    • Abstract: In A v B [2017] EWHC 596 (Comm), Christopher Butcher QC, sitting as a Deputy High Court Judge, considered and rejected a series of challenges to an award under section 68 of the Arbitration Act 1996, alleging serious misconduct. As is typical of such cases, the court found no merit in any of the challenges.

  • Appeals against arbitration awards: the provision of security
    • Abstract: Where there is an appeal against an arbitration award, the court has power under section 70 of the Arbitration Act 1996 to order the applicant to provide security for costs (section 70(6)) and also security for the award itself (section 70(7)), failing which the application can be dismissed. The conditions to be satisfied for the making of an order (section 70(7)) were discussed by Sir Jeremy Cooke in Erdenet Mining Corporation LLC v ICBC Standard Bank plc and Others [2017] EWHC 1090 (Comm); [2017] 2 Lloyd's Rep 25.

    • Abstract: The decision of Belinda Ang J in the High Court of Singapore in BMO v BMP [2017] SGHC 127 covers a lot of ground, including the law applicable to an arbitration clause and the proper approach to its interpretation. However, the most important aspect of the decision is the detailed analysis of the circumstances in which a right to arbitrate is lost by a party who commences litigation instead of arbitrating.

    • Abstract: The decision of Mimmie Chan J in the Hong Kong Court of First Instance, in Arjowiggins HKK2 Ltd v X Co [2016] HKCFI 1901, considers a number of important issues on the invalidity of an award and challenges to the jurisdiction of the tribunal. The case was decided under the Hong Kong Arbitration Ordinance, but it does not differ in any material particular from the English Arbitration Act 1996 for the purposes of the issues raised.   • Enforcement of New York Convention awards: security for the award
    • Abstract: Lord Mance, delivering the judgment of the SupremeCourt in IPCO (Nigeria) Ltd v Nigerian National PetroleumCorporation [2017] UKSC 16, has decidedthat the English court has no general power to order an award debtor to providesecurity for the amount of a New York Convention award as a condition of beingallowed to defend enforcement proceedings. In conformity with the New YorkConvention, that power is confined to the situation where the enforcementproceedings are adjourned pending the outcome of a challenge to an award in thecurial courts.

    • Abstract: The lengthy judgment of Marcus Smith J in Microsoft Mobile OY Ltd v Sony Europe Ltd and Others [2017] EWHC 374 (Ch); [2017] 2 Lloyd's Rep 119 considers a range of complex questions on the jurisdiction of the English courts over a number of defendants. The point of greatest interest for present purposes is the applicability of an arbitration clause to a claim for damages for alleged infringement of EU competition law.

    • Abstract: L Capital Jones Ltd and Another vManiach Pte Ltd [2017] SGCA 03 is an important decision of the Court ofAppeal of Singapore, a fact that underlies the importance of the decision. Itis an appeal from the lengthy and closely-reasoned decision of Vinodh CoomaraswamyJ, [2016] SGHC 65, and raises important issues as to the arbitrability ofclaims for relief by minority shareholders, loss of the right to seek a stay byan applicant who has allegedly taken a step in the judicial proceedings and theinterpretation of arbitration clauses.

    • Abstract: The English courts will not recognise or enforce an award – whether it is purely domestic or whether it is made abroad and the application is under the New York Convention – where such enforcement is contrary to public policy. The essential question, albeit arising in a complex factual scenario, was whether an arbitration award holding that A had no claim against B for improperly acquiring shares, in that the shares belonged to C, precluded a claim in judicial proceedings by A against C in respect of those shares.

  • Jurisdiction: validity of arbitration clause
    • Abstract: In Yegiazaryan v Smagin [2016] EWCA Civ 1290 the Court of Appeal heard an appeal from the judgment of Teare J on the meaning of a dispute resolution clause. By common consent the arbitration clause was poorly drafted and purported to bind a person who was not a party to the agreements to which the clause related. The Court of Appeal agreed with Teare J that the provision did indeed qualify as an arbitration clause.
