      Abstract: AbstractIn international law, there are norms which have the status or degree of jus cogens, therefore may not be violated, excluded or exempted under any circumstances. When a new norm of jus cogens in international law emerges, any treaty in conflict with that norm becomes invalid or void. This is what distinguishes jus cogens with other norms or principles in international law. This journal aims to determine the criteria for determining the principles of jus cogens and to analyze which human rights can be categorized as a jus cogens in international law. This journal is a normative research, using a statute and a conceptual approach. To determine the criteria of jus cogens, this paper analyzes that it should be done by looking at the formal aspects, namely the condition that forms the norm, and the substantive aspects, which are substantially the binding norrm itself. These two aspects are then used to determine which human rights can be catagorized as jus cogens. It can be seen from international recognition, the language in international agreements, both in the preamble and the articles, the majority of countries that have ratified the agreement, and also the analysis of the decision or judicial body towards such international norms.
      AbstrakDalam hukum internasional, terdapat beberapa norma yang memiliki status jus cogens, sehingga tidak dapat dilanggar, dikesampingkan atau dikecualikan dalam keadaan apapun. Bila muncul norma jus cogens yang baru dalam hukum internasional, maka perjanjian yang telah ada yang bertentangan dengan norma tersebut menjadi tidak sah atau batal. Hal inilah yang membedakannya dengan norma dan prinsip hukum internasional yang lain. Jurnal ini bertujuan untuk mengetahui kriteria untuk menentukan prinsip jus cogens dalam hukum internasional serta menganalisa hak asasi manusia apa saja yang dapat dikategorikan sebagai jus cogens dalam hukum internasional. Jurnal ini merupakan penelitian normatif, dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conseptual approach). Untuk menentukan kriteria jus cogens, jurnal ini menganalisa bahwa hendaknya dilakukan dengan melihat aspek formal, yaitu sebuah kondisi yang membentuk norma tersebut, dan aspek substantif, dimana norrma tersebut memiliki substansi yang memaksa. Sedangkan untuk menentukan HAM apa saja yang merupakan jus cogens, maka dapat dianalisa berdasarkan aspek formal dan substantif diatas yang dapat dilihat dari pengakuan internasional, bahasa di dalam sejumlah perjanjian internasional, baik di dalam preambul maupun pasal-pasal, mayoritas negara yang telah meratifikasi perjanjian tentang norma jus cogens tersebut, dan juga analisis terhadap putusan badan atau peradilan internasional terkait norma tersebut.

      Abstract: AbstractForeign Investment Company or better known as PMA is considered to have a proven competence to ensure its business along supported by a good capital structure, a bureaucratic procedure mechanism that must be passed by a foreign investment to run a company in Indonesia as an advantage, making the company selective, so banking industry considers a it to be potentials’ as a target market in the distribution of credit facilities.Credit Facility Distribution to Foreign Investment Company has a high risk if incase non-performing loan happen, therefore the status of foreign citizenship owner become shield from legal protection of the bank. Due on those cases, the author analyze the following issue: 1) What are the factors that causes non-performing loan in credit facility distribution by the foreign investment company' 2) What are the risks of the bank in the event of a non-performing loan y the foreign investment company' 3) How is the legal protection against bank in case of a non-performing loan occurs by the foreign investment company'The research method used for this research is empirical theory with sociological approach, case study in Bank Maspion, Mangga Dua Branch, Jakarta. The conclusion is credit facility distribution to a foreign investment company is there is no special legal regulation that regulates the protection of the Bank as a creditor in case of a non-performing loan from foreign investors. So, the government is expected to make a constitution of legal protection against bank to assure a strong legal certainty. It will also help support banking industry to advance the nation’s economy.    