  • Editor's Introduction
    • Abstract: In my introduction to The Jurist 75 (2015) 2, I wrote that current or recent legislative initiatives at the universal level may at times interfere with academic planning and call for changes of publication plans. When Pope Francis simplified and changed the procedure for the declaration of nullity of marriages with the promulgation of the motu proprio Mitis iudex Dominus Iesus for the Latin Church and the motu proprio Mitis et misericors Iesus for the Eastern Catholic Churches, the plan for that issue was changed and priority was given to the publication of commentaries to assist our readership and the many practitioners in implementing the new normative framework. Something similar happened again, albeit with less ... Read More

  • Renuntiatio Papae: Some Historical-Canonical Reflexions
    • Abstract: The announcement, with which Pope Benedict XVI on February 11, 2013 made known his own intention to renounce the Ministry of Supreme Pontiff on February 28 of that same year, was totally unexpected and has posed since then several questions for discussion.2The context of the renunciation calls attention to similar events in the history of the Roman Papacy, in which one believes precedents can be recognized. First to be mentioned is Pope Pontian who, in the year 235, resigned from his office after he was sentenced to forced labors in the mines of Sardinia under the consuls Severus and Quintinianus. Since he could not hope for a return to Rome, he resigned from office not to leave the Church without a Supreme ... Read More

  • What Made Synod 2014 and 2015 So Interesting': Collegiality and
           Synodality!
    • Abstract: Two stories come to mind when I think of the twin "sisters" collegiality and synodality. The first is about little Johnny's most unusual birthday present. Instead of choosing a present for him, Johnny's parents handed him a voucher to the local shop, with the instruction: "Get yourself a birthday present that tells us something important about yourself!" Off went little Johnny, returning almost immediately with his present. When the time came to open the present, his parents watched expectantly to see what he had chosen. Johnny opened his special present very carefully, revealing bit by bit a picture poster depicting a lovely, luscious green leaf, but on the edge of the leaf was a hideous looking caterpillar ...            Natura. A Year of Mercy Examination of Challenges to Compliance in a US
           Context
    • Abstract: I am so grateful to Father Kaslyn for giving me this undeserved opportunity to offer this year's Provost Lecture. Given Professor Provost's long tenure at The Catholic University of America and his broad interests, I can think of few canonists who have had a greater impact on the study of canon law in the United States, and indeed on the Church in the United States. I consider it a privilege to be part of your faculty's remembrance of him. Allow me to note at the beginning that I am not an academic, but rather a pastor with a strong interest in canon law and with a few interesting experiences in this field. I certainly hope that my lack of scholarly expertise does not dishonor the memory of Father Provost. My hope ... Read More

  • Liturgical Preaching in the 21st Century
    • Abstract: During the 2008 Bishop's Synod on the Word of God, a fundamental theme which emerged both in plenary sessions and in the small group discussions was that of the homily. Bishops agreed that Sunday morning is the one opportunity each week that pastors have to engage in dialogue with the majority of their parishioners. Indeed, for better or worse, it is usually the quality of the homily which people use to determine the overall quality of the liturgical celebration.Catholic laity have come to expect a level of homiletic preparation and professionalism in their clergy that is concomitant with what they experience in dealing with professionals in other fields of expertise. Thus, they seek true inspiration, edification ... Read More

  • Vultum Dei Quaerere: New Norms for Nuns
    • Abstract: In April 2014, the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life sent a letter to the world's monasteries of nuns informing them that Pope Francis was "open" to revision of legislation on the contemplative and cloistered life.1 In particular, the letter noted that the Roman Pontiff was considering revision of the apostolic constitution Sponsa Christi which, although issued by Pope Pius XII in 1950, more than a decade before the beginning of the Second Vatican Council, was still the most recent papal legislation regarding nuns. In addition, the congregation noted that it would develop a new instruction on "the Contemplative Life and on the Enclosure of Nuns" to update or replace its ... Read More

  • To Seek the Face of God: The Cloister and Renewal of Women's Contemplative
           Monasteries
    • Abstract: The contemplative life for women consecrated to God has enjoyed a long and revered history in the Church.1 Some people who are challenged by the day-to-day demands of life in the secular world might long for the opportunity to withdraw from that busyness and to live a cloistered life dedicated to ongoing dialogue with the Lord. We should, however, resist the tendency to romanticize the contemplative life since it is not without its own difficulties. Nevertheless, it ought to be a life filled with the grace to fulfill that vocation. The Church has consistently acknowledged the great value of women's contemplative life, especially within the particular church that benefits from the constant prayer of the nuns of the ... • Papal Diplomacy—Characteristics of the Key Issues in Canon Law and
           International Law
    • Abstract: Over two thousand years ago, the Roman lawyer and philosopher Cicero said that there are two ways of resolving disputes: one by argument, the other by force. Since the first of these is right for man, and the other for wild animals, one should resort to the latter only if the first cannot be applied. In other words, the force of argument, rather than the argument of force, is the essence of diplomacy.Diplomacy, in the most general sense of the word, is a form of contact between those in power which has exsisted since ancient times. It was practiced by the pharaohs two thousand years before Christ. The ancient Greeks, from whom the term diploos derives, were familiar with it. The Greek expression meant a document ... Read More

