      How can environmental legal education engage with the Anthropocene' Focusing on the Japanese higher education context, this article interweaves the author’s own biographical experience (i.e., a recent professional move from the Graduate School of Law to the Graduate School of Arts and Sciences) with an analysis of how international non-monodisciplinary teaching frameworks can contribute to the development of environmental legal studies beyond the School of Law and its disciplinary focus. In this regard, what is considered is the extent to which a cross-listed course, Law and the Environment, designed for a mixed body of Japanese and international undergraduate students enrolled in different tracks (Environmental Sciences and Humanities & Social Sciences), may help both break down familiar approaches to environmental problems and turn the classroom into a new ‘community of inquiry’.

      For about three decades, Japan has been providing legal assistance to select countries in Asia in their transition endeavours from socialism to market economy. Whereas historically, international legal assistance traditions and their philosophies were designed by Western donors, Japan intends to demonstrate a shift from such traditional settings by offering its own ideas and approaches towards legal development in Asia. Among features such as request-based approach, prioritization of local culture and society in legal assistance, and supreme national interests in providing Official Development Assistance (ODA), Japan places a particular focus on human recourses development in Asia. This research article on the concrete example of Nagoya University will focus on Japan’s legal education assistance initiative to foster human resources in Asian countries of Uzbekistan, Mongolia, Vietnam, Cambodia, Myanmar and Laos. By focusing on educational projects of Nagoya University, which many refer to as the Asian hub for legal education, this article will shed light on the nature, primary objectives and challenges of nurturing future legal specialists as proposed by Japan’s broader legal assistance initiative in Asia. This article asserts that the goal of the Japanese legal education project is not necessarily to export Japanese law and theory to Asian recipient countries but to enable future Asian jurists to understand own law or the foreign legal systems in comparative perspective and teach skills to independently and adequately address future legal challenges arising in own country.

      With the mushrooming of legal aid clinics across institutions imparting legal education, there exists a conundrum as to their actual objectives. With passage of time, social justice theory is losing ground and skill development theory has gained greater predominance. In order to understand the objectives behind establishing legal aid clinics, the article traces its inter-linkages with the theory of social justice. In doing so, an analysis of the context under which legal aid clinics were established and their relevance to the present day is explored through the article. With the passage of 22 years of establishment of law school legal aid clinics in India, there still exists a dichotomy as to their real purpose and objective. These models of legal aid clinics of the past not only offer insights to develop present models of legal aid clinics, but there is also a need to emulate these models as they are relevant and apt even to this day. The article adapts a comparative approach between India and the USA, chronicling the past and present sojourns of the journey of law school legal aid clinics and the suitability of the social justice theory to the current Indian context.

      Legal education in India aims at enabling learners to think critically and apply what they have learned. Problem-based learning (PBL) can be used as an effective tool to achieve this objective. This study was carried out to understand the effectiveness of this tool in legal education. A comparative analysis of the traditional method with PBL has shown that the latter leads to benefits in the form of better retention of knowledge and recall, improved problem-solving skill, better decision-making ability and development of lifelong-learning ability. This article discusses the methodology adopted and the results generated through application of the method in the taxation law course taught to undergraduate students of law.

  • Comparing Experiential Legal Education in Canada and India

      Legal education has evolved over several centuries across the globe, and its effectiveness is a matter of significant concern not merely for legal practitioners but also for society in general. One approach that has been gaining considerable attention is the concept of experiential legal education, which is at different levels of implementation across the world. Countries such as the United States and Canada have been pioneers in implementing this form of legal education, which is also known as clinical legal education (CLE), whereas India is striving to catch up. This article attempts to inspect and compare the development and implementation of CLE in Canada and India. The findings from the comparison are then utilized to inform the way ahead for CLE in India. While pursuing this objective, the article also examines the concept of experiential education, in general, and in the context of legal education, in particular. Moreover, insights are provided regarding CLE. The status of experiential legal education in Canada is reviewed, and the author’s experience in Canada under the Shastri Research Student Fellowship (SRSF) is detailed to provide the author’s insights regarding the implementation of experiential legal education in Canada. The evolution of experiential legal education in India is also detailed, together with insights regarding the regulations of the Bar Council of India (BCI) as are relevant to CLE. Finally, the article compares the author’s opinion of the present status of CLE in Canada and India and provides recommendations to enhance the future implementation of CLE in India.

      Legal education in Indonesia has followed a traditional model, focusing on the rote transfer of legal doctrine. Students are taught legal theories and sources of law but not how to critically apply the law in concrete real-world scenarios. Consequently, law graduates tend to be unprepared for the workforce, which is a regular complaint of employers. To overcome this impediment, some law faculties in Indonesia adopted clinical legal education (CLE) as a ‘new method’ in the legal education system, whereby students not just learn theory but also gain practical legal experience. This article analyses the adoption of the model and methods of applying CLE to legal education in Indonesia. This study uses the doctrinal research method with a qualitative approach. It is found that the adoption of CLE in Indonesia is diverse; some programmes include it in the core curriculum, while others make it an extracurricular activity. CLE programmes generally use three of six methods, namely street law, advocacy and internship. The differences in the three methods of CLE directly influence their success, exposing participants to interaction with live clients, public speaking and networking. This article recommends that in order to achieve the optimal implementation of CLE, uniformity of the CLE adoption model in Indonesia’s legal education curriculum is needed.

      Social, economic and political changes have brought new challenges and divergent views to twenty-first-century legal education. Law is an expression of the social idea, and more creative solutions evolve from interdisciplinary collaborations. The resolution by legal luminaries to elevate legal research to a high standing, on par with other disciplines, is yet to find a foothold even after the introduction of reforms to legal education in the past two decades. This article makes an attempt to explore the emerging interdisciplinary trends, with the innumerable challenges that require exploration, identification, analysis and quality enhancement while conducting legal research in order to strike a fine balance between teaching and research, as they supplement each other.Law is a mechanism for ushering in social change, and the fact that it can never be studied in isolation demands the convergence and divergence of multiple disciplines. Yet, the traditional conceptualization of legal research is largely confined to the judicial process and the exclusion of social process. Keeping in mind the benefits of interdisciplinary association of law with other areas/disciplines and of research being a continuum, the article emphasizes law’s collaboration with other disciplines. The article accentuates the role of law schools to undertake and encourage interdisciplinary legal scholarship to diversify the learning experiences of students in conjunction with other disciplines. Learning through such experiences enables students to find solutions beyond the strict academic discipline of law and at the same time offers ample opportunities for them to explore a wide array of possibilities that interface with legal profession but transcend courtroom practice. A comparative analysis of two educational institutions imparting legal education, taken as cases in point, is performed for the present study.
