  • Evictions in South Africa during 2014 - an analytical narrative : feature

      Abstract: The South Africa Constitution and pertinent legislative frameworks recognise the right of access to housing. This right extends to people who live in informal settlements, where they erect shacks and other structures. These people also include persons that take occupation of places/settlements 'illegally', although they are not expected to resort to illegal means in exercising their right. Due to a lack of access to housing people often erect shacks or other structures on land for which they do not have legal occupation. Such persons occupy lands belonging to private persons or entities, government and local municipalities. As a result, South Africa continues to witness cases and incidents of forced evictions whereby persons who are in illegal occupation of land are forcefully removed from it. In addition, people are evicted for reasons to do with urban development and planning.

  • Bringing justice to the disadvantaged - a commentary on CESCR's decision
           in IDG v Spain (Communication No. 2/2014) : feature

      Abstract: This is the first decision of the Committee on International Covenant on Economic, Social and Cultural Rights (CESCR) after the entry into force of the Optional Protocol to the Covenant on Economic, Social and Cultural Rights in May 2013. The Optional Protocol was adopted in 2008 to allow for individual communication to the CESCR. It is believed that individual access to the CESCR will not only strengthen accountability mechanism to realize socio-economic rights, but will also give hope to the hopeless (Chenwi: 2010).

      Abstract: In his report to the UN General Assembly in October 2015, the Special Rapporteur on Extreme Poverty and Human Rights, Prof. Phillip Alston, (hereafter the Special Rapporteur) presented a report in which he examined the various approaches of the World Bank to human rights. The Special Rapporteur noted that the Bank needs a new approach that will serve the interests of the people and explored the options available to the Bank.

  • Project on Enhanced Civic Understanding and Engagement : events - project
           launch

    • Abstract: On 15 October 2015, the Cape Town Refugee Centre (CTRC), in partnership with the Dullah Omar Institute and the KwaZulu-Natal Christian Council (KZNCC) launched the Enhanced Civic Understanding and Engagement Project at an event hosted by the Mayor of the City of Cape Town. The goal of the project is to simultaneously strengthen refugees' awareness and participation in democratic processes in host communities, and enhance local government capacity for participative governance, in order to promote tolerance and social cohesion in the Western Cape and KwaZulu-Natal provinces.

      Abstract: This second issue of the ESR Review for 2015 includes three feature articles and an update. The first feature, by Matsiko Samuel, examines a hitherto unexplored but important issue: giving attention to socioeconomic rights during the transitional justice process. Samuel argues that transitional justice processes should give as much attention to people's socio-economic needs as they do to civil and political challenges. This becomes inevitable given the indivisible and interrelated nature of human rights. Citing the South African transitional justice process as an example, he observes that attention was given to violations of civil and political rights at the expense of equally important socioeconomic rights issues.

  • Economic inclusion in transitional societies : a necessary prescription

      Abstract: A conversation on the role of economic and social rights within the transitional justice paradigm is way overdue. Transitional justice, as defined by the United Nations, is the full range of processes and mechanisms associated with a society's attempt to come to terms with a legacy of large-scale past abuses of human rights (UN, 2010:2). Determining what makes a society transitional is still a subject of academic debate and inquiry (Roht-Arriaza, 2006:1). However the political, social and historical realities can determine whether a society is ripe for transition.

      Abstract: The right of access to adequate housing is recognised as a basic human right under Section 26 of the South African Constitution (the Constitution). In the celebrated case of Government of the Republic of South Africa and Others v Grootboom and Others 2001 (1) SA 46 (CC), it was noted that the right to housing is about more than bricks and mortar: it includes people living in dignity, security and peace.

For the realisation of socio-economic rights, 2015 began on a high note with South Africa's long-awaited ratification of the International Covenant on Economic, Social and Cultural Rights (ICESCR). The ICESCR is important for enforcing the rights of those living in poverty; it has particular relevance to the majority of communities in South Africa, who do not have access to some of the most basic human rights.

      Abstract: State reporting is an integral part of the obligation to respect, protect, promote and fulfil children's rights as set out in global and African human rights instruments. South Africa is thus under obligation to report on the measures it has taken towards realising children's rights. As a member of the United Nations (UN) and the African Union (AU), South Africa is required to report on its progress (and challenges) to the Committee on the Rights of the Child (CRC Committee) and the African Committee of Experts on the Rights and Welfare of the Child (ACERWC Committee) respectively.

    • Abstract: International Women's Day was celebrated on 8 March 2015. This year's theme was Empowering Women, Empowering Humanity: Picture it! This highlights the Beijing Declaration and Platform for Action, a historic roadmap signed by 189 governments 20 years ago. The Beijing Declaration set the agenda for realising women's rights. While there have been many achievements since then, many serious gaps remain.

  • Roundtable meeting on state of maternal health in South Africa : events

    • Abstract: On 18 and 19 November 2014, the Community Law Centre (CLC) and School of Public Health (both at the University of the Western Cape) and Amnesty International held a meeting on maternal health that brought together members of various civil society organisations. Its aim was to discuss research findings on maternal health conducted by these three institutions, as well as to identify recommendations and top issues on which to focus while embarking on advocacy with Government's representatives and policy makers.
