  • La racionalización jurídica de las relaciones laborales y la emergencia
           de nuevas fuentes reguladoras en el orden internacional

      Abstract: La globalización neoliberal no ha perdido su identidad y su pretensión autorreguladora respecto del Derecho Internacional y de la legislación territorializada de los Estados. La autorregulación expresa un pluralismo jurídico en virtud del cual existe una permanente tensión entre las fuentes extralegislativas (lex mercatoria, principalmente) y las fuentes clásicas del Derecho Internacional contemporáneo y las propias de los Derechos estatales. En el actual proceso de mundialización se está ante un nuevo pluralismo jurídico y un policentrismo jurídico. La lex mercatoria es un derecho de grupos empresariales creado para regular sus actividades sin interferencias de los Estados nacionales. Es a través de la lex mercatoria y la red de acuerdos formales e informales entre empresas y entre sectores económicos y entidades financieras donde se expresa la centralidad del derecho de la producción en la época de la economía global. Este derecho de la producción impulsa los valores e imperativos del sistema económico sobre los sistemas socio-políticos y culturales. Los límites de los gobiernos nacionales sobre el control de la economía de escala mundial han incidido en una erosión de la capacidad regulatoria del Derecho del Trabajo y también en un vaciamiento del proceso de democrático de toma de decisiones. Es así que los derechos sociales ha sido objeto de flexibilización (rectius, liberalización de las relaciones laborales) o de desconstitucionalización expresa o tácita.---------------------------------------------------------------Neo-liberal globalization has not lost its identity and its pretension self-regulating with respect to international law and the territorialized legislation of States. Self-regulation expresses a legal pluralism by virtue of which there is a permanent tension between the extralegislative sources (lex mercatoria, mainly) and the classical sources of contemporary international law and the rights inherent State. The lex Mercatoria is a right of business groups created to regulate their activities without interference from the national states. It is through the lex Mercatoria and the network of formal and informal agreements between companies and between economic sectors and financial institutions where the centrality of the right of production is expressed at the time of the global economy. This right of production promotes the values and imperatives of the economic system on the socio-political and cultural systems. The limits of national governments on the control of the global economy have affected the erosion of the regulatory capacity of labour law and also in an emptying of the democratic decision-making process. Thus, social rights have been the subject of flexibilization (Rectius, liberalization of labour relations) or of deconstitutionalization expressed or tacit.

  • Il contributo della giurisprudenza e degli studi giuridici
           all’effettività della Carta Sociale Europea nell’ordinamento
           italiano: cenni ricostruttivi

