      Abstract: According to article 154, paragraph 2 of the ACT 23, 2014 the implementation of the duties and authority of parliaments is set in the code of conduct. Member of House of Representatives of District / city perform other duties according to the regulation  including the code of ethics. They exercise the rights and obligations under the code of conduct. This article will analyze the role of the Honor Code Agency in the enforcement of violations committed by the council members. The factors restricting the performance of Honor Code Agency in Pemalang. The strategy to improve the Agency performance. This article is a  juridical sociological research which uses  a qualitative approach. Sources of research data is primary and secondary data. The techniques used are interviews, observation, and literature studies. The results showed that in carrying out the duties and authority of the Honor Agency of legislative body has an active and passive function. The active function is to evaluate each member of the Board in the meeting, to supervise legal product that is produced, reviewing the intensity of the meeting by members of Parliament. The passive function is to evaluate and process complaints, ethical issues or crime committed by members of Parliament. Factors that affect the performance is a code of ethics that has not been established, litigation procedures conflicts, the procedural issues of complaint, low cooperation of complaint, and the nature of solidarity among members of parliament. Board performance improvement strategy is based on the establishment of a code of ethics and litigation privilege Agency, meeting attendance evaluation, public courtroom, optimization of existing facilities in the working paper of Parliament. Board member attendance strategy evaluation is based on the evaluation of the Agency's internal honor, value filtering, the policy statement of honor Agency, penalties or rehabilitation.
      AbstrakSesuai Pasal 154 ayat 2 UU 23 Tahun 2014 tata cara pelaksanaan Tugas dan wewenang DPRD diatur dalam tata tertib. Anggota DPRD Kabupaten/kota melaksanakan wewenang dan tugas lain sesuai peraturan perundang-undangan termasuk tentang kode etik. Alat kelengkapan DPRD dalam melaksanakan hak dan kewajiban berdasarkan Tata Tertib. Permasalahan yang dikaji dalam penulisan jurnal ini adalah: peranan Badan Kehormatan DPRD dalam penegakkan pelanggaran kode etik yang dilakukan anggota dewan. Faktor Penghambat Kinerja Badan Kehormatan DPRD Kabupaten Pemalang. Strategi peningkatan kinerja badan kehormatan DPRD. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian yuridis sosiologis. Sumber data penelitian adalah data primer dan sekunder. Teknik pengambilan data: wawancara, observasi, dan studi pustaka. Hasil penelitian menunjukan bahwa dalam melaksanakan tugas dan wewenangnya Badan Kehormatan DPRD memiliki fungsi aktif dan fungsi pasif. Fungsi aktif yaitu evaluasi setiap anggota dewan dalam rapat, mengawasi produk hukum yang dihasilkan DPRD, meninjau intensitas rapat yang dilakukan anggota DPRD. Fungsi pasif Badan Kehormatan yaitu mengevaluasi dan memproses aduan  yang masuk, aduan dalam hal ini tentang permasalahan etik atau pidana yang dilakukan anggota DPRD. Faktor yang mempengaruhi kinerja Badan Kehormatan perekrutan anggota Badan Kehormatan, belum mengatur kode etik, terbenturnya tata beracara Badan Kehormatan, masalah prosedural pengaduan yang rumit, pengadu kurang bekerjasama, sifat solidaritas antar anggota DPRD. strategi peningkatan kinerja Badan kehormatan terealisasi : berdasarkan pembentukan kode etik dan tata beracara Badan Kehormatan, evaluasi kehadiran rapat, public hearing, optimalisasi sarana prasaran yang ada di DPRD. Strategi evaluasi kehadiran anggota dewan : evaluasi internal badan kehormatan, penyaringan nilai, pemanggilan anggota dewan, pernyataan anggota dewan, kebijakan badan kehormatan, pemberian sanksi atau rehabilitasi.

