  • Over-indebtedness and the paradigms of the responsible financial consumer
           and the professional finance provider

    • Abstract: RESUMEN El presente artículo analiza el estándar de diligencia esperable del consumidor financiero en el sistema jurídico nacional, advirtiendo su usual formulación casi en exclusiva a partir de la posición en la que este queda una vez cumplidos los deberes de información por parte del proveedor. No obstante, nos parece que tal acercamiento no revisa el comportamiento esperable por parte del proveedor financiero, quien, a la luz del deber de profesionalidad, se encuentra en mejor posición para aplicar medios preventivos para evitar que el deudor se enfrente al dilema del sobreendeudamiento.ABSTRACT This paper analyzes the expected diligence on the part of the financial consumer in the Chilean legal system, noting that its usual formulation almost exclusively arises from the position in which she is left once the information duties of the provider have been fulfilled. However, we believe that the said approach does not consider the expected behavior of the financial provider, who, in light of its duty of professionalism, is in a better position to apply preventive tools to avoid the debtor from facing the over-indebtedness dilemma.
       
  • Justice, procedure, and revision action. The culpability principle facing
           res judicata

    • Abstract: RESUMEN El trabajo presenta una reconstrucción racional de la regulación de la acción de revisión, plasmada en el Código Procesal Penal, que se sustenta en una caracterización del proceso penal como un contexto de justicia procedimental impura e imperfecta. Sobre esta base se explica cómo la regulación de la revisión es indicativa de un compromiso con un “principio de valoración asimétrica” del riesgo de una decisión sustantivamente injusta. Después de ofrecer una sistematización de las cinco causales de revisión legalmente previstas, el artículo se cierra con una doble desambiguación de la noción procesalmente relevante de inocencia.ABSTRACT The paper presents a rational reconstruction of the regulation of so called “revision action”, established in the Chilean Penal Procedural Code, that rests upon a characterization of the criminal trial as a context of impure and imperfect procedural justice. Upon this basis, it is explained how that regulation is indicative of a commitment to a “principle of asymmetrical valuation” of the risk of a substantively unjust decision. After offering a systematization of the five legally acknowledged revision grounds, the paper closes with a double disambiguation of the procedurally relevant notion of innocence.
       
  • Legal protection to metadata and digital copyright management

    • Abstract: RESUMEN Los tratados de la OMPI de 1996 establecen que la integridad de los metadatos de derechos de autor como un nuevo objeto de protección de la propiedad intelectual bajo la categoría de información sobre la gestión de derechos (ISGD). Este artículo analiza desde el ámbito jurídico y de las ciencias de la información el origen de esta clase de tutela jurídica, sus objetivos y fundamentos, así mismo se discute de qué manera la definición de la ISGD adoptada por la OMPI es vaga e imprecisa. El artículo resalta la importancia de los metadatos legales para la circulación eficiente de obras en las redes digitales, incluyendo las obras en el dominio público, el licenciamiento y la gestión de derechos y regalías. Además, se analiza el desarrollo de infraestructuras de información de derechos como parte de las nuevas políticas públicas en materia de propiedad intelectual y como piedra angular para resolver el problema de las obras huérfanas.ABSTRACT The integrity of copyright metadata (information rights management) is a new subject matter for intellectual property. The WIPO treaties of 1996 established that the integrity of the metadata that provide copyright information must be protected. This article discusses from an interdisciplinary perspective the origin of this kind of legal protection, its objectives and foundations. It analyses how WIPO adopted a vague and imprecise definition of the ISGD. The article highlights the importance of legal metadata for the efficient dissemination of works in digital networks, including works in the public domain, licensing and management of rights and royalties. The development of rights information infrastructures is analyzed as part of new public policies on intellectual property and as a cornerstone to solve the orphan works problem.
       
  • Fundamental right to the cultural identity of indigenous peoples,
           configuration in accordance with international law and perspectives for
           its reception in Chile

    • Abstract: RESUMEN Se estudia el derecho fundamental a la identidad cultural de los pueblos indígenas reconocido por la Corte IDH, su naturaleza jurídica, sus fuentes y estándares jurisprudenciales. En especial, cómo se puede amparar constitucionalmente en Chile y se enuncian algunas perspectivas de impacto en la legislación interna.ABSTRACT We study the fundamental right to cultural identity of indigenous peoples recognized by the IACHR. We review its legal nature, sources, and its standards in the precedents. Specially, we study how the Chilean Constitution can protect this right and we enunciate some perspectives of impact on Chilean domestic legislation.
       
