  • The prohibition of introducing into the market products that are dangerous
           when used normally or in a reasonably foreseeable way

    • Abstract: Resumen La responsabilidad penal del fabricante por los delitos de homicidio y lesiones presupone, en muchos casos, la infracción de la prohibición de colocar en el mercado productos que sean peligrosos en caso de empleo conforme a su finalidad o racionalmente previsible. El propósito de este artículo consiste en analizar pormenorizadamente esta prohibición. Producers’ criminal liability for death and personal injuries presupposes, in a number of cases, the infringement of the prohibition of introducing into the market products that are dangerous when used normally or in a reasonably foreseeable way. This paper intends to provide a detailed analysis of such prohibition.
       
  • Tax hypothesis: Conceptual approach and application’s possibility for
           the strengthening of the Chilean tax system

    • Abstract: Resumen En el presente trabajo se examinan los alcances que la doctrina brasileña de derecho tributario ha otorgado a la denominada teoría de la hipótesis tributaria, a objeto de que sea incorporada en Chile a través de argumentos que el propio autor propone. The following paper examines the motives which Brazilian doctrine of tax law has had on the theory of the tax hypothesis, in order to be incorporated in Chile through arguments that the author himself proposes.
       
  • The functional scope of the paritary commissions in the Spanish legal
           order. A comparative legal antecedent of the bipartite commissions for the
           implementation and monitoring of the compliance of collective instruments
           in Chile

    • Abstract: Resumen Este artículo analiza el ámbito funcional de las comisiones paritarias de la negociación colectiva en el ordenamiento jurídico español, centrando el estudio en las competencias más relevantes de dichas comisiones (con especial énfasis en la delimitación entre la administración y la negociación del convenio colectivo, y el papel de estas comisiones en la solución extrajudicial de conflictos laborales), y en la eficacia jurídica de sus pronunciamientos en el ejercicio de sus distintas funciones. El estudio del modelo español importa una contribución al actual debate sobre la solución de conflictos colectivos en Chile, principalmente en lo que dice relación con la institucionalización reciente de las comisiones bipartitas para la implementación y seguimiento del cumplimiento de instrumentos colectivos. En efecto, se identifican elementos fácticos y normativos que permiten hacer un contrapunto entre ambos sistemas normativos. This article analyzes the functional scope of the paritary committees of collective bargaining in the Spanish legal system, focusing the study on the most relevant powers of these committees (with special emphasis on the delimitation between the administration and the negotiation of the collective agreement), and the legal effectiveness of its pronouncements in the exercise of its various functions. The study of the Spanish model brings a contribution to the current debate on the solution of collective conflicts in Chile, mainly in relation to the recent institutionalization of bipartite commissions for the implementation and monitoring of collective instruments compliance. Indeed, factual and normative elements that allows to make a counterpoint between both normative systems are identified.
       
  • Legal aspects on managed aquifer recharge (MAR). Survey from the Chilean
           water law, with reference to Spain and Australia*

    • Abstract: Resumen En este trabajo se realiza una descripción fáctica acerca de la Recarga Artificial de Acuíferos en cuanto objeto de estudio, para luego realizar un análisis de dos casos de la regulación dictada especialmente: España y Australia. Luego se expondrá analíticamente la regulación de aguas vigente en Chile aplicable al caso de estudio a nivel legal, reglamentario y de soft law, realizando enseguida un análisis crítico de ello. Finaliza el trabajo con las conclusiones correspondientes. In this paper the object of study is the Artificial Aquifier Recharge, followed by an thorough analysis of two cases of special regulation: Spain and Australia. Also, there will be an analytical exposition of the current Chilean Regulation of Waters, on different levels, including the legally, regulatory and soft law approach, finishing with a critical analysis and the conclusions.
       
  • The no functional equivalence between the electronic proof and the
           documentary proof: A reading from the Colombian procedural regulation

    • Abstract: Resumen El principio de equivalencia funcional se constituyó en el vehículo para que la prueba electrónica pudiera ser ingresada al proceso civil con plenos efectos de eficacia y validez a fin de que el juez del conocimiento la admitiera y valorara según el estándar establecido para la prueba documental. Sin embargo, la prueba electrónica dista en gran medida de la prueba documental, lo que pone en duda la veracidad de este principio de equivalencia funcional y, a su vez, la efectividad de la prueba electrónica en el juicio civil. The principle of functional equivalence constituted the vehicle so that the electronic proof could be entered into the civil trial with full efficacy and validity effects in order that the judge of civil process would admit them and evaluate them according to the standard established for the documentary proof. However, the electronic proof is far distance from the documentary proof, questioning severely the veracity of this principle of functional equivalence, and in turn, the effectiveness of the electronic proof in the civil trial.
       