      Abstract: Air pollution caused by haze has become an annual event in Southeast Asia, the cause is a forest fire that occurred almost in every dry season in Sumatra and Kalimantan. Transboundary haze pollution is considered being common to the countries in ASEAN, because the impact caused by smoke pollution is not only plagued the country (Indonesia), but also other ASEAN member countries. Another consequence of this pollution is the emergence of diplomatic tensions between Indonesia as polluter toward other countries that affected by the pollution. To overcome these problems, ASEAN form regulations regarding transboundary haze pollution through the ASEAN Agreement on Transboundary Haze Pollution (AATHP) which begin effective since 2003 and has been ratified by all members of ASEAN in 2014. This research aimed to analyze the effectiveness of AATHP which regulates the transboundary haze pollution in the ASEAN member countries. This research used normative studies with statute, conseptual and case approach. The results showed that AATHP cannot be effective in its implementation in national law in the countries that ratified the treaty. The ineffectiveness of AATHP in national law is influenced by three factors, there is no clear mechanism for implementing AATHP, the compliance of the parties a low marked by the lack of willingness of the state (the parties) to carry out its obligations under AATHP and third parties by delegation authority to monitor the implementation of AATHP still unformed. Ineffectiveness of AATHP is also demonstrated by the absence of changes in behavior and environmental change for the better after AATHP formed. AbstrakPolusi udara yang disebabkan oleh pencemaran asap telah menjadi peristiwa tahunan di Asia Tenggara, penyebabnya adalah kebakaran hutan dan lahan yang terjadi hampir disetiap musim kemarau di wilayah Sumatera dan Kalimantan. Pencemaran asap lintas batas dianggap sebagai masalah bersama negara-negara di ASEAN, karena dampak yang ditimbulkan oleh pencemaran asap ini tidak hanya melanda satu negara (Indonesia) saja, tetapi juga negara anggota ASEAN lainnya. Akibat lain dari pencemaran ini adalah timbulnya ketegangan diplomatik antara Indonesia sebagai negara pencemar dengan negara-negara lain yang terkena dampak pencemaran. Untuk mengatasi masalah tersebut, ASEAN kemudian membuat regulasi mengenai pencemaran asap lintas batas melalui ASEAN Agreement on Transboundary Haze Pollution (AATHP) yang mulai efektif berlaku sejak tahun 2003 dan telah diratifikasi semua anggota ASEAN pada 2014. Jurnal ini bertujuan untuk menganalisis efektivitas AATHP dalam hukum nasional yang mengatur tentang pencemaran asap lintas batas di negara anggota ASEAN. Jurnal ini menggunakan metode jurnal yuridis normatif dengan pendekatan perundang-undangan, pendekatan konsep dan pendekatan kasus. Hasil jurnal menunjukkan bahwa AATHP ternyata tidak bisa berlaku dengan efektif dalam implementasinya pada hukum nasional di negara-negara yang meratifikasi perjanjian tersebut. Ketidakefektifan AATHP pada implementasinya dalam hukum nasional dipengaruhi oleh tiga faktor yakni tidak ada mekanisme yang jelas dalam mengimplementasikan AATHP, tingkat kepatuhan para pihak yang rendah yang ditandai dengan kurangnya kemauan negara (para pihak) untuk melaksanakan kewajiban yang tertera dalam AATHP dan pihak ketiga yang diberi delegasi kewenangan untuk melakukan monitoring dalam pelaksanaan AATHP masih belum terbentuk. Ketidakefektifan AATHP juga ditunjukkan dengan ketiadaan perubahan perilaku dan perubahan lingkungan menjadi lebih baik setelah AATHP dibentuk.

