  • CLOUD COMPUTING : RECOMMENDATIONS FOR THAI PERSONAL DATA PROTECTION ACT

      Abstract: Cloud Computing is a valuable technology for both business operators and individuals as it assists the businesses in IT cost reduction as well as facilitates individuals to access and manage data over the Internet everywhere. Cloud computing is also relevant to personal data due to the fact that there are a great number of personal data stored in cloud computing and, as a consequence, there is possibility and risk of cloud data leaks. To deal with this issue, various international organizations and many countries have legislated personal data protection laws and enforced such laws and regulations with cloud computing services. In Thailand, there has been only one effective data protection law so far which is “the Official Information Act 1997” applied with data in possession of the government sector. For private sector, there have been a number of drafted personal data protection laws over a long period of time. However, the lasts drafted personal data protection of Thailand is not consistent with international standard guideline and in appropriate to apply with the context of cloud computing.

  • A COMPARATIVE STUDY OF SCOPE OF PROTECTION FOR VICTIMS OF VULNERABLE GROUP
           UNDER THE THAI CRIMINAL CODE : A STUDY OF UNITED STATE, AUSTRALIA, FRANCE
           AND GERMANY

      Abstract: At the present time, as crime has increased, especially one that is committed against the vulnerable, or those who are dependent to other people in their everyday living or tend to be easily swindled by persuasion such as innocent children, elderly, disable, legally insane, mentally challenged, or pregnant. The group of people mentioned is usually fragile physically and mentally. As they are already weak and not very keen to understand an action of the others, they tend to lose their ability to adequately protect themselves from danger or hazard created by others. As such, wrongdoers are likely to commit a crime by taking advantage of their vulnerability. The crime can be done easily and conveniently as compared to doing it against people with strength. However,
      the current criminal law does not specifically protect the vulnerable as the punishment applied to wrongdoers is the same whether or not the wrong is done to the vulnerable or to people without vulnerability. Therefore, criminal law should impose appropriate offences and associating punishment, which are believed to safeguard the vulnerable from being taken advantage of in the future. Also, the correct measures would prevent and defer wrongdoing against such group later on.

  • CONTROL MEASURES FOR PUBLIC INTOXICATION

      Abstract: The damage caused by the influence of alcohol appears. For instance: drunk driving, drunk strife, assault. Those offenses originate from the consumption of alcoholic beverages. But drinking alcohol is not illegal. Drunkenness in public is the beginning of the damage. As the aforementioned, this thesis has focused on the public intoxication on the public arena. The methodology is analyzing the regulations under the Thai Laws. For instance: The Criminal Code, Section 378, concerning as the significant point on this thesis, including the Alcohol Control Act BE.2551. For more understanding and finding the solutions on the damage caused by the influence of consumption of the alcohol in the public, the foreign laws and regulations are brought up to analyze as well. The countries that have the concerning points on the legally drunkenness in public are brought up, including criminal theories in order to explain the appropriateness of establishing a public offense clause. The expectation for this thesis is to improve the effectiveness of the law enforcement on the problem of intoxication of alcohol in the public and to prevent the damage caused to the society from the habitual offense.

  • LEGAL MEASURES FOR THE CONTROL OF GARBAGEDISCHARGE FROM SHIP OPERATIONS

      Abstract: Pollution due to commutation of ships is a major problem that affects the environment and ecosystems in the sea. Currently, maritime transportation has become very common, thus, this leads to a large number of the ships traveling in the sea. Therefore, the emphasis of marine pollution control is extremely crucial and requires cooperation from many sectors. There are three types of pollution that caused by ships: dumping, incidents of navigation and discharge of waste as a result of the operation of ships. The composition of these types of pollution includes oil, noxious liquid substances, harmful substances, sewage, garbage and air pollution. This article will primarily discuss about the garbage generated by the discharge of waste from ship operations, as well as the measures in the international perspective on the pollution control of ships. Furthermore, it will also examine whether the measures in Thailand is in line with the international regulation standards.

