  • Responsibility of the Administrators in Non-Profit Organizations

    • Abstract: Resumen Las Entidades Sin Ánimo de Lucro (ESAL) son organizaciones creadas para el beneficio de comunidades vulnerables y su buen funcionamiento es responsabilidad de su administrador. Pero ¿hasta dónde llega la responsabilidad de un administrador de este tipo de entidades' Este artículo analizará las normas que rigen a las sociedades comerciales y las ESAL, así como los alcances, particularidades e interpretaciones que enmarcan la responsabilidad de los administradores de este tipo de entidades. La regulación a las ESAL y a sus representantes es un ejemplo de caso en que la analogía ofrece soluciones a vacíos normativos y ayuda a armonizar las ramas del derecho en beneficio de la organización y su fin.Abstract Non-Profit Organizations (NOPs) were created to benefit vulnerable communities; their proper functioning is their administrators’ responsibilities. Nevertheless, how far does the responsibility of an administrator of this type of entity go' This article analyzes the regulations that govern commercial firms and NPOs, as well as the scope, particularities and interpretations that frame the responsibility of the administrators of Non-Profit Organizations. Regulating NPOs and their representatives is an example case in which analogy offers solutions to regulatory gaps and helps to harmonize the branches of law for the organizations’ benefit and their purpose.
       
  • The Hermeneutics and Phenomenology in Research in Human and Social
           Sciences

    • Abstract: Resumen Este artículo de reflexión problematiza las relaciones entre la fenomenología y la hermenéutica como lugares epistémicos del quehacer investigativo por medio de un abordaje documental construido en dos fases. En primer lugar, el texto reflexiona alrededor del uso terminológico presente en los paradigmas, enfoques, perspectivas epistemológicas y métodos investigativos, identificando con ello que no existe unicidad de criterios en sus referencias y aproximaciones en los tratados de metodología de la investigación analizados. De igual manera, se evidencian que hay propuestas metodológicas que comprenden la fenomenología y la hermenéutica de manera complementaria, articulada o aislada sin permitir con ello lugares precisos de comprensión que permitan situar su aplicación en la investigación. En razón de lo anterior, la segunda fase propone una aproximación individual a los antecedentes y comprensiones de la fenomenología y la hermenéutica, identificado particularidades que les caracterizan, posibles diferencias teórico-prácticas y aproximaciones que se pueden establecer de cara a su relevancia desde el marco epistémico y metodológico de la investigación en las ciencias humanas y sociales.Abstract This article of reflection problematizes the relationships between phenomenology and hermeneutics as epistemic places of research work through a documentary approach built in two phases. First, the text reflects on the terminological use present in the paradigms, approaches, epistemological perspectives and research methods, thereby identifying that there is no unique criteria in its references and approaches in the research methodology treaties analyzed. In the same way, it is evident that there are methodological proposals that include phenomenology and hermeneutics in a complementary, articulated or isolated way without allowing precise places of understanding that allow placing their application in research. Based on the foregoing, the second phase proposes an individual approach to the background and understandings of phenomenology and hermeneutics, identifying particularities that characterize them, possible theoretical-practical differences and approaches that can be established for their relevance from the framework Epistemic and methodological research in social human sciences.
       