      Abstract: This study was conducted to examine the alternative punishment for the cyber pornography crime. The purpose of this study is to find the punishment formulation which theoretically and philosophically is more acceptable in accordance with the moral development of society and technology. This normative juridical study uses a conceptual approach. While the analysts is conducted by descriptive method to find the basic theory of punishment for the crime of cyber pornography. The results can be concluded that imprisonment has not provided solutions in the criminal offense of cyber pornography without accompanied by other alternative punishment. The alternatives are special minimum penalties, social work, restrictions on access to electronic devices (internet) and compensation to victims of pornography. Key words: cyber pornography, imprisonment, criminal alternative AbstrakPenelitian ini dilakukan untuk mengkaji alternatif pidana yang tepat untuk tindak pidana pornografi siber. Tujuan penelitian ini menemukan formulasi pemidanaan yang secara teoritikal dan filosofis lebih dapat diterima sesuai dengan perkembangan moral masyarakat dan tekhnologi. Penelitian Yuridis Normatif ini  menggunakan pendekatan konseptual. Sedangkan analis dilakukan dengan metode deskriptif analisis untuk mencari dasar teori pemidanaan untuk tindak pidana pornografi siber. Hasil  yang dapat disimpulkan dalam penelitian ini adalah pidana penjara belum memberi solusi dalam pemidanaan tindak pidana pornografi siber tanpa dibarengi dengan alternatif pidana yang lain. Alternatif pidana itu antara lain denda dengan minimum khusus, kerja sosial, pembatasan akses terhadap perangkat elektronik (internet) dan ganti rugi kepada korban pornografi. Kata kunci: pornografi siber, penjara, alternatif pidana

      Abstract: I-Doser Application in smartphone had caused public anxiety and seized greater attention. The purpose of this research is to analyze whether the I-Doser Application application could be put into new narcotic category, to understand and to analyze the impact of law vacuum in I-Doser Application arrangement if understood from law certainty perspective, and to analyze law reformulation policy against I-Doser Application as digital narcotic through Indonesia’s ius constituendum. This is a normative research using statute, conceptual and comparative approaches. Result of this research indicated that I-Doser Application was viewed as the base concept of narcotic thus considered as new narcotic category. The implication of law vacuum, I-Doser Application had embedded its hegemony deeper that could ruin national well-being in the future unless a concrete law measure was taken, so that the necessary law reformulation policy against I-Doser Application as digital narcotic within Indonesia’s ius constituendum.
      AbstrakAplikasi I-Doser yang terdapat pada smartphone menimbulkan keresahan dan menyita perhatian publik. Penulisan ini bertujuan untuk menganalisa aplikasi I-Doser apakah dapat dikategorikan sebagai narkotika baru, memahami dan menganalisa dampak dari kekosongan hukum pengaturan tentang I-Doser dalam perspektif kepastian hukum dan menganalisa kebijakan reformulasi hukum terhadap aplikasi I-Doser sebagai narkotika digital dalam ius constituendum di Indonesia. Penulisan menggunakan jenis penelitian hukum normatif dengan pendekatan undang-undang, konseptual dan komparatif. Hasil pembahasan, aplikasi I-Doser merujuk pada konsep dasar narkotika, dapat dikategorisasikan sebagai narkotika baru. Dampak dari kekosongan hukum, aplikasi I-Doser semakin menancapkan hegemoninya untuk merusak generasi bangsa kedepannya tanpa bisa diberikan sebuah langkah hukum yang kongkrit, sehingga diperlukan kebijakan reformulasi aturan hukum terhadap aplikasi i-doser sebagai narkotika digital dalam ius constituendum di indonesia.

      Abstract: The purpose of this paper to explain and analyze the binding force of the contract as a legal basis in International business. The method applied is normative, which are based on legal principles contained in the law, or set specific standards or norms against a phenomenon by reviewing secondary data or literature. The result is that a contract or agreement as an expression of the will expressed by the offer and acceptance is regarded as a constitutive element of contractual binding force. Supply and demand contains a promise. The new agreement is formed when there is an encounter or an agreement between the promises devoted to one another. Of the nature and scope of a binding legal contract, there are national contract, a contract made by two individuals in an area of the country that no foreign element. While the international contract is a contract with foreign elements.  A contract is a legal agreement that can be enforceable, the activities undertaken entrepreneurs. Buy products in one country and sell them in third countries. Firmly binding provision, set the time the contract was agreed upon, signed by both parties. Since starting preparations to transport goods that require funding for preparatory activities up to shipment, payment risks in traveling with the importer. Everything reflects the "rule of the game" has to be clear and detailed. Terms of trade in international trade are to determine the point or place where the seller must fulfill its obligations delivers physical and juridical goods to the buyer. Every business contracts must be preceded with the precision of each of the parties to study the contract clauses, which are generally based on the standard contract or agreement.
