      Owen Dixon retired in April 1964 after a career of twenty-three years as a Puisne Judge and then twelve years as Chief Justice. A survey of what is written and said about him since his retirement is examined in political and legal-historical context to disclose how the former Chief Justice is mythologised and to what ends the myth of Dixon has been employed.

      Dixon delivered an address to the Medico-Legal Society of Victoria in Melbourne in 1933 concerning the possible approaches the law should take to recognise its limitations when confronted with complicated scientific questions. Then in an address given to a general meeting of the Victorian Branch of the Australian Chemical Institute, he suggested ways in which the scientific expert might be prepared, personally and by counsel, for the task of giving scientific evidence in a court of law.

      A case study of a trial of a person in a position of social privilege for a sexual offence during the 1850s in New Zealand is illustrated. Reverend Arthur Baker an Anglican priest was prosecuted for allegedly indecently assaulting Mary Schroder, a schoolgirl, but he was successful in having the conviction set aside in the Supreme Court and then filed a writ in the Supreme Court seeking damages for assault by George Schroder, the girl's father.

      Australia's first copyright litigation was in 1773 when ex parte injunctions were granted by the Lord Chancellor, later dissolved in two suits directed to protecting the valuable property in Hawkesworth's Voyages. Because of the coincidence of its timing, its price and its quality, Hawkesworth's Voyage served as an effective example of the issues at stake in the crucial and parliamentary development of the law.

  • Volume 9 Issue 2 - Magwitch's Forbears: Returning from Transportation in
           Eighteenth-century London
    • Abstract: Durston, Gregory
      A study examining the Old Bailey court, the only forum in Metropolitan area that tried returnees in significant numbers, and its prosecution of prematurely returned transports between 1718 and 1799 focusing on the way in which they were apprehended, convicted and punished is illustrated. Transportation provided the prisoners an intermediate punishment between death and immediate release without occasioning the considerable costs entailed in long-term penal imprisonment.

      The Roman partnership is not based on management but on contributed goods and the analysis presented shows that the idea of the Roman contract of societas is embedded in Civil Law and in the discipline of civil obligations. Medieval annotators were prevented from giving shape to an independent commercial law because of Roman jurists' linearity of construction, but forced the nature of Roman juridical relation.

      The Court can only regard the alleged right of intervention [of the United Kingdom] as the manifestation of a policy of force, such as has, in the past, given rise to most serious abuses and such as cannot, whatever be the present defects in international organization find a place in international law. Intervention is perhaps still less admissible in the particular form it would take here: for, from the nature of things, it would be reserved for the most powerful States, and might easily lead to perverting the administration of international justice itself.

      Insolvencies in Melbourne during the late 1880s reveal a gambling culture, careless business practices, or the caprices of illness and accidents, and insolvencies including failures among land boomers, which had an impact on trades-people and labourers. The hard-luck traders and workers, inept but honest entrepreneurs, crooked boomers, and the boomers' victims formed an analytic organization of insolvents, which does not focus on specific trades and classes.

      The reasons behind the failure of the federal reform with the repeal of the Insolvent Act in 1880 initiatives during the nineteenth century are studied. The failure of Parliament to reinstate a national bankruptcy law after Confederation ended in failure due to the fact that the general principle of whether to have a bankruptcy law at all was a matter of dispute in the Parliament and the variety of federal proposals made a stable outcome unlikely.

      This essay asks how well Law and Economics theories and claims describe the real behaviour of jurists, legislators and ordinary people in the past. It is not intended to serve as a critique of the soundness of Law and Economics reasoning in the fields of contract, tort, property, legislation, and custom (or, for that matter, in the fields of civil rights, crime, or civil liberties law), which strikes, in general, as being quite plausible and powerful. But that is neither here nor there. This paper seeks only to estimate the importance (or relative unimportance) of two core law and economics theories - those of 'wealth-maximizing' and 'welfare-maximizing' - among common-law jurists, legislators and ordinary folk in nineteenth century North America and the Antipodes.

           Common Law: A Hypothesis
    • Abstract: Klerman, Daniel
      A study analysing the implications of competition for the evolution of the common law in England is illustrated. An important legal change in England from the twelfth century to the nineteenth century was that the courts competed by giving the plaintiffs more leverage. This 'leverage' involved giving plaintiffs more choices, making court procedures cheaper, swifter and more effective and developing legal doctrines. These changes in turn made it difficult for defendants to prevail; the result of competition among the courts led to pro-plaintiff bias in the common law.