  • Psychology and the Seminarian: Historical Developments and Praxis in the
           United States
    • Abstract: In the summer of 1970, The American Journal of Psychology published an unlikely obituary; the obituary of a Carthusian monk who had spent the last twenty years of his life secluded in a Spanish monastery. Though less famous than other psychologists and psychiatrists whom he knew and under whom he studied, Thomas Verner Moore made a significant impact on the field of psychology in his own right. In addition to being the first man to obtain a doctorate in psychology from The Catholic University of America in 1903, he would later become a distinguished professor there. He would go on to become a pioneer in the field of psychology, developing techniques and methods that considerably advanced the science and practice of ... Read More

  • Anglicanorum Coetibus and CCEO Canon 35
    • Abstract: The Second Vatican Council set down a series of principles delineating the Catholic Church's approach to dialogue with non-Catholic Christians in the decree Unitatis redintegratio. Since that landmark document, however, many efforts in ecumenism have failed to take into account a warning against "superficiality and imprudent zeal, which can hinder real progress toward unity" (UR, 24). For many years, Anglicans who came into communion with the Catholic Church used the metaphor of "swimming the Tiber" to represent their spiritual journey back to full communion with the Holy See. On November 4, 2009, Pope Benedict XVI built a bridge for those who would "swim the Tiber," radically altering the face of Ecumenism with ... Read More

  • Fede, evangelizzazione e diritto canonico ed. by Ìñigo
           Martínez-Echevarría (review)
    • Abstract: Fede, evangelizzazione e diritto canonico contains a collection of eight essays presented in conjunction with the 17th study meeting of the Faculty of Canon Law of the Pontifical University of the Holy Cross held in Rome on April 11–12, 2013. The meeting occurred during the Year of Faith declared by Pope Benedict XVI, now emeritus, the celebration of which continued in the initial months of the pontificate of Pope Francis. The scholars undertook a rather timely look at the intersection of faith and canon law, particularly with regard to efforts in the Church to teach, to evangelize and to be evangelized. The study meeting was divided into four topical sessions, with two papers being presented during each session. ... Read More

  • Las Universidades Católicas: Ensayo de Teología del Derecho canónico,
by Iván Federico Mejía Álvarez (review)
    • Abstract: Las Universidades Catolicas: Ensayo de Teología del Derecho canonico is a six-volume study on certain theological and canonical principles applied to Catholic universities. The work is divided into two major parts. The first major part, which encompasses two of the volumes (1:1–290; 2:1–303), considers the contribution of a hermeneutical model to the theological foundations of canon law. The second major part, which encompasses the remaining four volumes of the series (3:1–525; 4:1–578; 5:1–370; 6:1–198), examines the application of this hermeneutical model to select canons that pertain to Catholic universities, namely, canons 748 §1; 809; 811 §2 and 820. The author also discusses the relationship between these ... Read More

  • Le ius particulare dans le droit canonique actuel ed. by Marc Aoun and
           Jeanne-Marie Tuffery-Andrieu (review)
    • Abstract: This small volume brings together presentations made during a May 6, 2011 international colloquium at the University of Strasbourg, France. Following upon an earlier colloquium in 2008 on the theme of provincial councils and diocesan synods, the intent of the 2011 colloquium was to study the interrelationship between the universal Church and the particular churches through the promulgation of particular law.The volume consists of ten short essays. His Eminence, Francesco Cardinal Coccopalmerio, President of the Pontifical Council for Legislative Texts, offers a general overview of the topic. The author explains the categories of particular law within the Church as well as their constitutive elements. He likewise ... Read More

  • Role of the Laity in the Diocesan Curia: A Comparative Study of the Latin
and the Eastern Codes by Mathew John Puthenparambil (review)
    • Abstract: In this study, Puthenparambil examines three areas where, canonically, the curia assists the bishop: "directing pastoral action, administration of the diocese and exercise of judicial power." He does this through the identification of possible involvement of the laity in offices spelled out in both the Codex Iuris Canonici (CIC) and the Codex Canonum Ecclesiarum Orientalium (CCEO) flowing from the conciliar teaching regarding the reception of baptism. Puthenparambil follows the link of baptism to the priestly, prophetic and kingly functions of Christ found in Lumen Gentium 31, tying this to the lay exercise of curial offices. The author attempts to cover the cooperation of the laity in all curial offices in both ...