AbstrakPerusahaan penanam modal asing atau yang lebih dikenal dengan istilah PMA dianggap memiliki kompetensi yang telah teruji untuk menjamin kelangsungan usahanya serta didukung oleh struktur permodalan yang baik, mekanisme prosedur birokrasi yang harus dilalui sebuah perusahaan penanam modal asing untuk dapat menjalankan usahanya di Indonesia dianggap sebagai keuntungan bagi industri perbankan dikarenakan proses tersebut akan membuat perusahaan penanam modal asing yang ada bersifat selektif, sehingga industri perbankan memandang perusahaan penanam modal asing (PMA) sangat potensial untuk dijadikan pasar sasaran dalam penyaluran fasilitas kredit.Penyaluran fasilitas kredit kepada debitor penanam modal asing (PMA) juga memiliki resiko yang besar terutama apabila terjadi kredit macet dalam penyaluran kredit tersebut, status kewarganegaraan asing pemilik usaha menjadikan aspek perlindungan hukum terhadap Bank selaku Kreditor memiliki posisi yang kurang baik, berdasarkan latar belakang tersebut penulis mebatasi permasalahan: 1)  Apa  yang menjadi faktor-faktor terjadinya kredit macet dalam penyaluran kredit oleh perbankan kepada Debitor penanam modal asing' 2) Bagaimana resiko Bank bila terjadi kredit macet atas debitor penanam modal asing ' 3) Bagaimana upaya perlindungan hukum terhadap Bank bila terjadi kredit macet pada kredit yang disalurkan pada penanam modal asing'.Metode Penelitian yang digunakan dalam penulisan jurnal hasil penelitian ini adalah penelitian empiris dengan pendekatan sosiologi hukum  (sosio legal research), dengan studi kasus di Bank Maspion cabang Mangga Dua Jakarta, hasil penelitian dapat disimpulkan bahwa dalam penyaluran fasilitas kredit oleh Bank kepada debitor penanam modal asing (PMA), belum terdapat aturan hukum yang bersifat khusus yang mengatur perlindungan terhadap Bank selaku kreditor apabila terjadi kredit macet dari debitor penanam modal asing, maka diharapkan pemerintah dapat segera melakukan membuat Undang-undang yang mengatur perlindungan terhadap Bank selaku kreditor bila terjadi kredit macet dengan debitor penanam modal asing sehingga dapat memberikan kepastian hukum yang kuat dan seimbang dalam rangka mendukung industri perbankan dalam memajukan perekonomian bangsa.

      Abstract: AbstractThis research is motivated by the practice of buying and selling land rights with is preceded by a treaty called the Sale and Purchase Fastenings Agreement of Land Rights. The agreement is a pre-agreement before the implementation of sale and purchase of land rights. The issue raised is whether such agreements are acceptable in land laws. This paper is intended to obtain answers to these problems, and therefore could be used to form a more explicit legal norms regarding the Sale and Purchase Fastenings Agreement of Land Rights. This is a normative legal research using the conceptual approach and statute approach. The results shows that that: First, the legal position of the Sale and Purchase Fastenings Agreement of Land Rights can be accepted as the law of life in the practice of the people of Indonesia, as well as to fill the void of legal norms. Secondly, payment of the price of the Sale and Purchase Agreement Landrights does not result in the ownership of the land from the seller to the buyer, but only a downpayment or sign so. Third, legal protection for well-meaning potential buyers and has paid in the event of nullification agreement is given in the form of their absolute power and the clauses contained in the Sale and Purchase Fastenings Agreement of Land Rights. AbstrakDilatarbelakangi oleh adanya praktik jual beli dengan objek hak atas tanah yang  didahului dengan suatu perjanjian yang disebut dengan Perjanjian Pengikatan Jual Beli Hak atas Tanah (PPJB-HAT). PPJB-HAT merupakan suatu bentuk perjanjian sebelum dilaksanakannya jual beli hak atas tanah. Isu yang mengemuka kemudian, apakah perjanjian tersebut dapat diterima dalam hukum pertanahan. Tulisan ini dimaksudkan untuk memperoleh jawaban terhadap permasalahan tersebut dan selanjutnya dapat dipergunakan untuk membentuk norma hukum yang lebih eksplisit mengenai PPJB-HAT. Dengan metode hukum normatif dan menggunakan dua pendekatan, yaitu pendekatan konsep dan pendekatan perundang-undangan, diperoleh jawaban, bahwa: Pertama, kedudukan hukum PPJB-HAT dapat diterima sebagai hukum yang hidup dalam praktik masyarakat Indonesia, serta untuk mengisi kekosongan norma hukum. Kedua, pembayaran lunas terhadap harga dalam PPJB-HAT belum mengakibatkan beralihnya hak atas tanah dari penjual kepada pembeli, namun hanya merupakan panjar atau tanda jadi.  Ketiga, perlindungan hukum bagi calon pembeli yang beritikat baik dan telah membayar lunas dalam hal terjadi kebatalan perjanjian diberikan dalam bentuk adanya kuasa mutlak dan klausula yang tercantum dalam PPJB-HAT.