      AbstrakTujuan penulisan ini untuk menjelaskan dan menganalisis kekuatan mengikat kontrak sebagai dasar yuridis dalam bisnis Internasional. Metode yang diterapkan adalah yuridis normatif, yang berpedoman pada kaidah-kaidah hukum yang terdapat pada perundang-undangan, atau menetapkan standar atau norma tertentu terhadap suatu fenomena dengan mengkaji data sekunder atau kepustakaan. Hasil penelitian: kontrak atau perjanjian sebagai ungkapan kehendak yang dinyatakan dengan penawaran dan penerimaan dianggap sebagai elemen konstitutif dari kekuatan mengikat kontraktual. Penawaran dan permintaan mengandung suatu janji. Perjanjian baru terbentuk jika ada perjumpaan atau kesepakatan  antara janji-janji yang ditujukan satu terhadap lainnya. Dari sifat dan ruang lingkup hukum yang mengikat kontrak yaitu ada kontrak nasional  adalah kontrak yang dibuat oleh dua individu dalam suatu wilayah negara yang tidak ada unsur asingnya. Sedangkan kontrak internasional adalah kontrak yang ada atau terdapat unsur asing (foreign element). Kontrak: suatu persetujuan legal yang dapat dipaksakan berlakunya, dalam aktivitas yang dilakukan para pengusaha. Membeli produk di suatu negara dan menjualnya di negara ketiga. Ketentuan mengikat tegas, mengatur sejak kontrak disepakati, ditandatangani kedua belah pihak.  Sejak mulai persiapan pengiriman barang yang membutuhkan dana untuk kegiatan persiapan sampai dengan pengapalan, resiko dalam perjalanan dengan pembayaran pihak importir. Semuanya mencerminkan “rule of the game” yang jelas dan rinci. Syarat perdagangan dalam perdagangan internasional adalah: untuk menentukan titik atau tempat di mana penjual harus memenuhi kewajibannya melakukan penyerahan barang secara fisik dan yuridis kepada pembeli. Setiap kontrak bisnis harus diawali dengan kecermatan masing-masing pihak untuk mempelajari klausula kontrak, yang pada umumnya berdasarkan kontrak atau perjanjian berstandar.

      Abstract:  The ICT advancement to connect health centers and hospitals to use electronic health applications (e-health) has become a global issue. E-health which is one of the Action Plan of the World Summit on the Information Society (WSIS) Geneva 2003 is an ICT-based application for the health care industry. The use of e-health application is to improve access, efficiency, effectiveness, and quality of medical process involving the organization of medical services in hospitals, clinics, health centers, medical practitioners both doctors and therapists, laboratories, pharmacies, insurers also involves the patient as a consumer. But in the service process will collect some sensitive personal data of consumers and cause new legal  problems, to what extent of the health providers can protect the personal data of patients that their personal data can be accessed, disseminated easier through advances in ICTs. This research aims to examine in depth about how far patient's personal data will be protected in e-health program and how far the existing law has provided protection. The method used is normative juridical approach with descriptive analytical specifications. The process of data collection is done through literature and field research. The results of the research to date e-health program has been carried out in several provinces in Indonesia but until now the existing regulations do not provide maximum protection of personal data of patients. The approach of existing law is still sectoral and very general therefore has not yet provide maximum protection  AbstrakPemanfaatan Teknologi Informasi dan Komunikasi (TIK) untuk menghubungkan pusat kesehatan maupun rumah sakit dengan menggunakan aplikasi electronic health (e-health) telah menjadi isu global. E-health yang merupakan salah satu Rencana Aksi World Summit on the Information Society (WSIS) Geneva 2003 tersebut merupakan aplikasi berbasis TIK untuk industri pelayanan kesehatan. Penggunaan aplikasi e-health bertujuan untuk meningkatkan akses, efisiensi, efektivitas, serta