  • Trial by Jury - The experience of Buenos Aires and Neuquén, Argentina

    • Abstract: Resumen La implementación del juicio por jurado, siguiendo el modelo clásico angloamericano, ha estado en el centro del debate de la academia procesal penal argentina, desde que se introdujo ese instituto en la primera Constitución Política de 1853. Recién en la segunda década del siglo XXI dos provincias -Neuquén y Buenos Aires- pusieron en marcha ese modelo, lo cual permite contar con información empírica relevante para reconfigurar aquellas viejas confrontaciones. De igual modo, esta enriquecida disputa, derivada de la experiencia dada en contextos culturales similares, permite desarrollar programas de reformas en otros países de Latinoamérica, destinados a poner en vigencia el sistema de juicio por jurados, trazándose como principales objetivos la participación ciudadana, un aumento en la percepción positiva de la comunidad del Poder Judicial, y una mejora en la administración de justicia. The implementation of Trial by Jury, following the classic Anglo-American model, has been in the center of debate by argentine criminal procedure academia, since the first Constitution introduced it in 1853. But only in the second decade of the 21st. Century two provinces -Neuquen and Buenos Aires- started up that model. That allows us to have relevant empirical information to reconfigure that old discussion. In the same way, this dispute -enriched by the experience of similar cultural contexts- permits the development of reform programs in other Latin-American countries, destined to put in force the Jury by Trial Procedure, with citizen participation, positive perception of justice administration and its improvement, as main objectives.
       
  • Self defense and choosing the less damaging mean

    • Abstract: Resumen La legítima defensa es procedente como causal de justificación cuando la acción defensiva ha sido racional y necesaria. Un criterio que se emplea para valorar la acción defensiva consiste en que esta sea el resultado de la elección del medio menos lesivo por parte del sujeto. Este trabajo pretende justificar que dicho criterio es derrotable y una mala generalización acerca de la “necesariedad” de la defensa, y, además, no cumple con la máxima “debe implica puede”, sobre la base de estudios de la neurobiología y de la psicología. Self defense justifies actions if the defense has been rational and necessary. One of the criteria applied to value the action, is that the defender should use only the minimum force required to achieve the defensive goal. Thus, the defender should choose the less damaging mean from all the available options to defend himself (lesser evil). This paper attempts to give reasons to argue that the criterion of “minimum force” is defeatable, is a bad generalization about defensive actions and it is contrary to the criterion “ought implies can”. I will back up these statements using empirical research from Neurobiology and Psychology.
       
  • The duty to identify the beneficial owner in companies: Some difficulties
           related to the scope, implementation and effectiveness of this new
           anti-money laundering and against terrorist financing measure

    • Abstract: Resumen En 2017 la Unidad de Análisis Financiero ha emitido la Circular Nº 57/2017, que establece el deber, para diversos actores del sistema financiero, de identificar al denominado “beneficiario final”. Esta medida busca determinar quiénes son las personas naturales que finalmente poseen, directa o indirectamente, a través de sociedades u otros mecanismos, una participación igual o mayor al 10 % del capital o de los derechos a voto de una persona jurídica, así como aquellas que, sin perjuicio de poseer directa o indirectamente una participación inferior al 10 % del capital o de los derechos a voto de una persona jurídica, a través de sociedades u otros mecanismos, ejercen el control efectivo en la toma de decisiones de la persona jurídica. La adopción de esta medida se considera fundamental para prevenir efectivamente el lavado de activos y el financiamiento del terrorismo. El objetivo de este trabajo consiste en examinar dicha circular, con miras a identificar algunas dificultades que puede plantear su implementación respecto de las sociedades en nuestro país, en el marco de una prevención efectiva del lavado de activos y del financiamiento del terrorismo. In 2017 the Financial Analysis Unit has issued Circular Nº 57/2017, which establishes the duty, to various actors of the financial system, to identify the “beneficial owner”. This measure seeks to determine who is (are) the natural person (s) who finally owns (n), directly or indirectly, through companies or other mechanisms, a share equal to or greater than 10% of the capital or the voting rights of a legal person, as well as those which, despite possessing directly or indirectly a participation of less than 10% of the capital or of the voting rights of a legal person, through societies or other mechanisms, exercise effective control in the decision-making process of the legal person. The adoption of this measure is considered essential to prevent money laundering and terrorism financing effectively. The aim of this paper is to analyze Circular Nº 57/2017, in order to identify some barriers that its implementation can raise regarding the companies in our country within the framework of an effective money laundering and financing of terrorism prevention.
       
  • Problems of the intellectual property law of plant varieties protection in
           Chile

    • Abstract: Resumen En este trabajo se tratan algunos de los problemas que existen en cuanto al derecho del obtentor de variedades vegetales en Chile, específicamente con respecto al objeto y el régimen jurídico de la institución, acusándose el vacío existente en el campo de las acciones protectoras en el ámbito civil y las consecuencias de tal carencia. Se examina si en la dogmática y en la jurisprudencia se ha dado alguna respuesta certera con respecto al problema, o bien si, lejos de ello, existe un panorama marcado por la incerteza jurídica. This paper intends to highlight some questions that may arise regarding the breeder’s right of plant varieties in the field of Chilean civil law and more specifically on the regulation or legal regime of the institution and development on protective actions in the field civil. To thus analyze whether in the dogmatic and jurisprudence have given an answer around the area or far from it have caused a landscape marked by legal uncertainty.
       
