      Abstract: the concept of the commons goes back to the thirteenth-century Magna Carta, which guaranteed the enjoying of “ancient liberties and free customs, both by land and by water.” These rights allowed all people free access to shared natural assets, which in turn required common care, for the benefit of all. Five hundred years later, in his Second Treatise, John Locke posited that individuals might appropriate ownership of natural assets through their labor.       Abstract: in his famous section, “so-called primitive accumulation,” in volume one of Capital, Karl Marx (1976, 883, 908) argued that the enclosure of the commons and the expropriation of the land and lives of peoples throughout the world constituted the necessary preconditions for the agricultural and industrial revolutions in England in the seventeenth and eighteenth centuries.1 The genesis of modern capitalism was the result of a process of worldwide expropriation that is still occurring today.       Abstract: the disappearance of the commons has generally meant their being converted into private property. In some instances where they have been converted into state property, such as forests in colonial India, the right to collect the products of these assets has been generally granted to private individuals for a price. Common resources, in short, have been transformed into objects for private appropriation, not for consumption by owners or lessees, but for sale.This should not be taken to mean a conversion of one form of property into another, of common property into private property.       Abstract: The extant literature on the private appropriation of common lands follows a well-beaten path, recounting the historical process in Europe from the sixteenth century of the transition from the system inherited from medieval agriculture to exclusively private capitalist property and production in agriculture.
