Comparative study of insects associated with guinea pig corpses in two
forms of death in Castilla, Piura (Peru)
- Abstract: Resumen Se determinaron los insectos asociados a cadáveres de cobayas, en las dos formas de muerte con mayor incidencia en Piura: envenenamiento (raticida) y arma blanca (cuchillo); utilizando como testigo una muerte por parada cardiorrespiratoria. Para este fin, se sacrificaron cobayas hembras, de pesos similares y procedentes de la misma granja, en tres repeticiones (una por mes), expuestos en un área de bosque seco en el distrito de Castilla, dentro de jaulas de malla metálica, y separadas 60 metros entre sí. La colecta de dípteros adultos se realizó mediante una red entomológica, y se les sacrificó con cianuro en un frasco mortal. Los coleópteros se colectaron por muestreo manual alrededor del cadáver, y se sacrificaron en un frasco mortal con alcohol al 70%. Todos los individuos fueron determinados y cuantificados con un estereoscopio y claves taxonómicas, siempre procurando llegar al nivel taxonómico más bajo. Se utilizó el programa SPSS Vs.22 para calcular las diferencias en la entomofauna entre las formas de muerte, mediante el análisis de varianzas (ANOVA); encontrándose un total de 24 especies, correspondientes a 22 especies para el testigo, 17 para envenenamiento y 19 para arma blanca, a una temperatura y humedad promedio de 25,94 °C y 63,19%, respectivamente. Estadísticamente, no existían diferencias significativas entre las formas de muerte con un nivel de significancia de 0,05.Abstract The insects associated with corpses of guinea pigs were determined, in the two forms of death with the highest incidence in Piura: poisoning (rat poison) and white weapon (knife); using as a witness, a death due to cardiorespiratory arrest. For this purpose, female guinea pigs, of similar weights and from the same farm, were slaughtered in three repetitions (one per month), exposed in an area of dry forest in the district of Castilla, in metal mesh cages, and separated 60 meters between them. The collection of adult diptera was carried out with an entomological network, and the sacrifice of these, in a deadly vial with cyanide. Coleoptera were collected by manual sampling around the body, and sacrificed in a deadly vial with 70% alcohol. All individuals were determined and quantified with a stereoscope and taxonomic keys, always trying to reach the lowest taxonomic level. The SPSS program Vs.22 was used to calculate the differences in the entomofauna between the forms of death, through the analysis of variances (ANOVA). There were a total of 24 species, corresponding to 22 species for the control, 17 for poisoning and 19 for weaponry, at an average temperature and humidity of 25.94 °C and 63.19% respectively, there being no statistically significant differences between the forms of death at a significance level of 0.05.
Relation between prison factor and personality dimensions’ Eysenck
extraversion and neuroticism
- Abstract: Resumen Una de las hipótesis que se barajan para explicar la relación entre las bajas puntuaciones entre la dimensión de la extraversión (E) y las elevadas puntuaciones entre la dimensión del neuroticismo (N) del modelo psicobiológico de Eysenck y la conducta criminal, respectivamente, es la influencia del tiempo de permanencia en prisión. En el presente estudio, se ha realizado un estudio correlacional de las dimensiones E y N con el tiempo de permanencia en prisión de los sujetos, empleando para ello una muestra heterogénea de 55 varones presos y en libertad, a los que se les pasó el cuestionario de personalidad desarrollado por Eysenck, EPQ-A. Los resultados son indicativos de que no existe relación entre el tiempo de estancia prolongado en prisión y la dimensión E, mientras sí parece existir una relación entre la prisionización y la dimensión N; no obstante, parecen existir variables mediadoras en dichas relaciones.Abstract One of the hypothesis which are being considered in order to explain the connection between the low scores in the extroversion (E) dimension and the high scores in the neuroticism (N) dimension from the Eysenck psychobiological pattern and the criminal behaviour, respectively, is the influence of the period of imprisonment. In the present study, a correlated research of dimensions E and N with the period of imprisonment of individuals has been done by using a heterogeneous sample of 55 imprisoned and free men, to whom the personality test developed by Eysenck EPQ-A was given. The results are indicative of not existing connection between the prolonged period of imprisonment and the dimension E, whereas a connection between the imprisonment and the dimension N does seem to exist. It seems, however, there are variables interceding in these connections.