  • Approaches to the Concept of Social Imaginary

    • Abstract: Resumen El artículo ofrece una serie de elementos para introducir al lector en la comprensión del concepto de imaginario social, concepto polivalente que cuenta con una importante tradición y amerita un acercamiento minucioso; un concepto abierto que, en la actualidad, se nutre de perspectivas que lo enriquecen y matizan. En respuesta a dicha situación, se exponen algunos puntos para situar los referentes de su discernimiento, lo que a su vez lo diferencia de conceptos y términos que suelen ubicarse como equivalentes. También se presentan las ideas centrales que, frente al mismo, han desarrollado tres autores que hacen parte de dos corrientes intelectuales: Cornelius Castoriadis, Manuel Antonio Baeza y Juan Luis Pintos. Finalmente, se destaca la riqueza conceptual del imaginario social, su utilidad en el debate teórico-metodológico y práctico de la ciencia social, así como se pretende estimular la discusión e interés al rededor del mismo. En particular, se resalta la posibilidad que abre para contrarrestar el anquilosamiento que produce el afán de proponer y hacer uso de conceptos definidos y cerrados, una suerte de lugar común de la “ciencia verdadera”, ofreciendo caminos innovadores para el ejercicio de la ciencia social en un contexto tan maleable y dúctil como el contemporáneo y, que al ser situado en el escenario latinoamericano y nacional, encuentra panoramas contradictorios y por qué no, hasta irracionales.Abstract This article offers a series of elements to introduce the reader to the understanding of the concept of social imaginary. This is a polyvalent concept with an outstanding tradition that deserves a detailed approach and that, at present, is nourished by perspectives that enrich and nuance it. In this situation, the references of its discernment are placed, which in turn differentiates it from concepts usually located as equivalent. The central ideas developed by Cornelius Castoriadis, Manuel Antonio Baeza and Juan Luis Pintos, who are part of two intellectual currents, are also presented. Finally, the text highlights the conceptual richness of the social imaginary and its usefulness in the theoretical-methodological and practical debate of social science and aims to stimulate the discussion and interest around it. In particular, it emphasizes the possibility that it opens to counteract the stagnation produced by the eagerness to propose and make use of defined and closed concepts, a sort of commonplace of “true science”. Moreover, the search offers innovative paths for the exercise of social science in a context as malleable and ductile as the contemporary one and that, when placed on the Latin American and national scenario, finds contradictory and even irrational views.
       
  • The family: the First Area of Civic Education

    • Abstract: Resumen Las circunstancias históricas y sociales actuales que evidencian un deterioro de la democracia y de la capacidad para actuar como ciudadanos críticos y reflexivos, exigen fortalecer tanto los ejercicios de formación ciudadana como el rol de los nuevos actores. En el caso del presente artículo se explora el rol de la familia en la educación cívica. El objetivo de este texto es mostrar que la familia es un ámbito educativo central en la formación de un conjunto de virtudes cívicas y, por ende, en el desarrollo de una capacidad ética de actuación política.Abstract The current historical and social circumstances, which evidence a deterioration of democracy and of the capacity to act as critical and reflexive citizens, demand the strengthening of both citizen training exercises and the role of new actors. In the present essay, the role of the family in civic education is explored. The text aims to demonstrate that the family is a central educational sphere in the formation of a set of civic virtues and, therefore, in the development of an ethical capacity for political action.
       
  • Social Division by Strata, Materialism, and the Situation of Dogs in
           Colombia

    • Abstract: Resumen La presente investigación examina una serie de variables que influyen en la preferencia de los dueños de perros de raza en Colombia, así como la forma en que la estratificación social modera esta relación. Se elaboró una investigación de orden cuantitativo, utilizando una encuesta estructurada como herramienta de recogida de información. El trabajo de campo se llevó a cabo en Bogotá. La muestra está formada por dueños de perros de la capital de Colombia. A través de la metodología SEM, test de invarianza y análisis multi-grupo, los resultados muestran que el materialismo influye en la percepción social de los dueños sobre los perros de raza; los perros de dueños más materialistas muestran mayores problemas de comportamiento, lo que influye en la intención de los dueños de abandonarlos. En la mayoría de los casos, estas conductas se presentan en menor intensidad en los ciudadanos de estratos medio y alto que en aquellos que viven en estratos bajos.Abstract This paper examines a series of variables that influence the preference of purebred dogs in Colombia, and the role of social stratification regarding this matter. A quantitative methodology was elaborated using a structured questionnaire as data recollection tool. The sample was made up of dog owners in Bogotá, the capital of Colombia, where the fieldwork was conducted. Through the SEM methodology, invariance test and a multiple-group analysis, the results show that materialism influences the social perception about purebred dogs; the dogs of more materialistic owners show greater behavioral problems, which influences owners’ intention to abandon them. In most of the cases, these behaviors are less intense in citizens of middle or high strata than in those living in lower strata.
       
