  • The Issues of Criminal Policy in the Interwar Period in Poland

      Abstract: One of the debates carried out in interwar Poland among legal professionals, including on the pages of legal journals, regarded the issue of how to define and delimit the scope of criminal policy. It was contributed to by many prominent jurists of that era, such as J. Makarewicz, B. Wróblewski or E.S. Rappaport. The aim of this article is to present J. Reinhold’s and A. Moginicki’s views on criminal policy. However, these two authors perceived the combat against crime differently as to the use of various means by the state or both the state and society (penalties and/or preventive/protective measures). Although they were influenced by the sociological school of criminal law, mainly F. von Liszt’s position, an analysis of their views points to a number of differences in their positions.

  • Concealing the Crime of Homicide by the Perpetrator

      Abstract: This article deals with the issue of masking the homicide by its perpetrator. The considerations made hereby are an attempt to bring the problem of the behavior of the homicide culprit at the crime scene, as well as outside of it, which are aimed at avoiding criminal liability for the committed crime. Unlimited human imagination leads to a multitude of ways in which criminals can behave in order to try to hinder or prevent their detection by law enforcement agencies. In addition, it should be noted that on the basis of the Polish Penal Code, the perpetrators who mask their offences do not bear criminal liability.

  • Model of Employment Relationship in Higher Education – A Theoretical
           Approach

      Abstract: There is no uniform model of employment in Polish legislation. The shape of the employment relationship of an academic employee is strongly influenced by the specific normative relationship that exists between the Labour Code and the Law on Higher Education. It should be noted that the Law on Higher Education is not a sufficient regulation. It regulates, in principle, sufficiently those issues that require, due to its nature, a different than regulatory code. The relations between these two acts are diverse, which results from the construction of Article 5 of the Labour Code. The statutory regulations affect the shape of the employment relationship. Each college as part of its autonomy can regulate various issues, creating many different hybrid work relationship models.

  • A Political Upheaval as a Form of Succession of the Royal Power in the
           United Monarchy of Israel. From Saul to Solomon

      Abstract: The aim of this article is to analyse the issues related to a political upheaval as a form of the succession of royal power in the monarchy of united Israel in the period that started during the reign of the first king of the Hebrews – Saul – till the last years David spent on the throne. During the period analysed in this article, there were several unsuccessful attempts to seize power through a political coup. Due to the fact that the inheritance based on the principle of primogeniture was never unambiguously introduced in the Kingdom of Israel, the most serious upheaval, described as a palace revolution, took place at the end of King David’s life. As a result, the younger son of David – Solomon – ascended to Israel’s throne, despite the fact that there were no legitimate grounds for him to take power.

  • Review of the Legislation Regulating the Use of Land. Legal and
           Administrative Issues

      Abstract: Degradation of the land in various forms is one of the basic and persistent global problems. Irrational agricultural activity, deforestation, increasing industrialization and progressive urbanization lead to the loss of important functions of this natural resource. This is a serious problem throughout the European Union, as evidenced by statistical data disclosed in reports of the European Commission. Due to the failure to develop regulations at the EU level ordering the issues of protection of land surface and the fragmentary nature of binding regulations, each of the Member States, including Poland, selected legal means to achieve the assumed objectives related to both the obligation to protect the function of this resource, quality monitoring, registration pollution, or restoring utility and natural values. The aim of the conducted research was to analyze legal regulations establishing administrative law forms of rationing for the use of earth’s surface and their assessment in terms of implementing the principles of sustainable management of this resource. It should be stated that the gradually introduced instruments of land use regulation are not completely used to implement the principle of sustainable land management, although de lege ferenda would have to make an application for ensuring stable, comprehensive and coherent solutions.

  • Liability of Juveniles Under Article 10 § 2 of the Criminal Code for
           Various Forms of Criminal Cooperation. Part Two

      Abstract: The entire study is devoted to the question of the imputability of criminal responsibility to a minor acting under the conditions set out in Article 10 § 2 of the Criminal Code for acts committed in various phenomenal forms. In the second part of the study, the author justifies his own concept, referring it to the construction of a single entity, in particular using the so-called indirect agency as well as incitement and aiding. The work ends with a concise conclusion combined with a reference to the general rules of interpretation.

  • Some Remarks for the Law as It Should Stand in the Matter of State’s
           Evidence Witness’ Testimony

      Abstract: The article addresses the slightly anachronistic, in the author’s opinion, institution of state’s evidence witness, whose current legislative shape may raise objections, in particular from the point of view of the application of the principle of equality before the law. The study presents a few conclusions on the law as it should stand (de lege ferenda), which, if implemented, could be used to optimize the legal solutions provided for in the Act on State’s Evidence. The article puts forward, among other things, the proposal to include the subsidiarity principle in the discussed institution, kind of like the requirement relating to operational surveillance, which is also debatable in moral and juridical terms, as it leads to restrictions, which is also not indisputable in the moral and juridical sense. The article also refers to the wording of Article 6 of the aforementioned Act, which provides for a rule that eliminates evidence from the suspect who ultimately did not acquire the status of a state’s evidence witness. According to the author, the approach under this rule is too broad and imprecise, thus it requires an appropriate correction.
