  • Extension of time for appeal: application in agricultural holding cases
    • Abstract: In Smyth-Tyrrell and Another v Sowden [2017]EWHC 2331 (Ch) HHJ Paul Matthews considered and refused an application for an extensionof the 28-day period permitted for an appeal under the Arbitration Act 1996. Thearbitration was held under the mandatory requirement in the Agricultural HoldingsAct 1986, but the court proceeded on the basis that the 1996 Act’s principles applied.

    • Abstract: The lengthy judgment of Teare J in UMS Holdings Ltd and Others v Great Station PropertiesSA andAnother [2017] EWHC 2398 (Comm) sets out ina great deal of detail the limits of serious irregularity challenges under section68 of the Arbitration Act 1996. It might be thought somewhat concerning to see thata challenge that the court regarded as misconceived was resolved only after a four-dayhearing and a judgment stretching to 144 paragraphs.

    • Abstract: In UnionMarine Classification Services LLC v The Government of the Union of Comoros andAnother (No 2) [2017] EWHC 2364 (Comm) achallenge was made to an arbitration award on the ground that the issueresolved by the arbitrator had not been a part of the original submission toarbitration. HHJ Waksman QC ruled that the parties had agreed to ad hocarbitration on the point.

  • Enforcement of arbitration awards: effect of setting aside by curial court
    • Abstract: In the usual course of events, where a foreign arbitration award has been set aside by the curial court, the English courts will treat themselves as bound by the ruling of the court and will not recognise or enforce the award under the New York Convention as implemented by the Arbitration Act 1996. In Maximov v Open Joint Stock Company “Novolipetsky Metallurgichesky Kombinat” [2017] EWHC 1911 (Comm) the award holder tried to persuade the English court that the ruling of the Russian curial courts setting aside the award should not be recognised, by reason of the bias of those courts. Sir Michael Burton rejected the argument on the facts.

    • Abstract: One of the grounds uponwhich enforcement of a foreign arbitration award made in a New York Convention countrymay be refused by the English courts is where the respondent was not given propernotice of the appointment of the arbitrator or of the arbitration proceedings orwas otherwise unable to present his case.

    • Abstract: The English courts haveaccepted that a court has inherent jurisdiction to stay its own proceedings wherethe action depends upon the outcome of an arbitration between either the same ordifferent parties. An obvious example is where a creditor brings judicial proceedingsagainst the guarantor in advance of the determination of the primary debtor’s liabilityin ongoing arbitration proceedings.

The meaning of writingis set out in section 5 of the 1996 Act.     • Abstract: Section 9 of the Arbitration Act 1996 requires the Englishcourt to stay its proceedings if the dispute coming before it is “in relation toa matter” falling within the parties’ agreement to arbitrate. The meaning of thisphrase has received very little attention in England, a matter put right by thelengthy discussion of Blair J in Autoridaddel Canal de Panamá v Sacyr SA [2017] EWHC2228 (Comm).

  • Binding effect of arbitration award: status of the Financial Ombudsman
           Service
    • Abstract: In Berkeley Burke SIPP Administration LLP v Charlton and Another [2017] EWHC 2396 (Comm) Teare J decided that the Financial Ombudsman Service was not an arbitrator because its rulings were not binding on the complainant. The decision discusses section 58 of the Arbitration Act 1996, and makes the important point that there can only be an arbitration award if there is an underlying arbitration agreement within section 6 of the 1996 Act.

  • Enforcement of foreign awards: excess of powers and public policy
    • Abstract: In Quanzhou Sanhong Trading Ltd Liability Co Ltd vADM Asia-Pacific Trading Pte Ltd [2017] SGHC 199 it was argued before Chua LeeMing J that the Singapore courts ought to refuse to enforce a foreign award underthe New York Convention because the tribunal had erred in ruling that the substantivecontract was governed by Chinese law rather than English law. The court found thatan error of that type was no basis for refusing enforcement.

  • Supportive powers of the court: order for the sale of goods
    • Abstract: Under section 44 of theArbitration Act 1996 the High Court may exercise its ordinary powers in supportof arbitration where the arbitrators themselves cannot act. In Dainford Navigation Inc v PDVSA Petroleo SA (TheMoscow Stars) [2017] EWHC 2150 (Comm) Males J confirmed that the legislationconfers jurisdiction upon the court to order a sale of cargo subject to a lien inan arbitration for the recovery of hire charges.

    • Abstract: In FulhamFootball Club (1987) Ltd v Richards[2011] EWCA Civ 855 the Court of Appeal decided that disputes arising undershareholder agreements can be referred to arbitration even though there is astatutory remedy for minority shareholder oppression in the Companies Act 2006.Singapore and Australia have taken a similar approach. The most recent decisionis that of the New South Wales Supreme Court in Re Infinite Plus Pty Ltd [2017] NSWSC 470.

  • Removal of arbitrators: apparent bias
    • Abstract: The English courts have accepted that an arbitrator may be removed for demonstrating actual bias or putting themselves in a position where there are circumstances which objectively give rise to the possibility of an appearance of bias. In H v L and Others [2017] EWHC 137 (Comm) the primary allegation – dismissed by the court – was that the arbitrator had wrongly accepted two subsequent appointments creating a risk of overlap but without disclosing those later appointments.

    • Abstract: In Symbion Power LLC v Venco Imtiaz Construction Co[2017] EWHC 348 (TCC) Jefford J had to determine whether the arbitrationtribunal had failed to deal with all the issues that were put to it so that theaward should be set aside or varied on the grounds of serious irregularityunder section 68(2)(d) of the Arbitration Act 1996.