  • Rururban gentrification in intermediate cities Theoretical and normative
           approaches in the cases of the ‘vereda’ La Florida, Villamaría
           (Manizales, Caldas) and the ‘vereda’ Clarete (Popayán, Cauca),
           Colombia

    • Abstract: Resumen Este artículo analiza y discute la naturaleza del proceso de gentrificación rururbana que se está desarrollando en la vereda La Florida (Villamaría, Caldas) y la vereda Clarete (Popayán, Cauca), Colombia. Los casos examinados permiten una revisión teórica-conceptual y normativa que contribuye a esclarecer, desde una perspectiva comparativa, los procesos de gentrificación que vienen ocurriendo en dos ciudades intermedias en Colombia. De un lado, se presenta un proceso residencial intensivo que revela el resultado de una especulación inmobiliaria (caso La Florida), y del otro, se documenta un proceso de transformación territorial que implica un reordenamiento de las relaciones entre campesinos y profesionales citadinos (caso Clarete). Conceptos como el de gentrificación rururbana, territorialidad, territorialización y ordenamiento territorial resultan pertinentes para explicar lo que sucede en la frontera urbano-rural. A nivel metodológico, nos apoyamos en la investigación documental y etnográfica territorial realizada a través de entrevistas abiertas y estructuradas, observaciones, recorridos topográficos, y compendios fotográficos.Abstract This paper analyzes and discusses the nature of the rural gentrification process that is taking place in the La Florida vereda (rural division) in Villamaría (Caldas) and Clarete vereda (Popayán, Cauca), Colombia. The cases studies examined allow a theoretical-conceptual and normative revision that contributes to clarify, from a comparative perspective, the rural gentrification processes that have been occurring in two intermediate cities in Colombia. On the one hand, an intensive residential process is revealed as the result of real estate speculation, which implies an increase in equipment, services and infrastructure (La Florida case). On the other, a documented process of territorial transformation implies a rearrangement of the relations between peasants and city professionals (Clarete case). Concepts such as rural gentrification, territoriality, territorialization, spatial planning and land-use planning are pertinent to account for what happens in the urban-rural border. At the methodological level, we rely on documentary and ethnographic territorial research achieved through workshops, open and structured interviews, observations, topographical tours, and cartography and photographic compendia.
       
  • The Zapatista Subject and His Political Project. An Analysis from Core

    • Abstract: Resumen El propósito de este artículo fue analizar la producción intelectual y científica más importante sobre la propuesta de sujeto político postulada por el zapatismo en los espacios académicos de América Latina. Este análisis se apoyó metodológicamente en revisión documental y cartografía conceptual dado que permiten contrastar el discurso ideológico de los zapatistas tanto con los hechos y procesos político-sociales de México como con los estudios elaborados al respecto sobre este fenómeno. Los resultados de esta investigación muestran que el sujeto político zapatista es una formulación intelectual e ideológica que busca ser materializada por quienes integran y apoyan la propia movilización de los rebeldes del sureste chiapaneco.Abstract The purpose of this article is to analyze the most important intellectual and scientific production that has been written about the discussion of the proposed political subject postulated by Zapatismo in the academic spaces of Latin America. This analysis is supported methodologically in the documentary review and conceptual cartography that allows contrasting the ideological discourse of the Zapatistas both with the political-social facts and processes of Mexico and with the studies elaborated on this phenomenon. The results of this investigation show that the Zapatista political subject is an intellectual and ideological formulation that seeks to be materialized by those who integrate and support the own mobilization of the rebels of southeastern Chiapas.
       