kualitas proses medis yang melibatkan organisasi pelayanan medis di rumah sakit, klinik, puskesmas, praktisi medis baik dokter maupun terapis, laboratorium, apotek, asuransi juga melibatkan pasien sebagai konsumen. Akan tetapi dalam proses pelayanan dengan menggunakan program E-health akan mengumpulkan sejumlah data pribadi konsumen yang merupakan data pribadi sensitif dan menimbulkan permasalahan hukum yang baru yaitu sejauhmana pihak penyelenggara jasa kesehatan dapat melindungi data pribadi pasien  dapat diakses, disebarluaskan secara lebih mudah melalui kemajuan TIK. Penelitian ini bertujuan untuk menelaah secara mendalam tentang bagaimana perlindungan  data pribadi   pasien dalam program e-health dan bagaimana hukum yang ada (existing law) dalam memberikan perlindungan. Metode penelitian yang digunakan adalah menggunakan pendekatan juridis normatif dengan spesifikasi bersifat deskriptif analitis. Proses pengumpulan data dilakukan melalui penelitian kepustakaan dan penelitian lapangan.  Hasil penelitian hingga saat ini program e-health telah dilakukan dibeberapa Propinsi di Indonesia akan tetapi hingga saat ini peraturan yang ada (exisiting law) belum memberikan perlindungan yang maksimal atas data pribadi pasien karena pengaturannya masih bersifat sekoral dan tersebar dalam beberapa perundang-undangan.

      Abstract: The purpose of this research is to determine the concept of Article 16(2) of Apartment Act in favor of the LIC in terms of ownership of an apartment unit, and also the elaboration of this concept that provide convenience to the LIC. This is a normative legal research using the legislation and conceptual approach. The results is that the meaning of the concept of 20% in the provisions of Article 16(2) of the Apartment Act was the construction of general apartment at least 20% of the total floor area of commercial apartment is a legal obligation of the perpetrator development of this commercial, in which the liability asserted in Article 97 followed the criminal sanctions under Article 109. 20% should be interpreted according to the political law and balanced composition between the number of simple, medium and luxury homes (3: 2: 1). More detailed settings of Article 16(2) of Apartment Act are necessary because it takes certain assertions, among others: a. Executive Agency affirmation by government formation, incentives given to construction of  general apartment actors, and to provide support and services to the ownership of the apartment unit for the LIC  ; b. affirmation of the maximum limit for the commencement and completion of construction of general apartment as the implementation of the obligations of Article 16 (2); and, c. LIC classification affirmation made by Government Regulation.
      Abstrak     Tujuan penelitian ini adalah untuk mengetahui  dan menganalisis makna konsep pasal 16 ayat (2) UU Rumah Susun tentang kewajiban menyediakan rumah susun umum sekurang-kurangnya 20% (duapuluh persen) dari total luas lantai rumah susun komersial, dan bagaimana penjabaran konsep pasal 16 (2) UU Rumah Susun yang memberi kemudahan bagi MBR.Penelitian hukum normatif ini dengan menggunakan  pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitiannya adalah bahwa makna konsep 20% dari ketentuan Pasal 16 ayat (2) UU Rumah Susun yaitu pembangunan rumah susun umum sekurangnya-kurangnya 20% dari total luas lantai rumah susun komersial yang dibangun merupakan kewajiban hukum dari pelaku pembangunan rumah susun komersial, di mana kewajiban ini dipertegas dalam Pasal 97 yang diikuti ancaman pidana dalam Pasal 109 Pengertian 20% itu seharusnya ditafsirkan menurut politik hukum tentang komposisi jumlah rumah yang berimbang antara rumah rumah sederhana, rumah menengah, dan rumah mewah (3 : 2 : 1).  Penjabaran konsep pasal 16 ayat (2) Undang-Undang Rumah Susun diperlukan karena dibutuhkan penegasan-penegasan tertentu, antara lain: a. penegasan pembentukan Badan Pelaksana oleh pemerintah, pemberian insentif  kepada pelaku pembangunan rumah susun serta memberikan bantuan dan kemudahan untuk pemilikan sarusun bagi MBR; b. penegasan tentang jangka waktu dan selesainya pembangunan rumah susun umum sebagai pelaksanaan kewajiban dari Pasal 16 ayat (2) Undang-Undang Rumah Susun; dan, c. penegasan klasifikasi MBR dilakukan melalui Peraturan Pemerintah.Kata kunci: rumah susun, masyarakat berpenghasilan rendah

