  • Legal Framework for Cabotage Regime in Nigeria: Making a Case for Reform
           Initiatives

    • Abstract: Nigeria's cabotage regime is critical to supporting indigenous involvement and growth in the marine sector. This paper investigates the Coastal and Inland Shipping (Cabotage) Act 2003, the legal framework controlling Nigeria's cabotage regime, and makes a case for reform proposals targeted at improving its efficacy in encouraging Nigerian shipping, shipbuilding, and other marine businesses and addressing existing issues. It investigates the current framework's strengths and shortcomings, indicating areas that require adjustment to fulfil the cabotage regime's planned objectives. It also examines key issues such as a lack of local capacity, a limping legal framework, insufficient enforcement, ambiguities in the legal provisions, a lack of capacity building, and limited access to funding that impede the effective implementation of the cabotage regime. The principal results of this study are the recommendation of broad reform initiatives such as enforcement procedures, institutional coordination, capacity-building programmes, financial incentives, and the promotion of shipbuilding and ship repair infrastructure to solve these difficulties and encourage long-term growth in Nigeria's marine industry. This study calls for a comprehensive strategy for reforming the legislative structure controlling Nigeria's cabotage regime. It emphasises the significance of stakeholder engagement, effective enforcement, and focused policy interventions to improve indigenous involvement, encourage economic development, and increase Nigeria's standing in the global marine industry. A major conclusion of this paper is that where these proposed reforms are implemented, they will provide a favourable climate for Nigerian shipowners, seafarers, and allied industries to prosper, thereby contributing to the nation's maritime sector's growth and sustainability.

  • Impact of International Arbitration Centers on Arab Arbitration Cases: A
           Comparative Study of the Negative Effects on Arab Dispute Resolution

    • Abstract: This study addresses the impact of international arbitration centers on traditional Arab dispute resolution methods, which are deeply rooted in cultural and religious values. Despite the growing popularity of arbitration centers worldwide, their effects on Arab societies remain inadequately explored. Through a comparative analysis of select Arab arbitration cases, the present study has examined the adverse consequences arising from international arbitration centers. Key factors contributing to these negative effects, including cultural and language barriers, as well as the financial costs associated with arbitration have been investigated. The research objectives encompass understanding the clash between international arbitration and traditional methods and proposing strategies for better integration and coexistence. Drawing on the findings, the present study offers practical recommendations to enhance the collaboration between international arbitration centers and local communities. The study underscored the importance of upholding cultural diversity and advocated for the preservation of community-specific dispute-resolution mechanisms. By shedding light on these complexities, this study has contributed to theoretical advancements and practical solutions for understanding the arbitration’s influence on Arab societies and promoting harmonious coalescence between global arbitration practices and traditional values.

  • Application of the Principle of Distinction under IHL in Outer Space

    • Abstract: The principle of distinction can be applied to armed conflicts in outer space. Under the principle of distinction, combatants refer to armed personnel who directly participate in hostile actions in outer space, and military objects refer to those that have made actual contributions to military operations in outer space and can provide a definite military interest. All other personnel and objects are non-military targets that must not be attacked. Objects on which spaceflight participants depend for their survival, certain areas and cultural relics on celestial bodies, outer space, the natural environment of the earth, and space objects used for humanitarian relief are special protected objects. In order to implement the principle of distinction, the defender needs to effectively differentiate its own personnel and objects, and the attacker also needs to take feasible preventive measures.

  • Freedom Fighter or Terrorist'

    • Abstract: In certain cases, making a distinction between freedom fighters and terrorists is a matter of dispute between states. This article examines the main reason for this disagreement and suggests some criteria for separating these two concepts. By referring to the practice of states as well as some regional counter-terrorism conventions, this article argues that the root cause of the issue arises from the legal interpretation of self-determination at the present postcolonial epoch. Therefore, permissions and limitations arising from the right to self-determination clarify the main differences between freedom fighters and terrorists. Finally, the article concludes that a freedom fighter is someone who fights for legal rights in conformity with the law of armed conflict; while a terrorist is someone who fights to achieve illegal advantages by means of targeting civilian objects.

  • International Arbitration by Diplomatic Means to Resolve Disputes Between
           the Parties

    • Abstract: Direct diplomatic negotiations are the most important and most common means to settle international disputes. Studies indicated that, historically states had felt a legal obligation to negotiate before resorting the use of force, even if that commitment does not exceed the formal framework. This concept played its role in the efforts made by jurists during the middle-age to determine the nature of war and the necessity to negotiate before everyone agreed to use the legal forces. The negotiation of subsequent countries was considered to be one of the necessary preconditions for the recognition of fair use of power. Even if it is clear that the negotiations are nothing more than a demonstration, it still remains necessary, without it the use of power is condemned. The present study aims to provide an analytical discussion on the peaceful means of settling international disputes. Specific focus is provided to the diplomatic means of dispute settlement, especially in the gulf countries. The effectiveness of diplomatic means of dispute settlement is further studied by analyzing the case of border issues held between Qatar and Saudi Arabia. The overall discussion indicated that the role of negotiations has increased, especially after the World War II. The group witnessed a new era characterized by the propagation of alliances in various fields and the complexity of international relations, intertwining and developing in the economic, political, military, cultural, social and other areas. This helped the negotiations to flourish as the central tool of diplomacy was described as a negotiation stage. With this in mind, all the principles that regulate relations between countries are reflected in the application of method of international dialogue. The analysis revealed that though diplomatic means take long to settle disputes, they are still the most effective methods to resolve the rising conflicts between different nations. However, in cases where conflicts remain unresolved through dialogue law enforcement organizations are approached to seek solution.
