  • WASIAT WAJIBAH KEADILAN DAN KESEJAHTERAAN KELUARGA PERSPEKTIF
           UNDANG-UNDANG MESIR DAN KOMPILASI HUKUM ISLAM

      Abstract: AbstractA will is a trust that must be conveyed, so that the trust cannot be concealed or given to another person who is not entitled. So far, many wills have been neglected and various ways have been done so that the will does not reach the rightful, because that is why the verses of the Qur'an came down to regulate the will and make people who change and falsify the will as a great sinner. This research is normative with a historical and regulatory approach to the Egyptian State Law. The obligatory will of the State of Egypt applies to a grandchild whose parents have died first in the life of the grandfather or grandmother, such a situation in the compilation of Islamic law is included in the realm of successor heirs, while the obligatory will of article 209 in KHI only to children or parents lift. If seen from the difference between the obligatory will law of the State of Egypt and KHI in Indonesia, which both have similarities in the limits of the obligatory will section, which is 1/3. KHI pays great attention to children or adoptive parents so that a mandatory will is enforced, this shows that KHI in Indonesia not only cares about the welfare of the same family, but also cares about others who have served in his life.Abstrak:Harta wasiat merupakan amanah yang harus disampaikan, sehingga amanah tersebut tidak boleh disembunyikan atau diberikan kepada orang lain yang tidak berhak. Sejauh ini banyak wasiat yang dilalaikan dan berbagai cara dilakukan agar wasiat tersebut tidak sampai kepada yang ber-hak, karena itulah ayat al-Qur’an turun mengatur tentang wasiat dan menjadikan orang yang merubah dan memalsukan wasiat sebagai pelaku dosa besar. Penelitian ini merupakan normatif dengan pendekatan sejarah dan peraturan Undang-undang Negara Mesir. Wasiat wajibah Negara Mesir berlaku bagi seorang cucu yang orang tuanya telah meninggal terlebih dahulu di masa hidupnya sang kakek ataupun nenek, keadaan seperti ini dalam kompilasi hukum Islam dimasukkan dalam ranah ahli waris pengganti, sedangkan wasiat wajibah pasal 209 dalam KHI hanya terhadap anak atau orang tua angkat. Jika dilihat dari perbedaan antara undang-undang wasiat wajibah Negara Mesir dengan KHI di Indonesia yang mana keduanya memiliki persamaan dalam batasan bagian wasiat wajibah yaitu 1/3. KHI sangat memperhatikan anak atau orang tua angkat sehingga diberlakukan wasiat wajibah, hal ini menunjukkan bahwa KHI di Indonesia tidak hanya peduli terhadap kesejahteraan keluarga senasab, melainkan juga peduli terhadap orang lain yang pernah berjasa dalam hidupnya.

  • WORLDVIEW SEBAGAI LANDASAN SAINS DAN FILSAFAT: PERSPEKTIF BARAT DAN ISLAM

      Abstract: Worldview sebagai keyakinan dan pengetahuan dasar di dalam fikiran, perasaan, sikap dan perilaku benar manusia. Realitanya, pandangan hidup di Barat dibatasi dengan kebenaran bersifat fisik, disebabkan mengedepankan peran rasio dan fakta ekperimen dalam memaknai dan menentukan kebenaran konsep Tuhan, manusia, nilai, dan alam, serta manusia sebagai pusat nilai bersifat sekularistik dan dualistik. Sedangkan wolrdview Islam berpusat pada konsep Tuhan sebagai moral tertinggi, kemudian berelasi kepada pandangan tentang manusia, iman, ilmu, dan ahklak yang bersifat tawhidi dengan bersandar pada wahyu dapat mengambarkan kebenaran fisik dan metafisik. Ini sebagai basic belief untuk mengarahkan manusia dalam memaknai realitas, hakikat, nilai, dan tujuan hidup manusia yang benar di dunia dan akhirat. Penelitian ini bertujuan mengetahui wacana baru dari worldview sebagai basis sains dan filsafat. Untuk mencapai tujuan tersebut, peneliti menggunakan metode deksriptif analisis. Akhirnya, penelitian ini menghasilkan dua kesimpulan. Pertama, worldview merupakan cara pandang yang benar dalam melihat hakikat kebenaran yang bersifat fisik dan metafisik. Kedua, worldview Barat didasari akal dalam memaknai Tuhan, nilai, hukum dan lainnya yang bersifat berubah-ubah tanpa arah tujuan yang jelas, sedangkan worldview Islam berangkat dari pengenalan dan pengakuan kepada Allah dengan bersumber pada wahyu dalam mengartikan konsep-konsep tersebut bersifat tsabitah, sehingga mengarahkan kepada keyakinan, fikiran, dan perbuatan yang berpusat kepadaNya.