  • The panel of experts of the general law of electrical services:
           considerations for a consequentialist decision

    • Abstract: RESUMEN El presente artículo aborda el surgimiento del Panel de Expertos de la Ley General de Servicios Eléctricos (LGSE) como un órgano que ejerce jurisdicción en un área regulada de la economía de carácter altamente técnico. Se sostiene que, en tanto la ley contiene un principio general de eficiencia económica, motivo por el cual el ejercicio jurisdiccional del Panel puede justificar sus decisiones en argumentos de carácter consecuencialista a partir del citado principio, en contraposición a la tesis tradicional, consistente en que el juez solo debe conocer y resolver el caso concreto, sin que se deban considerar fines ulteriores.ABSTRACT This article deals with the emergence of the Panel of Experts of the General Law of Electrical Services (LGSE) as a body that exercises competence in a regulated area of ​​the economy of a highly technical nature. It is considered that, as much as the law presents a general principle of economic efficiency, the jurisdictional exercise of the Panel can justify his decisions in arguments of a consequentialist nature, stressing the traditional thesis that the judge should only know and solve the specific case without considering subsequent ends.
       
  • Transitional justice: in the postmodernity of the law

    • Abstract: RESUMEN El texto plantea la cuestión de si la justicia transicional, como paradigma contemporáneo en materia de resolución de conflictos, responde a una herencia de la posmodernidad, a partir de la ruptura del derecho positivo como metarrelato de la modernidad. Para ello se parte de la configuración del metarrelato del derecho positivo, la explicación del proceso de ruptura consistente en la posmodernidad, la redefinición del derecho posmoderno como nuevo metarrelato y la correspondencia de ese nuevo metarrelato con la justicia transicional.ABSTRACT This text is about transitional justice as contemporary paradigm in conflict resolution. It responds to a legacy of postmodernity, starting with the rupture of the positive law as metanarrative about modernity. The analysis starts with the positive law as metanarrative, after there is an explanation about the process of rupture of modernity by the postmodernity ,and redefinition of the postmodern law as a new metanarrative and the correspondence of this new metanarrative with transitional justice.
       
  • Criminal liability of legal persons in Ecuadorian law

    • Abstract: RESUMEN Este trabajo de investigación está dirigido a realizar un análisis jurídico-penal de la responsabilidad penal de la persona jurídica en el Derecho ecuatoriano. En tal sentido, se analiza este régimen de responsabilidad conforme al Código Orgánico Integral Penal que entró en vigencia en el año 2014 y estatuyó de manera primigenia a las personas jurídicas como sujetos susceptibles de una pena. En tal sentido, se estudian las generalidades en relación a la Responsabilidad Penal de las Personas Jurídicas, así como la regulación específica que realiza la legislación ecuatoriana, particularmente los elementos normativos que estatuyen los tipos relacionados con esta responsabilidad, posteriormente se estudia el régimen de penas (medidas) que pueden imponerse a una persona jurídica y por último, se abordan los aspectos procesales relacionados con la aplicación de los tipos penales en contra de estos entes.ABSTRACT This research work is aimed at conducting a legal-criminal analysis of the criminal liability of the legal person in Ecuadorian law. In this regard, this liability regime is analyzed in accordance with the Comprehensive Criminal Organic Code that entered into force in 2014 and originally established legal persons as subjects subject to a penalty. In this regard, the generalities are studied in relation to the criminal liability of legal persons, as well as the specific regulation that makes Ecuadorian legislation, particularly the regulatory elements that provide the types related to this responsibility, then the penalty regime is studied (measures) that can be imposed on a legal person and finally, the procedural aspects related to the application of the criminal offenses against these entities are addressed.
       
