  • Chile Presidential Elections of 2017. How Many Indigenous People Vote and
           For Whom'

    • Abstract: Resumen Este artículo indaga sobre el comportamiento electoral de un segmento específico pero relevante de la sociedad como son los indígenas en Chile contemporáneo, a partir de dos dimensiones: su asistencia a votar —participación electoral— y su inclinación ideológica —preferencia electoral—. Se estudian cuantitativamente los factores sociodemográficos que pueden explicar tanto la participación como la preferencia electoral. Además, se analizan diacrónicamente los resultados electorales en las quince comunas del país que tienen más de 50% de población indígena. Se concluye que la interacción entre las variables alta pobreza y alta población indígena inciden en la participación electoral y en la preferencia ideológica; además, el examen pormenorizado de las comunas revela trayectorias de comportamiento muy disímiles y que están mediadas por su propia historia electoral, el tipo de elección que se enfrente y cambios en la regla sobre la voluntariedad del voto.Abstract This study addresses the electoral behavior of indigenous people in contemporary Chile -a specific but relevant sector of society. It considers two dimensions: attendance to vote (electoral participation) and voting ideological preference (electoral preferences). One the one hand, it addresses the socio-demographic factors that may explain electoral participation and preference from a quantitative stand. On the other hand, it proposes a diachronic electoral analysis in the 15 municipalities that have more that 50% of indigenous population. The study concludes that the interaction between poverty and high indigenous population correlates both with participation and electoral preference. Also, a detailed communal analysis shows a great difference in their historical development, in which the relevance of the electoral history, the type of election citizens are facing, and the establishment of the voluntary system of voting play an important role.
       
  • Where do Latin American Former Presidents Go' The Way Out of Politics
           and Post-Presidential Careers in Latin America (1978-2018)

    • Abstract: Resumen La mayor parte de los estudios sobre trayectorias políticas centran su atención en la entrada o el desarrollo de estas. Los trabajos sobre la salida de la política, en general, y en el caso de los presidentes, en particular, son prácticamente inexistentes. Este trabajo tiene como propósito analizar las trayectorias de los expresidentes latinoamericanos a partir de dos estrategias metodológicas: el análisis estadístico y la revisión documental. Para ello, se elabora una clasificación tipológica, reconstruyendo las trayectorias de los expresidentes de dieciocho países latinoamericanos desde las transiciones a la democracia hasta el presente (1978-2018), partiendo de la premisa de que los expresidentes latinoamericanos tienden a seguir su carrera política al dejar el cargo. Si bien hay determinados rasgos objetivables que diferencian a los expresidentes que se desempeñan en el sector público o abandonan la vida pública de aquellos que lo hacen en la esfera privada, esta última no representa un impedimento para seguir teniendo presencia política.Abstract Empirical studies based on the careers of Latin American former presidents are practically non-existent. Most of the literature is focused on the development of the political career. Hence, the main goal of this proposal is to fill in this gap. It presents an empirical analysis based on the post-presidencies of eighteen Latin American countries since their transitions to democracy in 1978 up until 2018 in order to explore relevant factors that explain them. Using statistical and documentary methods, we create a typology of post-presidential careers, considering variables related to the individual characteristics of the former presidents, as well as with their previous political careers. The study found that former presidents tend to continue their political careers after their presidential period is over. The study also showed that it is possible to assess differences between those who continue in the public life and those who abandon it; however, even if they retired from public life it does not represent an obstacle for them to keep having political influence.
       
  • Fraudulent Electoral Democracy. Electoral Transhumance as a Strategy to
           Win Local Elections in Colombia

    • Abstract: Resumen Este artículo analiza la trashumancia electoral, una modalidad de fraude electoral con la cual se movilizan electores de municipios que no corresponden a los padrones electorales locales. Es una de las más reiteradas y determinantes en los resultados, falseando así el proceso electoral. Este artículo es un análisis empírico de nueve elecciones consecutivas del periodo 1990-2015, de las dimensiones, tendencias y de la lógica que impera en esta modalidad. La metodología incluye el análisis de estadísticas de registro, cedulación y anulación de las inscripciones por presunción de trashumancia, la recolección de testimonios orales y escritos, y un análisis sistemático de diarios nacionales y regionales. Se concluye que, pese a la normativa al respecto y a la creación del nuevo tipo penal de fraude electoral, es muy difícil demostrar el delito y condenar a los implicados, y en muy pocas ocasiones se ha procedido a la anulación de las elecciones; finalmente, se propone para el caso colombiano la denominación de democracia electoral fraudulenta.Abstract This article analyzes electoral transhumance, a form of electoral fraud that mobilizes voters in municipalities that do not correspond to the local electoral rolls. It is one of the most repeated and decisive strategies that affect the election results; thus, distorting the electoral process. This article provides an empirical analysis of nine consecutive elections in the period 1990-2015, and takes into account the dimensions, tendencies and logic that prevails in this modality of electoral fraud. The methodology includes the analysis of registration statistics, registration and cancellation of inscriptions for presumption of transhumance, the collection of oral and written testimonies, and a systematic analysis of national and regional journals. The study concludes that, despite the regulations and the typification of a new criminal type of electoral fraud in this regard, these crimes are very difficult to prove; therefore, it is also very difficult to condemn the people involved. As a result, elections have been cancelled in very few cases associated to this crime. Finally, it is proposed to denominate the Colombian regime as a fraudulent electoral democracy.
       
