  • Reinterpreting The Concept of Shari’ah and Its Implication on Gender
           Issues

      Abstract: This paper deals with Mahmoud Mohamed Taha’s
      thought on shari’ah and gender. The main message conveyed by
      shari’ah is equality between man and woman with the aim of
      achieving gender justice in society. Many Muslim scholars,
      however, interpret shari’ah text written in the Qur`an and the
      Sunnah textually, partially and out of its context. Such
      interpretation then produce gender biased understandings and
      unequal gender rulings. This paper analyze how Mahmoud
      interprets the concept of shari’ah and implements it on gender
      issues. Different from many Muslim scholars, Mahmoud views that
      shari’ah evolves continuously in the history of human beings and it
      is showed by the presence of different shari’ahs from one prophet
      to another, from Adam until Mohamed (peace be upon them).
      Because of its characteristic, the last shari’ah brought by Mohamed
      also must evolve, namely, evolving from the subsidiary verses of
      the Qur`an to its primary verses. In this way, shari’ah rules which
      contain gender discriminations are regarded as transitional rules
      suiting the social context at the time. In the contemporary era, the
      relation between men and women must be based on the primary
      verses of the Qur`an which emphasize the principles of gender
      equality.

  • Membaca Gelombang Fikih dalam Hukum Nasional di Indonesia

      Abstract: Banyaknya masalah hukum Islam belum
      ditransformasikan karena mempunyai beberapa kendala dan
      hambatan dari berbagai kalangan. Para ulama dalam
      mentransformasikan hukum Islam di sekitar sebelum abad XX
      memakai dua cara; pertama, membiarkan hukum berlaku
      sepanjang tidak bertentangan dengan hukum Islam. Kedua,
      mengganti lembaga hukum adat yang bersangkutan dengan
      hukum Islam dengan lembaga hukum Islam yang sejenis, atau
      mengganti dengan lembaga hukum Islam lain melalui tehnik
      hilah.
      Para ulama pasca abad XX mentransformasikan hukum Islam
      ke dalam legislasi nasional dengan menggunakan tehnik
      takhshishu al-qadla, takhayyur atau talfiq, reinterpretasi, siyasah
      syar’iyyah, dan keputusan pengadilan. Sedangkan tiga problem
      yang selalu menyertai eksistensi hukum Islam di Indonesia
      adalah lemahnya interes intelektual, konflik politik dengan
      kekuasaan, dan ketegangan versus adat.
      Di sisi lain hukum Islam mempunyai banyak peluang untuk
      dikembangkan di Indonesia, yaitu adanya political will dari
      pemerintah bagi dikembangkannya hukum Islam di dalam
      masyarakat, berdasarkan penelitian, masyarakat Indonesia
      memiliki keinginan kuat untuk berhukum dengan agama
      (hukum Islam), dan kesadaran hukum masyarakat yang
      mayoritas beragama Islam tidak bisa dilepaskan dari hukum
      Islam. Ini berarti hukum nasional yang dikehendaki negara RI
      adalah hukum yang menampung dan memasukkan hukum
      agama dan tidak memuat norma yang bertentangan dengan
      hukum agama.

      Abstract: Perbincangan sekitar topik tulisan ini tidak bisa
      dilepaskan dari tradisi --atau lebih tepatnya elemen penting—
      dalam disiplin ilmu usul al-fiqh (metodologi hukum Islam). Ada 3
      (tiga) elemen penting yang dikaji dalam ilmu tersebut, yaitu
      sumber/dalil hukum Islam, metode istinbat hukum Islam, dan
      studi tentang hal-ihwal pelaku ijtihad. Dalam berijtihad,
      organisasi-organisasi sosial keagamaan di Indonesia seperti
      Nahdlatul Ulama (NU), Muhammadiyah, dan Persis masingmasing
      memiliki kekhasan dalam melakukan istinbat hukum.
      NU melalui forum lajnah bahs al-masail mempunyai suatu tradisi
      untuk menempatkan al-kutub al-mu’tabarah (khazanah kitab-kitab
      standar) sebagai sumber rujukan dan pertimbangan pokok
      dalam beristinbat yang mendampingi al-Qur’an-Hadis sebagai
      sumber/dalil utamanya. Hal ini dilakukan oleh karena para
      ulama yang menyusun karya-karya al-kutub al-mu’tabarah
      tersebut di samping kredibilitas keulamaannya tidak diragukan
      lagi juga transmisi keilmuan antarulama relatif bersambung
      (ittisal al-sanad) sampai pada generasi awal keislaman.