      Abstract: El il presente studio considera nella sua prima parte la giurisprudenza italiana che a vario titolo ha preso in considerazione la Carta sociale europea, mettendone in evidenza l’evoluzione. In primo luogo, vengono richiamate le pronunce della Corte di cassazione che reputano le norme della Carta prive di effetti in capo ai cittadini, cioè incapaci di creare diritti e obblighi in mancanza di un intervento preventivo, attuativo, da parte del legislatore domestico; e ciò anche quando tale intervento non sia necessario, alla luce del contenuto e dei termini impiegati in tale trattato. In secondo luogo, viene evidenziata una tendenza opposta a quella appena ricordata, recente, sempre della Corte di cassazione, volta a collocare la Carta e gli altri strumenti internazionali posti a garanzia dei diritti umani nella dimensione che mira all’integrazione delle garanzie tratte dai vari livelli ordinamentali, allo scopo di ottenere la maggior tutela possibile per ciascun individuo. Infine, viene presa in considerazione una recente sentenza della Corte costituzionale, la n. 178 del 2015, dalla quale emerge la ricerca di un’integrazione sistematica delle tutele, che coinvolge anche la Carta sociale e che è a sua volta coerente con la ricerca della massima garanzia possibile per i diritti coinvolti nei singoli casi di specie. Nella seconda parte del saggio, viene invece illustrato sinteticamente il contributo della letteratura giuridica italiana a favore del pieno riconoscimento della Carta nell’ordinamento interno. Emergono così tre importanti filoni. Il primo è rappresentato dal tentativo di scardinare l’idea che occorra sempre un intervento del legislatore italiano prima di poter dare effetto diretto alla Carta nel nostro ordinamento o per poter invocare di fronte ad un giudice nazionale la tutela più favorevole offerta dalle sue disposizioni. Il secondo filone teorico, che si collega al primo e in un certo senso è volto a superarlo, prescinde da una considerazione casistica degli effetti diretti della Carta nel nostro ordinamento, per proiettare invece tale strumento nel sistema globale di tutela dei diritti umani, laddove, nel momento della soluzione di casi concreti, il giudice ispira la propria interpretazione del diritto domestico rilevante anche alle norme esterne (internazionali e sovranazionali) pertinenti, nella prospettiva della massima espansione delle tutele. Il terzo filone teorico si fonda sulle interpretazioni che il Comitato europeo dei diritti sociali (CEDS) ha dato alla Carta nel corso della sua complessa e articolata attività di controllo. Vari autori hanno cercato – e seguitano a cercare – di estrapolare dalle complesse attività di controllo del Comitato dei canoni interpretativi che possano essere generalizzati e fatti quindi circolare tra gli studiosi, ma soprattutto accolti dai tribunali internazionali (Corte EDU e CGUE) e dai giudici di tutti gli Stati contraenti. In conclusione, si può affermare che la giurisprudenza rilevata e gli studi giuridici compiuti finora in Italia manifestano segni di un inesausto e profondo impegno, teso a dare piena effettività alla Carta sociale europea nell’ordinamento interno. Manca tuttavia un univoco e inequivoco riconoscimento della sua efficacia giuridica ad opera dei giudici comuni e della nostra Corte costituzionale, insieme ad un esplicito riconoscimento dell’efficacia vincolante delle decisioni rese dal CEDS nella sede dei reclami collettivi.----------------------------------------------------------------------The present study considers, in its first part, the Italian case-law which, for various purposes, has taken into consideration the European Social Charter, highlighting its evolution. Firstly, it presents the Court of Cassation's judgments that comply with the rules of the Charter but which have no effect on citizens. In other words, they are incapable of creating rights and obligations in the absence of a prior implementation by the domestic legislator; and this, even when such legal action is not necessary in the light of the content and terms used in that treaty. Secondly, there is a tendency opposite to the one recently and above-mentioned by the Court of Cassation that put the Charter and other international aiming to safeguard human rights in the dimension that integrate the guarantees derived from the various levels of legal orders in order to obtain the greatest possible protection for individuals. Finally, the study takes into account the recent ruling no. 178/2015 of the Constitutional Court which highlights the pursuit for systematic integration of the safeguards, and which also involves the Social Charter, consistent therefore with the pursuit for the maximum possible protection for the rights involved in the specific cases. In the second part of the essay is briefly illustrated the contribution of Italian legal literature in favor of the full recognition of the Charter in domestic law. Therefore, there are three important features. The first is the attempt to undermine the idea that an action by the Italian legislator is always necessary before giving direct effect to the Charter, or before invoking the most favorable protection afforded by its provisions before a national court. The second theoretical approach in relationship with the first, and in some way aiming to overcome it, is independent of the cases on direct effects of the Charter in our system.  Instead, this tool is placed into the global system of human rights protection, in which, in the instant of solving concrete cases, the court’s interpretation of domestic law considers relevant external (international and supranational) norms in the perspective of the maximum extension of protection.   • La coordinación comunitaria de la protección en situaciones de
           dependencia

      Abstract: Los refugiados se enfrentan a problemas de exclusión social, marginación y explotación debido a la insuficiencia de un marco jurídico uniforme que regule, de manera acorde a la realidad social, el estatuto para las personas con derechos a la protección subsidiaria. A este respecto, se deja en manos de los distintos ordenamientos jurídicos nacionales la aplicación de las reglas de juego en esta materia. Lo que, al tiempo, determina el establecimiento de sistema plural y discrecional que dependerá de la comunidad autónoma en la que se encuentre el ciudadano que solicita asilo, la situación administrativa, el tiempo de residencia y permiso en España. Por tanto, aunque el derecho al acceso a las prestaciones por dependencia se constituya como derecho colectivo social y universal, en la práctica únicamente podrán beneficiarse aquellos refugiados que cumplan con los requisitos que establecen las leyes de asilo, dependencia y extranjería en España.-------------------------------------------------------------------------The refugees are facing problems of social exclusion, marginalization and exploitation due to the lack of a uniform legal framework governing, way according to social reality, the Statute for persons with subsidiary protection rights. In this regard, is left in the hands of different national legal systems the application of the rules on this subject. What, at the time, determines the establishment of plural and discretionary system that depends on the autonomous community in which the citizen requesting asylum, the administrative situation is, the time of residence permit in Spain. Therefore, although the right to access to the dependency allowance is established as collective social and universal law in practice only benefit those refugees who meet the requirements that establish the laws of asylum, Unit and immigration in Spain.

