  • Historical Perspectives on Precarious Work: The Cases of Egypt and India
           under British Imperialism

      Abstract: The concept of precarious work is used by social scientists to describe work that is “uncertain, unpredictable, and risky from the point of view of the worker” (Kalleberg, 2009: 2). This paper argues that such work can take a variety of forms, beyond those seen in the transition from the stable post-WWII era to the neo-liberal era in the West. Egypt and India offer instructive case studies. Industrialisation (or lack thereof) in Egypt and India has been thoroughly documented by others. The purpose of this paper is to argue that these developments can be seen as the emergence of precarious, industrial working arrangements. This framework is useful for demonstrating that precarious work has come along with industrial development in a range of countries during different time periods. In this light, the stable employment arrangements characteristic of the post-war West were an anomaly. The global economic and social history of industrialisation is characterised by precarious working arrangements, as seen in colonial-era Egypt and India.

  • Conflict over Conflict: The Right to Strike in International Law

      Abstract: The existence of a right to strike under international law has been challenged by the International Organization of Employers since the late 1980s. The employer group claims that no such right exists under international law and has been moving to undermine recognition of the right at the International Labour Organisation (ILO). This article examines the right to strike in international human rights law. It considers specifically the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the International Covenant on Civil and Political Rights (ICCPR) and finds that the right to strike exists in both of these treaties. Further, the article demonstrates that while the ILO employers group may challenge the existence of the right to strike, its government members have overwhelmingly ratified international human rights treaties contradicting the employer group's position that there is no such right.

  • The Political Economy of Prison Labour: From Penal Welfarism to the Penal
           State

      Abstract: The article traces the return of prison labour for commercial purposes in the United States. In the age of Fordism, work for commercial purposes was prohibited in prisons; the emphasis was on rehabilitation. This “penal welfarism” gave way to a “penal state” of extremely high incarceration rates and exploitative prison labour. While this shift mirrors the turn to neo-liberalism, it is also the result of specific labour market conditions and racial discrimination.

  • Between Precarity and Paternalism: Farm Workers and Trade Unions in South
           Africa's Western Cape Province

      Abstract: The labour market in rural areas of South Africa’s Western Cape province has undergone considerable changes over the last thirty years. New labour and tenure legislation protecting farm workers combined with trade liberalisation, the abolition of subsidies and in-migration from other areas of South Africa has significantly reshaped labour on commercial farms. There is an increasing divide between permanent farm workers and a growing pool of precariously employed workers who labour seasonally on farms and are frequently employed through labour brokers. These divisions came to a head in 2012 when workers, many of whom work seasonally on farms, launched a strike that was to last for six months. Trade unions have struggled to organise an increasingly fragmented rural labour market and at the same time negotiate the forms of paternalism that continue to exert a strong influence over rural labour relations. Based on interviews with trade union organisers, this article examines how they have responded to the twin challenges of labour broking and paternalism. The farm strikes highlight the need for a form of social movement unionism that goes beyond wage demands and tackles the multiple factors that influence poverty in rural areas.

  • Germany’s Willkommenskultur: Trade Unions, Refugees and Labour
           Market Integration

      Abstract: This article investigates the relationship between German trade unions and refugees by focusing on union policies and practices aimed at integrating refugees into the labour market and wider society. Based on web research, newspaper articles, participant observation and internal documents, this article shows that unions follow a “logic of optimisation” in their support of the state’s migration and asylum policies. As employers aim to undermine existing labour standards, unions’ strategies of integration run up against limits. This article further finds that that unions’ positive stance toward refugees is based on Germany’s labour shortage, demographic trends and their commitment to anti-racism.