- Abstract: Resumen La sumisión química consiste en la administración de sustancias químicas a una persona, sin su consentimiento y sin su conocimiento, con fines delictivos. En las últimas décadas este fenómeno se ha incrementado notablemente, adquiriendo una gran relevancia social. Los delitos contra la libertad sexual son los más frecuentes. En su mayoría, las víctimas son mujeres, y las más vulnerables son las más jóvenes. Por ello se justifica la necesidad de informar de una manera clara y veraz a la población más joven, para que sepan en qué consiste este fenómeno, qué sustancias pueden estar implicadas, cuáles son los síntomas principales, qué pueden hacer para evitarlo y qué deben hacer en los casos de conocer o ser víctimas de un delito de esta índole.Abstract Chemical submission consists on giving chemical substances to a person, without him/her consenting or being aware of it, and with a criminal purpose. In the last decades, this phenomenon has significantly increased, becoming a considerable social concern. Sexual assaults are the most frequent crimes, the victims are mainly women and the youngest are the most vulnerable ones. For this reason, it is necessary to instruct young people in a clear and truthful way. They need to know what this phenomenon is, what substances can be involved, what the main symptoms are, how to avoid this situation and what to do in case of being a victim of this kind of crime or knowing someone who is.
Feminicide in Bogotá, a view from the legal-medical approach
- Abstract: Resumen En el presente trabajo, se realizó una caracterización de las variables asociadas con el diagnóstico de feminicidio en la población de Bogotá-Colombia, entre el periodo de mayo de 2015 y diciembre de 2016. Para este fin, se hizo un estudio observacional analítico ensamblado en una cohorte de mujeres víctimas de muerte violenta reconocidas en el Instituto Nacional de Medicina Legal y de Ciencias Forenses, mediante una revisión de informes periciales de necropsia, de clínica forense y una búsqueda activa de los expedientes judiciales en la Fiscalía General de la Nación, para documentar el seguimiento de los casos. El análisis de las variables estudiadas demuestra que, en Bogotá-Colombia, es tres veces más frecuente que se tipifique el feminicidio si la causa de muerte es un trauma por arma blanca, comparado con un trauma por proyectil de arma de fuego [odds ratio (OR) 3,21; P 0,049], y ser trabajadora independiente disminuye en un 64% la probabilidad de que se tipifique el feminicidio, comparado con ser ama de casa [OR 0,34; P 0,038]. Dentro de los principales factores de riesgo asociados al feminicidio, susceptibles de ser evidenciados durante un procedimiento de necropsia médico-legal, se encuentra la asociación con los siguientes hallazgos: los hechos ocurridos en la vivienda (41,46%), el mecanismo de lesión cortopunzante (41,03%), la pareja como presunto agresor (35,71%), el patrón de lesiones y heridas de defensa (25%) y el homicidio asociado a la actividad sexual (11,9%). Estos hallazgos le permiten al perito tener herramientas estadísticamente significativas para sustentar una hipótesis de feminicidio en el informe pericial de la necropsia.Abstract In the present work, a characterization of the variables associated with the diagnosis of feminicide in the population of Bogotá-Colombia, between the period of May 2015 and December 2016 was carried out. For this purpose, an analytical observational study assembled in a cohort of women victims of violent death recognized in the National Institute of Legal Medicine and Forensic Sciences, through review of expert autopsy reports, forensic clinical expert reports and active search of judicial files in the Office of the Attorney General of the Nation to document the follow-up of the cases. The analysis of the variables studied shows that in Bogotá-Colombia it is three times more frequent to classify feminicide if the cause of death is white-collar trauma compared to trauma due to a firearm projectile [OR 3.21; P 0.049] and being an independent worker reduces by 64% the probability that feminicide is typified compared to being a housewife [OR 0.34; P 0.038]. Among the main risk factors associated with feminicide that can be evidenced during a medical-legal necropsy procedure, there is an association with the following findings: events in the home (41.46%), mechanism of sharps injury (41.03) %), partner as alleged aggressor (35.71%), pattern of injuries and defense injuries (25%), and homicide associated with sexual activity (11.9%). These findings allow the expert to have statistically significant tools to support a feminicide hypothesis in the autopsy expert report.
