      Abstract: : Pre-Marriage Training: The Concept and Its Implementation (Comparative Study between BP4 KUA and GKKB Congregation in the Eastern District of Pontianak). This study compared the practices of pre-married Training conducted in KUA and in the GKKB Congregation in the Eastern District of Pontianak. This study is a field research using descriptive-comparative analysis. The goal is to see the similarities and the differences between the two practices that can be utilized for further study. The study finds out that the pre-marital courses, either that was conducted at KUA—known as Suscatin—or that was carried out in the GKKB Church—termed as Pre-Marriage Consultation—are not different in principle. The difference is only on technical matters. The two institutions, in fact, have similar goal of encouraging, preparing, dan guiding the prospective husband and wife to be able to establish harmonious household.Abstrak: Kursus Pra-Nikah: Konsep dan Implementasinya (Studi Komparatif Antara BP4 KUA Kecamatan Pontianak Timur dengan GKKB Jemaat Pontianak). Penelitian ini membandingkan praktik pemberian bimbingan bagi pasangan yang akan menikah yang dilaksanakan di KUA dengan yang dilaksanakan di lingkungan gereja. Studi ini adalah penelitian lapangan (field research) dengan menggunakan analisis deskriptif-komparatif. Tujuannya adalah untuk melihat perbedaan dan persamaan di antara kedua lembaga tersebut yang dapat dijadikan sebagai bahan untuk kajian lebih lanjut. Hasil penelitian menyimpulkan bahwa secara umum antara Kursus pra-nikah di KUA Kecamatan Pontianak Timur—yang dikenal dengan istilah Suscatin, dengan yang dilaksanakan di GKKB Jemaat Pontianak—dikenal dengan istilah Konseling Pra-Nikah—tidak memiliki perbedaan yang prinsip. Perbedaannya yang ada hanya pada hal-hal yang bersifat teknis. Keduanya memiliki tujuan yang sama yakni memberi arahan, gambaran persiapan, bimbingan, dan konseling kepada calon pasangan suami-istri untuk dapat membina rumah tangga yang sakînah, mawaddah, dan rahmah.

  • Konvergensi Pembagian Harta Waris dalam Hukum Islam.

      Abstract: : The Convergence of Inheritance in Islamic Law. This article examines the legal position of Islamic inheritance law in Indonesia, especially from the aspect of implementation and factors hindering the implementation of the legal system in the Muslim community. As this study finds out, there are two main reasons why the Islamic Inheritance Law can not be implemented in Indonesia: (1) Indonesian Muslims are still bound to Customary inheritance law, either in forms of individual inheritance system (patrilineal, matrilineal or bilateral), collective inheritance syatem (inheritance is not distrubuted but is managed collectively), or Majorat inheritance system where the oldest son master the entire inheritance. (2) The Muslims have not fully grasped the concept of fairness and equality in Islamic law, especially when it pertains to the portion of sons and daughters which follows 2: 1 ratio.


      Abstrak: Konvergensi Pembagian Harta Waris dalam Hukum Islam. Artikel ini mengkaji posisi hukum kewarisan Islam di Indonesia terutama dari aspek implementasi dan faktor-faktor apa saja yang menghalangi penerapan sistem hukum tersebut di kalangan masyarakat Muslim. Berdasarkan hasil kajian diperoleh fakta bahwa Hukum Kewarisan Islam belum dapat terlaksana di Indonesia karena masyarakat masih dipengaruh oleh hukum kewarisan adat, baik mengikuti sistem kewarisan individual-patrilinial, matrilinial atau bilateral-kewarisan kolektif-harta warisan tidak dibagi tetapi dikelola bersama-, maupun sistem kewarisan majorat di mana anak tua menguasai seluruh harta warisan. Selain dari kuatnya pengaruh tradisi/hukum adat, hambatan lain adalah umat Islam belum sepenuhnya memahami konsep keadilan dan kesetaraan dalam hukum waris Islam, khususnya ketika berkaitan dengan porsi anak laki-laki dan perempuan yang mengikuti perbandingan 2: 1.

  • Eksistensi Hukum Adat dalam Kompilasi Hukum Islam Indonesia (KHI).

