  • Rough Justice
    • Abstract: Abstract Informal justice often is castigated as rough justice, procedurally unauthorized and substantively unrationalized and prone to error. Yet those same features are present, to some extent, in formal justice as well: they do not form the basis for any sharp categorical contrast between formal and informal justice. Furthermore, some roughness in justice may be no bad thing. Certain of those elements of roughness in formal justice are inextricably bound up with other features of formal justice that are rightly deemed morally important. And rough informal justice can sometimes be used to change formal justice in more just directions.

  • Political-Liberal Legitimacy and the Question of Judicial Restraint
    • Abstract: Abstract The term “judicial restraint,” applied to courts engaged in judicial constitutional review, may refer to any one or more of three possible postures of such courts, which we here will distinguish as “quiescent,” “tolerant,” and “weak-form.” A quiescent court deploys its powers sparingly, strictly limiting the agenda of social disputes on which it will pronounce in the constitution’s name. A tolerant court confirms as valid laws whose constitutional compatibility it finds to be reasonable sustainable, even though it independently would conclude to the contrary. A weak-form court acts on the understanding that its pronouncements on matters constitutional will be duly open to considered rejection by other political agencies. Theory commonly tends to treat the question of judicial restraint as turning on a bedrock political value of democracy. We may also, however, understand debates over judicial restraint in the light of a different bedrock value, that of political legitimacy. Where democracy is the focal concern, debaters may tend toward conflating into one measure the three dimensions of judicial restraint. A focus on legitimacy rather tends toward a dis-bundling of the three dimensions, thus complicating the choices while also clarifying the stakes. The political philosophy of John Rawls helps us to see how and why this occurs.

  • Public Reason in the Universe of Reasons
    • Abstract: Abstract In this article, I examine the ways in which “Public Reason” (or public reasons, in plural) can be said to resonate with some types of reasons as presented and defended in contemporary legal theory. I begin by identifying the concept of Public Reason within the context of a discussion sparked by the between “internal” and “external” reasons, which was made famous by Bernard Williams. I will then compare this interpretation of Public Reason with Joseph Raz’s celebrated concept of exclusionary reasons. Next, I refer to two concepts of moral “neutrality” and how such concepts affect our understanding of Public Reason. I also reflect upon whether it is tenable to draw a distinction between the good reasons for actions that we conduct in our own lives and good reasons to be adopted in public life. Finally, I raise the question of a distinction between the reasons which we press in general societal discourse and those that we press in the advocacy-related law-making process.

  • Populism and the Politics of Resentment
    • Abstract: Abstract This article argues that understanding the dangers and risks of authoritarian populism in consolidated constitutional democracies requires analysis of the forms of pluralism and status anxieties that emerge in civil and economic society, in a context of profound political, socioeconomic, and cultural change. This paper has two basic theses. The first is that when societies become deeply divided, and segmental pluralism maps onto affective party political polarization, generalized social solidarity is imperiled, as is commitment to democratic norms, social justice, and liberal democratic constitutionalism. The second, is that populist political entrepreneurs excel in fomenting social antagonisms by framing shifts in the forms of social pluralism in ways that foster deep political polarization, generalized distrust and a politics of resentment against “elites,” “the establishment,” “the oligarchy,” and “outsiders.” Why populist offers resonate requires a social theoretical analysis of status/solidarity and class issues and a direct response to them. I draw on Polanyi and Habermas to develop an explanatory approach to the current crisis and the populist responses it triggers. I navigate between two inadequate approaches: that of the Hofstadter consensus school which construes status concerns and populism as retrograde, anti-modern, paranoid and meriting no direct response; and that of the neo-Marxist tradition that acknowledges the mobilizing power of “cultural factors” and status anxieties but deems them to be epiphenomena of the deeper story of economic distributive injustice. I reject this assessment and seek to take up the status/solidarity issues in ways that take them seriously, challenge populist framing and provide alternative direct responses to them. I reject the narrative frames of left populists who foment polarization and I try to present an alternative narrative framing for a future democratic politics that draws on the best in politically liberal, constitutionalist, democratic, and socialist traditions.

  • Hegemony in a Multipolar World Order: Global Constitutionalism and the
           Großraum
    • Abstract: Abstract Recent setbacks to international institutions and projects of global governance have been viewed as marking a resurgence of nation-state sovereignty. In fact, however, many of the major controversies and developments in contemporary international law and geopolitics concern the administration, autonomy, and internal hierarchy not of states, but of supra-state regions. The spatial logic of a world divided into such regions is best articulated in Carl Schmitt’s theory of the Großraum, which in various respects describes and explains key features of modern world order. Taking regional systems as self-constituting political units characterized by internal forms of dominance and legitimation aids in identifying the operation of hegemony in contemporary international law and institutions. It also makes possible a reinterpretation of global constitutionalist discourse as a democratizing project that finds its most important expressions in counter-hegemonic movements within the various “great spaces” constituting today’s world.

  • “Most Reasonable for Humanity”: Legitimation Beyond the State
    • Abstract: Abstract Legal and political philosophers of a normative bent face an uphill struggle in keeping themes of global justice and cosmopolitan governance, at the forefront of their disciplinary debate, given the perceived urgency of confronting, at the domestic level, the populist upsurge in mature democracies and “democratizing societies” alike. In this paper, these two levels of analysis—national and transnational—mutually enrich one another through a reflection on the ground of legitimacy. In the first section (“Perfectionism Redux”), (a) neo-perfectionist approaches to the legitimation of transnational authority (rooted in Kantian or Hegelian notions, or in some natural law conception of human rights) and (b) public reason approaches rooted in the paradigm of “political liberalism” will be contrasted. In the second section (“From Balance to Separation of Powers”), a non-perfectionist and normative conception of the legitimacy of transnational authorities will be derived from Rawls’s “liberal principle of legitimacy” (renamed “legitimation by constitution by F. Michelman) and the difference with the application of the same principle at the domestic level will be elucidated. In the third section (“Legitimacy and the Flourishing of Humanity: Buchanan and Keohane on Global Institutions”), on the basis of such conception, one of the most complete and influential approaches to the legitimacy of transnational authorities—i.e., the “Complex Standard of Legitimacy” expounded by A. Buchanan and R. Keohane in “The Legitimacy of Global Governance Institutions”—will be critically assessed.