  • STUDI TENTANG PELEMBAGAAN SUBSTANSI BUDAYA ORGANISASI DALAM KONSEP
           LEARNING ORGANIZATION

      Abstract: The educational agenda's long-term viability and suitability for institutional revitalization efforts are still being debated. To address the issue of educational institutions, a new conceptual framework model is required. The concept of organizational development via the concept of learning organization is already numerous and well-established. As a result, the study seeks to understand the governance model of long-term learner organizations that have been thoroughly examined in terms of organizational culture. The descriptive survey method was used for qualitative research. The study's findings revealed five essentials in the implementation of the learner school concept, namely the creation of an educational environment, the enhancement of institutional independence, the succession of learner leadership, and the caderization program as evidence of the institution's sustainability guarantee. Several school programs, including extracurricular activities, school literacy movements, habitation activities, and spontaneous behavior, reflect the cultural actualization of organizations. Managers' commitment to education is recommended by the study's findings in order to remain sustainable; community participation is optimized, with a focus on aspects of data inventory, planning, implementation, monitoring, and evaluation of programs, and optimization of community participation by being supported by Local Governments, including stakeholders. The practical implications of learner concepts create broader and more transformative cultural values that reflect the 21st century's complex challenges and the need for structural reform in sustainable organizations.

      Abstract: This study aims to describe the development of entrepreneurship in three Islamic boarding schools, namely: Ainurrafiq Islamic Boarding School, Kuningan, Walindo Islamic Boarding School, Pekalongan, and Miftahul Ulum Islamic Boarding School, Madura. The method used is content analysis carried out by deductively analyzing the three main sources of research results in the three pesantren by three previous researchers. The results of the study reveals that the three pesantren have relatively developed entrepreneurship, but are still in the early stages. Entrepreneurship is carried out based on local wisdom and only meets the internal needs and the surrounding community. From the case of entrepreneurship in the three pesantren, strong support from government policies towards entrepreneurship development is needed in the form of financial support, legislation, and also coaching. This needs to be done so that Islamic boarding schools become one of the driving forces for the growth of national entrepreneurship which ratio to the total population is only 3.3 percent.

  • ANALISIS MANAJEMEN JAMINAN HALAL PERSPEKTIF MASLAHAH MURSALAH

      Abstract: The purpose of this paper is to find out the analysis of halal assurance management from the perspective of maslahah mursalah. The results of the study stated that the management of the halal assurance system involves several institutions, namely; Ministries/institutions (K/L), Halal Product Guarantee Agency (BPJPH), Halal Inspection Agency (LPH), and the Indonesian Ulema Council (MUI). Each institution has its own main duties and functions. Maslahah perspectives regarding the management of the halal assurance system include; First, each institution (BPJPH, LPH, and MUI) has its own main duties and functions so as to minimize the occurrence of throwing responsibilities at each other. Second, there are checks and balances between each institution, checks and balances are activities to control each other in order to maintain balance between institutions.

  • MAKNA UMRAH BAGI MUSLIM MADURA

      Abstract: Haji dan umrah berada pada tataran yang berbeda dalam ajaran Islam. Namun muslim Madura memiliki pandangan bahwa keduanya hampir setara hal ini terlihat dari kesamaan tradisi yang melingkupi penyelenggaraan keduanya. Penelitian ini bertujuan untuk mengungkap bagaimana tradisi yang melingkupi pelaksanaan umrah beserta makna yang muncul tentang umrah itu sendiri. Dengan menggunakan etnografi sebagai unit analisis ditemukan bahwa tradisi yang melingkupi penyelenggaraan umrah (sebelum, saat dan setelah keberangkatan) tidak jauh berbeda dengan ibadah haji. Muslim Madura menganggap umrah tidak jauh berbeda dengan haji, keduanya merupakan perjalanan spiritual untuk mendekatkan diri kepada Allah dengan beribadah di tanah suci Mekkah.