      Abstract: AbstractOne of the factorsthat hampers theimprovement of the investment climatein Indonesia is due to regulatory issues. Regulatory issues related to several industries including the land sector. Based on data from the Ministry of Agricultural and Spatial Planning / National Land Agency of Republic of Indonesia there are about 632 regulations related to land whereas 208 are no longer valid leaving only 424 regulations applicable. Regulation of some 424 hadimplementationproblems and conflicts between agencies.The primary key of law enforcement begins with the quality of theregulation. Due to regulation which has many shortcomings that need to be addressed to improve the investment climate in Indonesia. To overcpme these problems the Minister of Agrarian and Spatial Planning / National Land Agency of the Republic of Indonesia, Mr. Sofyan Jalil  threw the idea of omnibus law to resolve regulations problems that influence the growth of investment in Indonesia. Sofyan jalil said that the government is discussing the legislation remedial solutions through the Omnibus Law. Omnibus Law's existence has been known in legal theories from common law countries. However, the existence of omnibus law is still lessknownamong the academic community of the faculty of law in Indonesia. For that purpose than this article to understand the omnibus law and its use to resolve the regulatory issues in Indonesia. AbstrakSalah satu faktor yang menghambat peningkatan iklim investasi di Indonesia disebabkan karena permasalahan regulasi. Permasalahan regulasi terkait dengan beberapa bidang industri diantaranya adalah bidang pertanahan. Berdasarkan data yang dirilis dari Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional Republik Indonesia ada sekitar 632 regulasi yang terkait bidang pertanahan dimana 208 peraturan sudah tidak berlaku lagi sehingga yang berlaku 424 regulasi. Regulasi sebanyak 424 beberapa memiliki permasalahan penerapannya dan benturan antar instansi. Padahal kunci utama penegak hukum dimulai dari kualitas mutu regulasi yang berlaku. Akibat regulasi yang memiliki banyak kekurangan maka perlu untuk dibenahi karena menjadi faktor penghambat peningkatan iklim investasi di Indonesia. Untuk mengatasi permasalahan tersebut maka Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Republik Indonesia Bapak Sofyan Jalil melontarkan gagasan konsep Omnibus Lawuntuk menyelesaikan pemasalahan regulasi yang menghambat pertumbuhan investasi di Indonesia. Sofyan jalil mengatakan bahwa  pemerintah tengah menggodok solusi perbaikan undang-undang melalui Omnibus Law. Keberadaan Omnibus Law sudah dikenal dalam teori-teori hukum. Teori Omnibus Law berasal dari negara yang menganut sistem hukum common law. Akan tetapi keberadaan Omnibus Lawmasih kurang diketahui dikalangan civitas akademika fakultas hukum di Indonesia. Untuk itu tujuan daripada tulisan ini untuk memahami Omnibus Lawdan penggunaannya untuk membenahi permasalahan regulasi di Indonesia.

      Abstract: AbstractThe general understanding of grant is an act included in a legal action in which transfer of ownership rights are intentionally transferred to those or others. The grants under civil law stipulated in the Law of Civil Law or Burgelijk Wetboek (BW) in Article 1666 to Article 1693, whereas in Islamic law grants are stipulated in Islamic Law Compilation (KHI) from Article 210 to Article 214. The Principal Problems in Cancellation Deed of Grant numbers: 162 / KLJ / 11/1999, where there was a mistake of judgment on the first and second claims is that the Religious Court authority to decide the case of cancellation deed grants whereas there are already rules which clearly stipulates that the Religious Court authorized in deciding the case among Muslims in Article 3 and Article 49 of Law No. 3 of 2006 which has been updated to Law Number 50 Year 2009 on Religious Courts. To the level of Final Appeal and Review of judgment turned into the Religious Court in charge of the case of cancellation of the Grant Deed. The objective to be achieved through this research is to analyze the Supreme Court ruling number: 78 PK / Ag / 2013 and all processes so that there is an error the same for judges who would decide a similar case. The study was conducted using the method of juridical normative statute approach and conceptual approach which is then analyzed by using prescript. The Judge's decision that deviates from the rules of law regarding the authority of the Religious Court may result in an injustice and not achieving legal certainty, while the state has regulated it very clearly in the Act. 