      Abstract: The reformulation of the Welfare State in the framework of a changing social model and linked to a new reality that emerged after one of the greatest crises that this continent has experienced, is configured as an essential point of debate. De la formulation d’un cadre de réformes correctes, nous pourrons garantir sa continuité, bien que dans des termes différents de ceux actuels, ou faire face à de nouveaux modèles sociaux avec des taux plus élevés d'isolement et d'exclusion humaine, foyers propice de mouvements extrémistes sur la base de l'exclusion sociale.

      Abstract: Las mujeres se han incorporado al mundo laboral en situación de desventaja, cargando el rol de género que la sociedad les ha impuesto (principales responsables de los hijos y de la administración del hogar). El único reconocimiento que el Derecho Laboral les ha concedido son los derechos de las madres, los cuales si bien constituyen un avance, han dejado de evolucionar y no han podido transformarse en lo que debería ser: el “Derecho Familiar del Trabajo y de la Seguridad Social” y no sólo obligaciones y prestaciones para mujeres trabajadoras. Es por ello que este artículo incorpora un análisis jurídico de las prestaciones laborales vigentes para las madres trabajadoras en la iniciativa privada y su relación con el Derecho Familiar en México.----------------------------------------------------------------------------Women have entered the workforce in disadvantage, carrying with them a gender role imposed by society (they are responsible of taking care of the children and organizing the house administration). The only recognition that the Labor Law has granted to these women are the called “motherhood rights”; although they constitute an important improvement in the Law sector, they stopped evolving and did not become in what they really should be: “Family Labor and Social Security Law" and not only obligations and benefits for working women. Therefore, this article incorporates a legal analysis about the labor benefits for working mothers in the private initiative and its relationship with the Family Law in Mexico.

      Abstract: En este artículo se propone una aproximación al ejercicio del juzgamiento penal durante el gobierno de Juan Manuel Rosas (1829-1852) a través de la cual se  busca poner en tensión la idea de la existencia de un derecho penal, considerado como la  forma de contener y reducir el poder punitivo del Estado. Se aborda la práctica de impartición de justicia en la época en particular presentando dos casos de pena de muerte. Desde esta perspectiva, se concluye en la posibilidad de sostener que existía en aquellos tiempos un mero sistema penal.----------------------------------------------------------------In this article is proposed an approximation to the criminal trials practices during the government of Juan Manuel de Rosas (1829-1852) across which there is sought to put in tension the idea of the existence of criminal law, considered as the way of constraining and reducing the State punitive power. The practice of imparting justice is approached in this period especially presenting two cases of death sentence From this perspective, is concluded in the possibility of holding that a mere penal system existed in those times.

  • Los riesgos psicosociales en el trabajo: un reto colectivo en el
           desarrollo laboral cubano

      Abstract: El presente artículo deviene acercamiento a los riesgos psicosociales, tema que ha sido tratado por teóricos y prácticos del Derecho Laboral y de otras ciencias, y que incide en la gestión empresarial reviste a nuestra estima enconada polémica, detallando lo que se tiene y de lo que se adolece en el derecho patrio. Teniendo por objetivo argumentar la necesidad de configurar en la legislación laboral cubana los elementos que tipifiquen los riesgos psicosociales como factores de riesgos que propician la vulneración de los derechos de los trabajadores. Se emplearon los métodos de investigación propios de las ciencias jurídicas consistentes en el método teórico-jurídico, exegético-jurídico. Como principal resultado se encuentra la prevención de los riesgos psicosociales relacionados con el trabajo y la protección de la salud mental y el bienestar de los trabajadores en el ámbito normas jurídicas sobre seguridad y salud en el trabajo Y como conclusión la necesaria la inclusión de los riesgos psicosociales en estrategias y políticas nacionales sobre seguridad y salud en el trabajo.--------------------------------------------------------------This article becomes an approach to psychosocial risks, a topic that has been dealt with by the theorists and practitioners of Labor Law and other sciences, and which affects business management. It has to do with our controversial, bitter esteem, detailing what we have and what we have. it suffers in the native law. With the objective of arguing the need to configure in Cuban labor legislation the elements that typify psychosocial risks as risk factors that lead to the violation of workers' rights. We used the research methods of the legal sciences consisting of the legal-theoretical, exegetical-legal method. The main result is the prevention of psychosocial risks related to work and the protection of the mental health and well-being of workers in the field of legal norms on safety and health at work. And, in conclusion, the need to include the risks psychosocial strategies and national policies on occupational safety and health.