  • Youth Participation in the Community Environment

    • Abstract: Resumen La participación comunitaria de los jóvenes entenderá la heterogeneidad y diversidad de formas y ámbitos de su propia participación. Así, contrario a lo que se presupone, encontramos altos niveles de participación, reflejado en el estudio realizado en diversos barrios con jóvenes de sectores vulnerables en Chile. De esta manera podemos verificar que los jóvenes encuentran, en ámbitos locales, respuestas a sus necesidades, las que habían perdido por la desafección y lejanía de la participación política y ciudadana convencional.Abstract Young people participating in community spaces will understand the heterogeneity and diversity of forms and environments, from there, they construct their definition of participation. In the study conducted in various neighborhoods with young people from vulnerable sectors in Chile, contrary to what is assumed, we found high levels of youth participation. In this way, we can verify that young people find answers to their needs in local areas. Answers that they had lost due to disaffection and distance of conventional political and citizen participation.
       
  • Social Market Economy versus Rentier Capitalism. Reflections for Latin
           America

    • Abstract: Resumen El presente artículo es un estudio comparado de tres modelos de organización económica: economía de mercado “des-regulada”, capitalismo de Estado y la economía social de mercado. El primer y el segundo modelo son analizados como caminos que conducen, paradójicamente, en una dirección similar, hacia un capitalismo rentista. Por contraposición, se presenta el enfoque de la ESM como un modelo alternativo, constituido por un marco institucional que propone prevenir o combatir conductas de tipo rentista. Entendemos que la región Latinoamericana vive una coyuntura histórica que, a pesar de los desafíos estructurales y de un contexto internacional con altas dosis de incertidumbre y riesgos, luce como propicia para discutir nuevos conceptos capaces de armonizar crecimiento económico y desarrollo social.Abstract The present article studies and compares three models of economic organization: the deregulated economy, state capitalism, and the social market economy. Both the first and the second model are analyzed as paths that paradoxically lead in a similar direction: toward rentier or crony capitalism. On the other hand, the SME approach is presented as an alternative model, consisting of an institutional framework that proposes to prevent or combat rentier type behaviors. We argue that the Latin American region is experiencing a historical conjuncture which, despite structural challenges and an international context with a high dose of uncertainty and risks, seems conducive to discussing new concepts capable of harmonizing economic growth and social development.
       
  • Intellectual Property and Innovation Process under Goal 17 of Sustainable
           Development

    • Abstract: Resumen En este documento se presenta un debate conceptual centrado en la visión básica de la ciencia y la tecnología, la cual es el propósito principal y el marco de referencia de los documentos producidos al respecto por las Naciones Unidas y los Objetivos de Desarrollo Sostenible (SDG) de la Agenda 2030. La intención y el objetivo de aquellos documentos es la transferencia de tecnología, que conlleva el riesgo de no reconocer otras opciones tecnológicas -como la ecotecnología- y el limitado papel que representan la ciencia y la innovación en el logro de estos Objetivos de Desarrollo Sostenible. Nos centramos en los aspectos más amplios de los enfoques del derecho internacional de patentes que se aproximan a los incentivos de la transferencia tecnológica y el proceso de innovación. Este artículo contribuye a la visión general teórica del derecho de patentes en el proceso de aplicación del uso de la propiedad intelectual en el contexto internacional. En conclusión, discutimos, de acuerdo con la revisión de la literatura, la posibilidad de mantener el medio ambiente considerando la transferencia tecnológica y el proceso de innovación como soluciones para los desastres mundiales. Se proponen objetivos de desarrollo sostenible para la misma prevención, que deben ser claros para todos los países del mundo.Abstract This paper presents a conceptual discussion focused on the basic vision of science and technology, which is the primary purpose and reference framework of the produced United Nations’ documents and the Sustainable Development Goals (SDGs) of the 2030 Agenda. The most important intention and the objective of these documents is the technology transfer, which carries a risk of not recognizing other technological options-such as eco-technology-and the limited role representing science and innovation in the achievement of these Sustainable Development Goals. We focused on the broader aspects of international patent law approaches that approximate to incentives of technological transfer and innovation process. This article contributes to the theoretical overview of patent law in the application process of intellectual property use in the international context. In conclusion, we discussed, according to the literature review, the possibility of maintaining the environment by considering technological transfer and innovation process as solutions for world disasters. Sustainable development goals are proposed for the same prevention, which should be clear for every country in the world.