      Abstract: : Existency of the Elements of Traditional Law in Indonesia Islamic Law Compilation (KHI). This paper reviews the accommodative attitude of the Indonesia Islamic Law Compilation (KHI) towards customary law. Such a positive attitude is indicated by the provisions concerning joint property and mutual inherit between adopted child and the adoptive parents through the institution of wasiyat wajibah. (compulsory wish). Both provisions adopted from customary law is purely the result of ijtihad (legal initiative) of Indonesia Muslim scholars because the issues are not found in Islamic Jurisprudence. The Indonesian cleric’s innovative creations, aside of being a manifestation of the dynamic and creative characteristics of Islamic law, are also becoming an identity of Islamic Archipelago (Islam Nusantara) in the field of law. Viewed from this aspect, KHI Indonesia may be named as the Indonesian Muslim Jurisprudence (Fikih Indonesia).


      Abstrak: Eksistensi Hukum Adat dalam Kompilasi Hukum Islam Indonesia (KHI). Tulisan ini mengulas sikap akomodatif KHI terhadap hukum adat tersebut yang ditunjukkan oleh ketentuan tentang harta bersama dan saling mewarisi antara anak angkat dan orang tua angkat melalui institusi wasiat wajibah. Kedua ketentuan hukum yang diadopsi dari hukum adat ini merupakan hasil ijtihad ulama Indonesia, karena persoalan keduanya tidak ditemukan dalam fikih. Kreasi inovatif ulama Indonesia ini, selain merupakan bentuk manifestasi dari karakteristik hukum Islam yang bersifat dinamis dan kreatif, juga merupakan identitas Islam Nusantara dalam bidang hukum. Dilihat dari aspek ini, KHI Indonesia, dalam bahasa Undang-Undang, dapat disebut sebagai Fikih Indonesia karena selain berwatak kepribadian Indonesia juga mengadopsi hukum adat yang hidup dalam tradisi lokal.

  • Analisis Penerapan Akad Ju’âlah dalam Multi Level Marketing (MLM)

      Abstract: : Analyzing the Ju’alah Contract in Multi Level Marketing (MLM) Business. The massive proliferation of Multi Level Marketing (MLM) based business is not likely to be halted as the MLM principle has become a part of the mu’amalah. Yet, it is not uncommon among those who followed the MLM plan system that they feel cheated. Is it true that MLM business forms of fraud' This paper attempts to analyze the concept of contract occurring in MLM business especially on www.jamaher.network. The goal is to minimize the different opinion among Muslims about MLM business. The study concludes that the MLM system, particularly in the network Jamaher, is not contradictory to the Qur’anic principles as the Qur’an recognizes individual or group authority of legally-owned property and gives full independence to carry out any transactions to the extent it does not exceed the limits prescribed by Shari’ah.

      Abtrak: Analis Penerapan Akad Ju’âlah dalam Multi Level Marketing (MLM) (Studi atas Marketing Plan www.Jamaher.Network). Maraknya bisnis berbasis Multi Level Marketing (MLM) tidak mungkin dihentikan, karena MLM secara prinsip adalah bagian dari muamalah. Sungguhpun demikian, tidak jarang di antara mereka yang mengikuti system plan MLM banyak yang merasa tertipu. Benarkah MLM bentuk bisnis penipuan' Tulisan ini mencoba untuk menganalisis konsep akad yang terjadi pada bisnis MLM, khususnya pada www.jamaher.network. Tujuannya adalah meminimalisir perbedaan di kalangan umat Islam tentang apa sesungguhnya bisnis MLM itu. Studi ini menyimpulkan bahwa sistem MLM, khususnya di jaringan Jamaher, tidak bertentangan dengan Alquran. Karena Alquran mengakui otoritas individu atau kelompok terhadap harta yang dimiliki secara legal dan memberi kemerdekaan penuh untuk melakukan transaksi apa saja sepanjang tidak keluar batas-batas yang ditentukan oleh syariah.

  • Desain Penyelesaian Kredit Macet Pembiayaan Murâbahah BMT Bina Ummat
           Sejahtera Melalui Pendekatan Socio Legal Research.

      Abstract: : Bad Debt Settlement Design in Murâbahah Financing of BMT Bina Ummah Sejahtera with Approace of Socio Legal Research. This article evaluates the operations of Islamic financing in BMT Bina Ummah Sejahtera, particularly in dealing with bad credit problems. This study concludes that the credit crunch occurring in the BMT is caused by both internal and external factors. The Internal factors relates to a number of falacies, such as: (1) The inaccuracy of employees in providing financing by not doing BI Checking to know the track record of a prospective customer. (2) Weak supervision of the management; (3) Not all financing agreement follow the procedure applicable by law; (4) contract agreements offered were not in favor of the BMT. External factors include; (1) Member bad character, (2) member experience bad luck such as bankruptcy or Household problems. Hence, it is advisable that oversight and enforcement are strictly performed by the government upon the Islamic financial institutions, assuring them to apply existing regulation. By doing so the Islamic finance institution can be expected to be a solution for the national economic development.