      Abstract: Problems related to land will always be actual and complex issues. Population growth will not be accompanied by increments of shelter, economic progress, the need for all the infrastructure support for the space for humans, the level of public awareness and ease access to various parties on the ground. Land acquisition became the most complicated problems in the past few decades that are often faced by the government .It is stated that the state can only control the land and not as the owner of the land. In this study, the authors used the normative method with a comparative, historical and conceptual approach. The studies show the shifting meaning of land as one of the symbols of the economic concept of liberalism also play a role in the difficulty of gaining ground as a medium of development for the benefit of the public. Therefore there is a need of a method, and other strategies capable of addressing the land issues that are fundamental, effective, efficient sustainable. The land bank concept is very urgent to be applied in Indonesia. Land bank itself has a meaning as a private or government land reserve performed before starting development activities so as to avoid speculation in land prices. Land Bank is one means management of the resources necessary to improve the productivity of land use. The method uses market control and soil stabilization of local markets. Because that regulation is required as a legal umbrella for the implementation of the Bank's foundation soil and related institutional arrangements are authorized to implement the practice of the Land Bank. AbstrakPermasalahan terkait pertanahan akan selalu menjadi isu yang aktual dan bersifat kompleks. Pertumbuhan penduduk yang tidak akan diiringi dengan pertambahan tempat hunian, kemajuan ekonomi, kebutuhan akan segala infrastruktu penunjang bagi ruang gerak manusia, tingkat kesadaran hukum masyarakat dan kemudahan akses berbagai pihak terhadap tanah. Ketersediaan tanah untuk pembangunan menjadi permasalahan paling rumit dalam beberapa dasawarsa ini yang kerap dihadapi oleh pemerintah.  UUPA telah mengamanatkan bahwa negara hanya boleh menguasai tanah dan bukan sebagai pemilik tanah. Dalam penelitian ini penulis menggunakan metode normatif dengan pendekatan historis, komparatif dan faktual. Pergeseran makna tanah sebagai salah satu simbol dari konsep ekonomi liberalisme juga berperan dalam sulitnya bagi pemerintah mendapatkan tanah sebagai media pembangunan untuk kepentingan umum. Berpijak dari permasalahan tersebut maka dibutuhkanlah suatu  metode, dan strategi lain yang mampu mengatasi masalah pertanahan secara mendasar, efektif,efisien dan berkesinambungan. Berangkat dari permasalahan tersebut konsep bank tanah sangat mendesak untuk dapat diterapkan di Indonesia sebagai salah satu alternatif penyediaan tanah bagi pembangunan untuk kepentingan umum. Bank tanah sendiri memiliki makna sebagai pencadangan tanah pemerintah ataupun swasta yang dilakukan sebelum kegiatan pembangunan dimulai sehingga menghindari spekulasi harga tanah. Bank Tanah adalah salah satu sarana manajemen sumber daya alam berupa tanah yang penting untuk meningkatkan produktivitas pemanfaatan tanah. Metode yang diusung dalam bank tanah adalah kontrol pasar dan stabilisasi tanah pasar lokal. Karena itulah diperlukan regulasi sebagai payung hukum landasan pelaksanaan Bank tanah di Indonesia dan pengaturan terkait kelembagaan yang berwenang melaksanakan praktik Bank Tanah.Kata kunci: bank tanah, penyediaan tanah, kepentingan umum
