made by the government in encouraging economic growth is to seek capital or sources of financing, one of which is through investment both domestically and abroad. Like other developing countries, Indonesia relies heavily on investment to support the financing of its economic development, both through foreign and domestic investment. Islam strongly recommends investment from both a non-economic and an economic point of view. Viewed from an economic point of view, investment is a commitment to sacrifice funds in a definite amount at the present time to gain the profits in future, of course, with the guidance of the Shari'a. Investment activities are part of Muamalah activities that are permissible unless there is an implication of the argument from the Qur'an and al-Hadith which prohibits it either explicitly or implicitly.Keywords: Investment, Economic Growth, and Development, Islamic Economics

  • Praktik Peralihan Akad Gadai Ke Jual Beli Dalam Tinjauan Fiqh Muamalah

      Abstract: The purpose of the study was to find out the Practice of Transferring Pawn Contracts for Sale and Purchase in Gunung Rejo Village, Way Ratai District, Pesawaran Regency. In addition, the study examines the review of Fiqh Muamalah on such Implementation. The type of research used is field research with a qualitative approach. Data collection was conducted through documentation and interviews with pawnshop (rahin) and pawn taker (murtahin). The results of this study indicate that the rahin cannot repay the debt he borrowed, then rahin offers collateral to murtahin with the aim of selling it. But in this case, the selling price is determined by the murtahin which causes the sale and purchase price of the land to be much lower than the actual price in the village. The transition from a pawning contract to buying and selling is not in accordance with the rules of Islamic law, because it does not meet the requirements stipulated in the Fatwa of the National Sharia Council No.25/DSN-MUI/III/2002 or Fiqh Muamalah. If the pawnshop (rahin) cannot repay the loan, the collateral is sold through auction or offered to a third party.Keywords: Fiqh Muamalah, Pawn, Sale and Purchase

      Abstract: Through the law on traffic and road transportation number 22 of 2009, specifically article 74, the Government plans to delete vehicle data if the (PKB) is in arrears for up to two years. Based on the issue, the purpose of this study is to find out the views of the interpretation of Islamic economic law regarding bulging motorbikes due to tax arrears. Viewed the type of research, it is including library research where the main data is in the form of documentation of various information then they will be qualitatively analyzed using the content analysis method and the thematic interpretation method with the approach of sharia economic law theories. From the perspective of interpretation of shari'ah economic law, buying-selling as well as taxes are two completely different things. Legal buying and selling have the authority to guarantee full ownership of something. This is the reason why such conditional buying and selling are not legalized in Islam. Therefore, tax arrears cannot simply annul the ownership rights that have occurred from the sale and purchase contract. Thus, falsifying the status of a motorbike because of tax arrears is a wrong action. This case is similar to conditional buying and selling, a form of buying and selling that is prohibited in Islam.Keywords: Motorcycles, Bulging, Interpretation of sharia economic law.

Adapun Jenis penelitian ini menggunakan penelitian kualitatif deskriptif analitik atau kepustakaan, karena yang dijadikan objek kajian ini adalah karya literartur berupa buku-buku yang berkaitan dengan wakaf untuk pembangunan infrastruktur negara dalam perspektif Isla. Berdasarkan hasil penelitian ini yaitu wakaf untuk pembangunan infrastruktur negara dalam persepktif hukum islam yang disimpulkan menjadi beberapa poin yakni: Ketentuan wakaf umtuk infrastruktur negara telah ditentukan dalam Undang-Undang Nomor 41 Tahun 2004 pada Pasal 22 yaitu: Dalam rangka mencapai tujuan dan fungsi wakaf 1 harta benda wakaf hanya dapat diperuntukkan bagi: Sarana dan kegiatan ibadah,Sarana kegiatan pendidikan serta kesehatan,Bantuan kepada fakir miskin, anak terlantar, yatim piatu, dan beasiswa, Kemajuan dan peningkatan ekonomi umat, Kemajuan kesejahteraan umum lainnya yang tidak bertentangan dengan syariah dan peraturan perundang-undangan.Wakaf untuk infrastruktur negara dalam islam dibolehkan, karena pada awal mulanya wakaf untuk infratruktur yaitu pada zaman pemerintahan Khulafaur Rasyidin yaitu Dinasti Umayyah dan Abbasyiah.Kata Kunci: Wakaf untuk infrastruktur negara, Hukum Islam