Fortuitous atypical death. A case report
- Abstract: Resumen En la Medicina Legal se presentan con frecuencia casos que tienen como etiología médico-legal la accidental, en sus más variadas situaciones. Accidente es cualquier hecho o fenómeno traumático o morboso espontáneo que sobreviene en el individuo sano, o en el curso de una enfermedad. La amplitud de los términos de esta definición obliga a tener presente que los diferentes tipos de accidentes se hallan condicionados por múltiples fenómenos de carácter imprevisible e incontrolable. En el presente estudio, se expone un caso poco común y atípico de accidente doméstico, que lamentablemente culminó con la muerte de la víctima. Se trata de una anciana de 72 años que, según datos aportados por la instrucción policial, fue hallada en su domicilio, tendida en la cocina, con una herida incisa penetrante en la cavidad torácica. Tenía antecedentes de epilepsia desde la infancia, para lo cual seguía un tratamiento, y se pudo conocer que había manifestado sentirse mal antes de quedarse sola en la vivienda.Abstract In Legal Medicine, there are frequently cases having an accidental medico-legal etiology in its more varied situations. An accident is any spontaneous traumatic or morbid fact or phenomenon that happens in a healthy individual or in the course of an illness. The wideness of this definition terms obliges us to take into the account that the different kinds of accidents are conditioned by multiple phenomena of unforeseeable and uncontrollable character. In the current work, we expose an uncommon, atypical home accident, unfortunately ending in the victim’s death; it deals with an elder woman aged 72 years who, according with the data provided by the police instruction was found lying in the kitchen of her house with an incised penetrating wound in the thoracic cavity. She had antecedents of epilepsy since childhood, and for that was treated; it was obtained information that she referred feeling bad before staying alone at home.
Paranoid schizophrenia and forensic-psychiatric expert assessment. Case

- Abstract: Resumen La Medicina Legal y la Psiquiatría son ciencias estrechamente relacionadas, y es habitual que los peritos médicos asesoren a los tribunales y jueces en materias de carácter psiquiátrico, para ayudar a esclarecer hechos delictivos. Establecer el estado mental de una persona que comete un delito, analizar de forma retrospectiva a qué nivel funcionaba el sujeto cuando lo cometió, y a su vez, establecer su facultad para comprender el alcance de su acción y dirigir su conducta en dicho momento, es una de las tareas más difíciles que se le presenta a la Psiquiatría Forense. En este artículo, se aborda de manera conjunta, por un equipo multidisciplinario, la presentación de un caso que se llevó a la comisión de peritación mental de la ciudad de Matanzas, en Cuba, ya que se acusaba a un joven con antecedentes de esquizofrenia paranoide del delito de homicidio en grado de tentativa, y era imperativo para el tribunal poder dilucidar si el sujeto en cuestión, en el momento de agredir a su víctima, conservaba o no la facultad para comprender el alcance de su acción y dirigir su conducta.Abstract Legal Medicine and Psychiatry are tightly related sciences, being usual that medical experts advise our courts and judges in the subjects of psychiatric character for helping in clarifying criminal acts. To establish the mental status of a person committing a criminal offence, to analyze retrospectively the level the subject functioned at when he committed it, and at the same time, to establish his faculty to understand the reach of his actions and to direct his behaviour at that moment, are the most difficult tasks that Forensic Psychiatry could afford. In this article, a multidiscipline team works in the presentation of a case that was taken to the mental assessment commission of Matanzas, Cuba, because a young man, with antecedents of paranoid schizophrenia, was accused in attempted murder, and it was imperative for the court to elucidate if, at the moment of assaulting his victim, the judged kept or not the faculty of understanding the reach of his action and directing his behavior.