      Abstrak: Desain Penyelesaian Kredit Macet Pembiayaan Murâbahah BMT Bina Ummat Sejahtera Melalui Pendekatan Socio Legal Research. Artikel ini mengevaluasi operasional pembiayaan syariah di BMT Bina Ummat Sejahtera khususnya dalam menangani masalah kredit macet. Hasil penelitian menyimpulkan bahwa kredit macet yang terjadi di BMT tersebut disebabkan oleh faktor internal dan faktor eksternal. Faktor internal berkait dengan: ketidaktelitian dari karyawan dalam memberikan pembiayaan, tidak dilakukannya BI Checking untuk mengetahui rekam jejak calon nasabah. Lemahnya pengawasan dari pimpinan, tidak semua perjanjian pembiayaan mengikuti prosedur hukum yang berlaku, akad perjanjian yang ditawarkan tidak menguntungkan pihak BMT. Sedangkan faktor eksternal meliputi: iktikad buruk anggota, anggota mengalami musibah misalnya pailit atau mengalami problem rumah tangga. Untuk itu, disarankan adanya pengawasan dan penertiban secara ketat oleh pemerintah terhadap lembaga keuangan syariah agar mentati peraturan perundangan yang berlaku sehingga pembiayaan syariah dapat menjadi solusi dalam pembangunan ekonomi nasional.

      Abstract: Abstrak: Legal Protection of Outsourcing Labor in Indonesia Employment Act Number 13/2003 and Islamic Law. This article compares the concept of outsourcing labor protection of or as stipulated in Employment Act Number 13/2003 to the Islamic law. The goal is to find similarities and differences in both legal systems which can be used as a source in refining the existing legal rules. The analysis used here is descriptive qualitative comparative, describing the issue of labor protection both in the positive law and Islamic law. In Islam, the outsourcing mode of employment is similar to syirkah ‘abdan and ijârah. On account that the outsourcing it self contains two agreements/contracts, first, the contract between the provider of employment and the using company and second between the company providing employment with the workers. The Islamic law shows positive attitudes towards the outsourcing employment relations to the extend that both parties fulfill all the rights and obligations among themselves.


      Abstrak: Perlindungan Hukum Tenaga Kerja Outsourcing Menurut Undang-Undang RI Nomor 13 Tahun 2003 dan Hukum Islam. Artikel ini membandingkan konsep perlindungan tenaga kerja outsourcing atau alih daya sebagaimana diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Hukum Islam. Tujuannya adalah untuk menemukan persamaan dan perbedaan perlakuan dari kedua sistem hukum yang dapat dijadikan sebagai bahan dalam menyempurnakan aturan hukum yang telah ada. Analisis yang digunakan adalah deskriptif kualitatif komparatif, yang menguraikan secara jelas dan ringkas terhadap perlindungan tenaga kerja outsourcing atau alih daya dalam hukum ketenagakerjaan dan hukum Islam. Outsourcing diqiyaskan ke dalam dua konsep dalam Islam, yaitu syirkah ‘abdan dan ijârah. Karena dalam outsourcing sendiri memang terdapat dua perjanjian/akad, yaitu antara perusahaan penyedia pekerjaan dengan perusahaan penyedia/penyalur jasa tenaga kerja dan antara perusahaan penyedia jasa tenaga kerja dengan karyawan/pekerjanya sendiri. Sikap Islam terhadap outsourcing (OS) pada prinsipnya menerima sepanjang hak dan kewajiban kedua belah pihak, dalam hal ini buruh dan majikan, dipenuhi secara baik.

      Abstract: : Analysing the Protection of Children Sexual Exploitation Victim from Yuridical-Normative and Psychological Perspectives: A Case in the Police Resort of East Lampung Region. This study analyzes the handling of cases of children sexual exploitation in the Police Resort of East Lampung Region. Child sexual exploitation is a type of sexual abuse in which children are sexually exploited for money, power or status. The cases of exploitation of children, known as CSEC, are .increasingly prevalent lately and pose a concern from many parties. This is because the CSEC problem is not only a legal issue, but also involves other aspects, religion, psychology, sociology and Medic. This study finds out that the handling of cases of CSEC in the Police Resort East Lampung Region have been running optimally, starting from the registration of the complaint process, examination of the victim, guarding the anonymity of victims, relief, until the process of rehabilitation. The pattern of handling of such cases is realy in accordance with the principles of Islamic law.