  • PROBLEM IN ESTABLISHING DEVELOPED-ESTATE JURISTIC ENTITY OF THE LAND
           DEVELOPMENT PROJECT

      Abstract: This article examines the problems in establishing developed-estate juristic entity of the land development project. Like the land developer fails to perform the duty in connection with the maintenance of public facilities or the land developer bankruptcy until causing unable to establishing developed estate juristic entity. Because of this problem, this article applies a comparative study to examine how other countries i.e. the United State, the United Kingdom and Australia solve this problem. The analysis demonstrates shows that the United State, the United Kingdom and Australia have registered with the association for a license this can be adopted into Thailand by amending the land development act. B.E. 2543 From the comparative study, the article propose to establish developed-estate juristic entity from the beginning.

  • XTRA-BUDGETARY OF THE OFFICE OF THE NATIONAL BROADCASTING AND

      Abstract: This article concluded that extra-budgetary the Office of NBTC is inconsistent with good fiscal discipline, an independent organs authorized to impose its own levies and disburse such an income before being transmitting as public revenue. Moreover, the Office of NBTC also has a power to approve its own budgets regardless of the National Assembly’s approval procedure. The author is, thus, of opinion that some provisions should be amended in order to enforce the Office’s budgetary administration to conform to good fiscal discipline and maintain its independence without any effects in its operations.

  • LEGAL MEASURES TO PROMOTE RECYCLING PLASTIC HOUSEHOLD WASTES

      Abstract: A comparative legal study was made of regulations on recycling plastic household waste (PHW) in Thailand, Japan, and Germany.             Results were that in Japan and Germany, comparably clear laws define civic duties for promoting PHW recycling. Manufacturers, plastic packaging distributors, and municipal administrations are all given coordinating responsibilities to gather separated wastes before bringing them to the recycling process or entrepreneurs. By contrast, in Thailand, no law exists about promoting the recycling of PHW distinct from other waste management. Instead, rules apply that were drafted to cover other methods of waste disposal. These findings suggestion that to improve the Thai approach, manufacturers and consumers should be the focus of promoting PHW recycling. The Thai government and municipalities as well as private and public sectors should become partners in recycling by law and official policy. In terms of legal reform, the Act on the Maintenance of the Cleanliness and Orderliness of the Country, B.E. 2535 (1992), amended in 2017, as well as the Excise Act, B.E. 2560 (2017) require revision to directly promote PHW recycling.

  • EVIDENCE INDICATING CELL PHONE LOCATION OF THE OFFENDERS

      Abstract: This article explores the problems on the process of obtaining cell phone location information by State Agency that impact with privacy rights of the offender. Therefore, Thailand should have criminal procedure to acquire cell phone location information, it must consider the appropriateness conditions, the Rechtsstaat and the rule of law. The benefit of crime control must be weighed against human rights, due process. Not only the subpoena is issued with the internal control and external control process but also with necessity and proportionality condition. To increase transparency of the obtaining cell phone location process, State Agency should report the number of the requested subscribers to the public. Cell phone location information are the records that created, processed, collected by the computer system of the mobile operators. The court must consider the reliability of electronic evidence obtained, the accurately processing and recording of computer systems to weighting of evidence. So the mobile operators should provide a certificate the information that the records are created, processed, collected by authenticity and reliability of computer systems.

  • THE RESTRICTIONS ON THE OWNERSHIP OF CONDOMINUIM UNITS OF ALIENS AND
           JURISTIC PERSONS DEEMS BY THAI LAW TO BE ALIENS