The osteological reference collections as a forensic and researching tool
in Colombia
- Abstract: Resumen La variabilidad poblacional en Colombia y su marcado mestizaje hace que la morfología del colombiano sea heterogénea, lo que no permite aplicar fielmente los postulados, métodos y técnicas implementadas en el ámbito internacional en poblaciones homogéneas, a la hora de realizar una identificación de individuos esqueletizados. Para llevar a cabo esta identificación, se recurre a modificaciones que amplían el margen de error que cada estándar posee, haciéndolo ineficaz e inexacto para los grupos poblacionales. Motivo por el cual, en este trabajo se desarrolla la problemática de la identificación de individuos esqueletizados en el contexto colombiano, en una etapa histórica de postacuerdo con las Fuerzas Armadas Revolucionarias de Colombia (FARC), y la importancia de las colecciones de referencia osteológica como una herramienta forense e investigativa, donde han de surgir métodos y técnicas propias para la población colombiana, posibilitando las labores de identificación de individuos esqueletizados.Abstract The population variability in Colombia and its marked miscegenation makes the morphology of the Colombian is heterogeneous, which does not allow faithfully apply the postulates, methods and techniques implemented internationally in homogeneous populations at the time of making an identification skeletonized individuals. To carry out this identification, we use modifications that increase the margin of error that each standard has, making it ineffective and inaccurate for the population groups. Reason for which, in this work, the problem of the identification of skeletonized individuals in the Colombian context is developed, in a historical stage of post-agreement with the Fuerzas Armandas Revolucionarias de Colombia (FARC) and the importance of the osteological reference collections as a forensic and investigative tool, where methods and techniques must be developed for the Colombian population, making it possible to identify skeletonized individuals.
Medical action after the death (certification of the death or
judicialization of the death): legal consequences
- Abstract: Resumen Cuando el médico comprueba la muerte de una persona, debe determinar su origen y su causa, tarea que tiene repercusiones jurídicas, sanitarias, sociales, económicas y éticas, pues tendrá que discernir entre la comunicación al encargado del Registro Civil, en el caso de muertes naturales, o la judicialización del cadáver, si la muerte es violenta o sospechosa de criminalidad. Este aspecto es motivo de preocupación para muchos profesionales, pues en ciertas ocasiones, será difícil establecer el origen de la muerte, pudiendo derivarse consecuencias, tanto para el médico, que puede verse inmerso en procedimientos administrativos o procesales, como para los familiares, que pueden verse privados de la posibilidad de conocer la causa cierta de la muerte (importante, por ejemplo en reclamaciones de responsabilidad civil por mala praxis médica), o aumentar su dolor con la judicialización indebida del cadáver.Abstract When the doctor verifies the death of a person, he must determine the origin and the cause of it, a task that has legal, sanitary, social, economic and ethical repercussions, since he will have to discern between the communication to the person in charge of the civil registry, in the case of natural deaths, or the prosecution of the corpse if the death is violent or suspicious of criminality. This aspect is of concern for many professionals, because in certain occasions it will be difficult to establish the origin of death, and consequences may arise both for the doctor, who may be immersed in administrative or procedural procedures, and for family members, who may be deprived of the possibility of knowing the true cause of death (important, for example, in civil liability claims for medical malpractice), or increase their pain with the improper judicialization of the corpse.
