  • Obscenity Crime

      Abstract: Obscenity is regulated in Article 226 of the 5237 crime in the Turkish Penal Code. Law did not determine the term. It will determine the boundaries of the concept and the scope of judicial decisions. Crime is organized in different article for children and adults. Connecting obscenity sanctions also is the need for international agreements. If it occurs in the suggestive nature of hesitation as to whether a product may be necessary expert examination. The matter was taken under the domestic law provisions in different laws. In this study, we examined the subject of obscenity in terms of the Turkish Penal Code. The definition of the concept of fault elements and examined the judicial decisions concerning the application.

  • Nation-State At The Present Day

      Abstract: Nation, nation-state and nationalism are artificial concepts produced under conditions that are not natural. In the historical process, the nation and the nation-state emerged in the axis of England and France. 1789 The French Revolution invented both the nation state and the modern institution and ideology of national citizenship. The nation refers to a form of sociality. In this society, people can hold an identitythat is both cultural and political in nature. In the modern state's process of building society, the ideology that aims to hold people together and create a sense of belonging is nationalism. Nationalism is theconstruction of a non-existentnation at theend of certain processes. Nationalism produces ideas, slogans, symbols, and ceremonies that mediate the linking of individuals with mass emotions. But with the pluralism and human rights, the legal system has become universalized. Now, the use of personrights in international institutions has emerged. As a result, nationalism, which is the legitimation and ideology of the nation-state, is faced with a crisis. Globalization brings about two changes in the direction of integration and fragmentation in the role of nation-state. This crisis does not mean that the nation-states have come to an end. However, the idea of a nation-statebased on the concept of a heterogeneous nation is no longer valid. In this study, the modern appearance of the nation concept, nation-state and nationalism ideology have been evaluated in terms of the effects of globalization.

      Abstract: With the adoption of the law on amendment of the Constitution No. 6771 with the referendum of 16.4.2017, the presidential system was adopted in Turkey. The US presidential system model, which is taken as a basic example in terms of being both successful and democratic in presidential systems, is distinguished from Turkey in terms of presidential system as well as being determinative. One of these separation points is the vice-president. This article examines similar and different aspects of the vice president between Turkey and United States.

      Abstract: Conciliation in Turkish Criminal Law was initially regulated in Lawnumbered 5237 article 73/8. This regulation is abrogated by Law numbered5560 dated December 6th, 2006; articles 253, 254 and 255 of CriminalProcedure Law are amended.Finally, amendments on Code of Criminal Procedure no. 5271 art. 34and 35 are issued by Law Regarding the Amendments on Code of CriminalProcedure no. 5271 and Miscellaneous Codes no.6763 entered into force byOfficial Gazette dated December 2nd 2016, no. 29906. With this amendment,crimes assessed within conciliation and the scope of crimes against children areextended. In this study, amendments on “conciliation” made by Law no.6763are examined.

      Abstract: The istidane establishment, which means indebtedness on behalf ofsomeone else, was heavily applied during the Ottoman period. Thisestablishment has provided social security to people when social security is notas institutionalized as it is today. Today, however, the contens, covering andconditions of this establishment are not much emphasized. For this reason, ourstudy aims to explain the establishment of istidane in general.Our work has benefited from basic fiqh books, Ottoman court records andrelevant works on this subject to designated the covering of this establishment.In terms of present-day law, it is possible to find examples of this establishmentin matters concerning curatorship, tutelage, management of foundatitons andrepresentation of conjugal community. However, the numbers are quite limitedwhen compared to Ottoman period. Nowadays, the implementation of thisestablishment in case of need, especially in the field of private law, may be asolution to disputes

      Abstract: It is generally acknowledged that freedom of expression is afoundational human right of the greatest importance. As well as other humanrights, freedom of speech have stemmed from the inherent dignity of man as amember of the community of human kind. It shows a key function to theprotection of all human rights, and fundemental to human dignity in its ownright. Notwithstanding it is also globally recognised that it is not an absoluteright, and every democracy has develeoped some system of limitations onfreedom of expression. As freedom of expression and this freedom’slimitations also are one of the most important factors determining whether asociety is democratic or not.Limitations about freedom of speech must be formulated in a way thatmakes clear that its sole purpose is to protect individuals holding specificbeliefs or opinions, rather than to protect belief systems from criticism. Theright to freedom of expression implies that it should be possible to scrutinize, openly debate, and criticize, even harshly and unreasonably, every faith,opinions and institutions, as long as this does not amount to hate speech,violence and obscene speechs against an individual. But this does not mean thatit should be provoked to “harsh” and “unreasonable”.