  • Mekanisme Keuangan dalam Struktur Modal Perusahaan

      Abstract: There are several Islamic modes of financing which
      serve as alternatives to interest based financing. There is,
      however, divergence of views between theory and practice
      about the order of preference of these modes of financing. The
      theoreticians are, generally, of the view that profit-loss sharing
      should be the most widely prevailing mode of financing in the
      financial system of Islam. Some theoreticians have been quite
      critical of this practice. Profit-loss sharing techniques make the
      capital owner share the profit according to-actually realized
      productivity. Thus, the actually realized return on profit is the
      price of capital which will determine its allocation. Among PLS
      techniques, musyarakah may have an edge over mudarabah in
      the sense that in musyarakah, capital owner has a right to
      interfere in the management and hence can have some control
      over the problems created by informational asymmetry and
      moral hazards, mudarabah is void of any such control. This
      divergence is a result of the fact that the capital user does not
      have to bear the uncertainties that the capital owner does. It
      may also be noted that since an upper limit on their profit is
      fixed by the rent or the mark up which are not related to the
      profitability of the enterprise, these techniques may not have as
      primary a role in investment decision making as profit-loss
      sharing techniques.

      yang merupakan hasil ijtihad Sultan Agung yang luar biasa di
      zamannya. Namun demikian sebagai produk ijtihad Kalender
      Islam Jawa perlu dikaji dan ditindaklanjuti agar kalender
      tersebut sesuai dengan semangat awal yang diinginkan Sultan
      Agung dan sesuai pula dengan tuntutan zaman. Artinya, jika
      hendak menyikapi perkembangan ilmu pengetahuan baru
      secara dinamis, maka penghargaan terhadap Kalender Jawa
      Islam seyogyanya bukan dalam bentuk pelestarian teori itu apa
      adanya, tetapi mengembangkannya secara dinamis dan kreatif.

      democratics system in American government was practically on
      equelity of righs, freedom of consience,freedom of
      opinion,freedom of expression, and economic freedom. And a
      realistic, democratic and responseble government was
      estableshed by the prophet of Islam. As many as fourteen
      century before this time. Equelity of righs, independence of
      opinion and freedom expreesion, werw all cultivated with a
      view to developping a sound nation caracter, it is nore wothey
      that this way succes fully achieved and carnet out in practice in
      the teeth on two adverse factors. One of them was the fact of
      the prophet receiving revelition for guidance of the people. He
      could very well play the roll of shepherd, driving the sheep in
      the direction liked; but the case, he could not become a nation
      builden nor a democrat.

      demikian, dalam konteks hukum Islam, istilah penemuan hukum
      lebih tepat, karena diyakini bahwa hukum itu tidak dibuat tetapi
      ditemukan. Dalam rangka menemukan hukum terhadap berbagai
      persoalan yang tidak ada atau tidak jelas hukumnya, para juris
      muslim telah mengembangkan metode penemuan hukum Islam
      yang bertolak dari sumber-sumber hukum Islam itu sendiri.
      Dalam Hukum Islam ada tiga metode ditemukannya hukum,
      pertama, metode interpretasi literal yaitu hukum yang ditemukan
      adalah bukan hukum hukum baru tetapi menafsirkan kembali apa
      yang ada dalam teks, karena bunyi teks dianggap tidak atau kurang
      adanya kejalasan hukum. Kedua, kausasi (ta’lili), yaitu mencari
      dasar penetapan hukum baik dari segi alasan maupun tujuantujuan
      ditetapkannya hukum syara’. Metode ini mecakup dua
      temuan hukum yang meliputi metode qiyas iyaitu menetapkan
      hukum berdasarkan adanya kesamaan indikasi dan metode
      teleologis, yaitu menetapkan hukum karena adanya tujuan-tujuan
      hukum. Ketiga metode sinkronisasi, yaitu mencari solusi terhadap
      perlawanan antara dua dalil yang sama derajatnya, misalnya antara
      ayat al-Qur'an dengan ayat al-Qur'an yang lain, antara hadis
      mutawatir dengan hadis mutawatir yang lain, dan seterusnya.
      Berbeda dengan ad-Dawalibi, beliau berpendapat Ada tiga model
      (penemuan hukum) ijtihad yang dilakukan oleh para sahabat
      Nabi, hanya saja tidak ditegaskan istilah-istilahnya, yaitu ijtihad
      bayani, ijtihad qiyasi dan ijtihad istislahi.

      Abstract: Syahrur menerapkan teori hudud untuk menjelaskan
      ketentuan hukum. Terdapat dua pembatasan istilah dalam
      diskusi tentang poligami, yaitu pembatasan pada kuantitas (al-
      Had al-Kamy) empat istri dan pembatasan pada kualitas (al-Had
      al-Kalfy). Hal ini menunjukkan bahwa istri kedua, ketiga, dan
      keempat adalah janda dengan anak-anaknya, yang suaminya
      meninggalkannya.
      Syahrur membolehkan poligami dalam dua kondisi, yaitu
      pertama, istri kedua, ketiga, dan keempat adalah janda-janda
      beranak yang suaminya meninggalkannya. Kedua, suami harus
      memiliki perasaan gelisah bahwa dia tak akan dapat berbuat adil
      kepada anak-anaknya. Jika kedua syarat di atas tidak terpenuhi,
      poligami akan gagal. Syahrur menerapkan dua kondisi ini
      berdasarkan struktur norma bahasa dalam al-Qur'an surat an-
      Nisa ayat 4.