  • Les principaux piliers de a collaboration scientifique Et du « Bien-Etre
           » Academique. Exemple d’une recherche Internationale

      Abstract: À l’heure où l’enseignement supérieur semble glisser vers un « marché commun de l’éducation et de la formation », le débat sur l’amélioration des politiques éducatives universitaires suscite l’intérêt des chercheurs, hommes politiques et public large. Dans le cadre de cet article, nous abordons les principaux piliers pour la coopération scientifique et le « bien-être académique ». La recherche s’est basée sur un échantillon de chercheurs jeunes ou expérimentés provenant d’une vingtaine de pays de cinq continents. Les principaux défis académiques identifiés sont : la mobilité académique, les diplômes conjoints, l’influence de l’Union européenne, le financement et la bureaucratie administrative, la précarité du métier d’enseignant-chercheur, le réseautage international et « l’emprise anglaise » de la recherche, la vulgarisation scientifique et l’ingénierie éducative. Une série de solutions ont été proposées, parmi lesquelles on peut citer : la création d’un dispositif d’ingénierie éducative, l’affinement du cadre administratif-juridique pour les diplômes conjoints, l’accessibilité à l’enseignement supérieur, une meilleure gestion financière et un fort soutien aux jeunes chercheurs. Ces changements augmenteraient le « bien-être académique », renforceraient le courage, la confiance et la motivation d’agir, rendraient la mobilité plus fructueuse et l’éducation interculturelle plus prégnante.-------------------------------------------------------------------At the time where higher education seems to drag a “common market of education and training”, the debate on the improvement of university educational policies interests researchers, politicians and wide public. In this article, we analyse the main pillars for scientific cooperation and “academic well-being”. The search is based on sample of young and experienced researchers from twenty countries of five continents. The main academic challenges identified are: academic mobility, joint diplomas, influence of the European Union, financing and administrative bureaucracy, precariousness of the profession of professor/researcher, international networking and “English influence” on research and educational engineering. A series of solutions have been proposed, some of which including: the creation of a mechanism of educational engineering, refinement of the legal-administrative framework for joint degrees, accessibility to higher education, better financial management and strong support to young researchers. These changes would increase the "academic well-being", strengthen the courage, confidence and motivation to act, make mobility more fruitful and intercultural education more meaningful.

      Abstract: The reduction of protections in the event of an unlawful dismissal, made by the c.d. The Job Act issued in 2014-2015 by the Italian Parliament and Government, with a particular focus to workers hired after March 7, 2015, was the subject of an order submitted by the Labor Court of Rome to the Italian Constitutional Court, on suspicion of unconstitutionality. The legal construction used by the Judge highlights the violation of Article 24 ESC as an <<interposed (standard)rule>>. It is the first time that an Italian Labor Court has raised this issue so clearly. The comment aims to identify the different plans of protection measures in this kind of hypothesis.--------------------------------------------------------------------La réduction des protections en cas de licenciement illégal, faite par le c.d. Job Act promulguée en 2014-2015 par le Parlement et le Gouvernement italiens, en particulier les travailleurs embauchés après le 7 mars 2015, a fait l'objet d'une ordonnance du Tribunal du Travail de Rome devant la Cour constitutionnelle italienne, soupçonnée de inconstitutionnalité. L'interprétation juridique utilisée par le juge met en évidence la violation de l'article 24 CSE en tant que «règle interposée (standard)». C'est la première fois qu'un Tribunal du Travail italien soulève cette question si clairement. Le commentaire vise à identifier les différents plans de mesures de protection dans ce type d'hypothèse.