  • The lack of service in the act of congress nº 19.966 (GES)

    • Abstract: RESUMEN Este trabajo presenta una interpretación de la ley Nº 19.966 GES (ex AUGE) que justifica su especialidad en relación a la Ley Orgánica Constitucional de Bases Generales de la Administración del Estado (LOCBGAE). Sobre este punto de partida, se argumenta que el sistema de responsabilidad por falta de servicio de la mencionada ley es (parcialmente) especial en relación a la LOCBGAE. Esta relación de especialidad implica que el juez tiene una carga de argumentación muy precisa: debe integrar los principios de acceso, oportunidad, costo y equidad del sistema sanitario al juicio de imputación de responsabilidad, pues este es el único modo de interpretar e integrar la cláusula «falta de servicio» de forma coherente con la legislación sanitaria. Así se defiende que la consideración de estos principios es más intensa en el caso de falta de servicio por prestaciones GES que en el caso de prestaciones generales de salud. Finalmente, para realizar la integración en el razonamiento judicial se propone usar el modelo de especificación de principios que, en otro contexto, ha desarrollado la Teoría del Derecho para resolver el problema del razonamiento judicial en casos donde hay principios en conflicto.ABSTRACT This paper presents an interpretation of the act of congress Nº 19.966 GES (ex AUGE) that justifies its specialty in relation to the Constitutional Organic Law of General Bases of the State Administration (LOCBGAE). On this starting point, it is argued that the liability system for lack of service of the aforementioned law is (partially) special in relation to the LOCBGAE. This specialty relationship implies that the judge has a very precise burden of argumentation: he must integrate the principles of access, opportunity, cost and equity of the health system to the imputation of responsibility judgment, since this is the only way to interpret and integrate the clause "Lack of service" in a manner consistent with health legislation. Thus, it is argued that the consideration of these principles is more intense in the case of lack of service for GES benefits than in the case of general health benefits. Finally, to make the integration in the judicial reasoning it is proposed to use the model of specification of principles that, in another context, the Theory of Law has developed to solve the problem of judicial reasoning in cases where there are principles in conflict.
       
  • Atypical torts: a critic

    • Abstract: RESUMEN Este trabajo analiza la teoría de los ilícitos atípicos y la teoría de los enunciados jurídicos formulada por Atienza y Ruiz Manero en ‘Ilícitos Atípicos’ y en ‘Las Piezas del Derecho´. En específico, se estudia cómo la teoría de los ilícitos atípicos oscurece a la teoría de los enunciados jurídicos. La tesis que se sostiene es que la teoría de los ilícitos atípicos es una teoría interpretativa relativa a la construcción de excepciones implícitas. Se concluye que los autores deben explicitar su teoría interpretativa.ABSTRACT This paper analyses the atypical torts theory and the legal disposition theory that has been formulated by Atienza and Ruiz Manero in ‘Ilícitos Atípicos’ and ‘Las Piezas del Derecho’. Specifically, it is studied how the atypical torts theory darkens their legal disposition theory. The thesis that holds is that the atypical torts theory is a theory of legal interpretation related to the construction of implicit exceptions. It is concluded that the authors should make explicit their theory of legal interpretation.
       
  • Incorporation of mines to the public domain category. History of the
           doctrinal discussion and current situation

    • Abstract: RESUMEN En los estudios doctrinarios sobre los regímenes mineros a nivel mundial ha sido una preocupación constante tratar de responder, entre otras cosas: ¿A quién pertenecen las minas o la riqueza mineral', ¿Cuál es la relación que existe entre los particulares y el Estado con las minas' ¿Qué naturaleza tienen los derechos que se pueden adquirir sobre la riqueza mineral' Las teorías que se han planteado para responder a estas y otras cuestiones, pueden hallarse en lo que en la doctrina se ha denominado “dominio minero” o para algunos “propiedad minera,”, términos que hacen referencia fundamentalmente a la determinación de a quién pertenecen la mina y los recursos minerales, u otros sistemas de ordenación que tratan de explicar el vínculo existente entre el Estado y estos, así como la forma en la que los particulares pueden o no aprovecharlos. Aunque en el derecho comparado parece claro que las minas están integradas al género “dominio público”, categoría macro que incluye a una serie de bienes y derechos sometidos a una normativa especial, de la que el dominio minero es entonces, una especie; en el caso de Chile, esto no ha sido así siempre. Al menos desde el punto de vista dogmático. De la revisión de la literatura chilena puede observarse que, salvo excepciones, aún existen vestigios de teorías civilistas para intentar explicar dicho vínculo. De esta forma, aunque el Estado suele estar vinculado con las minas o con la riqueza minera, en Chile la explicación sobre la naturaleza jurídica de ese vínculo es en un principio difusa, habiéndose formulado como una verdadera propiedad, pero luego se les afecta definitivamente a un interés general. De ahí que el presente trabajo busca explicar que, efectivamente, en la actualidad las minas se han venido a integrar a la noción de “dominio público” que incluye las más diversas categorías de bienes.ABSTRACT In the doctrinal studies on the mining regimes it has been a constant concern to try to answer, among other things: To whom do the mines or mineral wealth belong' What is the relationship that exists between individuals and the State with the mines' What is the nature of the rights that can be acquired over mineral wealth' The theories that have been proposed to answer these and other questions can be found in what has been called in the doctrine "mining domain" or for some "mining property," terms that fundamentally refer to the determination of who do the mine and mineral resources belong to, or other legal systems that try to explain the link between the State and these, as well as the way in which individuals may or may not take advantage of them. Although in comparative law it seems clear that mines are integrated into the public domain genre, a macro category that includes a series of goods and rights subject to special regulations, of which the mining domain is then a species; in the case of Chile, this has not always been the case. At least from the dogmatic point of view. From the review of Chilean literature, it can be observed that, with some exceptions, there are still vestiges of civilist theories to try to explain this link. In this way, although the State is usually linked to mines or mining wealth, in Chile the explanation of the legal nature of this link is at first diffuse, having been formulated as a true property, but then being definitively affected to a general interest. Hence, the present work seeks to explain that, indeed, today the mines have come to be integrated into the notion of “public domain” that includes the most diverse categories of goods.
       
