  • Revisiting vicarious liability in sexual harassment cases heard under the
           Sex Discrimination Act

      This article considers recent trends in the judicial interpretation of workplace vicarious liability provisions with respect to sexual harassment matters under the Sex Discrimination Act 1984 (Cth) (SDA). In a study undertaken by the authors in 2008, we found that the Federal Court and Federal Magistrates Court appeared to be taking a ‘broad-brush’ approach in interpreting employers’ duty to take ‘all reasonable steps’ to prevent sexual harassment and defining ‘in connection with employment’. The authors update that analysis and evaluate a sample of cases from 2011 to 2018, concluding that it is possible the Courts are approaching these legislative elements of vicarious liability with an increasingly narrow brush.

  • Citation as a measure of ‘impact’: Female legal academics at a
           disadvantage'

      This article discusses whether the demand that law academics show citations by a superior court is disadvantageous to women, using the citations of academic work by the High Court of Australia from 2015, 2016 and 2017. The preliminary data show that male academics were cited much more often than female academics (even for works written after 1999), and academics who were cited were associated primarily with ‘elite’ universities in Australia, England and the United States. The use of citation by superior courts may not really show ‘impact’ but may rather indicate that the common law displays historical and unconscious biases.

      The Legal and Social Issues Committee of the Victorian parliament will soon publish a report on spent convictions and criminal record discrimination. Victoria is the only state in Australia that does not have a spent convictions scheme. The purpose of this article is to review the recent decision of the High Court in Frugtniet v ASIC, a decision about the federal spent convictions scheme, and outline the lessons that decision provides for Victoria and for the successful appellant in that case.

  • Police practice and false confessions: A search for the implementation of
           investigative interviewing in Australia

      Since the 1960s, the United States developed ‘Reid interrogation technique’, and its variations have been widely used around the world. Due to its interrogative and confession-driven nature – and thus the increased risk of false confessions – many countries (including Australia) have since moved away from this model towards the UK-developed PEACE-approach. This article will utilise case studies and forensic psychological research to explain how coercive techniques used during police interviews increase the risk of false confessions. It will then describe the implementation of investigative interviewing in Australia by presenting an analysis of those state and territory police manuals which are publicly available.

  • Australian Secret Intelligence Service’s new powers: A step too far
           towards extraterritorial killings'

      This article examines recent amendments to the Intelligence Services Act 2001 (Cth) (IS Act). The amendments provide Australian Secret Intelligence Service staff and agents with additional protection from Australian criminal prosecution when using force under certain circumstances in overseas jurisdictions. The authors assert that while well-intentioned, and despite new and existing oversight provisions, the amendments allow pre-emptive use of force that could potentially be used to justify carrying out extraterritorial killings of Australians and foreign nationals, thereby breaching the lawful boundaries of Australian Secret Intelligence Service’s functions.

  • Making the law work for women: Standard-setting through a new Gender
           Legislative Index

      This article is premised on the fact that every area of law needs a gender perspective. It discusses the prospects for a Gender Legislative Index, a tool to enable us to evaluate and score legislation, by placing laws on a scale from gender-regressive to gender-responsive, when set against global benchmarks from international law – primarily CEDAW. In doing so, this article defines and defends the need for gender-responsive legislation, showing how a common set of standards for global good practice can be developed and the shortcomings, but also advantages, of an online tool to benchmark, score and rank laws.

  • Sex offenders no more: Historical homosexual offences expungement
           legislation in Australia

      The capability to remove homosexual offences from a criminal record has finally been adopted across Australia with the introduction of expungement legislation. This article analyses the reasons for its introduction, considers the number of people affected and suggests that a pardon, similar to the Turing Law in the UK, may address the low number of applications. The passing of this legislation not only restores the offender, it also allows current legislators to address the injustice of their predecessors' actions and to demonstrate continued support for LGBTIQ communities.