  • Violence and Justice in UNASUR’s Institutional History. From the Early
           Optimism to the Fragile Cooperation Combating Criminality

    • Abstract: Abstract This paper aims to understand how the Union of South American Nations (UNASUR) has worked (or not) to promote policies to make progress in the fight against crime, criminal justice and citizen security in the period between 2012 and 2017. Although South America is regarded as a peaceful region by some researchers when it comes to interstate conflict, when looking at intrastate violence the region may be viewed as one of the most violent in the world. In this context, it is crucial to understand the role of regional organizations. Our work was grounded on the documental analysis of 34 minutes and official documents of the South American Council on Public Security, Justice and Coordination of Actions against Transnational Organized Crime (CSSCJDOT) of UNASUR. The results demonstrate that the CSSCJDOT was an innovation in bringing the debate of crime and violence to a regional organization, but its initial promises have not been fulfilled because of political changes in key member states, the excess of normativism in UNASUR and because of the crisis the organization currently undergoes.Resumen Este artículo tiene como objetivo comprender cómo la Unión de Naciones Suramericanas (Unasur) ha estado trabajando para promover políticas que avancen en la lucha contra el crimen, la justicia penal y la seguridad ciudadana en el periodo 2012-2017. Aunque se considera que Sudamérica es pacífica según algunos investigadores, cuando se tiene en cuenta la violencia dentro del Estado la región puede considerarse una de las más violentas del mundo. En este contexto, es fundamental comprender el papel de las organizaciones regionales. Para este artículo se realizó un análisis de 34 documentos oficiales del Consejo Sudamericano de Seguridad Pública, Justicia y Coordinación de Acciones contra la Delincuencia Organizada Transnacional (CSSCJDOT) de Unasur. Los resultados demuestran que CSSCJDOT fue una innovación para llevar el debate del crimen y la violencia a una organización regional, pero sus promesas iniciales no se cumplieron debido a los cambios políticos en los Estados miembros clave, el exceso de normativismo en Unasur y la crisis que actualmente vive la organización.
       
  • The Guiding Principles of the Public Policy of Access and Equity as
           Dimensions of the Public Policy Network of ICT in Colombia 2009-2018

    • Abstract: Resumen El artículo aborda la política pública de regulación del servicio público de las tecnologías de la información y las comunicaciones (TIC) en Colombia en el periodo 2009-2018, centrándose en la dinámica y estructura de los principios rectores de política pública de acceso y equidad como dimensiones de red de política pública. La metodología es mixta, utilizando el enfoque del análisis de redes sociales (ANR) en cuanto a consolidación de actores y análisis de la estructura en red. Los resultados demuestran que el principio rector de acceso es de mayor relevancia para la estructura en red de la política pública de TIC en Colombia que el de equidad, sustentado en la relación sumamente desigual entre control de la infraestructura y los servicios.Abstract The research deals with the public policy of regulation of the public service of Information and Communication Technologies (ICTs) in Colombia during the period 2009-2018; focusing on the dynamics and structure of the guiding principles of public policy of Access and Equity as dimensions of the public policy network. The analysis uses a mixed methodology, based on the approach of social network analysis (ARS) in terms of stakeholder consolidation and network structure analysis. The results show that the guiding principle of access is of greater relevance for the network structure of the public policy of ICTs in Colombia than the guiding principle of equity, based on the extremely unequal relationship between control of infrastructure and services.
       
  • The Role of Brazilian Intelligence in the Geopolitics of Grandeza
           (1964-2002)