      Abstract: This article discusses specific issues “Restrictions on the ownership of condominium units of aliens or juristic persons deemed by Thai law to be aliens” which is part of the problem in the thesis on the issue of legal problems relating to ownership of condominium units of aliens or juristic persons deemed by Thai law to be aliens. This article aims to study the problems that arise from the limitation of the ownership ratio of condominiums of aliens or juristic persons deemed by Thai law to be aliens under Section 19 bis of the Condominium Act BE 2522 and as amended. Due to the increasing number of residential condominiums and condominium units in Thailand are of interest to foreigners due to lower prices than other countries with good returns and condominium law, namely the Condominium Act BE 2522, the aliens may hold ownership of the apartment under restrictions on the ownership of condominium units. The study noted that Thailand has a policy of promoting economic growth and wants foreign investors to invest money in the country. But why must limit the benefits of housing in the ownership of condominium units of aliens or juristic persons deemed by Thai law to be aliens. This limitation is an obstacle to foreign investment in the Thai property market. The result of studying foreign countries that have economic growth and have a good legal system such as the United States Australia Japan and Singapore, Found that the condominium laws of these countries do not have restrictions on the ownership of aliens and foreign entities. But there are measures in accordance with other laws that are effective in controlling trading behavior and holding ownership of immovable property of foreigners and foreign legal entities such as measures under the law for investment promotion or tax measures. In order to prevent the problem of buying real estate for speculation that may lead to the economic crisis in the future. Therefore, if Thailand has terminated the limitation of the ownership ratio in the condominium units of aliens or juristic persons deemed by Thai law to be aliens, which is considered an alien to be supporting foreign investment policies in Thai real estate, Thailand should have other legal measures which is effective in controlling the behavior of residents and behavior of transactions relating to condominiums of aliens or juristic persons deemed by Thai law to be aliens to replace. In order not to affect social security and Thai economic security.

  • SETTING UP DEBTOR'S DEFENCES AGAINST THE ASSIGNEE IN ASSIGNMENT OF
           CLAIM CONTRACT

      Abstract:              The assignment of claim in Thailand Civil and Commercial Code, the debtor can raise defences against the assignee if they existed at the time of the assignment following article 308. This article found that the decision of Supreme Court of Thailand has a verdict in the 9206/2538 that the meaning of “defences” in article 308 is “Only defences were justified at the time of an assignment”, but the debtor always set up a defences which exist after the assignment. In contrast with some opinion of lawyers, they informed that the debtor can raised defences against the assignee at the time of an assignment become enforceable against him. If the defences have arisen after the assignment, it cannot be raised against the assignee because the relationship between assignor and assignee absent.             The study of law in France, Germany and United Kingdom revealed that the debtor’s defences in the assignment of claim contract were classified into 2 type including the substantive defences (Ab Initio) and personal defences. Conversely, Thailand Civil and Commercial not Legislated clearly in the law, Therefore, this approve can be adopted in Thailand Civil and Commercial Code.

Defects and unsafe products inspection, sometimes, fail to be performed effectively due to many factors, including the lack of technology and knowledge in that specific time. The pre-market measures, such as standard setting, could not protect consumer sufficiently, it is thus important to have measures protecting consumers even after they have acquired a product or post-market notification of unsafe product so that consumers can protect themselves against risks relating to such product. The right to be informed is especially necessary in this era of electronic commerce that goods can be transferred borderless with very little control from governments.

  • LEGAL MEASURES TO CONTROL ARTIFICIAL RECHARGE OF GROUNDWATER

      Abstract: Groundwater is a significant water supply source for consumption, agriculture and industrial. However, at present, the volume of groundwater in storage is decreasing rapidly, causing some environmental impacts such as land subsidence, saltwater intrusion etc. Artificial recharge of groundwater is a measure that can solve such problems. The study revealed that legal measures to control artificial recharge of groundwater of the Groundwater Act B.E.2520 and Regulations prescribed pursuant to such Act are not suitable, so should be improved.

  • PROBLEMS OF USING A LIMITED COMPANY NAME

      Abstract: The status of a limited company name under the Thai Civil and Commercial Code are unclear. On the one hand, it is deemed as a natural person name which is a part of personality. On the other hand, it may be deemed as trade name under Section 1012. Realizing that the is recognized by the law; it is to be noted that the result of using and interpreting with current laws may be contrary to the spirit of law and juristic method. The evidential fact resulting from such contradiction is when the registrar is not empowered by the law to prevent a third parties from using either similar or identical name which belong to the bankruptcy company of which itself against to the good faith principle and also has direct damage to the public. Furthermore, the revocation of the limited company name is leading to an ineffective of personality preservation and identity capability