      Abstrak: Perlindungan Terhadap Anak Korban Eksploitasi Seksual dalam Perspektif Yuridis-Normatif dan Psikologis (Studi Kasus Wilayah Hukum Polres Lampung Timur). Penelitian ini menganalisis penanganan kasus eksploitasi seksual terhadap anak di wilayah hukum Polres Lampung Timur. Kasus eksploitasi terhadap anak, yang dikenal dengan sebutan CSEC, akhir-akhir ini kian marak dan menimbulkan keprihatinan banyak pihak. Hal ini dikarenakan masalah CSEC tidak hanya merupakan isu hukum, tetapi juga involves other aspects, such as religion, Psychology, sociology and Medis. Penelitian ini menemukan bahwa penanganan kasus CSEC di Polres Lampung Timur telah berjalan secara optimal mulai dari tahap penerimaan pengaduan, pemeriksaan korban, penjagaan kerahasiaan identitas korban, pemberian bantuan, hingga proses rehabilitasi korban. Pola penanganan kasus yang demikian bukan saja sesuai dengan Standard Operating Procedures tetapi juga sesuai dengan prinsip-prinsip dalam hukum Islam.

      Abstract: : Polygamy and Its Relevance to Household Harmony (A Case in the Rajabasa Village, Bandar Lampung). This article covers the issue of polygamy in domestic life - ranging from a polygamous husband grounds to the consequences of polygamy in household life.. This type of research is a case study located in the neighborhood of Rajabasa village, Bandar Lampung. The study reveals several facts, among others: First. The principal reason behind the husband’s polygamous tendency is generally related to biological desire, coupled with the assumption that they are able to support more than one wife. Second, the case of polygamy is likely to cause negative impact in the household, in the form of disharmony either between the husband and the first wife, or between the first wife and the second wife. In addition, polygamy is also likely to cause negative impact among children, in which attentions to children is neglected and displaced. 
      Abstrak: Poligami dan Relevansinya dengan Keharmonisan Rumah Tangga (Studi Kasus di Kelurahan Rajabasa Bandar Lampung. Artikel ini mengulas masalah poligami dalam kehidupan rumah tangga, mulai dari alasan suami berpoligami hingga dampak yang timbul akibat terjadinya poligami. Jenis penelitian adalah studi kasus dengan lokasi penelitian di lingkungan Kelurahan Rajabasa, Kotamadya Bandar Lampung. Hasil penelitian mengungkap beberapa fakta antara lain: Pertama, alasan pokok yang melatarbelakangi suami melakukan poligami umumnya bermuara pada keinginan biologis, ditambah dengan anggapan bahwa mereka mampu untuk menghidupi lebih dari seorang istri. Kedua, kasus poligami cenderung menimbulkan dampak negatif berupa ketidakharmonisan rumah tangga, baik antar suami dengan istri pertama maupun antara istri pertama dengan istri kedua. Dampak negatif lainnya adalah perhatian kepada anak menjadi terabaikan, sehingga tidak jarang mereka menjadi anak yang terlantar.

      Abstract: : Philosophy of Wealth: Islamic Principles of Property Ownership. Seeking the wealth is everyone’s dream. Accordingly, people are competing to seek the opulence legally or even illegally. In Islamic teachings, happiness does not merely lies in the wealth but on the psychological and spiritual side of the owner. A person obtaining possession unlawfully will account it before God in the Hereafter. Prophet Muhammad reminded that there are four cases that will be accounted before God in the Hereafter namely: life, deeds, knowledge and wealth. For these reasons, Islam set the principles that must be adhered in seeking and utilizing the wealth.Abstrak: Filsafat Harta: Prinsip Hukum Islam Terhadap Hak Kepemilikan Harta. Memiliki harta merupakan dambaan setiap orang, karenanya orang berlomba-lomba mencari harta, adakalanya secara legal dan adapula secara illegal. Di dalam ajaran Islam kebahagiaan tidaklah semata-mata terletak pada banyaknya harta melainkan pada sisi psikologi dan spiritual pemiliknya. Orang yang memiliki harta dengan cara-cara yang tidak sah akan sangat berat mempertanggungjawabkannya di hadapan Allah diakhirat nanti. Rasulullah mengingatkan bahwa ada 4 perkara yang akan dipertanggungjawabkan di hadapan Allah yakni: umur, tubuh, ilmu dan harta kekayaan. Oleh karena itu, Islam mengatur prinsip-prinsip yang harus ditaati dalam mencari dan memanfaatkan harta tersebut.