    • Abstract: Abstract Far from what most scholars have assumed, under the authoritarian regime (1964-1985) Brazil did not limit itself to importing anticommunist concepts from the United States, but it developed a conceptualization of its own aimed at transforming the country into a regional hegemon. The author’s starting assumption is that little attention has been paid to the role of Brazilian intelligence in the aspirations of the leaders of the country since the putsch of 1964, who followed the scope of achieving regional hegemony. Moreover, this article shall show that this aim has historical continuity from the authoritarian regime through democratic Brazil given the fact that intelligence was still employed to support the country’s aspirations of greatness (Grandeza) under Collor de Mello (1990-1992) and Fernando Henrique Cardoso (1995-2002).Resumen Lejos de lo que la mayoría de los estudiosos han asumido, bajo el régimen autoritario (1964-1985) Brasil no se limitó a la importación de conceptos anticomunistas de Estados Unidos, sino que desarrolló una conceptualización propia que buscaba transformar al país en una potencia hegemónica regional. El punto de partida de este artículo es que se ha prestado poca atención al papel de la inteligencia brasileña en las aspiraciones de los líderes del país desde el golpe de Estado de 1964 en aras de alcanzar la hegemonía regional. Además, este artículo demuestra que este objetivo tiene una continuidad histórica entre el régimen autoritario y el Brasil democrático, dado que la inteligencia todavía se ha empleado para apoyar las aspiraciones de grandeza del país —Grandeza— bajo los mandatos de Fernando Collor de Mello (1990-1992) y Fernando Henrique Cardoso (1995-2002).

Se critica la apelación únicamente a los principios racionales y abstractos, ya que se dejan de lado las virtualidades de los contextos que aglutinan las experiencias morales de pueblos, comunidades de vida y movimientos sociales en una sociedad globalizada. Si las teorías discursivas de la justicia requieren articular tal nexo la cuestión teórica es encontrar la veta que permita vincular procedimentalismo y substantividad histórica. Por lo tanto, ¿en qué sentido la teoría habermasiana de la justicia exigiría un replanteamiento teórico explícito acerca de la capacidad normativa del contexto' La hipótesis propuesta aquí revela la respuesta de Rainer Forst y Mark Hunyadi, ya que estos replantean una teoría contextual de la justicia y reelaboran una noción filosófica de contexto que demuestra nuevas posibilidades y limitaciones de la teoría discursiva de la justicia. From the pragmatic turn of contemporary philosophy, the theories of justice have advanced in a series of topics related to justifying the principles of justice which presuppose the connection between universality, and historical and cultural particularity. The exclusive appeal to rational and abstract principles is criticized, since it sets aside the implicit influence of contexts, which unite the moral experiences of peoples, communities of life, and social movements in a globalized society. If discursive theories of justice require to articulate this connection, the theoretical challenge is to find the joint that would allow to link historical proceduralism and substantivity. In which sense the Habermasian theory of justice would demand an explicit theoretical reconsideration about the normative capacity of context' The article proposes that an answer to this problem can be found in the works of R. Forst and M. Hunyadi, since they rethink a contextual theory of justice and restore a philosophical notion of context which demonstrate new possibilities and limitations of the discursive theory of justice.
       
  • The Havana Peace Agreement. An Ambitious Institutional Change with a
           Dubious Strategy

    • Abstract: Resumen En este artículo se analizan las imbricaciones entre cambio institucional, conflicto y poder político en el sistema presidencialista colombiano, tomando como estudio de caso los puntos de Reforma Rural Integral y Participación Política del Acuerdo de Paz de La Habana durante el Plebiscito por la Paz y el Fast Track. A partir del enfoque del neoinstitucionalismo sociológico, el cual permite analizar las instituciones incrustadas en la cultura y la estructura social, se analiza por qué el Acuerdo de Paz de La Habana es un cambio institucional y cuáles son los cambios proyectados. Algunos hallazgos indican que los potenciales cambios en las reglas políticas y en el acceso y uso de la tierra deben considerarse cuidadosamente dentro de configuraciones institucionales más amplias y sedimentadas históricamente, ya que, aunque el cambio institucional buscaba modificar los arreglos de poder en las instituciones, no se tuvo en cuenta el arraigo de estos en la estructura social y la cultura.Abstract This research analyses the imbrications among institutional change, conflict, and political power in the Colombian presidential system, taking as a case study the points of the Integral Rural Reform and Political Participation of the Havana Peace Agreement, during the plebiscite for peace and the «Fast Track» implementation in order to approve the law changes in the Congress. The question that guides the analysis is the following: Why do the Havana Peace Agreement implies an institutional change and what are the changes projected by it' The study applies a sociological neo-institutionalism approach, which allows the analysis of the institutions embedded in the culture and social structure. The methodological strategy used is the qualitative case study. The analysis shows that the potential changes in political rules and in the access and use of land must be carefully considered within broader and historically sedimented institutional configurations. The institutional change sought to modify the power arrangements in the institutions; however, their roots in the social structure and culture were not taken into account in order to effect this modification.
       