      Pengertian hibah secara umum yaitu hibah termasuk dalam perbuatan hukum dimana terjadi pemindahan hak kepemilikan yang sengaja untuk dialihkan kepada pihak atau orang lain. Adapun hibah menurut hukum perdata diatur dalam Kitab Undang-undang Hukum Perdata atau Burgelijk Wetboek (BW) dalam Pasal 1666 sampai dengan Pasal 1693, sedangkan dalam hukum Islam hibah diatur dalam Kompilasi Hukum Islam (KHI) mulai dari Pasal 210 hingga Pasal 214. Dalam Pokok Permasalahan pembatalan Akta Hibah nomor : 162/Klj/11/1999, dimana terjadi suatu kesalahan yaitu putusan pada tingkat pertama dan kedua menyatakan bahwa Pengadilan Agama tidak berwenang untuk memutus perkara pembatalan Akta Hibah tersebut sedangkan sudah ada aturan yang dengan jelas mengatur bahwa Pengadilan Agama berwenang dalam memutus perkara diantara umat Islam atau muslim dalam Pasal 3 dan Pasal 49 Undang-Undang Nomor 3 Tahun 2006 yang telah diperbarui menjadi Undang-Undang Nomor 50 Tahun 2009 tentang Peradilan Agama. Hingga pada tingkat Kasasi dan Peninjauan Kembali putusan berubah menjadi Pengadilan Agama berwenang atas perkara pembatalan Akata Hibah tersebut. Adapun tujuan yang ingin dicapai melalui penelitian ini adalah untuk menganilisis putusan Mahkamah Agung nomor: 78 PK/Ag/2013 beserta segala proses sehingga tidak terjadi suatu kesalahan yang sama bagi para hakim yang kelak memutus perkara serupa. Penelitian dilakukan menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach) yang kemudian dianalisis dengan menggunakan teknik preskripif. Putusan Hakim yang menyimpang dari aturan perundang-undangan mengenai kewenangan Pengadilan Agama mengakibatkan terjadinya suatu ketidakadilan dan tidak tercapainya suatu kepastian hukum, sedangkan negara telah mengatur dengan sangat jelas dalam Undang-undang.

      Abstract: AbstractThis study aims to find out how current legal devices could give legal certainty on excess of family heritage partition (radd) for widowers and widows in Islamic laws as well as analyse judicial consideration on which matters regarding excess of family heritage partition (radd) for widower and widow are based.The writer used normative law method which consists of statute approach and conceptual approach.The comprehension of radd  in Islamic scholars views differ from each other in terms of heirs. Some scholars accept the concept of radd whereas some do not. Scholars who do not accept radd base their views on An-Nisa verse 14 and hadiths which state that radd should be given to baitul mal as Muslims representative. On the other hand, scholars who accept the concept of radd refer their arguments to Al-Anfal verse 75 and hadiths which state that kinship has more influence to inheritance matter rather than relations based on religions or marriages. Nevertheless, scholars who accept radd also differ from each other in terms who has the right to receive radd. The matters of radd have been regulated on article 193 of Islamic Law Compilation (KHI). Radd should be given to all heirs with no exception including husband (widower) or wife (widow). Based on rational thinking, husband (widower) or wife (widow) are allowed to receive radd since under no circumstances is husband or wife unable to give heritage to their wife or husband. However, in different context and cases, it can be reconsidered without setting aside scholars arguments. AbstrakTulisan ini bertujuan untuk mengetahui dan memperbaharui sejauh mana perangkat hukum yang ada mampu memberikan kepastian hukum kedudukan kelebihan pembagian harta warisan (radd) untuk janda dan duda dalam hukum waris Islam dan menganalisis tentang pertimbangan yuridis yang dijadikan dasar pertimbangan dalam memutus perkara yang terkait dengan kelebihan pembagian harta warisan (radd) untuk janda dan duda. Penulis menggunakan metode hukum normatif yang terdiri dari pendekatan undang-undang (statue approach) dan pendekatan konseptual (conceptual approach). Pemahaman konsep radd dalam pandangan para ulama memiliki perbedaan mengenai ahli waris penerima radd. Ada ulama yang menerima radd dan ada juga yang menolak radd. Ulama yang menolak radd berdasakan Surat An-Nisa ayat 14 dan hadits, yaitu radd diserahkan kepada baitul mal sebagai perwakilan dari umat Islam. Sedangkan ulama yang menerima radd memperkuat argumennya dengan dalil surat Al-Anfal ayat 75 dan hadits, yaitu hubungan kekerabatan nasab jauh lebih berpengaruh dalam kewarisan dibandingkan dengan hubungan agama atau perkawinan. Karena dipandang lebih maslahah dan dapat membantu kehidupan keluarganya. Ternyata ulama yang menerima radd juga menimbulkan perbedaan tentang siapa saja ahli waris yang berhak menerima radd. Masalah radd diatur dalam pasal 193 Kompilasi Hukum Islam (KHI). Radd diberikan kepada semua ahli waris tanpa kecuali, termasuk suami (duda)/istri (janda). Secara lebih rasional suami (duda)/istri (janda) boleh menerima radd, karena dalam keadaan apapun tidak mungkin seorang suami (duda)/istri (janda) terhalang mewaris atau terhijab