  • Regulation of administrative sanctions and reference areas in the Chilean
           institutional system

    • Abstract: RESUMEN El Derecho Administrativo Sancionador en Chile ha sido objeto de un intenso debate en la última década, como consecuencia de una progresiva jurisprudencia judicial, constitucional y administrativa que encontró su justificación en el denominado ius puniendi estatal. Sin embargo, paralelamente el Congreso aprobó leyes que desde los sectores de referencia y en ausencia de una regulación general, fueron estableciendo criterios normativos para legitimar la potestad sancionatoria, pero esta vez pensando en el correcto funcionamiento de los ámbitos en donde deben operar los organismos administrativos. Así, esos “sectores testigo” están siendo determinantes en la identificación de los elementos básicos o comunes que debe cumplir la Administración Pública al momento de sancionar.ABSTRACT The regulation of administrative sanctions in Chile has been a subject of intense debate within the last decade, as a result of judicial case law, constitutional jurisprudence and administrative pronouncements that usually have found its justification in the so-called state’s “ius puniendi”. However, in parallel Congress has passed laws in different reference areas that, despite the absence of a general regulation, were able to establish normative criteria to legitimate sanctioning power, but with the aim of setting up the correct functioning of the spheres where administrative bodies must operate. Thus, these “witness sectors” are being decisive in the identification of the basic or common elements Public Administration must respect when imposing a sanction.
       
  • A proposal on the religious dimension of citizens in a new constitution

    • Abstract: RESUMEN El Estado debe preocuparse, no solo de la dimensión terrenal de la vida humana, sino que también de la religiosa, pero entendida como hecho social. La actitud del Estado se traducirá en el llamado Derecho Eclesiástico del Estado, especial rama del derecho que tiene cuatro principios principales: libertad religiosa, laicidad, cooperación e igualdad ante la ley y no discriminación. Con todo, para una adecuada protección del hecho religioso, las respectivas disposiciones de la nueva Constitución deben basarse en los ya enunciados principios.ABSTRACT The State must worry not only of the earthly dimension of human life, but also religious, but as a social fact. The attitude of the state will result in the call Ecclesiastical Law, special branch of law that has four main principles: religious freedom, secularism, cooperation and equality before the law and non-discrimination. However, for adequate protection of religion, the respective provisions of the new Constitution must be based on the already mentioned principles.

Lo anterior justifica realizar un análisis crítico de la ley, a fin de determinar si las reformas emprendidas satisfacen dicha ambición. Examinaremos así el tratamiento legal de todos aquellos factores que configuran la independencia del regulador, para compararla con la situación existente en forma previa a la reforma, y con los requerimientos que se formulan respecto de dicha garantía por la doctrina regulatoria, y el derecho comparado.ABSTRACT This text analyzes Law Nº 21,000 that created the Commission for the Financial Market, giving life to a new institution for the regulation of financial markets, in replacement of the Superintendence of Securities and Insurance.