  • Foundation of the Asses Management Companies and The Permit-Required
           Structure of Their Foundation According to Provisions of Turkish
           Commercial Code

      Abstract: Asset management companies function as acquiring defaultedreceivables of banks and nonbank financial institutions and collecting themthrough restructuring. The Asset management companies mainly drawn up byarticle 143 of Banking Code no. 5411. Regulations concerning the assetmanagement companies can also be found in Directive which is issued based onarticle 93 and article 143 of Banking Code no. 5411. The Asset managementcompanies are also correlated with Turkish Commercial Code no. 6102 sincethe Directive indicates that mentioned companies can be established as jointstock companies.This work analyzes issues of specific regulations regarding establishmentof the asset management companies and their permit-required legal transactionswith general provisions of Turkish Commercial Code no. 6102 and providessolutions via criticizing some matters of significance.

  • Termination of Obligation Due To Merger of The Titles of Debtor and

      Abstract: The merger of the titles of debtor and creditor fromthe termination of obligation is stipulated by Turkish Obligation Code art.135. According to TOC art. 135 “Theobligation shall terminate when the titles of debtor and creditor are mergeredin the same person. However, the existing rights of third persons on thecredits shall not be affected by the merger./ When the merger is removedretroactively, the obligation shall continue to be valid./ The specificprovisions on the pledge on immovable property and negotiable security arereserved.” In our study, firstly, wegive general information about the merger of the titles of debtor and creditor.Later, conditions and results of the merger of the titles of debtor andcreditor are examined.

           Article 230)

      Abstract: Equalization in the regime of participating to acquired properties is regulatedin Article 230 of the TMK. Therefore, when a group of property of one of thespouses shifts to another group, the equalization must be realized. In accordancewith Article 230 law paragraph I of TMK, if a debt of an acquired property is paidwith a personal property of a spouse, this value is removed from the remnantal valueand added to the personal properties. If a debt of a personal property is paid withthe acquired properties of one of the spouses, this value is added to the remnantalvalue. In a classical equalization, which is regulated in Article 230 TMK, increasesand decreases in value are not taken into consideration. In accordance with Article230 law paragraph III, the equalization occurs when an acquisition, an improvementor a protection of another group of property is contributed by a group of property ofone of the spouses. In variable equalization, which occurs when an acquisition, animprovement or a protection of a group of property is contributed by another groupof property; increases and decreases of the value of property, that is being talked of,are must be taken into consideration too. Because of that, from the standpoint ofthat property, changes in value, which occur between contribution and liquidationdates, are effective in equalization. If an acquired property is contributed by a personalproperty, the determined value must be subtracted for the remnantal value. Onthe contrary, if a personal property is contributed by an acquired property, the determinedvalue must be added to the remnantal value.

  • The Entitlement of Severance Pay For Those Who Have Fulfilled 15 Years
           Insurance Period and 3600 Premium Payment Days During The Termination of
           Their Contract

      Abstract: In the article 120 of the Labor Law No. 4857, it is foreseen that thearticle 14 of the Labor Law No. 1475 will remain in force until theestablishment of the severance payment fund. This article regulates severancepay. With the Law No. 4447 Unemployment Insurence Law, the retirement agehas been increased. Retirement age was set as 60 in males and 58 in females.Number of premium payment days were also increased. However, with the LawNo. 4447, a sub-article was added to Article 14 of the Labor Law No. 1475. It isenvisaged that the workers who do not complete the age limit for the old-agepension but have completed insurance period and the number of days payingpremiums will be able to receive severance pay if they leave their jobsdepending on their will. With the regulation of the Law No. 4447, theconditions of taking severance have been softened while the age of retirementhas been increased. The workers who entered the job before 08.09.1999 benefitfrom this arrangement with the conditions of 15 years insurance period and3600 premium payment days. The workers who entered the job between08.09.1999 and 01.10.2008 and the workers who entered the job after01.10.2008 benefits from this regulation with different conditions. Workers whoare not covered by Labor Law No. 4857 can not benefit from this benefit. It isalso obligatory for the employee to have at least one year of seniority in order toreceive severance pay. In our work, those who entered the work before08.09.1999 have been analyzed.

  • Loss Of 2/3 Of The Capital and Legal Reserve Costs In The Join Stock

      Abstract: Since the joint stock company is a capital company,capital is significant both in terms of partners, both of the company and itscustomers. The Turkish Commercial Code, No. 6102, considers the sum of thecapital and legal reserves as a guarantee for these people. The loss of 2/3part due to damage to the capital is regulated in article 376/2. The law bringssome obligations to the board of directors in the event of a loss, and offerstwo alternative ways for the general board to overcome this situation.