      Abstract: AbstractIn the Indonesian Journalist’s code of ethic, one of the principle regulated is respecting presumption of innocence principle. But when journalist report criminal case, they do not fully take respect for such principle, for example in Jessica Kumala Wongso case. Furthermore, there isn’t any specific regulation when breaking the principle. The problem is, many journalist are criminalized by article 310 (2) of the Indonesian Criminal Code. The purpose of this research is finding the real principle ] used by journalist when reporting criminal case and the legal implication of such violation. The method used in this research is library research with grammatical and systematical interpretation technique. This result shows that in in theoretical and practical, journalist applying different principal when reporting criminal case. The principal that used by journalist is presumption of guilt principal. As a result of applying presumption of guilt principal, journalist are considered to insult and make article 310 (2) KUHP as the only way out for journalist that considered to do insult. As a manifestation of restorative justice, a concept of penal mediation for journalist that has considered to do insult has been submitted.  AbstrakKode Etik Wartawan Indonesia salah satunya mengatur bahwa wartawan diharuskan untuk menghormati asas praduga tak bersalah. Akan tetapi dalam praktik pemberitaan perkara pidana, wartawan tidak sepenuhnya menghormati asas praduga tak bersalah. Hal ini dapat dicontohkan pada pemberitaan kasus Jessica Kumala Wongso. Selain itu, sampai saat ini tidak ada peraturan yang mengatur secara khusus untuk wartawan selain pada kode etik, jika muncul sebuah pelanggaran penghormatan terhadap asas praduga tak bersalah. Permasalahan muncul ketika wartawan banyak dikriminalisasi dengan pasal 310 (2) KUHP. Tujuan dari tulisan ini untuk menemukan asas yang seharusnya digunakan wartawan sebagai landasan untuk mempublikasikan perkara pidana dan implikasi hukum apabila publikasi perkara pidana oleh wartawan bertentangan dengan asas praduga tak bersalah. Tulisan ini didasarkan pada penelitian hukum normatif dengan teknik pengumpulan bahan hukum melalui studi kepustakaan menggunakan teknik interpretasi gramatikal dan sistematis. Dari penelitian tersebut diketahui bahwa secara teori dan praktik, wartawan menerapkan hal yang berbeda dalam melakukan pemberitaan perkara pidana. Asas yang digunakan wartawan dalam melakukan pemberitaan perkara pidana yaitu asas praduga bersalah. Sebagai akibat penggunaan asas praduga bersalah, wartawan seringkali dianggap melakukan penghinaan/pencemaran dan menjadikan pasal 310 ayat (2) KUHP sebagai jalan terakhir bagi wartawan yang melakukan penghinaan/pencemaran. Sebagai perwujudan keadilan restoratif, diajukan sebuah konsep mediasi penal bagi wartawan yang melakukan penghinaan/pencemaran.

      Abstract: AbstractThe aim of this paper is analyze the suitability between the protection of children as victims of sexual crimes as regulated in Act number 35/2014 on the Amendment of Act number 23/2002 on Child Protection relating to the handling of child victims of sexual abused with a restorative justice approach as set in Act Number 11/2012 on the Juvenile Criminal Justice System. This paper based on normative legal research. The results of the study indicate that the  protection of children as victims of sexual violence in Article 71D of Act Number 35/2014 on the Amendment of Act Number 23/2002 on Child Protection has not fully reflect the handling with restorative justice approach. AbstrakTulisan ini bertujuan untuk menganalisis terkait kesesuaian antara perlindungan anak korban kejahatan seksual  yang diatur dalam UU 35/2014 mengenai Perubahan atas UU 23/2002 tentang Perlindungan Anak  terkait penanganan  anak sebagai korban kekerasan seksual dengan pendekatan keadilan restoratif sebagaimana diatur dalam UU 11/2012 mengenai Sistem Peradilan Pidana Anak.  Untuk menjawab tujuan tulisan tersebut,  digunakan penelitian hukum normatif dengan menggunakan pendekatan undang-undang. Hasil penelitian tersebut menunjukkan bahwa pengaturan perlindungan terhadap anak sebagai korban kekerasan seksual dalam Pasal 71D UU 35/2014 mengenai Perubahan terhadap UU 23/2002 tentang Perlindungan Anak belum sepenuhnya mencerminkan penanganan dengan menggunakan pendekatan keadilan restoratif.