  • Decentralization or Governance' Water, Institutionalization and
           Politics in the High Basin of the Cauca River (Colombia)

    • Abstract: Resumen En una época en que se han quebrantado los alcances y la capacidad del Estado para suplir demandas sociales y ambientales —como el suministro del agua—, la gobernanza policéntrica es una alternativa ante la crisis de legitimidad del sector público, en parte agenciada por las restricciones fiscales y una iniciativa privada que amenaza acaparar los recursos naturales, profundizando los problemas redistributivos. La apuesta de esta investigación apunta a rastrear la degradación hídrica a través de sus relaciones con el proceso de institucionalización de reglas formales y su posterior ensamble en redes de gobernanza policéntrica. Es así como esta pudo integrar una serie de métodos que, bajo la orientación abstracta de un modelo presión-Estado-respuesta, abarca elementos de corte cualitativo —como el análisis documental— y cuantitativos —como el análisis econométrico y el estudio de grafos, muy cercano al desarrollo de la topología—. Esta investigación, pudo comprobar que los ligeros niveles de organización social afectaron positivamente los resultados en términos de reducción del efecto degradatorio sobre la calidad del agua. At a time when the scope and capacity of the State to meet social and environmental demands, such as water supply, have been lost, polycentric governance is an alternative to the crisis of legitimacy of the public sector, partly driven by fiscal restrictions and a private initiative that threatens to monopolize natural resources, deepening redistributive problems. The aim of this research is to track the water degradation through its relations with the process of institutionalization of formal rules and their subsequent assembly into networks of polycentric governance. The study integrates a series of methods that, under the orientation of a pressure-state-response model, includes qualitative elements such as documentary analysis, as well as quantitative analysis such as econometric analysis and the study of graphs, very close to the development of topology. This study verifies that the slight levels of social organization positively affected the results in terms of reducing the degradation effect on water quality.
       
  • Structural and Conjunctural Elements of a Conflicting Implementation of
           the Peace Agreement between the Colombian Government and the FARC-EP

    • Abstract: Resumen Tras la firma del Acuerdo final para la terminación del conflicto y la construcción de una paz estable y duradera entre las FARC-EP y el Estado colombiano se inició un proceso de implementación conflictiva, derivado de realidades de orden estructural y coyuntural. Dicha conflictividad ha sido consecuencia de limitaciones propias de un proceso de negociación que no se planteó la superación de las causas estructurales que originaron el conflicto y que se desenvolvió con un compromiso diferencial de los actores. Desde de una metodología histórico-descriptiva, con la intención de evidenciar el proceso de implementación del acuerdo y las complejidades que el proceso contrajo, este artículo analiza el primer año de implementación del Acuerdo y su carácter conflictivo a partir de categorías como la formación del Estado-Nación en Colombia, la refrendación del Acuerdo y el papel de las ramas del poder público en el proceso de su implementación efectiva.Abstract After the signature of the Final Agreement to End the Armed Conflict and Build a Stable and Lasting Peace, began the process of a very conflictive implementation caused by structural and conjunctural problems. On the one hand, the negotiation process did not approached the structural reasons that originated the conflict, that is, the continuity of social, political, and economic conflicts; on the other hand, there was a difference in the level of commitment by the actors. This article analyzes the conflictual implementation from different categories, as the conformation of the Colombian Nation-State, the endorsement of the Agreement, and the role played by the branches of public power in the implementation. The study is based on a historical-descriptive methodology with the aim of evidencing the process of the agreement and the complexities faced in its implementation.
       
  • Representations about Democracy, Institutions and Governmental Actors at
           the University of Antioquia

    • Abstract: Resumen El artículo presenta una caracterización de la cultura política a partir de un análisis de correlaciones entre las imágenes y representaciones que tienen los universitarios sobre el sistema social, sus acciones en el ámbito político y la imagen que poseen del sistema político. Toma como caso la Universidad de Antioquia y ofrece una aproximación a las percepciones de la democracia y las instituciones políticas de representación, de control y de participación en ella. A partir de una encuesta a una muestra representativa de estudiantes, profesores y empleados administrativos se concluye que, si bien hay una amplia aceptación de la democracia como idea general en términos normativos, este presupuesto se debilita cuando se pasa del plano valorativo a su materialización, es decir, los universitarios realizan una evaluación crítica del funcionamiento de la democracia colombiana. Adicionalmente, se pudo inferir que en este universo político coexisten dos matrices o constelaciones de cultura política: una que valora los procedimientos y mecanismos democráticos y otra que se muestra proclive a prescindir de elementos sustanciales para el funcionamiento de una democracia.Abstract The article presents a characterization of the political culture from an analysis of correlations between images and representations that the students at the Universidad de Antioquia have on the social system, their actions in the political field and the image they have of the political system. The analysis offers an approximation to the perceptions of democracy and the political institutions of representation, control and participation in it. From a survey to a representative sample of students, professors and administrative employees, it is concluded that, while there is broad acceptance of democracy as a general idea in normative terms, this acceptance is weakened when university students not merely value democracy but undertake a critical evaluation of the way in which the Colombian democracy works. Moreover, it could be inferred that two matrices or constellations of political culture coexist in this political universe: one that values democratic procedures and mechanisms, and another one that is prone to dispense with substantial elements for the functioning of a democracy.
