  • Legal Aspects of Scientific Misconduct

      Abstract: The present contribution reports the results of an anonymous survey of 249 researchers, ranging from students to professors, regarding their perceptions of scientific misconduct. The participants were sourced from the University of Novi Sad (70%), and from the Universities of Vienna, Prague and Stuttgart. The results indicated that 78% of the participants have personal knowledge of scientific misconduct committed by another person, while 20.9% have been personally affected by scientific misconduct. The results also show that the most frequently observed types of misconduct in the domain of science are: plagiarism, falsification, manipulation and the fabrication of data. More than one half of all participants recognized a lack of supervision as a reason for the emergence of scientific misconduct. The factors contributing to scientific misconduct include time pressure, inadequate oversight and the absence of legal consequences. Accordingly, the majority favoured greater supervision, institutional oversight, including random checks, and new legal regulations to reduce the incidence of scientific misconduct.

  • Voluntary Simplicity Strongly Backed by All Three Main Normative-Ethical
           Traditions

      Abstract: We examine the growing ‘Voluntary Simplicity’ (VS) movement from the perspectives of Utilitarianism, Kantian deontology, and Virtue Ethics. We argue that, from each of these three diverse perspectives, there is a compelling argument to the conclusion that citizens of the ‘developed’ world ought to embrace such simplicity in their own lives, and to facilitate its greater adoption societally and globally. We conclude by asking why it is that this compelling conclusion has not already been more widely found and acted upon. In reflecting on this question we outline some arguments for why a culture of voluntary simplicity may be needed to drive political and macroeconomic change.

  • Treating Others as Means, but not Merely as Means

      Abstract: Kant’s ‘Formula of Humanity’ is sometimes read as though it allows us to use humanity as a means to our ends, as long as we do not use it merely as means. The present contribution offers three arguments against this reading. First, this reading is not supported textually by the way that Kant uses the verb ‘to use’ (brauchen) in ethical contexts. Second, allowing for actions that use humanity, but at the same time respect its value as an end-in-itself is superfluous within Kant’s corpus. Third, relying on the force of ‘merely’ to modify ‘using as means’ is detrimental in the discussions in the public sphere and in applied ethics, because (lacking rigid and substantive criteria for how to interpret ‘merely’) it becomes possible to justify morally impermissible actions and policies on the grounds that they at the same time respect humanity as an end-in-itself. As a case study, we consider today’s debates on the moral permissibility of ‘saviour siblings’ and show that in it Kant’s ‘Formula of Humanity’ is used in ways that are, at best, conceptually vague and, at worst, distinctly non-Kantian. The paper concludes with an overview of Kant’s use of brauchen in the context of ‘relations of community’, in which (according to Kant) persons acquire rights of possession to one another ‘akin their rights to external objects’ or things; even in these types of relations we are not treating humanity as means (but also, at the same time, as an end). The article concludes that Kant’s ‘Formula of Humanity’ sets up an exclusive disjunction between actions that treat humanity merely as means on the one hand, and actions that are not guilty of this transgression.

  • How Neutral is being Neutral'

      Abstract: In this article, I scrutinise the viability of the concept of neutrality. More specifically, I deconstruct two recent cases – Quebec’s Bill 60 and the burkini ban in France – in which the discourses legitimating exclusionary practices towards religious minorities are founded, to greater or lesser extend, on the concept of neutrality. In discussing these examples, I defend the liberal position that the state must be neutral so as to prevent discrimination, inequality and partiality. At the same time, I move beyond the liberal frame in order to investigate the hegemonic functioning of the concept of neutrality. In bringing these two traditions together, I hope to counter the problematic and exclusionary functioning of neutrality without debunking the concept altogether. Rather, I propose a re-thinking of the concept of neutrality, arguing that its meaning and implications have to be open to contestation. More specifically, I argue for a need to contest the specific articulation of neutrality by the people who feel excluded by it. This critical, disruptive element of neutrality forces the concept to live up to its universal aspiration and to become ‘more neutral’.

  • Reliance and its Obligations

      Abstract: This article presents a principle identifying a form of internally conditional moral obligation concerning reliance. The need for internal conditionality arises from the generality of the concept of reliance, together with the thesis that ‘obligated’ implies ‘can’. The principle’s conditions include matters upstream from the reliant action (e.g. its being intentionally caused), downstream (harm), and concomitant with it (e.g. the absence of certain adversarial relationships). An epistemic condition straddles those categories. The principle is defended against objections, including the claims that it breaks the link between obligation and action and that reliance is normatively redundant. The principle may be derived from various moral theories, possibly via intermediate principles about harm, respect for autonomy, and the promotion of cooperation. Contrasts are drawn between moral and legal reliance-related obligations.