           los derechos sociales

      Abstract: Jean-Michel Belorgey nos presenta, en una excelente obra monográfica de excepcional valor bibliográfico y literario, un testimonio privilegiado de su experiencia como miembro, presidente y ponente general del Comité Europeo de Derechos Sociales durante más de una década (concretamente, doce años).Estructurado en doce capítulos, su estudio monográfico nos ofrece un análisis crítico del estatuto actual de los derechos sociales en Europa a través de una trama que se desarrolla en la sede del Comité Europeo de Derechos Sociales en Estrasburgo, el edificio “Agora”. El título, “Agorafobia”, es revelador de la crítica efectuada por el autor; el subtítulo, “la compleja construcción de la casa común europea de los derechos sociales” (que hemos incorporado con la amable autorización del autor) es exponente de los desafíos a los que se enfrenta la protección efectiva de los derechos sociales en Europa en el actual contexto de crisis.En efecto, el autor examina los avatares de la construcción de dicho edificio, el traslado a él del Comité Europeo de Derechos Sociales (tras ser “desgajado” del Tribunal Europeo de Derechos Humanos junto al que se encontraba en la sede actual de la jurisdicción europea de los derechos civiles y políticos, en detrimento “estético” o “cosmético” del principio de indivisibilidad de todos los derechos humanos que proclama explícitamente en su Preámbulo la Carta Social Europea revisada de 1996) y, sobre todo, los complejas relaciones humanas, políticas, diplomáticas y burocráticas que se desarrollan en el “Ágora”.En particular, el hilo argumental del autor consiste en presentar su compromiso a favor de los derechos sociales y de la dignidad humana a través de una compleja construcción en la que influyen factores diversos que sitúan al Consejo de Europa como el edificio que alberga una gran empresa común europea (a veces subversiva, a veces acertada, en el modo de seleccionar a sus dirigentes políticos, a sus burócratas, a su personal administrativo y a los miembros de sus numerosos órganos de monitoreo, entre los que destaca justamente el Comité Europeo de Derechos Sociales), es decir, la Organización paneuropea por excelencia.En este sentido, “Agorafobia” tiene un marcado carácter biográfico y autobiográfico, que narra con tono crítico e irónico la vida cotidiana en el “Ágora” (en sus salas de reuniones, en sus pasillos, en sus despachos, en la cafetería, etc.) alrededor del funcionamiento interno del Comité Europeo de Derechos Sociales y sus miembros, así como del personal del Servicio de la Carta Social Europea, en el contexto de unas relaciones humanas complejas (con numerosas reuniones, celebraciones, conspiraciones, contradicciones -“no hay reuniones públicas en el Ágora”- conflictos de competencia e incompetencia, espacios de inmunidad, opresión burocrática, pausas-café, etc.) en las que están implicados desde el Secretario General del Consejo de Europa hasta los camareros de la cafetería del “Ágora”, pasando por los servicios de seguridad o de traducción e interpretación. Jean-Michel Belorgey somete a escrutinio interesantes paradojas como el hecho de que la política de personal del Consejo de Europa no esté sometida a los estándares de la Carta Social Europea, o que los recursos dedicados a la defensa de los derechos sociales sean deficitarios.En fin, “Agorafobia” permite entender mejor los retos a los que se enfrenta la efectividad cotidiana de los derechos sociales en beneficio de los ochocientos millones de personas que viven en Europa. La obra de Jean-Michel Belorgey es una apuesta para superar las “fobias” que afectan a los derechos sociales, de tal suerte que el “Ágora” debe erigirse en la verdadera “Casa común europea de los derechos sociales” y, en paralelo, la Carta Social Europea (y la jurisprudencia del Comité Europeo de Derechos Sociales) ha de considerarse como la real “Constitución Social de Europa”, sin perjuicio de las sinergias con la Unión Europea que se promueven en el marco del denominado “Proceso de Turín”. En suma, la Carta Social Europea debe ser asumida como el auténtico pilar europeo de los derechos sociales.----------------------------------------------------------------------------Jean-Michel Belorgey presents us, through an excellent monographic study of exceptional bibliographic and literary value, a privileged testimony of his experience as a member, president and general rapporteur of the European Committee of Social Rights for well over a decade (specifically, twelve years).       Structured in twelve chapters, its monographic study offers us a critical analysis of the current status of social rights in Europe through a plot that takes place at the headquarters of the European Committee of Social Rights in Strasbourg, the "Agora" building.