  • Gender identity of children and adolescents: A matter of rights

    • Abstract: Resumen Este trabajo tiene por objeto defender el derecho fundamental de niños, niñas y adolescentes (NNA) a su identidad de género. Afirmamos que los NNA gozan de un derecho constitucional a la autodeterminación de género, el que encuentra reconocimiento también en el derecho internacional de los derechos humanos. Tratándose de un derecho constitucional, los NNA son titulares de ese derecho y gozan de autonomía progresiva para efectos de su ejercicio. Nos distanciamos así de posturas que asumen la situación de los NNA como una de carácter eminentemente médico o patológico -postura que ha encontrado fuerte eco en nuestra jurisprudencia-, en los casos en que ellos expresan o reclaman su propia identidad, o como un asunto en que son los padres y madres o adultos responsables quienes deben intervenir, excluyéndolos de la definición de esta identidad. This paper defends the fundamental right of children and adolescents to gender identity. We contend that children and adolescents are constitutionally entitled to autonomously determine their gender identity, a right which is also recognized in the international human rights law. As bearers of constitutional rights, children and adolescents can autonomously exercise their right to gender identity in accordance with their age and maturity. We then take distance from those approaches which either hold that children are incapable of autonomous exercise of rights, being a decision to be taken by their parents or any other responsible adult, or that see gender identity issues as medical or pathological matters -an approach that our jurisprudence has mistakenly endorsed-.
       
  • The principles of Environmental Law: Concretions, insufficiencies and
           reconstruction

    • Abstract: Resumen Este trabajo plantea una exploración en relación con los principios que se han ido desarrollando en el contexto del derecho internacional del medio ambiente, haciendo énfasis en su articulación en torno a la noción comprehensiva de desarrollo sostenible. Sucesivamente, se examina su impacto en la configuración del derecho constitucional de los Estados, para apreciar cómo estos principios pueden configurar el núcleo axiológico de un eventual derecho constitucional ambiental con vocación global. A continuación, se determinan las debilidades del modelo tal como ha ido configurándose históricamente y se termina por proponer una reconfiguración, con el objeto de proporcionar armas que permitan un control efectivo del poder en relación con las medidas que enmarcan las actividades humanas con impacto en el medio ambiente. This paper intends an exploration regarding the principles developed so far within the framework of international environmental law, underlining how they have been organized around the paramount concept of sustainable development. Then its impact in the configuration of national constitutional law is analysed, aiming to appraisal how these principles can result into the axiological core of an eventual constitutional environmental law with a global vocation. At this point the weaknesses of the model as has been constructed historically are also examined, finishing by proposing a reconstruction, addressed to provide tools for an effective control of power, regarding the decisions which frame the human activity with environmental impact.
       
  • Interpreting or creating the law' A critical approach to the judicial
           understanding of section 171 of the Labor Code

    • Abstract: Resumen En este artículo se sostiene críticamente que la aplicación que los tribunales hacen de la regla del artículo 168, inciso final, del Código del Trabajo al supuesto del despido indirecto (artículo 171), no es resultado de una tarea hermenéutica, sino creadora del derecho. Al amparo del principio protector del derecho laboral, los jueces modifican la valoración de los supuestos fácticos hecha por el legislador al momento de dictar la ley. De este modo, los jueces se erigen ellos mismos en legisladores. The purpose of this paper is to analyze a Labor case law which consists in the extension of a rule of section 168 final paragraph of the Labor Code to a different hypothetical, that of section 171. It states that judicial enforcement of section 168’s rule to those situations covered by section 171 ensues not as the product of judicial interpretation but as an outcome of judicial activism. Under the claim that they are applying a central principle of Labor Law, judges alter legislator’s intent by attaching a different juridical value to factual premises underlying the legal text. By this fashion, judges become legislators themselves.

    • Abstract: Resumen Las exigencias constitucionales de equidad y solidaridad territorial inspiran el actuar del conjunto de los órganos del Estado y, particularmente, vinculan al legislador a la administración para lograrlas, a través de herramientas que cuestionan la autonomía de los territorios. The constitutional requirements of equity and territorial solidarities inspire the actions of all the organs of the State, and particularly link the legislator to the administration to achieve them, through tools that question the autonomy of the territories.

Esto es así porque la realización de una sociedad justa implica que los ciudadanos puedan hacer un uso efectivamente equivalente de las libertades que están formalmente protegidas. De lo contrario, las libertades de todos los ciudadanos no están protegidas por igual. Redistributive taxes and their philosophical justification has only recently begun to be debated in contemporary discussions on tax reform. In this paper I present a reconstruction of the value of liberty as a plausible and attractive justification of redistributive taxation. The main argument states that equal protection of citizens’ liberty requires economic resources to efficient institutions, but, in addition, it requires approximately equally redistribution of economic resources among the population. A just society implies citizens who can make effective and approximately equal use of the liberties that are formally protected. Otherwise, the liberties of all citizens are not equally protected.
